Royal Palm Manufactured Home Community 2050 West Dunlap Phoenix, AZ 85021 RULES AND REGULATIONS These Rules and Regulations have been written for your safety and convenience to assure a most enjoyable and luxurious life-style of mobile home community living. Our staff has been trained to administer our rules fairly to all residents to assure the comfort and relaxation for residents who seek a carefree life-style. We request and require your compliance with our Rules and Regulations. The term resident shall include all legal residents and guests of his or her mobile home. The term management shall include owner and management staff of Royal Palm Mobile Home Park. Section I - General 1.1 In case of EMERGENCY, call one of the following numbers: Park Resident Office 943-5833 Emergency Number 725-4028 1.2 Registration: The law requires all residents to register at the Park business office. All residents must complete a Rental Reservation Application for approval by Park owner and if approved, complete and sign a Rental Agreement prior to residing in the Park. In addition: a) You must provide management with a copy of your current driver s license, birth certificate or passport; b) You will be asked to sign and acknowledge that you have received a copy of the Rules and Regulations and have read them; c) You will be asked to sign and acknowledge that you have received a copy of the Arizona Mobile Home Parks Residential Landlord and Tenant Act; d) You will be asked to read and sign an acknowledgement of the Park s Statement of Policy;

e) You must complete the Registration card covering your home which is required for tax assessment purposes by State law. 1.3 Rent: Space rent is due and payable in advance on the first day of the month and delinquent after five (5) days. On the sixth day a late charge of $5.00 per day, dating from the due date will be assessed until the rent is paid in full. Returned checks due to non-sufficient funds, etc. will be charged $20.00 for handling. These returned checks will also be assessed the late charge of $5.00 per day from the due date until they have been redeemed. More than one NSF checks may require a money order or cashier s check thereafter. Rental checks or money orders shall be payable to Royal Palm Mobile Home Park. We request that you do not use cash to pay your rent. Guest fees of $10.00 per person per day will be assessed after 14 consecutive days in any one month. Any person not on the signed current Rental Agreement is considered a guest, please register your guest at the Park office. This is for your security protection and that of all residents. 1.4 Quiet Hours and Noise Disturbances: Quiet hours are from 10:00 p.m. to 7:00 a.m. Trespassing on or through other mobile home lots is prohibited, whether occupied or vacant. Disturbing noises of any nature, drunkenness, immoral or unseemly conduct are not permitted at any time. Please be considerate of you neighbors. 1.5 Royal Palm Mobile Home Park is a community intended for occupancy by persons 55 and older. All facilities are provided to serve the residents and guests of a 55 or older community. a) At least one permanent resident in the home must be 55 years or older with no other residents under the age of 42 years. b) Prior written notice shall be given to owner if you plan to sell your home on site. Any person purchasing your home on site must complete an Occupancy Application and be Park approved by owner prior to the sale being consummated. The owner of this Park shall in no way discriminate against any resident regardless of race, color, religion, sex, national origin, familial status or handicap, except with respect to familial status as provided by Fair Housing laws. 1.6 Guests: Guests are your responsibility and they are required to abide by the same rules and regulations as residents. a) A guest may not occupy your home in your absence. b) Guests staying longer than 14 days in a calendar month will be charged $10.00 per day, per guest. 30 days in a twelve-(12) month period without written Park owner s permission. c) A resident must accompany all guests using the recreational facilities. d) No skateboard or roller-blades allowed in the streets. An adult or resident must accompany all children riding bicycles. 1.7 Absence: Please notify the office if you will be away for more than 72 hours. Keep your entry card current regarding permission to enter your home, emergency phone numbers, etc. 1.8 Solicitors and Vendors are not permitted in the Park. a) No resident shall conduct any type of business (commerce) from his or her mobile home. b) Moving Sale only will be permitted. 1.9 Utilities: No resident shall tamper with the utility connection, i.e., water or sewer lines or electric. No planting of trees or shrubs on top of water or sewer lines is permitted. Call the Park owner if you notice any trouble. No digging on spaces without prior approval to prevent interruption of water for other residents. 1.10 Signs: All directive signs posted in the Park must be adhered to and all signs and notices are made a part of these Rules and Regulations without reference. 1.11 Conduct: We ask that you treat your neighbors as you would like to be treated and that you and your guests conduct themselves in such a manner as not to disturb other residents in the Park. Conduct compliance will be in accordance with the Arizona Mobile Home Residential Landlord and Tenant Act. Section II Park Standards 2.1 Only 1995 or newer mobile homes will be approved by owner of Royal Palm Mobile Home Park to be admitted in the Park. a) All exterior improvements and alterations, whether required by the management or desired by the resident, must have prior written approval by the management. This included paint color, screening for carport or deck, installation of gutters, etc. Revised January 1, 1999 3

b) Exterior park packages including but not limited to skirting, awnings, concrete drive and sidewalks, and landscaping to be completed and/or installed at the time the home is being installed. All exterior including concrete must be approved by Park owner without exception. Each mobile home lot varies in size, shape and location in the Park. Therefore, customized work and designs would be required on each. This includes screening, change of steps, and alternation of landscaping. c) Air conditioners, heat pumps, evaporative coolers, ducts, antennas or any equipment are not permitted on the roof or on the outside walls. All equipment must be located on the ground and at the rear of the home and be landscaped so it cannot be seen from the streets. d) Satellite dishes 18 or smaller are permitted next to your home on the ground whereby they cannot be seen by other residents. Check with your Park owner prior to installation for best location at your home. e) All improvements must be permitted and comply with the local zoning and building regulations. f) No drying, hanging, airing or storage of garments, bedrolls, rugs, etc., permitted on the exterior of your home such as railings, carports or any visible location. g) All mobile homes should be kept in good repair at all times including but not limited to exterior paint and landscaping appearance. h) Failures to get Park owner approval in writing prior to making additions, changes to exterior of home or on the lot may result in removal or correction, if not complied with, may result in eviction. i) Only licensed contractors with a Certificate of Liability from Workman s Compensation of not less the $1,000,000.00 shall be received by Park owner to perform work on Park property. 2.2 Landscaping: Landscaping design must be selected at the time of signing the rental agreement. No grass lawns will be permitted and landscape compliance may be required at time of resale. Residents must maintain their own landscaping. Revised January 1, 1999 4

2.3 Driveways shall not be used for miscellaneous storage. No accumulations of any kind will be allowed around the mobile home. No enclosure of carports, slats, trellises or siding will be allowed without Park owner s written approval. 2.4 No fences may be constructed except those that have been architecturally designed and approved in writing by Park owner. It is extremely important that all exterior areas be maintained in a neat and attractive fashion at all times. 2.5 Planting of trees and shrubs is encouraged with prior consent of the Park owner when it is part of the landscaping design. Do not plant deciduous trees within 5 feet from curb to avoid dropping of leaves in the streets. No oleanders or hedges allowed over 4 feet in height. 2.6 Patio and outside furnishings only. No storage of debris or accumulation on the back of your home or carport. Outdoor furnishings, tables, chairs, gliders, umbrellas only. No home furnishings on the deck, carport or outside space of the home permitted. 2.7 Resident agrees that Park employees may have access to resident s mobile home in case of emergency when reasonably necessary to protect the person or property of residents of the mobile home park. Except in case of emergency, management does not have the right to access resident s home. 2.8 The management reserves the right to enter the lot if necessary to protect the health and safety of any resident or to verify compliance with the Rental Agreement or the Rules and Regulations. 2.9 All requests shall be made in writing to the owner for any changes, replacement or additions to your space or exterior of home. Section III Pets 3.1 If your pet causes any disturbances to the neighboring community, permission to keep your pet will be revoked. Barking dogs will not be tolerated. No visiting of pets will be allowed outside your home. 3.2 Failure to control your pet or to clean up after your pet on your own space will be cause for eviction. 3.3 Exceptions to pet restrictions will be made for assistive animals which are reasonably necessary to provide for the needs of handicapped residents. Pet fees will not be charged for assistive animals. Residents will be responsible for the conduct of and for cleaning up after assistive animals living in their home. Management reserves the right to require medical proof for the need of an assistive animal and the qualification of the animal to act as such. Revised January 1, 1999 5

Section IV Vehicles 4.1 MAXIMUM SPEED LIMITED IN THE PARK IS 15 M.P.H. AND MUST BE ADHERED TO. Anyone receiving three (3) written notices regarding speeding in the Park in a 12 month period will be cause for eviction. 4.2 Fire ordinances forbid on-street parking. A twenty-four hour maximum limit is allowed for loading and unloading only. a) Campers, motorhomes, trailers, boats, inoperable or stored vehicles that are not driven on a weekly basis and vehicles which do not bear current registration tags may not be parked on your space or under your carport area. b) Motorcycles must idle down in and out of Park. 4.3 You may not wash your vehicle, change your oil or repair any vehicle on you space, including under your carport area or in the street or common area of the Park. Vehicle washing of any type is strictly prohibited. 4.4 Parking around Recreation Center limited to overnight visitors only. Section V Laundry 5.1 Coin operated washers and dryers are located in the laundry room in the recreational building for the use of the residents. Section VI Refuse 6.1 All garbage and rubbish is to be secured in plastic bags. Garbage containers that have to be emptied are not acceptable and will not be emptied by our drivers. We do not pick up loose garbage. a) Please flatten all boxes and cartons. b) Garbage will be picked up in front of your space twice a week. Section VII Recreational Area Revised January 1, 1999 6

7.1 Conventional dress is expected in the Activity Center. Shoes and shirts are required. No swimming attire will be allowed in the billiard room or Activity Center. No one under 14 years of age allowed to use the billiard room without the immediate supervision of the responsible resident to whom they are visiting. 7.2 Rules related to swimming pool and therapy pool: a) Hours and rules are posted in these areas, please abide by them. b) State health laws require persons to shower before entering the swimming pool or therapy pool. c) No oils or body lotions prior to entering pool. d) No children in diapers allowed in pool. e) No children under the age of 14 allowed to be in the therapy pool at any time. f) Proper attire is required at all times. g) Responsible resident must be with guests at all times when guests are using the pool area or therapy pool area. h) Please replace pool furniture at its proper place and clean up your belongings and trash before leaving the pool area. 7.3 No alcoholic beverages to be in the pool area. Management reserves the right with regards to restricting the use of all recreation areas and facilities with regard to hours, purposes and conduct for the benefit of all residents. Section VIII Sale of Mobile Homes 8.1 Residents are required to inform management of their intention to sell their mobile home, in order to avoid conflicts resulting in a sale to an unapproved buyer. Prospective buyers who intend to keep the home in the Park must complete an Occupancy Agreement and meet the 55 or older status for the Park. They must first complete an Application for Residency for Park approval. 8.2 Before a resident sells his or her home to a buyer who wishes to become a resident, the buyer must complete a resident application. No buyer can become a resident unless the seller has obtained the written approval of the sale from the Park owner. While the Park owner anticipates no problem in granting approval, the Park owner may require the prospective resident (buyer) to make improvements to the mobile home including all appurtenances owned by the Revised January 1, 1999 7

resident or require that the home be removed from the park in order to preserve or upgrade the quality of Royal Palm Mobile Home Park. Section IX Legal Matters 9.1 Royal Palm Mobile Home Park operates under regulations set forth by the State, local and municipal codes governing the operations of mobile home parks. Any provisions of the foregoing rules which may be in conflict with the law and statutes of the State of Arizona shall be null and void for this reason, they shall be deleted and the remainder thereof shall be enforceable by the management. 9.2 Management is not responsible for the loss due to fire, theft, or accident. Each home owner shall have insurance coverage and provide the Park office for their files, a current copy of insurance certificates. 9.3 The grounds for termination of rental agreements and eviction are set forth in Section 33-1476(13) of the Arizona Mobile Home Parks Residential Landlord and Tenant Act. 9.4 A failure in one or more instances to insist upon terms, conditions or provisions of these Rules and Regulations shall not be construed as thereafter waiving or relinquishing any right that the management may have and the waiver of one default or right. 9.5 Residents are responsible for all damage caused by their negligence or that of their guests and will be held accountable for same. 9.6 The management shall not be liable for personal injury to any persons including residents or guests from any cause whatsoever other than its deliberate act or gross negligence. 9.7 The management shall make every effort to supply ample and sufficient utilities, but failure to do so shall not be an excuse for non-payment of rent, nor shall owner be liable for any loss sustained because of such failures. Further management reserves the right to disconnect utilities in order that repairs, alternations or additions may be made and the management shall in no way be responsible for any loss suffered by the resident in so doing. 9.8 The management reserves the right to revise, add, delete or change the Park Rules and Regulations from time to time in accordance to the law, if in the discretion of the Park owner, it is in the best interest of the Park and its residents. Copies of changed Rules and Regulations will be supplies to residents in writing as least 30 days before they become effective. Revised January 1, 1999 8

9.9 Residents must inform management of their intent not to renew the rental agreement at least 30 days before the expiration of the lease term. If resident does not so notify the management, the lease will be renewed in accordance with the Arizona Mobile Home Park Residential Landlord and Tenant Act. Section X Protection of Investment 10.1 Every resident in Royal Palm Mobile Home Park has made an investment in their home. Any resident found obstructing or interfering upon any other resident s investment through wrongful behavior directed against another resident, the Park or any fraction of the Park, may be liable for eviction. 10.2 Any resident removing property from other resident s or owner s property, whether thought to be debris or not usable, will be subject to eviction. Please be considerate of others and only use your own materials and property. 10.3 No contractors or workers allowed to work on premises (your space and home) without a current $1,000,000.00 Certificate of Liability filed at the Park Office.
