A Demo Permit Guide for Homeowners March 2013 WHY DO I NEED A PERMIT? Demolitions require demo permits to ensure public and personal safety. The standards for removing a structure are contained within the Ontario Building Code. The Building Code is Provincial Regulation administered by the Housing Development and Buildings Branch of the Ministry of Municipal Affairs and Housing. Under the Building Code Act, local governments are given authority for the enforcement of the Ontario Building Code. The Ministry of Municipal Affairs and Housing maintains a web site which contains useful information about the Ontario Building Code at www.obc.mah.gov.on.ca. It is the homeowner s responsibility to ensure that a demolition permit is obtained when required prior to demolition. WHEN DO I NEED A PERMIT? The following is a list of when building permit is required for a demolition: Demolishing a structure larger than 10m² AS A HOMEOWNER WHAT DO I NEED TO KNOW? If you are the homeowner and plan to demolish an existing residence there are two (2) major areas that you need to be aware of before making your application. The only two people that are able to apply for a demolition permit are: The property owner on title An authorized agent of the property owner listed on title 1. Conservation Authority Approval You may be demolishing something with in a prescribed distance of a flood plain. Lake Simcoe Region Conservation Authority and Nottawasaga Valley Conservation Authority may have legislation in place that requires their approval. You would need to get approval from the appropriate Conservation Authority before your submission for a permit is deemed complete.
2. Complete Submissions A Demo Permit Guide for Homeowners March 2013 When you are ready to make your application, you will be asked to make a declaration regarding a Complete Submission. By declaring a complete submission, you are telling us that you have completed all of the forms required by the for demolition, including information on your disconnects from utilities, questionnaire about the property, type of building to be demolished and the type of demolition process being used, and your drawings are complete and meet all the requirements set out in our Building Bylaw and Building Code regulations, and that you comply with all Applicable Law. When you declare you have made a complete submission, we are bound by the new legislation to either issue your permit or give you a complete list of deficiencies within a prescribed time period. OTHER APPROVALS In addition to a building permit, you may require other approvals. Our Building Services staff will let you know which approvals are necessary. Some common approvals are listed below: 1. Lake Simcoe Region Conservation Authority Lake Simcoe Region Conservation Authority approvals may be required if your property is located in a flood plain or is adjacent to any watercourse. You can contact the Authority at 1-800-465-0457or www.lsrca.ca. 2. Nottawassaga Valley Conservation Authority Nottawassaga Valley Conservation Authority approvals may be required if your property is located in a flood plain or is adjacent to any watercourse. You can contact the Authority at 705-424-1479 or www.nvca.on.ca. 3. Site Alteration Permit If your property is larger than ½ hectare you may be required to apply for a site alteration permit as per By-law 118-07, building staff will be able to assist you with any questions you may have with this process. 4. Ministry of the Environment -MOE When you demolish you may be required to decommission a well or a septic system or if you are proposing to relocate the debris from the demolition site to another site you may require consent from the Approvals Branch of the Ministry of the Environment (MOE) under the Ontario Environmental Protection Act. Ontario Ministry of Labour In accordance with the Ontario Occupational Health and Safety Act and Regulations (OHSAR) it is the responsibility of the building owner to ensure the safety of workers from hazardous materials. A detailed survey to determine the types and conditions of hazardous material shall be carried out and provided to the Contractor prior to demolition. SITE PLAN A siteplan (the bird s eye view of the property) will need to be submitted with your application. A site plan identifies buildings and other features in relation to property boundaries. The site plan should identify your existing house and proposed changes. Most of the information required for a site plan can be found on your property survey. You may have received one when you bought your home. If not you may need to hire a surveyor. SUBMITTING MY APPLICATION A building permit application is available at www.innisfil.ca or at the Town Hall, Customer Service, 2101 Innisfil Beach Road, Innisfil, Ontario, L9S 1A1. If you would like a form emailed or faxed to you please call Building Services at 705-436-3710 extension 3504 or 3506. Your completed application package should be brought to Customer Service during working hours Monday to Friday between 8:30 & 4:30. If you have any questions the Permit Processor will walk you through your application package to ensure that it has all of the following components: An example of a Complete Building Permit Application: 1. Two sets of fully dimensioned and scaled site plan. 2. A building permit fee in cash, Interac or cheque payable to the. The fees are determined by staff at Building Services and are based on the fees, determined in the Fees and Charges By-law. The fee will be calculated by the Building Services Department. 3. Permit Application to Construct or Demolish must be fully completed (all fields filled in). 4. Plans / information submitted must comply with the Ontario Building Code. 5. Must be in compliance with applicable laws. 6. Applicable Agreements must be executed, such as Site Plan Control, Committee of Adjustment and Subdivision Agreement or any other agreement. Please note when a complete application is submitted to Building Services, your plans will be reviewed and you will receive a response within the timeframe stipulated by the Province as to whether your permit will be issued or denied. WHAT HAPPENS NEXT? After the Permit Processor has reviewed your application and considers it complete, it is reviewed by Building Services. In Ontario a complete permit application must be reviewed within a prescribed time period starting the day after Building Services deems it complete.
A Demo Permit Guide for Homeowners March 2013 Each application will be thoroughly reviewed and will receive either: 1. a request for additional information listing out specific items, these items must be fulfilled prior to the continued processing of your application. 2. a call / email to you to let you know if your permit is ready and you may come in and pick it up, you will also be made aware of any adjustments to the fee calculations. Note : A Permit is not considered issued until the applicant has picked it up. INSPECTIONS When you pick up your permit package the following items will be enclosed: 1. A signed copy of your building permit with the prescribed inspections on the reverse. 2. The stamped Customer Copy of your plans/drawings. The Occupational Health and Safety Act and Regulations prescribes procedures for demolition involving hazardous materials such as asbestos and lead paint. It is the responsibility of the owner/authorized agent to ensure the safety of workers. Before asking for tenders for demolition, the owner/authorized agent shall cause an inspection to be made to establish whether any friable material that is likely to be handled, dealt with, disturbed or removed contains hazardous materials. The Ontario Building Code: sections 2.3.2.3 and 2.4.1.1(2), requires a Professional Engineer to be retained for the demolition review of any building. Further, the applicant shall submit, at the Time of application, a demolition brief detailing the structural design characteristics of the building and method of demolition. Abandonment of a Well shall be done in accordance with the Ontario Well Water Regulation #903. Please call The Ministry of Environment, Water Well Help Desk @ 1-888-396-9355 for more information. Abandonment of a Septic System requires the septic tank to be pumped and disconnected from the home or building. The tank shall be removed, crushed or filled with sand/soil material. Ontario Building Code (O.Reg. 350/06) Division C, Part 1 1.3.1.1.(1) A person is except from the requirement to obtain a permit under Section 8 of the Act. (a) for a demolition of a building located on a farm. 1.3.1.1.(3) Where a permit is required for the demolition of a building in Sentence 1.2.2.3.(1), descriptions of structural characteristics of the building and the method of demolition shall be including in the application for a permit to demolish the building. 1.3.1.1.(4) No person shall commence demolition of a building or any part of a building or any part of a building before the building has been vacated by the occupants except where the safety of the occupants is not affected. All building/demolition sites must be maintained in safe, clean conditions. A Building Inspector will be visiting your site to verify these conditions.
