Twp of HBM Minutes of April 20, 2015 Regular Council Meeting Page 1 of 11 REGULAR COUNCIL MEETING A Regular Meeting of the Council of the Corporation of the Township of Havelock- Belmont-Methuen was held on April 20, 2015 at 7:00 p.m. in the Havelock-Belmont- Methuen Council Chambers, Mayor Gerow in the Chair. All members of Council were in attendance. Staff present: CAO Pat Kemp; Director of Corporate Services/Treasurer Val Nesbitt; Planning Assistant Andrea Stillman; Deputy Clerk/Economic Development Officer Brain Grattan; and Clerk Glenn Girven. Mayor Gerow called the meeting to order and reminded Council of the requirement to disclose any pecuniary interest and the general nature thereof if the occasion arises. Minutes: Regular Council meeting of April 7, 2015. R-244-15 That the minutes of the April 7, 2015 Regular Council meeting be approved and adopted as circulated. Public Meeting for Committee of Adjustment: R-245-15 That this meeting move into a public meeting of the Committee of Adjustment with Deputy Mayor Martin in the Chair. Deputy Mayor Martin reminded members of the Committee of the requirement to disclose any pecuniary interest and the general nature thereof if the occasion arises. Minor Variance Applications: A-01/15 Ralph and Carrie Horton 11 Fire Road 26B, Concession 6, Part Lot 14, Belmont The purpose of this application is to seek minor variance approval for the construction of a new garage with the effect of reducing the side yard setback from 10 feet to 4 feet as per 4.1(e)(ii); reducing the water setback from 100 feet to 80 feet as per 4.35; and increase in lot coverage from

The Clerk advised that notice of the Public Meeting had been given by prepaid first class mail to every owner of land within 60 metres of the area to which the application applies and a notice was clearly posted on the property. No written comments from the public had been received on this application. The Planning Assistant presented the Planning Report to the meeting. A letter had been received from the Crowe Valley Conservation commenting that under the PPS the back of the lot where the garage would be built is in the flood plain regulated area and would require a permit. They recommended deferral to check the elevation of the proposed garage. Deputy Mayor Martin invited anyone present to speak in opposition to the minor variance three times with no response. Deputy Mayor Martin invited anyone present to speak in favour of the minor variance application three times. The applicants were in attendance to answer any questions the Committee may have. He said that he had talked to the CVCA and that he would know the elevation tomorrow. Councillor Pomeroy said that the Waterfront Committee had visited the site. The corner of the proposed garage is very close to the lot line and suggested that even one additional foot of setback would be better. Mr. Horton said that he could move the corner of the proposed garage an additional foot from the property line. R-246-15 Moved by Seconded by Councillor That Minor Variance application A-01-15 for the construction of a new garage is approved with the following conditions: That the proposed garage approximately 24 feet by 24 feet be permitted as per the amended site sketch labeled Schedule B dated April 20, 2015; That the rear yard setback be permitted to be 10 feet minimum; That the east side yard setback be permitted to be 5 feet minimum; That approval be received by the Crowe Valley Conservation Authority prior to the building permit issuance; That a 20-day appeal period lapse prior to the issuance of a building permit; and That a building permit be issued within 12 months of the approval of this application with appropriate submission including application, fees and supporting information required by the Chief Building Official. That the balance of the information in the Report be received.

Twp of HBM Minutes of April 20, 2015 Regular Council Meeting Page 3 of 11 A-03/15 Norman Tucker 316 Mile of Memories Road, Concession 5, Part Lot 13, Belmont The purpose of this application is to seek minor variance approval for the construction of a deck built on grade with the effect of reducing the south side yard setback from 10 feet to 2 feet as per 4.1(e)(ii); and increase in lot coverage from 15% to 17.6% (14.9% existing) as per 11.2.1(g) of Zoning By-law 1995-42 AA. The Clerk advised that notice of the Public Meeting had been given by prepaid first class mail to every owner of land within 60 metres of the area to which the application applies and a notice was clearly posted on the property. No written comments had been received from the public on this application. The Planning Assistant presented the Planning Report to the meeting. Crowe Valley Conservation had commented that they had no concerns. Deputy Mayor Martin invited anyone present to speak in opposition to the minor variance three times with no response. He explained that he would replace an old boathouse and deck (both demolished with permit) with a new deck on grade. Councillor Pomeroy said that the Waterfront Committee had visited the site. He said the minor adjustments proposed were good and much better than what was there. R-247-15 That Minor Variance application A-03-15 for the construction of a deck built on grade is approved with the following conditions: That the proposed deck be permitted as per the attached site sketch labeled Schedule B; That approval be received by the Crowe Valley Conservation Authority prior to the building permit issuance; That a 20-day appeal period lapse prior to the issuance of a building permit; and That a building permit be issued within 12 months of the approval of this application with appropriate submission including application, fees and supporting information required by the Chief Building Official; That the balance of the information in the Report be received.

Regular Meeting resumes: Delegation: Matt Ferguson, representing the Library Board, was in attendance at Council s invitation to provide more information on the Library Board s initiative to digitally scan historic documents in the possession of the Library. Digitization would improve the accessibility of the historic information which would be available on the Library s website. R-249-15 That the delegation of Matt Ferguson be received for information at this meeting. Staff Report: The Planning Assistant presented Staff Report 1 at this time regarding a proposed Zone Amendment of Lots 30 and 31, Concession 9, Methuen Township by Gerry Meharg. This report provided background information for the next delegation to the meeting by Gerry Meharg. R-250-15 That the report from the Planning Assistant regarding a proposed Zone Amendment of Lots 30 and 31, Concession 9, Methuen Township by Gerry Meharg, be received for information. Gerry Meharg was in attendance to explain his rezoning application requesting a 60 foot setback from the water. This delegation was for information only as the Public Meeting had not been held R-251-15 Moved by Councillor Gerow

Staff Reports: 2. Report from the Director of Corporate Services/Treasurer/Deputy CAO Havelock Soccer Field Maintenance Costs 2013 & 2014. R-252-15 Moved by Councillor Gerow Seconded by Councillor Pomeroy That staff are directed to provide a copy of the financial information contained in the Report to the Havelock Soccer Club; and That the report from the Director of Corporate Services/Treasurer/Deputy CAO regarding the Havelock Soccer Field Maintenance Costs 2013 & 2014, be received. 3. Report from the Director of Corporate Services/Treasurer/Deputy CAO Fees for Services and Activities. R-253-15 Seconded by Councillor Gerow That Council approves the schedule of fees attached to the report from the Director of Corporate Services/Treasurer/Deputy CAO and that a by-law be considered to formally authorize the Schedule of Fees for Services and Activities. 4. Report from the Director of Corporate Services/Treasurer/Deputy CAO - Write Off Water/Sewer Fees as uncollectible. R-254-15 That Council authorizes the Director of Corporate Services/Treasurer/Deputy CAO to write off a sum of $292.20 for Water/Sewer arrears deemed as uncollectible. 5. Report from the Director of Corporate Services/Treasurer/Deputy CAO Budget Performance Report Q1 2015. R-255-15 Seconded by Councillor Pomeroy

Report from the Director of Corporate Services/Treasurer/Deputy CAO Update on Request for Proposal (RFP) 2015-01 Design and Upgrade of Streetlights & Ball Park Lights. R-256-15 That staff are directed to contact senior staff at the Municipality of Trent Hills and Peterborough Utilities to request their help to review the current RFP results, with a report back to Council; and That the Ball Park lights be excluded from the RFP review. 7. Report from the CAO Provincial Planning Review. R-257-15 That the CAO s report on Provincial Planning Review be received for information at this meeting, for a report back to a May meeting recommending municipal comments on the Provincial Planning Review. 8. Report from the CAO Emergency Preparedness Week, May 3 rd to 9 th, 2015. R-258-15 Moved by Councillor Gerow That the Council of the Township of Havelock-Belmont-Methuen declares the week of May 3 rd to 9 th, 2015 as Emergency Preparedness Week. 9. Report from the CAO Special Meeting at Douro-Dummer Township on OPP Contracts. R-259-15 Moved by Councillor Gerow That the report from the CAO regarding the Special Meeting at Douro-Dummer Township on OPP Contracts be received for information; and

Report from the CAO Strategic Plan. R-260-15 That Council receive the CAO s report on the Strategic Plan at this meeting; and That Council review Appendices A and B to provide Staff with direction at the May 11 th, 2015 meeting. 11. Report from the CAO Part Time By-law Enforcement Officer. R-261-15 Seconded by Councillor Gerow That Council authorizes staff to proceed with hiring a part time By-law Enforcement Officer as approved in the 2015 budget; and That staff are asked to check with neighbouring municipalities to determine if they have additional By-law Enforcement Officer services available to meet our requirements, and if not, to initiate the hiring process. Correspondence: #70-15 Ministry of Transportation advised that they are unable to comply with Council s request to include Havelock on the destination sign on Highway 401 approaching County Road 30. R-262-15 That the correspondence from the Ministry of Transportation be received. #72-15 Township of Madawaska Valley asked Premier Wynne and the Province of Ontario to take immediate action to prevent the rise in electricity rates advocated in the Province s Long Term Energy Plan. They ask electricity rates should be lowered to a reasonable level as quickly as possible. R-263-15 Moved by Councillor Gerow

Twp of HBM Minutes of April 20, 2015 Regular Council Meeting Page 8 of 11 Seconded by Councillor Pomeroy That Council supports the Township of Madawaska Valley s position on electricity rates. #71-15 Ontario Provincial Police remind that the short term, six month agreement for the OPP policing service will expire June 30, 2015. Municipalities not having entered into a long term three to six year agreement would start to be policed and billed under S.5.1 of the Police Services Act (PSA). R-264-15 Seconded by Councillor Gerow That the balance of the correspondence be received and filed. Committee Liaison Reports Deputy Mayor Martin had nothing to report under Committee Liaison Reports. Councillor Pomeroy said that Larry Ellis had received a certificate at the last Source Water Protection meeting to recognize his involvement from the start. He said that Celebrate Havelock would be bigger than ever this year. Councillor Gerow provided the highlights from the April meeting of the Eastern Ontario Trails Alliance. Councillor Webb reported that the last School Council had been an abbreviated meeting due to a scheduling mix up. The School Council would be holding fundraising draws over the summer. Councillor Webb also presented a draft resolution from the Economic Development Committee for Council consideration. R-265-15 Seconded by Councillor Gerow That Council support the Economic Development Committee s proposal of hosting a Classic Car, Truck and Motorcycle Show on June 19, 2015 from 5:00 p.m. 9:00 p.m.; That Council authorizes the Economic Development Committee to close Oak Street from Highway 7 to George Street for the said show on June 19, 2015 from 5:00 p.m. 9:00 p.m.; and

Twp of HBM Minutes of April 20, 2015 Regular Council Meeting Page 9 of 11 That the Treasurer is authorized to transfer funds from the Administration Reserve with an upset limit of $2,000 for expenses associated with the Economic Development Committee s Classic Car, Truck and Motorcycle Show. Mayor Gerow reported that the insurance rates for the Crowe Valley Conservation Authority were going up by over $14,000 more than budgeted for. This puts them in a difficult financial position. Written Notice of Motion: There were no Written Notices of Motion for consideration at this meeting. Oral Notice of Motion or Discussion: There were no Oral Notices of Motion presented at this meeting. New Business: Councillor Martin noted that the OPP were doing foot patrols in our community. He did not like A frame signs being placed on County Roads. He was waiting on the report for parking on the streets. The Clerk said that a report was scheduled for the May 4 th meeting. Councillor Pomeroy said that he had received a call from Mrs. Seabrook on George Street County Road about flooding. Mayor Gerow said that he would look into tomorrow. Councillor Gerow said that he had received a few calls about dust. He said that he knew the public works were working on sweeping in the town and would get to the rural soon. Mayor Gerow said that the Crowe Valley Conservation was monitoring water levels. By-Laws: 1. A by-law to establish fees for Services and Activities. R-266-15 That the by-law to establish fees for Services and Activities for the Township of Havelock-Belmont-Methuen be read a first, second and third time and be passed in open session this 20 th day of April, 2015, and be numbered By-law No. 2015-34.

R-267-15 That the by-law to appoint persons to a Mathison Property Committee for 2015 and 2016, as amended to add Arlene Miles as a Volunteer from the community, be read a first, second and third time and be passed in open session this 20 th day of April, 2015, and be numbered By-law No. 2015-35. 3. A by-law to provide a one day exemption to dog control by-law re Celebrate Havelock. R-268-15 That the by-law to provide a one day exemption to dog control by-law re Celebrate Havelock, be read a first, second and third time and be passed in open session this 20 th day of April, 2015, and be numbered By-law No. 2015-36. Closed Session: There was no Closed Session scheduled for this meeting. Council added an item for consideration in a Closed Session at this meeting. R-269-15 That the meeting move into Closed Session at 9:45 p.m. under Section 239 (2) of the Municipal Act for litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board. R-270-15 Seconded by Councillor Gerow That the meeting rise from the Closed Session at 9:55 p.m. and the regular meeting resume.
