Request #: (To be filled by EMEPC) The recipient MATERIAL TRANSFER AGREEMENT RESPONSIBILITY TERM The Task Group for the Extension of the Continental Shelf (EMEPC) was established by Resolution of the Council of Ministers No. 9/ 2005, aiming to prepare and submit the Portuguese proposal for the extension of the continental shelf. Presently, EMEPC is responsible for continuing the Extension of the Continental Shelf Project (PEPC) until its term as determined by the United Nations Convention on the Law of the Sea. The aims of EMEPC are: a) To understand the geological and hydrographic characteristics of the bottom of the sea in order to strengthen the arguments used in the Portuguese proposal for the extension of the continental shelf; b) To promote the deep sea mineral resources exploration in EMEPC projects, namely during EMEPC sea campaigns, either Continental Shelf campaigns or M@rBis campaigns; c) To keep and update the database that supports the Continental Shelf Extension Project and to create the base of the national system to monitor and manage the ocean; d) To promote R&D projects which use and explore data collected during the Continental Shelf Extension Project and other EMEPC projects; e) To reinforce the national scientific community by promoting Continental Shelf Extension Project related PhD programs, namely in GIS, geology, geophysics, biology and international public law; f) To promote the participation of students and junior researchers in EMEPC projects, especially in EMEPC sea campaigns; g) To help and support the preparation of other states extension of the continental shelf proposals with which the Portuguese Government might have cooperation agreements; h) To coordinate the M@rBis project and to cooperate with the scientific community to ensure the sharing of information with other institutions 1

EMEPC organized several oceanographic campaigns, having in its possession a considerably amount of data, images and samples for the scientific areas of Marine Sciences, Hydrography, Geology, Geophysics, Geochemistry and Biology. Considering the need to safeguard the interests inherent to the task and objectives of EMEPC, of high value and importance to the Portuguese Government, it is important to regulate the terms and conditions under which the data, images and samples can be shared and used. The terms and conditions to be fulfilled by recipients are as follows: 1. st Use of Data, Images and Samples The data, images and samples to be shared by EMEPC, in general only during a given duration, can only be used for the purposes expressly authorized. 2. nd Property of Data, Images and Samples Unless otherwise stated, EMEPC retains the ownership and copyrights of the shared data, images and samples. The obligations of the recipient are: 3. rd Obligations of the recipient a) To comply with the scientific norms for the use of samples, warranting their due conservation; b) To comply with the scientific norms for the use of data and images; c) To formally transmit to EMEPC published scientific works and the results of analyses, studies or experiments conducted using the shared data, samples or images; d) To respond to every information request from EMEPC related with the shared data, images and samples; e) Not to share any data, images or samples with third parties without formal consent from EMEPC; f) Not to use the data, images or samples for purposes other than those stated in the Data Request Form; g) To make bibliographic references in scientific or outreach works to be published, in accordance with the procedure set down in annex I; 2

h) Not to publish scientific works based in data, images or samples without the formal authorization of EMEPC; i) To return the samples to EMEPC at the end of the sharing duration (if applicable); j) To pay the cost or/and fees of sending and returning the shared samples. 4. th Recipient s responsibility The breach by the recipient of any of the duties previously listed may imply that the petitioner incurs in civil or criminal liability in accordance with national law. 5. th Procedure for the sharing of data, images and samples 1. The sharing of data, images and samples shall be formally requested through the Data Request Form addressed to the Head of EMEPC, which shall include: a) Name, Passport or ID card number; b) Scientific Institution of the recipient and contact information; c) Purpose of use for the data, images or samples; d) Outcomes expected to be achieved with the use of the data, images or samples; e) Description of the data, images or samples to be shared. 2. The sharing of data, images or samples is granted by decision of the Head of EMEPC and is regulated by the provisions set down in the present document.
