1 MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY FOR FOREIGN AFFAIRS OF ICELAND AND THE DEPARTMENT OF NATIONAL DEFENCE OF CANADA CONCERNING DEFENCE COOPERATION 1/6

2 1. Introduction 1.1 The Ministry for Foreign Affairs of Iceland (MFA) and the Department of National Defence of Canada (DND), hereinafter referred to as the Participants : Recognizing that Canada and Iceland share common interests as North Atlantic countries and members of NATO, and Recognizing that it would be to their mutual advantage to strengthen bilateral defence relations, Have resolved to conclude this Memorandum of Understanding (MOU) to establish the basis for further defence cooperation. 2. Objectives and Scope 2.1 The Participants will seek to strengthen cooperation in the following areas: Consultation: The Participants will promote collaboration among their respective officials on defence and security matters of mutual interest Information Exchange: The Participants will consider, as mutually determined feasible, exchange of information, in particular concerning air and maritime picture. The Participants will continue to share information, through identified points of contact reflected in Annex A attached hereto, for queries regarding air and maritime activity. Either Participant may inform the other regarding amendment to the points of contact information by submission of a letter reflecting the amendment(s), thereby avoiding having to amend the MOU. Sharing of some types of information may require separate arrangements as determined by either Participant Education and Training: The Participants will explore opportunities to collaborate in the training of personnel including, but not limited to, training in air surveillance and control Exercises: The Participants will promote opportunities for cooperation in exercises, including the possibility of Canadian participation in exercises hosted in Iceland, its territorial waters and its airspace Visits: The Participants will promote opportunities for visits, including by Canadian staffs and elements of maritime, air and land forces to Iceland. 2/6

3 2.2 Further areas of cooperation may be identified and made subject to the provisions of this MOU with the mutual consent of the Participants. Should an opportunity of mutual interest to the Participants arise that would normally fall outside the scope of this MOU, the Participants may open dialogue with Ministries or Agencies of their respective governments in order to facilitate cooperation. 2.3 This arrangement will not affect either Participant s obligations under the North Atlantic Treaty. 2.4 This MOU is not to be considered an agreement within the meaning of the Vienna Convention of This MOU is not intended to conflict with national or international law, or with any existing international agreements between the Participants. In the event of a conflict between this MOU and any such laws or agreements, the laws or agreements will prevail. The Participants will notify each other in the event of any such conflict. 3. Financial Arrangements 3.1 This MOU will not impose any financial responsibilities on its Participants, except that each Participant will be responsible for the funding costs it incurs in its own interest, related to the support of the MOU. 3.2 Iceland will provide host nation support to Canadian personnel and activities related to predetermined defence cooperation activities in Icelandic territory. The extent and type of host nation support to be provided should be determined on a case-by-case basis prior to cooperation activities taking place. 3.3 The defence cooperation will be based on NATO standards and procedures applicable to host nation support (typically including MC 319/1, MC 334/1, AJP 4.5 (A), STANAG 3113 and STANAG 2034). 3.4 The exact arrangements for different kinds of presence and exercises in Iceland will be determined in advance on a case-by-case basis. 4. Liabilities 4.1 Liabilities incurred as a result of any activities carried out under the provisions of this MOU will be dealt with pursuant to the provisions of the Agreement between the Parties to the North Atlantic Treaty regarding the Status of their Forces, done on 19 June 1951 (SOFA). 3/6

4 5. Status of Personnel 5.1 The status of personnel participating in activities under this MOU will be in accordance with the provisions of the SOFA. 6. Security 6.1 Each Participant will control, safeguard and protect sensitive and classified information exchanged or generated under this MOU in accordance with the national security laws and regulations of its country to the extent that they will provide a degree of protection no less stringent than the protection rules of NATO Document C-M(2002)49, Security within the North Atlantic Treaty Organisation, of 17 June 2002, as subsequently amended. 6.2 Classified information will be transferred only through Government-to- Government channels, including information exchange systems, or through channels approved by the Designated Security Authorities of the Participants. 7. Disclosure of Information 7.1 General disclosure Each Participant will take all lawful steps available to it to ensure that information provided or generated pursuant to this MOU is protected from further disclosure without the other Participant s written consent to such disclosure. Accordingly, each Participant will ensure that: a) The recipients will comply with any distribution and access restrictions on information that is provided under this MOU; and b) Each Participant will promptly notify the other regarding any known or suspected compromise of information provided by or under this MOU. 7.2 Publicity Both Participants will strive not to release to any third party any information, press release or other publicity pertaining to any activities carried out under this MOU and/or concerning the other Participant without prior consultation with the other Participant. 8. Settlement of Disputes 8.1 Any disputes regarding the interpretation or implementation of this MOU will be resolved only by consultation between the Participants and will not be referred to a national or international tribunal or any other third party for settlement. 9. Amendment 9.1 This MOU may be amended at any time with the mutual written consent of the Participants. 4/6

Duration, Withdrawal and Termination 10.1 This MOU will remain in effect until withdrawal or termination pursuant to paragraphs 10.2 or This MOU may be terminated at any time with the mutual written consent of the Participants Either Participant may withdraw from this MOU upon presentation of 90 days written notice to the other Participant The provisions regarding security will continue to apply to information generated or exchanged under this MOU after withdrawal or termination Any financial responsibilities incurred by a Participant pursuant to paragraphs 3.1 or 3.2 before termination or withdrawal will remain the responsibility of the Participant after such termination or withdrawal. 11. Languages 11.1 This MOU is written in Icelandic, English and French, in six originals, each text being equally valid. In the case of divergence of interpretation the English text will prevail. 12. Effective Date and Signature 12.1 This MOU will become effective on the date of the last signature.
