General terms and conditions 1. Exotiq Property Jimbaran (EPJ) Liability a. EPJ is an agent acting merely as a booking agent who works between its guests and on behalf of the villa owners of the villas that have been listed. The contract is not effective until required payment has been received and confirmation has been sent to the client. b. Guests have the absolute right to choose any villa they want. EPJ will advise to the best of its ability of the villa conditions and all our villas have been inspected and checklists completed by our staff. c. We have spent considerable time gathering and checking all of the information about our villas and the other information we supply. Every detail has been checked and double checked to ensure that it is as accurate as possible. However, as the facilities at private properties may change from time to time we do not accept responsibility if any facilities become permanently or temporarily unavailable. d. EPJ is not responsible for any insurance 2. Booking through NoHotels and Exotiq Property Jimbaran a. Bookings are only secured once you have completed the Booking Form together with full payment. Please be aware that for some villas, 50 % deposit is non refundable. The 50 % remainder is refundable if notice given 61 days prior to arrival in low season and 91 days prior to arrival in high/peak season b. All payments can be made by bank transfer. All bank transfer fees are the responsibility of the client. Please send in full amount guarantee. Full Bank details are available on the last page of this contract. c. A contract will exist once you receive our Confirmation Booking Receipt. d. If for any reason we decline to accept your booking, the deposit or full payment will be returned. e. We can correspond with a business address (e-mail, telephone, and fax numbers), however, please specify a personal address (e-mail, telephone and fax numbers) for emergency contact. f. We will endeavor to provide Special Requests if they are highlighted on the Booking Form, however we do not guarantee that any special request can be met. 3. Amendments & Cancellations a. Amendments by the client, after booking is confirmed. We will make every effort to assist you if you need to amend your booking. All amendments must be made in writing, in the name of the signatory on the Booking Form 1

and are subject to a US$50 administrative fee to each change made after a booking has been confirmed. b. Cancellation by the client If for any reasons, this contract agreement is terminated by the client before the rental period finishes, the client is not allowed any refund from the Agent or Owner. Cancellation charges will be levied on the following basis: # days prior to arrival date % of Villa Cost Written notification received More than 61 days Less than 61 days 50% will not be refunded 100% of total villa cost will not be refunded c. Amendments by Exotiq Property Jimbaran Operator/Owner From time to time villa owners may make adjustments in their terms and conditions, including changes in price. We reserve the right to change the details on the website and in other written material published by the Operator, and will advise you of such changes at the time of booking. Once a Confirmation Invoice has been issued by us, we will make every effort to offer the villa as advertised, however the Operator may have to alter the villa arrangements before your arrival. In situations where an amendment and or cancellation is forced because of a natural disaster, act of war, terrorist acts or threats, industrial disputes, technical problems such as power failures, fire, flood, drought, adverse weather and other acts of God (force Majeure), we will endeavour to make suitable alternative arrangements at no extra charge, however you will not be entitled to any compensation. Failure to complete payment for your villa within the time period required will result in your booking being cancelled and appropriate charges will be levied as explained above. 4. Prices a. All prices quoted are in US dollars, and should be paid in US dollars by bank transfer. b. Exotiq Property Jimbaran is not obliged to provide you with a breakdown of specific prices. c. Exotiq Property Jimbaran reserves the right to change any advertised price prior to accepting your booking and receiving a deposit. 5. Security Deposit Security deposits of min US$2500 OR 25,000,000 (twenty-five million Indonesian Rupiah) is required for all villas to be used to pay for any damage caused by you 2

and/or your party s negligence. This deposit is also used to pay for any unpaid bills incurred by you and/or members of your party, during your stay at the property. Deposits will be refunded in full on the day of departure, unless damages/repairs need to be performed or outstanding utility bills require payment. The owner reserves the right to repossess the property if the client or a member of the party has caused excessive damage, in which case refunds will be made by bank transfer less the cost of damages. All villas through Exotiq Property Jimbaran require a security deposit. The client agrees to bear any replacement costs and or repair costs of any item on the inventory list as a result of loss (including theft) or breakage or breakdown. 6. Problems/Complaints EPJ will not entertain claims lodged by a client upon departure or after return home when it is no longer possible to investigate the complaint effectively. If you are dissatisfied with your villa you must immediately contact the property management/exotiq Property concierge during the period of your stay. We will do our best to satisfy your requirement in connection with the owner of the property if the agent considers the complaint valid. 7. Our Responsibilities a. Exotiq Property Jimbaran bares no responsibility for any loss or damage to your property incurred whilst staying at one of our villas. You are encouraged at all times to deposit valuables with the proper authorities or in safety deposit boxes. b. Any information you provide to the Operator which is of a personal nature (i.e. passport details, dietary needs, ages etc.) will be confidentially held by the Operator and will only be passed on to local representatives responsible for delivering you to your Villa accommodation. 8. Your Responsibilities a. Only those persons named in the Booking Form are entitled to stay at the villa without prior arrangement. If the villa is booked on a reduced price tariff which includes the use of a limited number of the available bedrooms, number of persons staying at the property must not exceed the number of sleeping places indicated in the tariff advertised. The client is responsible where stated on the booking form for payments of electricity charges due monthly and will be advised and collected by the villa management. The owner/villa management is responsible for any and all land / building taxes and levies and any other incidental fees / costs not associated with the occupation of the property. All pool maintenance charges, water rates / consumption charges, monthly security fees; monthly garbage removal fees and any other fees or contributions charged by the local authorities and for the other fees are paid by the villa management. The client is responsible for the complete inventory of locks and keys and will replace any that are lost or broken. The client is responsible for replacing any batteries in battery-operated appliances and equipment, which includes remote control units. 3

The client is responsible for the security of the property and agrees to take all necessary steps towards the safekeeping and security of the property at all times. The client agrees to register as a resident OF THE PROPERTY and comply with the local rules and regulations that apply to residents who rent and reside in properties in Bali. In the case of any incident / occurrence such as and not limited to fire, theft, loss, breakage, and damage, the client agrees to inform and report to the villa management or agent within twenty four (24) hours of such incident / occurrence. The client is advised to call the manager to make such reports. The client is forbidden to remove permanently any of the inventory items from the house. b. You are prohibited from organizing and holding any major party events at your villa beyond normal entertaining, unless with prior agreement for which there maybe an additional charge. c. Photography and filming of the villa is allowed for private use only. d. It is your responsibility to take good care of the property. All villas are supplied to you in good order at the beginning of the rental period and you must ensure they are left in the same state when you depart. Both PARTIES acknowledge that the inventory is checked by the Agent and any damages prior to check in are recorded. Husregler for Gateway studenter (house rules) 1. Keep doors closed and do not keep money or other valuables in sight of others or easily accessible. 4

4. Som hovedregel er det ikke lov og ha overnattingsgjester. Evt. unntak må avtales med Management og de andre du bor sammen med. Generally it is not allowed to have sleep over guests. Any exceptions from this rule must be agreed to by the Management in advance. 5. Det er ikke tillatt å verken husdyr(høner, haner, griser etc.) eller kjæledyr(katter, hunder, fugler, gekkoer m.m). It is not allowed to keep any livestock (chickens, roosters, pigs, etc.) or pets (cats, dogs, birds, geckos, etc.). 6. Hold rommet/ villaen ryddig og ren! Hvis du gjør din del av jobben, blir det enklere for rengjøringspersonalet og gjøre sin, og en ren og ryddig boligsituasjon er hyggeligere for alle du bor sammen med. Keep the place clean and tidy. Hvis du ønsker å pynte opp ved å henge opp noe på veggen, så må dette først avklares med Management FØR du setter i gang. Røyking innendørs er forbudt og skal kun skje utendørs, på steder de du bor sammen med har blitt enige om. Smoking indoors is strictly forbidden. 9. Bruk eller oppbevaring av narkotiske stoffer, inkludert sopp, vil automatisk og uten advarsel medføre bortvisning fra bostedet uten mulighet for å få tilbake det beløp som er betalt for innkvarteringen. Use or storage of drugs, including mushrooms, automatically and without warning lead to expulsion from the residence without the opportunity to get back the amount paid for accommodation 10.
