Pursuant to Law n 24/2001 of 27/4/2001, on establishment, organization and functioning of a health insurance scheme for government employees (RAMA); Pursuant to Law n 23/2005 of 12/12/2005 establishing Military Medical Insurance (MMI) and determining its organisation and functioning; ADOPTS: TITLE ONE: GENERAL PROVISIONS Article One: Scope of this Law This Law establishes and determines the organisation and the management of a mutual health insurance scheme. This Law shall determine its functioning and beneficiaries. Article 2: Establishment of the procedures of mutual health insurance scheme There is hereby established a mutual health insurance scheme. The mutual health insurance scheme is coordinated at the Fund which has its headquarters at the level of each district. Les mutuelles de santé sont coordonnées au niveau d un Fonds de mutuelle de santé ayant le siège au niveau de chaque District.

Article 4: Branches of the health insurance Fund The mutual health insurance Fund in each District is composed of branches which are at the level of health centres. Article 11: Appointment of the members of the Board of Directors and their term of office The Board of Directors is comprised of seven (7) persons appointed and removed by an Order of the Minister in charge of health. They are designated in accordance with knowledge and experience they posess. At least thirty (30) percent of its members shall be women. They have a term of three (3) years which may be renewable only once. The Board of Directors shall be composed of the following persons: 1 a district representative; 2 two (2) representatives of the branches of the mutual health insurance scheme operating in the district; 3 a representative of associations operating in a district; 4 a representative of religious denominations; 5 a representative of health care establishments collaborating with the mutual health insurance Fund of the District; 6 a representative of Sectors. 14 approuver la nomination des experts et leurs honoraires; 15 approuver le recrutement du personnel du Fonds de mutuelle de santé dont le recrutement n est pas de la compétence d autres organes. A member of the Board of Directors may leave such an office due to the following reasons: 1 if the term of office expires; 2 if he or she resigns in writing; 3 if he or she is no longer able to perform his or her duties due to physical or mental disability certified by an authorized medical doctor; 4 if he or she is assigned other duties; 5 if he or she is definitively sentenced to a term of imprisonment equal to or exceeding six (6) months without suspension ; 6 he or she is absent in meetings for three (3) consecutive times in a year with no justified reasons; 7 it is clear that he or she no longer fulfils the requirements considered at the time of his or her appointment in the Board of Directors; Article 12: : Conseil d Administration et causes de cessation de qualité de membre Le Conseil d Administration est présidé par un Président nommé par Arrêté du Ministre ayant la santé dans ses attributions. Its Chairperson or Vice Chairperson in case of absence of the Chairperson, shall convene it at least fifteen (15) days before it is held. It may be convened in its extraordinary meeting if considered necessary, at the invitation of its Chairperson at own initiative, or upon request in writing by a third (1/3) of its members at least five (5) days before it is held. The Director of the mutual health insurance Fund shall attend the meetings of the Board of Directors and serve as the rapporteur but does not vote. Le Directeur du Fonds de mutuelle de santé participe aux réunions du Conseil d Administration et en est le rapporteur, mais n a pas le droit de vote. Il ne participe pas aux réunions du Conseil d Administration lorsqu il s agit de l examen d une question le concernant ; dans ce cas, le Conseil d Administration élit un rapporteur en son sein.

In case of failure of achieving the majority vote, the Chairperson s vote shall settle the dispute. Article 16: Use of experts The Board of Directors may seek assistance from the experts when it examines an issue that requires special expertise. The powers of the expert in the expertise shall only relate to what has been required. They may, however, seek medical care from any health care establishment that collaborates with mutual health insurance scheme in case they have fallen sick in such a place where the health care establishment is situated. With exception of emergency case, a patient shall benefit from medical care of the second and the third category hospitals if he or she has a transfer note. An Order of the Minister in charge of health shall determine the categories of hospitals. Ils peuvent également bénéficier des prestations médicales dans tout établissement de santé qui collabore avec la Mutuelle de santé lorsqu ils tombent malades étant dans le District dans lequel se trouve cet établissement. A l exception d un cas d urgence, le patient ne bénéficie des soins médicaux dans les hôpitaux de deuxième et de troisième catégories que sur transfert médical. Un Arrêté du Ministre ayant la santé dans ses attributions détermine les catégories des hôpitaux.

It shall also cover the medicine approved in such medical services. The medical services which shall be covered are: 1 vaccination; 2 consultations; 3 medical surgery; 4 dental care; 5 medical radiology and scanning; 6 laboratory tests; 7 physiotherapy; 8 hospitalization; 9 supplying medicine that is on the list accepted by mutual health insurance scheme; 10 providing pre-natal, perinatal or post natal care; 11 ambulance fee ; 12 provision of prosthesis and orthosis not exceeding the value approved by the mutual Article 30: Prestations couvertes et celles non couvertes par le Fonds de mutuelle de santé Le Fonds de mutuelle de santé assure le remboursement des prestations médicales effectuées dans les établissements de santé ayant conclu un contrat avec lui. Article 35: Payment of subscription fee and validity of access to medical services A member shall pay his or her annual subscription fee irrespective of whether he or she benefited from medical care services. A member who joins the mutual health insurance scheme for the first time shall start benefiting from medical care services thirty (30) days after he or she pays the subscription fee. The member shall renew his or her insurance before the year ends. However, he or she shall continue to receive medical care services for thirty days (30) after the expiry of the insurance. Tout affilié qui souscrit à la Mutuelle de santé pour la première fois bénéficie des soins médicaux après trente (30) jours comptés à partir du versement de la cotisation. L affilié est tenu de renouveler son assurance avant la fin de l année. Toutefois, il continue de bénéficier des soins médicaux dans un délai ne dépassant pas trente (30) jours après l expiration de l assurance.

An indigent with a due certificate from the administration shall have his or her deterrent fee paid. The percentage of the deterrent fee and the person responsible for payment for the indigent shall be determined by an Order of the Minister in charge of health. Section 3: The property of the National Guarantee Fund of the mutual health insurance scheme Article 41: Establishment of the National Guarantee Fund of mutual health insurance scheme There is hereby established a National Guarantee Fund of the mutual health insurance scheme, which shall be under the Ministry of Health, with its personnel and which is audited by an Auditing Committee. If the Office of the Auditor General of State Finances carries out audit, a report and its copy shall be submitted according to provisions of the law establishing the Office of the Auditor General of State Finances. If audit is carried out by District internal Auditor as well as the external auditors, the report shall be submitted to the Board of Director, and copies shall be reserved to the Minister in charge of health and the District Mayor. TITLE VI: CONTRACTS Article 55: Contracts relating to medical activities the mutual health insurance Fund, the National Guarantee Fund of mutual health insurance scheme conclude with hospitals and pharmacies The mutual health insurance Fund and National Guarantee Fund of the mutual health insurance scheme shall conclude with hospitals and pharmacies contracts in relation with medical care services provided to their affiliated members. The format of such contracts mentioned in this Article shall be determined by an Order of the Ministry in charge of health. TITRE IV: DES CONVENTIONS Article 55: Conventions de prestations médicales conclues entre le Fonds de mutuelle de santé, le Fonds National de Garantie des mutuelles de santé, les établissements sanitaires et les pharmacies Le Fonds de mutuelle de santé et le Fonds National de Garantie des mutuelles de santé concluent, avec des établissements sanitaires et des pharmacies, des conventions de prestations médicales en faveur des affiliés. La nature des conventions visées au présent article est déterminée par Arrêté du Ministre ayant la santé dans ses attributions.

Inama y Ubuyobozi y Ikigo cy ubwisungane mu kwivuza yitoramo abagize Komisiyo y ubwumvikane ari bo: Article 56: The contracts the mutual health insurance scheme branches conclude with health centres or private hospitals and Pharmacies The mutual health insurance scheme branches shall conclude agreements with public health centers or private hospitals and pharmacies in order for the members to receive medical care or receive medicine which is not available in the health centers. The format of such agreements mentioned in this Article shall be determined by an Order of the Minister in charge of health. TITLE VII: ARBITRATION AND SANCTIONS Article 57: Arbitration committee, members and its functioning Before any litigation relating to the decision taken or any other act carried out in the mutual scheme is filed by a member or any other person to the Courts of Law, shall be referred to the arbitration committee. The Board of Directors of the mutual health insurance Fund shall elect among itself the following members who compose the arbitration committee: Article 56: Conventions conclues entre les sections de mutuelle de santé et les centres de santé publics ou les établissements sanitaires privés et les pharmacies Les sections de mutuelle de santé concluent des conventions avec des centres de santé publics ou des établissements sanitaires privés et des pharmacies en vue de faciliter l accès des affiliés aux soins médicaux et aux médicaments qui ne sont pas disponibles dans des centres de santé. Le contenu des conventions visées au présent article est déterminé par Arrêté du Ministre ayant la santé dans ses attributions. TITRE VII : DE L ARBITRAGE ET DES SANCTIONS Article 57: Comité d arbitrage, sa composition et son fonctionnement Un affilié ou toute autre personne doit, avant de saisir la juridiction pour examen d une décision prise ou de tout autre acte commis dans une mutuelle de santé, soumettre son litige au Comité d Arbitrage. Le Conseil d Administration d un Fonds de mutuelle de santé élit en son sein les membres du Comité d Arbitrage suivants:

57 57 1 uhagarariye Akarere; 2 uhagarariye amashami y ubwisungane mu kwivuza akorera mu Karere; 3 uhagarariye amavuriro akorana n Ikigo cy ubwisungane mu kwivuza. Inama y Ubuyobozi ishyiraho amabwiriza agenga imikorere ya Komisiyo y ubwumvikane. Ingingo ya 58: Uko impaka hagati y Ikigo cy Ubwisungane mu kwivuza, Ikigega ngoboka cy Igihugu n abo bakoranye amasezerano zikemurwa Impaka hagati y Ikigo cy Ubwisungane mu kwivuza, Ikigega ngoboka cy Igihugu n abo bakoranye amasezerano zikemurwa mu bwumvikane. Igihe ubwumvikane butabonetse, hitabazwa Urukiko Nkemurampaka nk uko ruteganywa n amategeko. Iyo hari utanyuzwe n ibyemezo by Urukiko Nkemurampaka, hitabazwa inkiko zibifitiye ububasha. 1 a representative of the District; 2 a representative of the mutual health insurance scheme branches operating in the District; 3 a representative of hospitals which collaborate with mutual health insurance Fund. The Board of Directors shall set up instructions governing the functioning of the arbitration Committee. Article 58: Modalities of settling disputes between the mutual health insurance Fund, the National Guarantee Fund and the contracting parties Disputes between the mutual health insurance Fund, the National Guarantee Fund and the contracting parties shall be mutually settled by consensus. In case consesus is not obtained, arbitration tribunal as provided by the law shall be referred to. In case there is any party that is not satisfied with the decisions of the arbitration tribunal, the dispute shall be referred to the competent courts. 1 un représentant du District ; 2 un représentant des sections des mutuelles de santé opérant dans le District; 3 un représentant des établissements sanitaires qui collaborent avec la mutuelle de santé. Article 58: Modalités de règlement de litige entre le Fonds de mutuelle de santé, le Fonds National de Garantie et les tiers contractants Tout litige entre un Fonds de mutuelle de santé, le Fonds National de garantie et les tiers contractants est réglé à l amiable. A défaut de compromis, les parties saisissent le tribunal d arbitrage dans les formes prévues par la loi. Lorsque l une des parties n est pas satisfaite de la sentance arbitrale, le litige est porté devant les juridictions compétentes.

Ingingo ya 60: Kudafata ubwishingizi bwo kwivuza cyangwa ubuza abandi kwitabira ubwisungane mu kwivuza Ahanishwa ihazabu y amafaranga y u Rwanda kuva ku bihumbi bitanu (5000Frw) kugeza ku bihumbi cumi (10.000Frw), umuntu wese utabarirwa mu batishoboye bagomba gufashwa udafite ubwishingizi bwo kwivuza. Article 59: Settlement of conflicts arising from inspection Conflicts arising from medical inspection involving a medical doctor, a medical assistant and a pharmacist due to faults or any other fraud in providing an affiliated member with medical care services, or conflicts that may arise from the implementation or interpretation of instructions based on this Law and the documents enforcing it, shall be mutually settled. In case consesus is not obtained, the conflict shall be referred to the arbitration committee as provided for by the law. In case there is any party that is not satisfied with the decisions of the arbitration tribunal, the conflict shall be referred to the competent courts. Article 60: Not holding mutual health insurance or inciting others not to participate in the mutual health insurance scheme Any person who is not included in destitutes that are supposed to be assisted and does not hold mutual health insurance shall be liable to pay a fine of between five thousand Rwandan francs (5.000 Rwf) and ten thousand Rwandan francs ( Rwf). Article 59: Règlement de litige lié à l inspection Le litige sur l inspection impliquant un médecin, un assistant médical et un pharmacien à la suite des erreurs médicales ou de toute autre fraude basée sur la prestation de soins au profit d un affilié ou tout litige pouvant résulter de l application ou de l interprétation des instructions découlant de la présente loi est résolu à l amiable. A défaut d accord amiable, le litige est porté devant le tribunal d arbitrage prévu par la loi. Lorsque l une des parties n est pas satisfaite de la sentence arbitrale, le litige est porté devant les juridictions compétentes. Article 60: Défaut d affiliation à l assurance maladie ou incitantation à la non affiliation Sera puni d une amende de cinq mille francs rwandais (5.000 Frw) à dix mille francs rwandais ( Rwf), quiconque, ne rentrant pas dans la catégorie des nécessiteux, ne se sera pas affilié à une mutuelle de santé.

Ingingo ya 61: Umucungamutungo wakoze ibyaha Ahanwa hakurikijwe amategeko yo mu gitabo cy amategeko ahana n agenga icungamutungo rya Leta, umucungamutungo wese : 1 wakoresheje nabi cyangwa wanyereje umutungo w ubwisungane mu kwivuza kubera inyungu ze cyangwa se agamije guteza imbere ibigo afitemo inyungu; 2 wasohoye nkana inyandiko z icungamutungo cyangwa se raporo agamije gusebya ubwisungane mu kwivuza; 3 wahaye ibisubizo bitari byo intumwa ya Minisiteri ishinzwe ubwisungane mu kwivuza, n abagenzuramutungo; Any person who incites people not to join mutual health insurance scheme shall be liable to an imprisonment of between seven (7) days and ninety (90) days and to pay a fine of between fifty thousand Rwandan francs ( Frws) and two hundred thousand Rwandan francs ( Frws) or one of the two penalties. Article 61: Manager who commits offences Any property manager who is guilty of one of the following offences shall be punished in accordance with the provisions of the criminal Code and Laws on public property management: 1 mismanagement or embezzlement the resources of the mutual health insurance scheme due to his or her own interests or for the purpose of promoting companies he or she is interested in; 2 deliberate release of accounts documents or reports with an intention of tarnishing the image of mutual health insurance scheme; 3 provision of false responses to the agent of the Ministry in charge of mutual health insurance scheme and to the auditors; Sera puni d une peine d emprisonnement allant de sept (7) à quatre-vingt-dix (90) jours et d une amende de cinquante mille francs rwandais ( Frw) à deux cent mille francs rwandais ( Frw) ou de l une de ces peines, quiconque aura incité les autres à ne pas s affilier à la mutuelle de santé. Article 61: Gestionnaire en infractions Sera puni conformément aux dispositions du Code pénal et à celles relatives à la gestion des finances publiques, tout gestionnaire qui : 1 se sera rendu coupable de la mauvaise gestion ou du détournement des fonds de la mutuelle de santé à des fins d intérêt personnel ou à des fins d enrichir les sociétés où il détient des intérêts; 2 aura publié délibérément les documents comptables ou des rapports en vue de ternir l image de la mutuelle de santé ; 3 se sera rendu coupable de fausses déclarations à un délégué du Ministère ayant les mutuelles de santé dans ses attributions et aux auditeurs ;

Article 62: Member who fraudulently uses a member s card Shall be liable to the payment of a fine of between five thousand Rwandan francs (5.000 Rwf) and twenty thousand Rwandan francs ( Rwf): 1 an affiliated member who shall lend his or her card to a non member or one who shall use an expired card; 2 an affiliated member who uses another fraud which may cause bankruptcy to mutual health insurance scheme. Article 2: Commencement This Law shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
