1 DATE: June 9, 2014 FALLBROOK UNION HIGH SCHOOL DISTRICT TOPIC: Purchase Agreement: Apex Learning License Purchases ACTION CONSENT X INFORMATION BACKGROUND INFORMATION: Apex Learning courses comprise standards-based instructional content specifically developed for online delivery, with assessment opportunities integrated throughout, scaffolding to support learning for all students, and resources to support effective teaching. This basic design for learning is enhanced by attention to multiple representations of information (including text, images, audio, video, animations, and interactive elements) that support students different learning styles. Apex offers exam prep, remediation courses, regular core courses, courses with literacy support, as well as College Board Certified AP courses. The District began using Apex Learning in the school year and has been using the program at all three schools since the school year. CURRENT CONSIDERATIONS While a valuable educational option, the District has found that the financial resources available are inadequate to support or expand upon existing use of online courses. For the school year, the District utilized 275 Apex licenses and 110 Edgenuity licenses at a total cost of $102,800. For the school year, the District proposes funding 285 Apex licenses and 40 Edgenuity licenses. Between these two licenses, the total cost to the District is estimated at $50,200, not including professional development-related costs. A copy of the Apex quote is attached. FINANCIAL IMPLICATIONS The cost of purchasing the 285 Apex Learning student licenses is approximately $30,000 and will be paid for from District instructional materials resources (Lottery/General Fund). The $2,200 in professional development services will be paid for from one-time common core state standards funds. ALIGNMENT WITH DISTRICT GOALS The purchase of Apex Learning licenses for student use is in alignment with District Goal I: The Fallbrook Union High School District will support a rigorous academic program with an emphasis on closing the achievement gap for all students through relevant 21 st Century Learning applications, as well as District Goal V: The Fallbrook Union High School District will implement technology strategies and resources and support achievement of the District s mission and goals. 6 Attachment A Purchasing Apex Learning Digital Curriculum and Services 1. Comprehensive Courses A subscription to comprehensive courses provides access to all available comprehensive courses. Unlimited Enrollment Subscriptions: An Unlimited Enrollment Subscription provides access for a period of 12 months for one student enrolled in any number of comprehensive courses at one time. If a student completes or withdraws from all courses in which he or she is enrolled, the Unlimited Enrollment Subscription may be used to enroll another student. Apex Learning counts the number of enrolled students if Unlimited Enrollment Subscriptions are purchased. The number of students enrolled at one time may not exceed the number of Unlimited Enrollment Subscriptions purchased. Additional Subscriptions: Additional subscriptions with access through the same order end date may be purchased either at the price per subscription of the initial purchase or a price per month per subscription. There are no credits or refunds for purchases of subscriptions to comprehensive courses. 2. AP Exam Review A Single Enrollment Subscription to AP Exam Review provides access through the following June 30 for one student enrolled in one AP Exam Review course. If a student completes or withdraws from the AP Exam Review subject in which he or she is enrolled, the Single Enrollment Subscription may be utilized to enroll another student in any AP Exam Review subject. The number of AP Exam Review enrollments at one time may not exceed the number of Single Enrollment Subscriptions purchased. There are no credits or refunds for purchases of subscriptions to AP Exam Review. 3. Course Materials Certain comprehensive courses have course materials that may be required or are optional for the digital curriculum such as books for English courses, lab materials for science courses, or other ancillary items such as a calculator for math courses or a microphone for world languages courses. The price for comprehensive courses and ALVS enrollments does not include any such course materials. The course materials list can be found at Required and optional books may be purchased from Apex Learning. The price for such books does not include applicable sales tax. If any such tax is due, it will be reflected on Apex Learning's invoice. There are no returns, credits, or refunds for books purchased from Apex Learning. 4. Parental Consent The client is responsible for obtaining any necessary parental consent for each student to use Apex Learning digital curriculum. 5. Laboratory Activities The client is responsible for the implementation of any hands-on laboratory activities, including ensuring that qualified personnel are available to supervise such hands-on laboratory activities. 6. Professional Development Scheduling: Onsite professional development sessions cannot be scheduled until Apex Learning has received a valid purchase order or executed contract and must be scheduled at least 2 weeks in advance of the delivery date. Cancellations: If a scheduled onsite professional development session is cancelled without at least 2 weeks prior written notice, the client will be required to pay Apex Learning for travel and related expenses at the time that onsite professional development session is delivered. Expiration: Professional development must be delivered prior to the order expiration date. There are no credits or refunds for unused professional development sessions.
