1 APPROVED KANSAS STATE BOARD OF EDUCATION Meeting June 11, 2013 CALL TO ORDER Chairman Jana Shaver called the monthly meeting of the State Board of Education to order at 10 a.m. Tuesday, June 11, 2013 in the Board Room of the Kansas State Education Building, 120 SE 10th Ave., Topeka, Kansas. 6/11/2013 A.M. She then asked for a moment of silence after which the Pledge of Allegiance was recited. APPROVAL OF AMENDED AGENDA Mrs. Busch moved to approve the June 11 agenda with two changes: add an Executive Session as Item 15 and delay the Commissioner s Report to Wednesday s meeting. Mr. McNiece seconded. Motion carried APPROVAL OF THE MAY MEETING MINUTES Mrs. Horst moved to approve the minutes of the May Board Meeting. Mr. Roberts seconded. Mrs. Wims-Campbell asked that the May specify the purpose of Preston Williams and Rev. Ben Scott s comments during the Citizens Open Forum last month and to reflect that she also was addressing negative, offensive comments made during the April 16 meeting. Mrs. Horst and Mr. Roberts agreed to amend the motion and approve the minutes with these additions. Session Audio (00:00:25) The Board took a break from 11:10 to 11:17 a.m. TURNER USD 202 WAIVER REQUEST Dr. Michelle Sedler, Superintendent of Turner USD 202, led a team presentation on the district s rationale for seeking an ESEA Accountability Waiver from the U.S. Department of Education to exempt the district from administering the Kansas assessments in Instead, the Turner School District is proposing use of a single-aligned assessment system ACT 3-12 to measure students growth as well as their ability to be successful after high school. Information was given on past assessment data, use of an alternate assessment system, and a proposed testing schedule. Other presenters were Bill Hatfield, Assistant Superintendent of Administrative Services; Jason Dandoy, Director of Finance/Student Services; Joy Engel, Assistant Superintendent of Student Services; and Deborah Geist, Director of Special Services. Board members initiated discussion including cost per child of the new test, benchmarking, previews of the ACT assessments, credibility of another testing system, and the process of reapplying for a waiver. Dr. DeBacker explained that USD 202 would still be accountable to meeting the equivalent of state assessments and that the district is allowed to submit the waiver request to the U.S. Department of Education with or without State Board approval. Mrs. Waugh moved to support the Turner wavier request proposal. Mr. McNiece seconded. Motion carried 9-1, with Busch voting in opposition. Mr. Roberts moved to continue hearing public comment in open forum until 12:30 p.m., break for a 45-minute lunch returning at 1:15 p.m. to continue with public comment and resume the regular agenda at 1:30 p.m. Mrs. Wims-Campbell seconded. Discussion followed and Mr. Roberts amended the original motion to resume hearing public comment until all speakers were finished following the 45-minute lunch break. Motion carried with Mr. Willard abstaining. CITIZENS OPEN FORUM CONTINUED The Citizens Open Forum continued with a second round of speakers: Shirley Koehn, Wichita, opposition to Common Core and new science standards; Dr. Phil Black, USD 305 Board of Education President, support of Common Core; Penny Hargrove, USD 415 Superintendent, thanks to the State Board for supporting Common Core; Carolyn Boyd, Olathe, benefits of retaining Common Core Standards; Dr. George Griffith, USD 208 Superintendent, support of Common Core and Next Generation Science Standards; Dr. Julie Ford, Superintendent of Topeka Public Schools, support of Common Core; Dr. Deb Hamm, USD 373 Superintendent, support for Common Core; Susan Estes, Wichita, opposition to Common Core concepts; Barbara Penn, Lenexa, concerns about data mining and privacy. Chairman Shaver declared the Citizens Forum closed at 2:43 p.m. and announced a five-minute break. The meeting resumed at 2:50 p.m. NEXT GENERATION SCIENCE STANDARDS (NGSS) Matt Krehbiel, KSDE Education Program Consultant, focused on three key concepts in his presentation of the Next Generation Science Standards as prepared for adoption by the Board of Education. He emphasized that these standards are Kansas standards, are researched based, and are college and career ready standards. Board discussion followed on these issues: the gathering of parent/teacher input, the development of curriculum on the local level to meet the standards, the development of assessments for new standards, and reaffirming that the Opt Out opportunity for parents exists for any curriculum. Mrs. Cauble moved to adopt the Next Generation Science Standards as the Kansas College and Career Ready Standards for Science and to make clear to parents that an Opt Out opportunity for specific curriculum is permissible. Mr. McNiece seconded the motion. Mr. Willard continued the discussion by reading a personal letter he had shared with the Board questioning whether or not the Next Generation Science Standards were right for Kansas. Mrs. Shaver, Mrs. Busch, Mr. McNiece, Mrs. Horst and Mrs. Wims-Campbell all noted specifics they supported within the standards. Mrs. Shaver called for a vote. Motion carried 8-2 with Bacon and Willard in opposition. BREAK (01:25:49) (01:27:09) (02:03:08) UPDATE ON STATE ASSESSMENTS The Board received additional information on the Kansas Assessment Program from Dr. Tom Foster, KSDE Career, Standards and Assessment Services Director. He provided qualitative survey results, plus information on transitional assessments, tentative timelines, and field tests. Dr. Foster also reviewed features of the ACT Aspire testing option. There was some Board discussion regarding adaptive tests, accommodations for special needs students, revealing student data, and costs. Board member Steve Roberts left the meeting at 5 p.m. APPOINTMENTS TO THE PROFESSIONAL STANDARDS BOARD Mrs. Cauble moved to approve the appointments of Deb Mercer, Fred Patton, Jonathan Goering, Paul Erickson and Monte Couchman to their first full three-year terms on the Professional Standards Board all to run from July 1, 2013 through June 30, Mrs. Horst seconded. Motion carried 9-0 with Roberts absent. APPOINTMENTS TO THE LICENSURE REVIEW COMMITTEE Mrs. Cauble moved to approve the appointments of Matt Fox and Annie Diederich to their first full three-year terms on the Licensure Review Committee both to run from July 1, 2013 through June 30, Mrs. Host seconded. 4 June Page 4 (03:36:51) (03:37:15) (03:52:48) 3 UPDATE ON KANSAS LEARNING NETWORK Mrs. Busch moved to postpone the Kansas Learning Network update to the July Board meeting. Mr. McNiece seconded. Motion carried 9-0 with Roberts absent. LEGISLATIVE UPDATE Deputy Commissioner Dale Dennis distributed a draft summary of the 2013 Legislative Session that highlighted bills related to education. He also shared a profile of the State General Fund, actual and estimated figures, for Fiscal Years 2011 through He noted that the Legislature approved a twoyear budget this year with State Base Aid per pupil listed at $3,852. Operating budget restrictions for KSDE are $1,143,119 less than the previous fiscal year. Next month, the Board will be asked to make suggestions for changes as the FY 2015 budget is being considered. The scheduled mini budget workshop did not occur because of time restrictions. CONSENT AGENDA Mrs. Wims-Campbell moved and Mrs. Horst seconded a motion to approve the Consent Agenda. Mr. Bacon asked for a description of item 14s. Contract Continuation for Migrant Family Literacy grant applications. The motion carried 9-0 with Roberts absent. In the Consent Agenda, the Board: Received the monthly Personnel Report. Confirmed the unclassified special projects personnel appointments of Javier Zarazua as Project Manager on the Career, Standards and Assessment Services team at an annual salary of $58,884.30; and William Wiley to the position of Enterprise Architect on the Information Technology team at an annual salary of $75,000. APPROVAL OF AMENDED AGENDA Mrs. Busch moved and Mrs. Horst seconded a motion to approve an amended Wednesday agenda with the addition of a five-minute Executive Session as Item 8 and to include Tuesday s Commissioner s Report along with the Board Reports. Motion carried PROFESSIONAL PRACTICES COMMISSION Calin Kendall, Chairman of the Professional Practices Commission, offered a summary of recommendations concerning 12 cases brought before the PPC. Mrs. Horst moved to adopt the findings of fact and conclusions of the PPC. Mrs. Wims-Campbell seconded. Mr. Bacon inquired about the split vote on Case 13-PPC-07. The motion carried with Roberts abstaining. REPORT ON INNOVATIVE DISTRICTS PROPOSED APPLICATION Deputy Commissioner Brad Neuenswander updated the Board on the progress KSDE has made in meeting its requirements concerning House Bill 2319, the Coalition of Innovative Districts Act, including the development of an application for districts to submit to be considered for innovative district status. The application is expected to be available and posted to the KSDE website by July 1. Because of the application and review process, school year would be the first year public innovative district designation could be in place. The State Board will give final approval of applications once the requests have been reviewed by a Coalition Board. KSDE has sought an Attorney General Opinion to clarify certain aspects of the Act, plus KSDE and State Board responsibilities. Board discussion followed and several questions were asked. 10 June 12, 2013 Page 2 (00:30:37) CHAIRMAN S REPORT (01:05:33) S (01:07:10) & (01:08:37) ATTORNEY S REPORT LEGISLATIVE REPORT OTHER BOARD MEMBER REPORTS COMMISSIONER S REPORT In her update to the Board, Commissioner DeBacker explained about several handouts that were included in Board member folders, including a report prepared by the National Council of Teaching Quality (NCTQ) which focused on teacher preparation, Education Week s document Diplomas Count ranking Kansas 12th in the nation for dropout recovery, the request letter for an Attorney General s Opinion on the Coalition of Innovative District s Act, and two ESEA reauthorization bills introduced at the federal level. She also discussed the agency s upcoming move to the Landon State Office Building and the introduction of an Infants at Work Policy for KSDE. In response to the NCTQ report, Mrs. Busch commented that the number of students going into education was dropping and that low teacher salaries are a deterrent. Mr. Bacon suggested that the required grade point average for teacher preparation programs be increased, particularly during the last 60 hours of study. BOARD REPORTS Chairman Shaver noted that the Board needed to appoint a representative on the Bullying Advisory Council for the Kansas Children s Service League. Mrs. Wims-Campbell agreed to serve in that capacity. In addition, the Board needed to select a delegate to represent Kansas at the National Association of School Board Executives (NASBE) annual convention and business meeting. Mrs. Waugh moved to nominate Mrs. Wims-Campbell. Mrs. Shaver seconded. Motion carried Mrs. Wims-Campbell moved to nominate Mrs. Horst as an alternate delegate. Mrs. Shaver seconded. Motion carried For her travel report, Mrs. Shaver attended a workshop in Pittsburgh, PA about building capacity for science education. Board Attorney Mark Ferguson referenced his summary submitted to the Board outlining his monthly activities. Mrs. Horst reported that she and other Board members were at the Statehouse several days supporting education issues during the last weeks of the Legislative session. In other activity since the last Board meeting Mrs. Busch attended the Kansas Learning First Alliance meeting in May and will be attending the afternoon KSDE/KSBE Coordinating Council meeting; Mr. McNiece attended a number of league meetings within south central Kansas visiting with principals and Athletic Directors, participated in KSDE s Summer Academy in Andover, and will be at the Kansas Volunteer Commission in late June; Mrs. Horst will be involved with a number of summer community events and setting up visit days with superintendents; Mrs. Wims-Campbell spent two days in meetings with the Kansas State High School Activities Association Executive Committee where there was significant discussion about recruiting and retaining sports officials, and she attended the Kansas Alliance of Black School Educators Conference where topics included attitude gap vs. achievement gap, students in transition and early childhood; Mr. Roberts attended the Professional Standards Board meeting and suggested that the State Board review the PSB s newly created Code of Conduct; Mrs. Waugh participated in several legislative meetings and was a Sunflower Girls State speaker; Mr. Willard attended the Kansas Council for Economic Education awards event, will be a speaker at the KCEE Financial Fitness Extravaganza this month, and will travel to D.C. for the NASBE Board Meeting to help interview finalists for the NASBE Executive Director position. Mr. Willard also referenced a letter the NASBE Governmental Affairs Council received about the backlash nationwide of Common Core and state s accountability. During his report, Mr. Bacon questioned comments made about the organization of the Citizens Open Forum and suggested that the public be informed of the rules beforehand. Mrs. Waugh asked for suggestions about how to better organize the forum.
