4 Broker Fee Agreement This is an agreement between Realty Collective, LLC, hereinafter referred to as the Broker, and the prospective tenant, hereinafter referred to as the Client. The Client understands and agrees that the Broker has represented the Client as broker for the purpose of locating an apartment. The Client agrees that if the Client or Client s Guarantor or Client s roommate(s) or representative(s) rents, sublets or otherwise obtains an apartment at an address introduced to the Client by Realty Collective, LLC, whether directly or indirectly from the owner/landlord or his/her agents, then a Broker s Commission in the amount of shall be due and owing to Realty Collective, LLC. If the landlord pays the Broker s Commission the Client may rent on a No Fee basis. The Client understands that the Landlord may withdraw the offer to pay the Broker Commission at any time in which case the Client has the option to pay a Commission to the Broker or to withdraw the application and receive a refund of any reimbursable deposit paid. It is hereby acknowledged that in certain instances Realty Collective, LLC may receive additional compensation from the owner/landlord of the property and such compensation does not forego or offset the brokerage commission the Client has agreed to pay to Realty Collective, LLC pursuant to the terms of this Broker Fee Agreement. This agreement shall remain in effect for a minimum of six months and can be renewed by mutual consent of both parties. All information furnished regarding properties for rental is from sources deemed reliable. The Broker makes no representation as to the accuracy thereof and such information is submitted subject to errors, omissions, change of price, rental, commission or other conditions, prior sales, lease or withdrawal without notice. The Broker, its administrators, partners and sponsors are not to be held liable for loss or damage resulting from misrepresentation or failure to perform on behalf of the over-tenant or Landlord.
