ACf4 - DS(2008)0002 DRAFT, dated 1 February In accordance with paragraph 6 of Reference A, notice is hereby given of the intent of the NATO Air Command and Control System Management Agency (NACMA), to invite bids for the Provision of Link 16 Coverage at 29,000 Feet, subject to the conditions stated hereafter. 2. Requirements for this Project are defined in Capability Package (CP) 5A0109, the Air Command and Control System (ACCS) Foundation Operational Capability. 3. The L16@29K Project builds upon the ACCS Level of Capability 1 (LOCI) Project by installing Link 16 Equipment Suites (L1 6ES) consisting of: Multifunctional Information Distribution System (MIDS) Low Volume Terminals (LVTs) and the associated hardware and software, at forty seven sites, to enable communication, both voice and data, clear and secure via designated ACCS host sites. This will extend the Link 16 Tactical Data Link (TDL) footprint to NATO Strategic airborne assets across the NATO European operations area, at an altitude of twenty-nine thousand feet and above. 4. The Project is being authorised under the Two Stage Authorisation Procedure, where the authorisation of the first stage provides agreement on the physical scope and procurement approach. The first stage authorisation has already been granted, while the authorisation of the second stage will be sought by the Host Nation before contract signature at the latest. Stage 2 authorisation provides agreement on the financial scope and funding and therefore constitutes final authority for the signature of the contract with the selected Contractor, by the Host Nation. 5. 2 6. The Optional Preliminary Bidding Procedure, as detailed in Annex I1 to Reference A will apply to this procurement beginning with a formal Request for Bidders Views (RFBV). Nominated companies will receive a RFBV including a draft copy of the Invitation for Bid (IFB) package and be requested to review it and comment on NACMA's intended approach prior to the formal issue of an IFB. It is planned to issue the RFBV to the nominated companies in Q3, The procurement scope of the project will be presented in the Invitation for Bids (IFB), together with a background brief on NACMA, the NATO Air Command and Control System and the Project, which are attached at Annex to this letter. 8. The IFB to be issued for this acquisition is identified as IFB-CO ACCS and all correspondence concerning this solicitation should reference this number. 9. Pursuant to paragraph 6 of Reference A, the following is provided for the information of the Nations: a. The rough cost estimate for the International Competitive (ICB) part of the current phase of the projects, as per the document at Reference C, is approximately 64 M Euros. This amount should be kept in confidence and not released as information to prospective bidders. b. It is anticipated that the IFB will be issued in Q c. The closing date for receipt of bids is scheduled for Q d. Award of the contract is scheduled for Q e. The project is expected to be completed in Q f. Bidders will be required to declare a bid validity of 6 months from closing date for receipt of bids, supported by a Bid Guarantee of Euro 500,000 (five hundred thousand). Should the selection and award procedure exceed the 6 months after Bid Closing Date, firms will be requested to voluntarily extend the validity of their bids and Bid Guarantee accordingly. Bidders may decline to do so, withdraw their bid and excuse themselves from the bidding process without penalty. g. National authorities are advised that the IFB package, including technical specifications applicable to the bidding and the contractual documents, is "". If classified material has to be included in the Bidder's response to the IFB, the transmission of it shall be processed through the Bidder's respective National Delegation/Mission to NATO. h. The successful bidder will be required to handle and store classified information up to the level of "NATO SECRET" and only companies maintaining such a facilities clearance will be eligible to bid on this project. In addition, Contractor personnel working on NATO sites will be required to hold individual security clearances of "NATO SECRET". i. The envisaged method of bidding will be in accordance with the one envelope procedure as described in Reference A. Contractor selection will normally result in contract award to the lowest compliant bidder. j. In order to ensure commonality in NATO and national logistics support arrangements, the Purchaser will direct the Contractor to procure MlDS LVTs 4 against a schedule of -2-

3 suppliers and quantities for use during installation and as spares. The bid prices for the Directed Purchases will be part of the bid evaluation to establish the lowest apparently compliant bidder. Bidders will have access to a NATO Basic Ordering Agreement (BOA) covering the Directed Purchases. k. NATO standard Cryptographic equipment will be procured by the NC3A and will be provided to the Contractor as Purchaser Furnished Equipment (PFE). I. The Bidders will also be required to quote for a number of options. These options will not be evaluated in the determination of the lowest apparently compliant bidder. m. The IFB will include a requirement for prospective bidders to demonstrate their ability to undertake this project, and a requirement to demonstrate experience of recent provision of similar types of systems. 7. 7 Annex to: NACMA(08) NACMA ANNEX - PROCUREMENT BACKGROUND The NATO Air Command and Control System (ACCS) Management Agency (NACMA) exists to ensure system integrity, provide central planning, system engineering, implementation and configuration for ACCS, without prejudice to the existing configuration control responsibilities of the operational commanders for in-service systems. Such activities may include improvements to existing systems, design studies on future systems and the development of new systems through projects assigned to it. NACMA's role can thus be summarised as threefold; global ACCS planning, ensuring interoperability and integrity, and the Implementation of ACCS projects. 2. NATO Air Command and Control System (ACCS) and LOCI Background a) The NATO ACCS aims to provide NATO with a fully integrated Air Operations and Airspace Management System to replace the existing range of outdated and inflexible systems currently being employed throughout the NATO region. The development programme is extremely challenging, both in terms of technical complexity and time scale of implementation. It requires the development of a significant amount of software, and due to the distributed nature of the system, has many interoperability and system integrity challenges. ACCS is being procured as a series of projects, each building on the previous to develop the overall planned capability. b) The ACCS First Level of Capability (LOC 1) comprises: four permanent Validation sites, two deployable entities and a Software Test and Validation Facility (STVF). Each site includes one Link 16 Equipment Suite (L1 6ES). Once the ACCS hardware and software reaches maturity a number of Replication sites will be installed throughout the NATO Theatre which will act as host ACCS sites for the installed Link 16 equipment. 3. L16 at 29,000 Feet (L16829K) Overview a) The L1 6029k Project requires the development, installation and test of Link 16 Equipment Suites and accompanying ancillary equipment at 47 sites within 14 nations and their integration with NATO ACCS LOCI. b) The L1 6029K Project augments the tactical data link coverage delivered under the ACCS LOCI Project by installing a specific number of Link 16 Equipment Suites (L1 6ES) consisting of; Multifunctional Information Distribution System (MIDS) Low Volume Terminals (LVTs) and the hardware and software needed to enable communication, both voice and data, clear and secure via a designated ACCS host site. c) This will extend the Link 16 Tactical Data Link (TDL) footprint to NATO Strategic airborne assets across the NATO European operations area, at an altitude of 29 thousand feet and above. d) The Link 16 Equipment suites will be positioned at various ground sites that are either colocated with a controlling ACCS LOCI host site or remote located by up to several hundred kilometres away from a controlling ACCS LOCI host site. The L16Q29K site may be either manned, or unmanned.
