2 BACKGROUND INTERNATIONAL PROGRAM ON IMPROVED MANAGEMENT OF LAND ACQUISITION, RESETTLEMENT & REHABILITATION (LARR) November 8-15, 2015 Massive infrastructure deficit exists in most developing countries. Difficulty in acquiring land has emerged as one of the most critical causative factor for the delay of infrastructure projects in these countries. The last few years have seen growing protest movements against displacement by project affected persons (PAPs). This has resulted in stalling/delaying several infrastructural projects of critical national importance. Most of these development projects involving land acquisition and displacement are essential not only to meet the needs of the modern society, but also to ensure more inclusive economic growth. However, worldwide experience on development-induced-displacement shows a dismal picture in terms of ability of the displaced people to regain their losses. Many projects tend to remain islands of prosperity in an ocean of poverty around them. Until recently, developmentinduced-displacement was considered as inevitable and a sacrifice that some people have to make for the larger good. Proper planning and implementation of resettlement programs can go a long way in reducing public resentment and resistance to infrastructure investment. A policy for resettlement and rehabilitation (R & R) signifies government commitment to ensure adequate resettlement. In India, after years of deliberation and several drafts, the Government of India notified the National Rehabilitation and Resettlement Policy (NRRP) IN However, even before the NRRP came into existence, several states and some public sector companies had adopted their own policies for R & R. All these policies had established certain procedures and minimum benchmarks in terms of benefits for the displaced. In 2013, India enacted an integrated law for Land Acquisition, Resettlement and Rehabilitation (LARR). The new legislation, titled, the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act greatly enhanced the benchmark compensation and provided for mandatory R & R benefits to all affected families (land titleholders as well as livelihood losers). ABOUT The Centre for Excellence in Management of Land Acquisition, Resettlement and Rehabilitation () is a dedicated Regional Centre engaged in organized capacity building, research and consultancy in LARR. Established with the support of the World Bank and AusAID, the Centre has been leading the capacity building interventions for specialist officers in LARR in the region. The Centre has been providing support to the Department of Land Resources, Government of India, the state governments and various organizations in the country. 3 ABOUT THE PROGRAM, ASCI is organising a one-week advanced training program on LARR for resettlement professionals/officers, exclusively focusing on the Asian and African region. The primary objective of this advanced training program on LARR is to provide a comprehensive understanding of the LARR issues and measures required for their effective management. The program gives special emphasis on disseminating information on best practices in various aspects of LA and R & R. The program is designed: to provide for a comprehensive understanding of the progressive legal framework (Legislations and Policies) governing LA and R&R, including the LARR integrated law in India to develop an in-depth understanding of the social and environmental impacts in diverse development projects, tools and techniques for predicting these impacts and developing appropriate mitigation plans. to provide an in-depth understanding of the R&R plans and create awareness about the appropriate measures required to deal with R & R issues; to familiarize with policies of Multilateral Institutions on involuntary resettlement and its requirements in project preparation and implementation; To provide an understanding of the alternate R & R models, good practices in land acquisition/r & R experiences of various organizations and to create awareness about the innovative approaches to deal with these issues. To equip the participants to critically evaluate the policies of their own organisation/country and ensure that R&R issues associated with the projects of their organizations are addressed appropriately. PROGRAM CONTENT Legislative/Regulatory Framework: Genesis of Regulatory Framework; Methods of Land Valuation, Acquisition of Land Under Different Laws, Resettlement and Rehabilitation Policies including that of Multilateral Institutions Social Impact Assessment (SIA): Social Impacts of Displacement; Need, Scope and Benefits; Statutory Framework; Principles & Methodology; Tools and Techniques; Planning, Implementation & Monitoring of SIA; Stakeholder Analysis; Interpretation of Findings; Terms of Reference for SIA; Review Template, Displacement Impacts on the Vulnerable Sections etc. Resettlement Action Plan (RAP) and Livelihood Restoration Plans (LRP): Components of Resettlement Action Plan; Identification of Project Impacts and Affected; Considerations in Planning for Relocation; Livelihood Restoration Plan; Planning for Community Infrastructure; Considerations in Planning Civic amenities and CPRs; Budgeting; Institutional Mechanism for Effective Planning, Implementing and Monitoring Resettlement Plans, Effective Participatory Resettlement, Organizational Arrangements for Implementation; Development of Micro Plan; RAP and RAP review; Key Measures for a Successful RAP; TOR for RAP Implementing Agency; Good Practices and Case Studies in RAP and LRP Implementation. 4 State, PSUs); Innovative Practices Followed in the Country and Worldwide to effectively deal with Land Acquisition/ R & R Issues etc. Transparency in LARR: Measures, Policy Provisions, Good Practices in Various Projects etc. Grievance Redressal Mechanisms in LARR: Grievance Redressal Mechanism - Need for a GRM, Essentials of GRM-Institutional structure, Time frame for Disposal of Grievance Appellate Authority, Case Studies of Successful GRMs. Engendering R & R: Understanding Gender Concerns in R & R, Analyzing Legislative Framework through a Gender Lens, Addressing Gender Issues in LARR; Gender Checklist Monitoring and Evaluation in LARR: Monitoring Framework, Ignored Aspects and Key Considerations in Evaluating R & R, Latest Tools and Techniques, MPI Index, IRR Index etc. Use of Technology in Addressing Moral Hazard Issues in LARR Corporate Social Responsibility (CSR): Managing CSR Budget and Strategising CSR Investment in line with Community Needs; Integrating CSR with R & R, Evaluating CSR using latest tools etc. Environmental Aspects: Environment Conscience; Environment Impact Assessment (EIA); Environmental Clearances for Projects; Good Practices in Various Projects. PROGRAM PEDAGOGY The program on Improved Management of Land Acquisition, Resettlement and Rehabilitation (LARR) at, ASCI is an integrated comprehensive course that aims at equipping the specialist officers with complete practical knowledge of the processes and procedures of Social Assessment, Land Acquisition and R & R. The Program incorporates detailed presentations, case studies, group exercises, role play exercises, project work and field visits. (i) Module The generic module is given above in the program content. The Centre will be pleased to share a detailed customised program plan depending on the sector specific orientation of the participants in the program. (ii) Case Studies, Group Exercises & Role Play Exercises The Course Module incorporates case studies of various projects. The participants would be divided into groups and presented these case studies after the completion of lecture sessions. Few such exercises along with their objectives are given below. During the course of the program, the groups will be required to perform specific tasks as required for the activity in hand. This would include carrying out brainstorming activities and making presentations. The objective of these exercises would be to sensitize the participants of various challenges/good practices in LARR so as to enable them to effectively address/replicate these in their respective projects 1. Case Study and Group Exercise - Identifying and Addressing Social Impacts: A general case that captures different type of social impacts in specific projects will be distributed to the participants. The task given to the participants in this interactive session will be to identify various social/economic/cultural/gender related impacts that are generic/ differential/cumulative across the distinct phases of a project cycle- pre-construction, construction, operation, de-commissioning. 5 understanding of: different type of social impacts in specific projects direct/indirect/differential and cumulative impacts various social/economic/cultural/gender related impacts that are generic/ differential/cumulative across the distinct phases of a project cycle- pre-construction, construction, operation, decommissioning. designing project specific mitigation plan in response to the felt need. 2. Case Study and Group Exercise-Stakeholder Management and Conflict Management/Resolution in LARR: The participants will be taken through a case study reflecting the various stakeholders in a typical LA project, their diverse interests and expectations, emerging conflicts etc. The case study may typically cover the mistakes committed by requiring bodies in identifying/managing stakeholders as also in addressing conflicts. The participants will get an understanding of how each of these stakeholders generally feel and react to the project, how best to engage & communicate with them and how to practically manage stakeholders/emerging conflicts for improved management of LARR 3. Case Study and Group Exercise-Transparency and Accountability in R & R: The exercise is intended to enable the participants to understand the type of education campaigns and extension measures that need to be taken to ensure a transparent process of implementing economic rehabilitation program in the project. The exercise would also provide awareness of the institutional mechanisms to build confidence of the affected communities and ensure transparency in R & R. 4. Case Study and Group Exercise LARR Planning: The exercise would enable the participants to work out the planning/implementation strategy of LARR in a typical project; also using the Avoid-Minimize-Mitigate framework. 5. Case Study and Group Exercise-Addressing Gender Issues: The exercise would enable the participants to understand the experiences of displacement and resettlement of women in development projects, evaluation of the legislative and regulatory framework through a gender lens and measures required for integrating the gender concerns in resettlement practice. 6. Case Study and Group Exercise-Preparation of Entitlement Matrix & Micro-plan: The lecture sessions will comprehensively cover the key components of a Resettlement Action Plan, critical aspects such as calculating losses, compensation packages, the determination of eligibility for entitlements, the compilation of lists of affected people and their assets inventories. The case study and group exercise is designed to enable the participants to identify the impacts and categorise the loss of affected persons, categorize them into different groups, prepare an entitlement matrix along with a micro-in line with the legal/policy requirements. 7. Stakeholder Consultation A Role Play Exercise: The role-play exercise would enable the participants to appreciate the concerns of all stakeholders while striving towards the successful rolling out of the project. The exercise, designed to reflect the real life experience in consultation/public hearing would enable the participants to understand how the people in group behave in a similar situation and the nature of such diverse influences. 6 would help the participants to practically demonstrate the learning of various sessions on social impact assessment, stakeholder management and conflict resolution. 8. Group Exercise-Learnings from Field Visits to Resettlement Colony/Income Restoration Activities: Based on the field work briefing, the participants will study different aspects-resettlement Sites, Compensation and R & R norms, Income Restoration Activities, Transparency and Consultation Mechanisms, Gender Concerns etc. The participants shall be making presentations on their observations in the Resettlement Colony-good practices and issues of concern and a way forward in terms of improvisations that they would like to carry out in their own projects. PARTICIPANT PROFILE Officers in Land Acquisition, R & R, Environment Departments PROGRAM VENUE The Program is fully residential and will be organized at ASCI s Bellavista Campus at Hyderabad. The participants will be accommodated in single air-conditioned rooms in the Bellavista Campus of ASCI at Hyderabad. Transport between Airport/Railway Station and Campus will be arranged by the College. The College does not provide accommodation for the family. The Bella Vista Campus of the college is WiFi enabled. PROGRAM DURATION The program will be held from Sunday, November 8, 2015 to Sunday, November 15, The participants are expected to arrive a day before commencement and may leave after the conclusion of the program. PROGRAM FEE The per participant fee is US $ US $ 2760 plus Service Tax (as applicable) for the 8-day Program per participant.
