1 REQUIREMENTS GENERAL LIABILITY Casualty business that you can quote, bind and issue must meet the following requirements: The Classification Manual must indicate that the Classification is Contract or PDQ business. You may quote, bind and issue Submit business after receiving prior approval from your Colony Underwriter. The risk must not fall in any way into the Prohibit classes of business. Primary casualty coverage may be written on the ISO Simplified Rating Plan using only the ISO Simplified Coverage Forms and approved Colony Management Forms. Policies are to be written on an annual basis only with the exception of Special Event policies & risks eligible for the Vacant Bldg PDQ. All other requests for short or extended term policies should be referred to the Company. Obtain payroll/receipts on all risks to help determine if the rating base is realistic. Coverage may only be written on Occurrence Form CG PDQ rates must be used in lieu of ISO rates, where provided. Risks that have had more than 3 losses in the previous 3 years and any one loss greater than $5,000 must be submitted. For A rate classifications, contact your Contract Underwriter if not listed in the CLM. In the event of cancellation, a 25% minimum earned premium is required based on the estimated annual premium. No downward adjustment is allowed. The company reserves the right to conduct audits and adjust the premium upward. You are expected to use underwriting judgment in binding any risk. GL-1 5/7/2010
2 The following exposures of business are unacceptable and coverage must not be written involving any of these exposures. 1. COMMERCIAL GENERAL LIABILITY: a. Demolition of buildings more than 36 feet in height b. Amusement parks or devices, midway rides, carnivals, circuses and motor sports events c. Blasting or excavating operations d. Production of motion pictures e. All mining or quarrying operations f. Tunnel or subway construction g. Work on or navigation of any oceangoing vessel h. Marine wrecking, including repair, cleaning, or demolition of vessels or barges i. Offshore or submarine operations j. Railroads, including street railways, manufacturers of railroad equipment and contractors doing repair work on railroad equipment, except side track agreements k. Aircraft, airports or flight operations l. All governmental bodies m. Natural or artificial fuel gas, butane, propane or liquefied petroleum gases, gasoline or fuel oils, except with respect to: (1) Wholesale distribution of gasoline and fuel oils within a 50-mile radius (2) Storage of gasoline and fuel oils with a combined total capacity of up to 75,000 gallons (3) Retail service stations n. Manufacturing of any explosive substance intended for use as an explosive o. Handling, transportation or storage of explosives, ammunitions or ammonium nitrates p. Gas or public utility companies q. Property damage liability arising out of the blasting, implosion, shoring or moving of buildings or structures r. Liquor liability, except when written in conjunction with general liability insurance and may be written only by special approval of the company (see PDQs where available) s. Products and completed operations as respects: (1) The manufacture, sale, handling or distribution of aircraft, aircraft parts, spacecraft or spacecraft components (2) The manufacture of drugs, pharmaceuticals, vitamins, herbal dietary supplements, cosmetics, hair, scalp, or skin products (3) The manufacture, blending, and wholesale distribution of agricultural chemicals t. Products recall insurance u. Any Endorsements to broaden the coverage of the policy that are not approved by your Colony Underwriter v. Any risk with fireworks or pyrotechnical exposures are to be prohibited (even if subcontracted) GL-2 5/7/2010
3 LIMITS OF LIABILITY **Maximum Limits of Liability - Final Underwriting Authority Rests with the Company. A. General Aggregate (other than Products-Completed Operations): $2,000,000 B. Products Completed Operations Aggregate Limit: $2,000,000 C. Personal Injury & Advertising Injury Limit: $1,000,000 D. Each Occurrence Limit: $1,000,000 E. Damage to Premises Rented to You: $ 100,000 F. Medical Expense Limit: $ 5,000 Damage to Premises Rented to You limit can be increased to $300,000 for $300 additional premium. **SUBMIT FOR HIGHER LIMITS MINIMUM PREMIUMS If General Liability (mono-line or packaged) is over $25,000 in premium, submit to your Underwriter. DEDUCTIBLES GENERAL LIABILITY GL Limit GL M.P. 11 Manufacturers of products purchased by our insured that are for our insured s use or for resale by our insured. Tenants or lessees if our insured is an owner or manager of the premises. Blanket Additional Insured requests must be declined for all risks domiciled in New York or risks domiciled in other States that may perform work in New York REQUESTS TO USE BROADENED NAMED INSURED LANGUAGE TO NAME AN ADDITIONAL INSURED OR REQUESTS TO ADD MULTIPLE ENTITIES ON A SINGLE ADDITIONAL INSURED FORM Often entities requesting additional insured status will request the named insured to be used with broadened language to include affiliates, subsidiaries and indemnities for example. Any request that broadens the named insured must be referred to your Colony underwriter for final approval and pricing. We will want to have a listing of the known affiliates, subsidiaries and indemnities. Generally pricing will be an additional $50 to $100 per known entity, but your Colony underwriter will make the final determination. The only exceptions are parent companies which do not require approval. Pricing would be an additional $50 per entity to be named as a parent company. PREMIUM CHARGES: All premium charges for additional insureds, primary additional insureds, waivers of subrogation and blanket additional insureds are: 1. Flat 2. Fully Earned 3. To be charged over and above the minimum GL premium that applies Once an additional insured endorsement with a premium charge has been issued the general agent does not have authority to go back later and cancel the endorsement and reverse the premium charges without company approval. List the premium charge for any additional insureds separately on the GL declarations page. The additional insured premium should be in addition to the General Liability premium. GL-11 5/7/2010
12 BLANKET ADDITIONAL INSURED GENERAL LIABILITY Available for Contractor type risks only. Not available for use with any other classifications such as Mercantile, Manufacturing, Hotel/Motel, Recreation, etc. Intended to blanket additional insured interests of Contractor type risks only (including Truckers GL) of owners, lessees or contractors for whom our insured is performing ongoing operations. Use company form U156 (0707) Additional Insured Owners, Lessees or Contractors Scheduled Person or Organization only. Do not use ISO forms. To make the form blanket in nature specify the following under the Name of Person or Organization : All persons or organizations as required by written contract with the insured Blanket Additional Insured requests must be declined for all risks domiciled in New York or risks domiciled in other States that may perform work in New York Any request to have the ongoing language deleted from the description of the insureds operations in the additional insured form must be declined. $500 flat, fully earned charge for estimates of up to 10 additional insureds per policy term. $1,000 flat, fully earned charge for estimates of up to 20 additional insureds per policy term. Estimates that exceed 20 additional insured s per policy term must be referred to your Colony underwriter for approval. If approved pricing will be at least $1,500, flat, fully earned but may warrant additional premium depending on the specifics of the account. PRIMARY AND NON-CONTRIBUTORY FOR SPECIFIED ADDITIONAL INSUREDS Available for Contractor type risks only (this includes Truckers GL). Not available for other classes of business. Primary language that must be manuscript to your additional insured form is to be as follows: It is further agreed that this insurance shall be primary and non-contributory but only in the event of a named insured s sole negligence. Blanket primary is not available. $250 flat, fully earned charge per entity. GL-12 5/7/2010
13 WAIVERS OF SUBROGATION GENERAL LIABILITY Coverage may be added using one of the following methods: Blanket Coverage Use form U047 (0702). Additional premium is $250 flat fully earned for up to 5 estimated entities maximum. If more than 5 are estimated, submit to your Colony underwriter for approval and pricing. Blanket Coverage is available only for the following: 1) Contractor type risks (including truckers GL) 2) Property Owners but only if the lease or rental agreement itself requires a waiver to be issued naming that Property Owner Note that Blanket Waivers of Subrogation are not available with other classes of business Designated Entities Coverage Use form U047A, and show the name of the designated person or organization on this endorsement s schedule. A separate U047A is required for each designated entity. Up to 5 designated entities may be added. Additional premium is $50 flat per entity, fully earned. Designated Entity Coverage is available for most classes of business. Submit if OTHER THAN: 1) PDQ-Eligible Contractor type risks (including truckers GL) 2) PDQ-Eligible Property Owners with a lease or rental agreement in place that requires a waiver to be issued naming that Property Owner Charitable Institutions Club Members CG /85 edition date only $50 flat, fully earned charge per entity CG /85 edition date only Club members are added as additional insureds with respect to the liability of such members for activities they perform on behalf of the club. 14 Condominium Unit Owners GENERAL LIABILITY CG /85 edition date only Condominium unit owners are added as additional insureds as respects those parts of the premises not reserved for their exclusive use. $50 flat, fully earned charge Church Members CG /01 edition date only Adds trustees, officials or members of the board, clergy as additional insureds. No premium charge required. Equipment Providers - Trucking Golfmobile Users Grantor of Franchise U This should satisfy Uniform Intermodal Interchange and Facilities Access Agreement requirements. $100 for each, or $500 for blanket. To make this form blanket, specify the following under the Name of Person(s) or Organization(s): All persons or organizations as required by written contract with the insured. CG /85 edition date only Use with risks classified as either Golf Courses or Golfmobiles Loaned or Rented to Others. It provides insured status to patrons of the named insured or the named insured s concessionaires who use or are legally responsible for use of the golfmobiles. No premium charge required CG /85 edition date only Grants insured status to franchiser organizations (i.e. chain stores) that sell franchises to others. An example would be a Subway shop that needs to add the parent franchise organization to their policy. $50 flat, fully earned charge per entity GL-14 5/7/2010
15 Lessor of Leased Equipment Use company form U158 (0310) only. Do not use ISO forms. Injured workers frequently bring suit against the manufacturer, supplier, or installer of commercial and industrial equipment that cause injury. As a result, entities that lease such equipment may ask for additional insured status from the entity that leases the equipment to them. $100 flat, fully earned charge per additional insured entity being added if our insured is a Contractor type risk (this includes Truckers GL). $50 flat, fully earned charge for all others Lessor of Land CG /85 edition date only $50 flat, fully earned charge per entity Managers or Lessors of Premises Use company form U157 (0310) only. Do not use ISO forms. Managers or lessors are often named involved in lawsuits that involve injuries sustained on their property so they will often request this endorsement. This endorsement will add managers or lessors of premises as additional insureds to policies covering the lessees or tenants. $50 flat, fully earned charge per entity Mortgagee, Assignee, or Receiver CG /85 edition date only Adds mortgagers (such as banks and lending institutions), assignees (such as an administrator or executor of a will), or receivers (someone appointed by a court to manage property involved in litigation) as additional insureds for their liability arising from the named insured s premises described in the endorsement.
