1 ACEA Allied Construction Employers Association March 21, 2013 TO: ACEA Affiliated Firms RE: Accounts Not Current Enclosed is the most recent Delinquency Clearinghouse report of Accounts Not Current listing contractors who appear to be delinquent in their contributions to the Carpenters Health, Vacation and Pension Funds, Laborers: Building, Sewer, Water, Tunnel and Heavy & Highway Pension Funds, Bricklayers Health & Pension Funds, Plumbers, Steamfitters, Iron Workers, Roofers, Cement Masons, Heat & Frost and Plasterers Pension Funds, and Painters Health Fund. This list has been prepared by, the Building Trades United Pension Trust Fund Employer Accounts Committee as of the date listed on the report. This list is important to you because fringe benefit trust funds have filed liens and otherwise sought to recover delinquent payments from general contractors when subcontractors do not pay. Defending these lawsuits, even if the lawsuits have no merit, can be quite costly. If the lawsuit has merit, the contractor might pay double once to the delinquent subcontractor and once to the fringe benefit trust fund in addition to legal fees. Also, private owners will not be too pleased about having a lien filed against their property and the law requires the general contractor to defend against the lien. Contractors may also find that both public and private owners will withhold sufficient amounts of money to pay the trust funds unless the general contractor can settle the matter. Proper use of this Accounts Not Current listing can prevent the initial payment to a subcontractor who does not make trust fund payments. PERSONS RECEIVING THIS MAILING ARE URGED TO CIRCULATE IT TO PROTECT MANAGERS, SUPERINTENDENTS, ACCOUNTING DEPARTMENT PERSONNEL AND ANYONE ELSE IN YOUR COMPANY RESPONSIBLE FOR PAYING SUBCONTRACTORS. The list enclosed with this memo is a service of Allied Construction Employers Association, exclusively for our affiliated firms.
