1 -SQA-SCOTTISH QUALIFICATIONS AUTHORITY HIGHER NATIONAL UNIT SPECIFICATION GENERAL INFORMATION -Unit Number Superclass- -Title- ZJ ROAD VEHICLE LEGISLATION DESCRIPTION- GENERAL COMPETENCE FOR UNIT: Applying current legislation to ensure the safe operation and use of road vehicles in the areas of vehicle technical standards, insurance and licensing, along with legislation as it affects the vehicle driver. S 1. apply current legislation to ensure that road vehicles meet technical standards; 2. apply current legislation in relation to insuring and licensing road vehicles; 3. apply current legislation relative to driving a vehicle on the road. 4. apply current legislation relative to hiring and leasing road vehicles. 2 HIGHER NATIONAL UNIT SPECIFICATION STATEMENT OF STANDARDS UNIT NUMBER: UNIT TITLE: ROAD VEHICLE LEGISLATION Acceptable performance in this unit will be the satisfactory achievement of the standards set out in this part of the specification. All sections of the statement of standards are mandatory and cannot be altered without reference to SQA. 1. APPLY CURRENT LEGISLATION TO ENSURE THAT ROAD VEHICLES MEET TECHNICAL STANDARDS (c) Application of construction and use legislation is correct for a specified road vehicle. Application of vehicle lighting and marking legislation is correct for a specified road vehicle. Application of annual testing legislation is correct for specific road vehicle. Construction and use legislation: weights; dimensions; vehicle systems. Lighting and marking legislation: obligatory lights; non obligatory lights; fitting; use. Annual testing legislation: threshold weights; test procedure; documentation; appeals procedure. Written or oral evidence of the candidate s ability to apply vehicle technical standards to a specific type of road vehicle as stated in performance criteria to (c). 2

3 2. APPLY CURRENT LEGISLATION IN RELATION TO INSURING AND LICENSING ROAD VEHICLES (c) Interpretation of road vehicle insurance requirements is correct in terms of current legislation. Application of vehicle excise and trade licence legislation is correct for a specific road vehicle. Application of operator licensing legislation is correct in terms of making application for a particular operator s licence. Vehicle insurance legislation: types; documentation; invalidation. Vehicle excise and trade licences legislation: application; categories; use; penalties. Operator licensing legislation: types; application; documentation; appeals. Written or oral evidence of the candidate s ability to apply insurance and licensing legislation to a specific situation as stated in performance criteria to (c). 3. APPLY CURRENT LEGISLATION RELATIVE TO DRIVING A VEHICLE ON THE ROAD (c) (d) Application of driving licence legislation is correct for a given range of vehicles. Identification of the procedures to be followed as a result of a road traffic accident is correct in terms of current legislation. Application of general road traffic regulations relative to the driver is appropriate for given situations. Analysis of driver s hours and records of work is correct in terms of current legislation. 3

APPLY CURRENT LEGISLATION RELATIVE TO HIRING AND LEASING ROAD VEHICLES Vehicle users legal obligations are clearly identified relative to the operation of a hired vehicle. Vehicle users legal obligations are clearly identified relative to the operation of a leased vehicle. Legal obligations: vehicle mechanical condition; operator licensing. Written or oral evidence of the candidate s ability to apply legislation for the operation of a vehicle which is acquired on a hired or leased basis as stated in Performance Criteria to. MERIT A candidate who achieves all performance criteria for all outcomes will be awarded a Pass in the unit Pass with merit may be awarded to a candidate who has successfully, achieved all outcomes and in doing so has consistently demonstrated superior performance when, for example: maximising the use of time and resources; applying road vehicle legislation to complex areas

5 ASSESSMENT In order to achieve this unit, candidates are required to present sufficient evidence that they have met all the performance criteria for each outcome within the range specified. Details of these requirements are given for each outcome. The assessment instruments used should follow the general guidance offered by the SQA assessment model and an integrative approach to assessment is encouraged. (See references at the end of support notes). Accurate records should be made of the assessment instruments used showing how evidence is generated for each outcome and giving marking schemes and/or checklists, etc. Records of candidates achievements should be kept. These records will be available for external verification. SPECIAL NEEDS Proposals to modify outcomes, range statements or agreed assessment arrangements should be discussed in the first place with the external verifier. 6 HIGHER NATIONAL UNIT SPECIFICATION SUPPORT NOTES UNIT NUMBER: UNIT TITLE: ROAD VEHICLE LEGISLATION SUPPORT NOTES: This part of the unit specification is offered as guidance. None of the sections of the support notes is mandatory. NOTIONAL DESIGN LENGTH: SQA allocates a notional design length to a unit on the basis of time estimated for achievement of the stated standards by a candidate whose starting point is as described in the access statement. The notional design length for this unit is 40 hours. The use of notional design length for programme design and timetabling is advisory only. PURPOSE The purpose of this unit is to enable candidates to demonstrate competence in the application of road vehicle legislation to ensure the safe operation and use of road vehicles. It is aimed at those who need to have a working knowledge of the legislation to enable them to advise others to ensure compliance with the legislation. CONTENT/CONTEXT It is most important that current legislation is used and that candidates are made aware of the significance of keeping abreast of these changes once their studies are complete. The requirements for carrying out checks at the roadside and on operators premises should be mentioned along with vehicle weight checks but need not be assessed. It is recommended that the candidate be made aware of the range of legislation as it applies to all types of vehicles whilst the assessment should actually centre on one type of vehicle. APPROACHES TO GENERATING EVIDENCE A candidate-centred, resource based learning approach is recommended. During the work of the unit, candidates should be given the opportunity to complete the assessment at appropriate points, perhaps after each outcome so that the assessment is spread over the delivery of the unit. ASSESSMENT PROCEDURES The suggested Instrument of Assessment for this unit should be an assignment based on cognitive competencies required to identify from various case-studies the correct application of the relevant legislation. The recommended assessment for outcome 1 should relate to a specific type of vehicle and the assessment report should seek to highlight the technical standards applicable to that vehicle and the assessment report should seek to highlight the technical standards applicable to that vehicle. It is recommended that the assessment for outcome 2 centre around an application for an operator s licence and the procedure involved in registering and taxing a vehicle from new. The recommended assessment for outcome 3 involves 6

7 checking a range of driving licences for validity, age limits and vehicle categories. Driver s hours and records can be assessed by analysing used charts for compliance with the legislation.
