1 Scheme rules for thermal insulation products for building equipment and industrial installations - certification scheme April 6, Introduction This document presents the rules of the product certification scheme "-Mark" for thermal insulation products for building equipment and industrial installations, based on harmonised European product standards. NOTE 1 The attestation of conformity procedures for this quality mark provide product certification related to all the requirements of the standard and to all characteristics (properties) of the product as declared by the manufacturer, complementing the requirements for CE marking. Product audit testing is included. These scheme rules are largely based on the existing Keymark scheme for factory made thermal insulation products for buildings and on the scheme for thermal insulation products intended for industrial installations. NOTE 2 The Keymark scheme for building insulation products was established in 2001 for products according to the product standards EN through EN See the web site for further information NOTE 3 The -Mark has been applied for more than two decades and requires a high quality level for insulation materials for industrial installations in the European market. The quality assurance scheme was established by Verein Deutscher Ingenieure e.v. for thermal insulation products for industrial applications based upon the Guideline The scheme rules are maintained by the -AG "Quality Assurance" ("Gütesicherung") working group. The -AG "Quality Assurance" uses an acknowledged certification body on the basis of a contract for the execution of its resolutions and for organisational support. The -mark does not apply to insulation products used in heating and exhaust equipments in account of national regulations like EnEV (Energy saving regulation) in Germany. In case of certification of products where no European Standard exists, the rules given in appendix H apply. Insulation products carrying the -Mark must have a significantly positive energy balance: This means the reductions in energy used and emissions produced during the service life of an -certified insulation product by far exceed the energy required for and the emissions generated during its production and later disposal. To limit costs and time delay for manufacturers, the product certification scheme is based on the following principles: - Scope: Common technical specifications - Organisation of the body responsible for managing the scheme Quality Assurance Committee, see appendix G - Acceptance of conformity assessment bodies (inspection, testing and certification) - Application procedures - Conformity assessment procedures (inspection, testing and certification) - Fee-system - Website - Rules for handling complaints, disputes and appeals - Right to affix markings
2 - Transitional arrangements 2. Scope The scheme is applicable for products described in the package of product standards for thermal insulation products for building equipment and industrial installations as presented in table 1. These scheme rules specify the basis for the operation of the voluntary product certification scheme for thermal insulation products for building equipment and industrial installations. These scheme rules shall be read in conjunction with the cooperation agreement between CEN and. The technical content of the conformity assessment procedures shall be in accordance with the technical specifications specified in table 1 and with EN and EN ISO 13787, with the additions as defined in these scheme rules. Quality Assurance Committee The Quality Assurance Committee is responsible for the development of the scheme rules and their maintenance, although it is understood that changes of these rules need to be confirmed separately in the two organisations before being applicable. This joint working group shall endeavour to ensure that it is composed of the major actors, with representation from all parties concerned (manufacturers, contractors, users, laboratories, inspection bodies and certification bodies). The scheme shall be managed as specified in Appendix G. 6. Acceptance of conformity assessment bodies 6.1 General requirements The testing laboratories and the inspection and certification bodies shall fulfil the following minimum conditions: - Availability of personnel and of the necessary means and equipment; - Technical competence and professional integrity of personnel; - Impartiality, in carrying out the tests, preparing the reports, issuing the certificates and performing the inspection and surveillance provided for in the scheme rules, of staff and technical personnel in relation to all circles, groups or persons directly or indirectly concerned with the products; - Maintenance of professional secrecy by personnel; - Subscription of a civil liability insurance. 4
5 Representatives of all third parties involved in the scheme shall regularly participate in meetings of the joint working group. Participants shall participate on a regular basis in the coordination activities within the framework of these scheme rules. 6.2 Notification requirements Conformity assessment tasks performed within the framework of compliance with the Construction Products Directive (89/106/EEC - CPD), as amended, will be taken into account in the scheme rules. The product certification scheme for thermal insulation products for building equipment and industrial installations is preferably applied simultaneously with the CE marking to prevent duplication of conformity assessment tasks. Therefore, notification within the framework of the Construction Products Directive, for the relevant technical specifications (see 2) and for the relevant task (see 6.3) is a precondition (as far as required, i.e. only if and where attestation of conformity systems 1 or 3 apply) to becoming recognised in the scheme rules, i.e. for certification bodies and for testing laboratories. 6.3 Requirements for Certification bodies Certification bodies shall be accredited by an EA-member in accordance with EN They are responsible for ensuring sub-contractors competence (inspection body(-ies) 1 and laboratory(-ies)) for the purpose of undertaking inspection and surveillance or testing activities. Certification Bodies shall operate a well-established certification scheme of their own for the products for which they apply. They shall obtain the contractual permission to operate a product certification scheme leading to the authorisation to apply the -Mark. The Quality Assurance secretariat shall be informed of new applications for authorisation and shall have the opportunity to submit observations to the CEN Certification Board. 6.4 Requirements for Inspection bodies Inspection bodies shall comply with the following: - Demonstrated evidence of at least 2 years experience with inspection of manufacturers' facilities producing thermal insulation products for building equipment and industrial installations - Demonstrated competence to inspect and assess manufacturers' compliance with FPC provisions particular to these scheme rules in accordance with Appendix A. 6.5 Requirements for registered testing laboratories In these scheme rules, registered testing laboratories are those which have demonstrated that they are sufficiently competent to examine some or all of the following important performance characteristics (to be listed in the registration): - Thermal conductivity curve - Maximum service temperature - Chloride content 1 Testing laboratories, accredited to EN ISO/IEC are permitted to perform inspection activities as well, if they comply with
6 - water vapour transmission properties, if relevant Laboratories shall be registered for the temperature range for which they prove their testing capability for the thermal conductivity curve (flat and pipe testing) and the maximum service temperature (flat and pipe testing). Having met the registration requirements, the applicant laboratories shall be registered. The registration shall be published on the web site(s) as registered by the scheme web manager. The group of registered testing laboratories will form the European group of reference laboratories active in the scheme. Registered testing laboratories shall be accredited in accordance with EN ISO/IEC and shall comply with the requirements laid down in Appendices B and C. 6.6 Requirements for testing laboratories (other characteristics) Testing laboratories responsible for testing all characteristics except thermal conductivity, maximum service temperature and chloride content, shall be accredited in accordance with EN ISO/IEC or act as sub-contractors to certification bodies (see 6.3). Testing laboratories may perform all tests in the product certification scheme for thermal insulation products for building equipment and industrial installations if they meet the requirements of 6.5 and Application procedures 7.1 Certification bodies Applicant certification bodies shall submit the following information to the Quality Assurance Secretariat: - Name and address - Contact person and his/her coordinates (address, tel. and fax number, address) - Person responsible for quality management - Person responsible for signing the contract with the national standardisation body - The body s internal certification scheme rules, including those that deal with appeals, complaints and disputes, to demonstrate its compliance with the requirements of the scheme rules. - Evidence of its accreditation according to EN Valid accreditation certificate - Records of recent evaluation visits by the EA member (upon request) - Evidence of notification where demanded by the Construction Products Directive (89/106/EEC) (or national recognition for non EU bodies) (see 6.2) - Accreditation for testing and inspection activities and/or evidence of accreditation of subcontracting testing laboratories and inspection bodies - For testing laboratories, the certification body shall provide evidence in its application that they comply with EN ISO/IEC and 6.5 and/or 6.6 of these scheme rules. - For external inspection bodies, the certification body shall provide evidence in its application that they comply with 6.4 of these scheme rules. - Evidence of experience - Evidence of existing mutual acceptance agreements of conformity assessment procedures and results. 6
7 Proposals for the extension of the number of testing laboratories, inspection bodies or of the scope thereof shall be handled in the same way. 7.2 Inspection bodies No specific application needs to be made. Inspection bodies application is part of the certification body s application. 7.3 Registered testing laboratories Testing laboratories applying for registration shall submit the following information to the Laboratory Group: - Name company/laboratory - Person responsible for the tests: - Address (location of the laboratory): - Tel. and fax number - Mailing address for samples (if different from above): - Mailing address for mail (if different from above, e.g. P.O. Box): - Evidence of notification in the framework of the Construction Products Directive (89/106/EEC) (see 6.2) - Evidence of accreditation according to EN ISO/IEC Technical specifications that the accreditation covers - Experience (on a regular basis) with comparative testing - Details about the test equipment that the laboratory intends to use for the tests An audit visit will take place at every laboratory candidate for registration. Registration shall only take place once an audit visit and acceptable comparative testing results have been assessed by the Laboratory Group. In addition, the testing laboratories application to become part of the scheme is part of the certification body s application. 7.4 Testing laboratories (other characteristics) No specific application needs to be made. The testing laboratories application is part of the certification body s application. 7.5 Manufacturers/Distributors Eligible parties Both manufacturers (producers) and distributors may apply for using the product certification scheme for thermal insulation products for building equipment and industrial installations. The certification and/or inspection body involved must have access to the production facilities. Note: In the framework of these scheme rules, producer means: 7
8 - the manufacturer of the product, when he is established in the European Community, and any other person presenting himself as the manufacturer by affixing to the product his name, trade mark or other distinctive mark, or the person who reconditions the product; - the manufacturer's representative, when the manufacturer is not established in the European Community, or, if there is no representative established in the Community, the importer of the product; - other professionals in the supply chain, insofar as their activities may affect the performances of a product; distributor means: any professional in the supply chain whose activity does not affect the performances of a product Application Applicants shall submit the following information to the Certification body: - Applicant s name and address - Manufacturer s name and address (if the applicant is not the manufacturer) - Business location(-s) and address - Place(-s) of production concerned - Name of product(-s) concerned - Contact person and his/her coordinates (address, tel. and fax number, address) - Person responsible for quality management - Person (name and function) responsible for signing the contract with the certification body - Technical documentation comprising (at least): - Product type(-s), together with technical data about the product(-s) - Production facility(-ies), line(-s) or unit(-s) producing the product(-s) - The manufacturing method (in a general way) - Proposed declared performances - Technical reports, demonstrating compliance with the technical specifications - Technical data, derived from FPC, demonstrating compliance with the technical specifications - Information about the FPC system - Traceability system - If available, copy of the EN ISO 9001 certificate(-s) (or similar) - If available, evidence of testing already performed. This work may be taken into account - Proposed inspection body and/or testing laboratory (optional) 8. Certification scheme 8.1 Common acceptance of conformity assessment procedures and results Mutual recognition of conformity assessment procedures and results between actors in the scheme is of fundamental importance. 8.2 Relationship with the Construction Products Directive (89/106/EEC) Conformity assessment tasks performed in the framework of compliance with the Construction Products Directive (CPD, 89/106/EEC), as amended, will be taken into account, as far as they have been performed in accordance with these scheme rules. 8
9 The scheme rules will adopt all decisions with regard to conformity assessment with the technical specifications (see 2), taken by Sector Group 19 Thermal insulation of the Group of Notified Bodies under the CPD. 8.3 Attestation system General The attestation scheme is based on Product certification system 5 in accordance with ISO/IEC Guide 67 and consists of: - Tasks for the manufacturer: - Implementation and maintenance of a factory production control system - Testing of samples taken at the factory by the manufacturer in accordance with a prescribed test plan. - Tasks under responsibility of the certification body: - Sample taking of products, representative for the product to be placed on the market - Initial type testing (ITT) - Initial inspection of factory and of FPC - Continuous surveillance, assessment and approval of factory production control - Audit-testing of samples taken at the factory These tasks are performed in accordance with the relevant product specification (see 2) and EN and EN ISO Additional requirements are specified in annexes to the scheme rules. When all requirements have been met by the manufacturer, the Certification body issues a certificate of conformity of the product. Note: Continuous surveillance, assessment and approval of factory production control and audit-testing of samples taken at the factory are conformity assessment activities performed once the certificate has been issued Initial type testing (ITT) Minimum requirements for ITT are specified in Appendix D Factory Production Control (FPC) Minimum requirements for FPC are specified in Appendix A Inspection and surveillance of the factory and factory production control A checklist for FPC inspections is given in Appendix A Audit testing Audit testing requirements have been specified in the relevant product standard (see 2) and in EN
10 8.4 Certificates Each individual product covered by the certification contract shall have its own unique identifier in the form of the manufacturer s commercial product name and/or code that appears on the product at the point of sale, and can only be assigned to a single certificate. More than one individual product may be covered by an individual certificate, but an individual certificate shall not cover products that comply with different technical specifications as presented in 2. An individual certificate may cover products from different production units, lines and plants. 9. Fees The scheme rules foresee a fee system to cover license fees and the operating cost of the secretariat(-s) involved. The fee system is specified in Appendix E. Costs covering testing, inspection and assessment between manufacturer and third parties are not governed by the scheme rules, but are negotiated by the contracting parties. 10. Website The -Mark website is the place where up to date information is found including product data of certified products. It allows a paper free system to an advanced extent. Papers that will remain, such as print outs of certificates, will refer to the web site as the only up to date information. As the web site only includes official information it is open for reading to all without any password. The official information on the web site(s) as registered by the scheme web manager includes: - The scheme rules - Information on manufacturers and products as found on the product labels, but no information on grouping of products for FPC or audit testing, inspection records and test results. - Lists of names and addresses for empowered bodies and registered testing laboratories can be found on the web site, but information on the relationship between empowered bodies and test results from comparative testing among laboratories shall not be published. The layout of the web site and updating of pure text (e.g. scheme rules, announcements) and the list of empowered bodies and testing laboratories is the responsibility of the -Mark scheme web master. Each certification body is responsible for continuous updating of its own part of the database. 11. Rules for handling complaints, disputes and appeals 11.1 General All complaints regarding the -Mark scheme, shall be dealt with in accordance with these specific scheme rules, and in accordance with the principles laid down in EN
11 11.2 Complaints about certified products Complaints about certified products may be lodged with the manufacturer or with the certification body concerned, or with the Quality Assurance Secretariat. In the latter case a copy of the complaint is also sent to the relevant certification body. The manufacturer of certified products shall: keep a record of all complaints relating to a product s compliance with requirements of the relevant European standard and the manufacturer's performance declaration and make these records available to the empowered organisation when requested; take appropriate action in respect of such complaints and any deficiencies found in products or services that affect compliance with the requirements for certification; document the actions taken. The certification body shall ensure that the manufacturer investigates complaints as soon as possible and, where appropriate, advice the complainant of the outcome. If the investigations of the certification body reveal non-compliance with the requirements of the relevant European standard or these scheme rules, the action arising from the investigation of this complaint is notified by the certification body in a registered letter to the manufacturer Complaints about certification bodies Complaints regarding the actions of a certification body may be lodged with the certification body concerned, or with the Quality Assurance Secretariat. In the latter case a copy of the complaint is also sent to the relevant certification body. The certification body shall deal with the complaint using its own complaints procedure, in accordance with the principles laid down in EN The Quality Assurance Secretariat shall be informed of the complaint and of the outcome and react if needed Disputes about test results Disputes regarding test results should be addressed to the certification body responsible for the placing of the test work with the laboratory involved. The certification body shall deal directly with the test laboratory involved using the complaints procedure of the certification body, in accordance with the principles laid down in EN In the event that a challenge of test results cannot be resolved, e.g. by comparative testing in the presence of the two disputing parties, the arbitration procedure (11.5) shall be followed. 11
12 11.5 Test result arbitration procedure. The certification body shall take samples as required preferably from the original production in question. Test specimens from the sample shall be tested for the property in dispute at an agreed 2 nd registered laboratory in the presence of both the manufacturer and the certification body. The number of test specimens tested shall be agreed between parties (e.g. large enough to enable a statistical comparison with the original results). A comparison shall be made between the test results obtained by the initial registered laboratory and the results obtained by the 2 nd registered laboratory to detect variations or to confirm similarity (if statistics are used the population shall be the same at a confidence level relevant for the test). If the second results are seen to be from the same population, the original results will be upheld, even where the result changes the pass/fail assessment. In the event that the results obtained by the 2 nd registered laboratory cannot be confirmed as from the same population as the original results, the results obtained by the 2 nd registered laboratory in the presence of both the manufacturer and the certification body shall be used. Both the manufacturer and the certification body shall have access to the test results from the 2 nd laboratory and details of the test procedures used, to enable both parties to investigate any possible nonconformity within their respective systems, and take the appropriate corrective actions Appeals Appeal to a certification body The manufacturer may lodge an appeal with the certification body to whom he addressed an application for the right to use the -Mark. The certification body for that purpose maintains its own appeal procedure, in accordance with the principles laid down in EN The appeal does not suspend the decision against which it is made. Appeals can only be related to the certification process carried out by, or under the responsibility of the certification body. An appeal should be lodged, by registered letter, with the certification body within one month of the formal notification of the contested decision. The certification body shall formally give its answer within one month of receipt of the appeal Appeal to the Quality Assurance Secretariat Manufacturers may lodge an appeal directly with the Quality Assurance Secretariat in the following cases: when an appeal is rejected or in case of lack of response by the certification body; If the appeal is in respect of the interpretation of the principles contained in this document. 12
13 The appeal procedure does not suspend the decision against which it is made. It shall be notified to the Quality Assurance Secretariat by registered letter, within one month of the formal notification of the contested decision. In the event of an appeal being addressed by the manufacturer to the Quality Assurance Secretariat, the secretariat prepares a decision within one month of receipt. The decision is formally notified to the manufacturer and to the certification body by the secretary. The Quality Assurance Secretariat may ask for possible expert assistance/advice by it's choice depending on the actual case 12. Labelling The labelling of products certified in accordance with these scheme rules may consist of the following marks if requested: - The CE Marking in accordance with the previsions of the Construction Products Directive (89/106/CEE), complemented by EC Guidance paper D, and with the harmonised product standard (see 2); - The -Mark, the design of which is shown in Annex 1. The -Mark includes an identification code referring to the Certification Body. The labelling combining the CE Marking with the -Mark shall be located as specified in the harmonised product standard (see principle of example in Annex 1). NOTE In addition the -Mark may be licensed for use in conjunction with a mark granted by an empowered/authorised certification body, demonstrating conformity with the European standard. 13. Right to affix the -Mark After decision of the Management Group the Quality Assurance Secretariat will inform about the authorisation of a certification body for the right to use the -Mark, can conclude a contract with this certification body pursuant to a license agreement. Formal application for the granting of a licence to use the -Mark is made through signing a contract between the manufacturer and the chosen certification body which sets their relationship, with respect to the implementation of the system for the product(s) concerned. Only those applicants having obtained a licence to affix the -Mark by means of the procedures laid down in these scheme rules shall be entitled to use the -Mark. 14 Transitional arrangements The transitional arrangements are presented in Appendix F.
