1 Regulations regarding the organization, development and financing of research activities Chapter1. Organization and Content Art. 1. The present regulations have been established according to the previsions of Law no 84/1995 of Education, Law no 128/1997 regarding the Status of the teaching staff, Law no 319/2003 regarding the Status of the research and development staff and of the Law no 324/2003 regarding scientific research and technologic development. Art. 2. The Bucharest University (from now on referred to as BU) is a part of the National research and development system as an accredited higher education institution. The scientific research activity is a major component of the educational processes of BU. Art. 3. (1). The scientific research, technologic development, design, consultancy, expertise and other scientific services from BU take place in research centers, separate structures of research and development created within departments, faculties or BU levels, with the approval of the Senate. (2). The scientific research activity can be accomplished in cooperation with other research centers from within the BU, with other teaching and research institutes from the country or abroad, within the framework of research networks or associations which could aid BU achieve research excellence. (3). The scientific research activity is organized and developed on the basis of research/ services contracts of national or international funding, included in the research themes of the chair/ department / faculty/ BU. Art. 4. (1). The Research centers are created and function at the departments, faculties or BU level, at the initiative of teaching staff/ researchers of BU that have preoccupations and a relevant scientific experience. (2). The establishing of the Research centers is advised by the Faculty Council and approved by the Senate Executive Board. (3). The research centers institutionally acknowledged can be accredited by the Ministry of Education and Research (referred to from this point as M.E.R), through the National Council For Higher Education Research (referred to from this point as NCHER). Following the NCHER evaluation, they are given competency levels A-E. (4). The research center is managed by a Board of Management formed by a director and other 2 to 4 members, from whom one is appointed scientific secretary. The Board of Management will draw up the Center Status. (5). The Board of Management of the research Center is appointed within the General Assembly of the Research Center Members. (6). The main object of activity of the research centers is fundamental and applicative research, advanced technologic research, consultancy activities, expertise and services. 1
2 Art. 5. (1) Research sraff, associated research personnel, including candidates for the doctor s degree and master s students, as well as other categories of personnel can behave on distinct functions within the research centers, according to Law no 319/2003 regarding the Status of the research-development staff and Law 324/2003 regarding scientific research and technologic development. (2) The functions and degrees of scientific researcher within the BU can be attained according to Law no 319/2003 and to the BU Regulations regarding the taking of teaching and researching positions. (3) Members of one research center cannot be simultaneously part of other research centers. Art. 6. (1) Financing of the research activity can be based on contracts, signed as the result of a project competition, with national or international financers, separate from the financing of the teaching process. (2) Financing the research activity can also be based on contracts signed directly with the beneficiaries of the specific research, from other financing sources than project competitions. Art. 7. (1) The activity research strategy at the BU level is drawn up annually by the Scientific Board of BU, according to the National and International development strategy for the Scientific research, technologic development and innovation domain. (2) The Scientific Board of BU will draw up the Research activity strategy at the BU level through the integration of annual institutional research centers programms and will seek for the BU Senate approval Art. 8. (1) The acknowledged results of the scientific research activity are established through: a) the number and value of the won research grants in the national and international competitions and the research contracts; b) final reports and precise of the scientific activity presented on the web page of the Research Center, filed to the research s beneficiaries and to the archive of the Research and Technologic Transfer Department; c) systems, models, products with the title of intellectual property, program products, solutions for the modernization and increase of the economic efficiency etc. together with the proper documentation, filed to the research beneficiaries and to the archive of the Research and Technologic Transfer Department; d) books, treaties and monographs with novel scientific content published in national and international acknowledged printing houses and filed to the BU libraries and to the archive of the Research and Technologic Transfer Department; e) national and international scientific communications, published in the conferences volumes; f) published articles in specialized magazines from the country and abroad, nationally acknowledged by N.C.H.E.R or internationally (ISI quoted magazines); g) finalized doctoral thesis; 2
3 h) representations in academies or international organizations; i) nationally and internationally received awards. (2) The results of the research issued from the financing contracts of the scientific research signed with M.E.R., belong to the executants. In case of research contracts signed with other beneficiaries, the right of the research results is determined by the contract. (3) For the patents of the inventions, the right of intellectual property belongs to the Bu and the team of researchers who carried out the research activity and is established by contract. Art. 9. Scientific seminaries, sessions, conferences and other scientific manifestations can be organized by BU, the faculties, departments and chairs, to share the results, of the gathered experience in the research activity, for the future publication and insurance of other forms of disseminating information. Art. 10. The scientific research of BU benefits from free service of the entire network of information and documentation of the BU libraries. Art. 11. BU can support, with the approval of the Senate Bureau and within the limits of their revenues, the financing of some research themes prior to the development of BU, as well as the appearance of specialized magazines having the purpose of disseminating the results of the scientific research. Art. 12. Sessions of scientific communications of the projects directors can be organized annually, with the purpose of presenting the research results activity in development in the research contracts. Their organization will be appointed to the deputy deans and deputy principal of that scientific activity. Art. 13. (1) the students research activity takes places in different ways, of which: - scientific research independently made, with the guidance of the teaching staff and which is finalized under the form of case studies, projects, dissertation papers etc. - the training and participation of the students to the achievement of some projects of scientific research. - organizing scientific meetings for students under the faculties aegis. (2). Annually there can be organized at the faculties and BU levels sessions of scientific communications of the students and professional competitions. Their organization is appointed to the department heads, the scientific secretaries from the faculty/ deputy principal of the scientific research activity. (3). BU can organize or participate at local and national phases of student scientific manifestations and professional competitions, in collaboration with other institutions. Chapter. II. Legislative bodies and attributions. 3
4 Art. 14. (1). The scientific research activity of BU is coordinated by a Scientific Council, subordinated to the BU Senate. (2). The Scientific Council is formed by the representatives of the BU faculties, appointed by the Teaching Council of the Faculties, containing in its structure the deputy principal and the director of the Research and Technologic Transfer Department. (3). The Scientific Council is run by a president, three vice-presidents and a secretary. (4). DC&TT has specific attributions designated by the Senate. Art. 15. (1) The Research and Technologic Transfer Department referred to from this point as DC&TT is established at the decision of the Principal and has his own organization structure. (2). The Research and Technologic Transfer Department is run by a director. (3). It can employ persons with scientific research activity administration attributions. (4). DC&TT has specific attributions designated by its Status. Chapter. III. Awards and incentives Art. 16. The scientific research activity is highlighted in the academic evaluation reports for the appointment of the teaching and research functions, and constitutes a main appreciation criterion of the scientific value of the teaching and research staff hired by the BU. Art. 17. The research staff that is part in the realization of the research contracts can be awarded with wages incentives if they are employed in a research center/ DC&TT. Art. 18. The research staff is payed according to the present legislation, from the sources specified and approved in the research contracts from which personnel list they belong to. That can also benefit from the research liquid assets included and approved by the estimate of the research contracts according to the specific terms. Art. 19. For the payment of the personnel who executed the contract the following equalization of teaching and researching positions can be used: Art. 20. The members of the managing research board can receive managing indemnities, from funds of the Research Center, according to the legal provisions of the operative norms.. Art. 21. The participation to the scientific manifestations from the country or abroad is financed from the revenues obtained through the research contracts and they are acknowledged by the Project Director, the Director of the Research Center and the Director of DC&TT. 4
5 Art. 22. The recognition of the scientific research is also being done through the awarding of prizes designated by the Scientific Council of BU and approved by the University Senate. Chapter. IV. Administrative norms Art. 23. The financing of the scientific research of BU is the beneficiary of the joint mechanism, created for this purpose by the operative regulations, which stipulate financing based on research contracts with national/ international financing and distinct financing based on contracts with different beneficiaries. Art. 24. (1) The internal BU revenues (management institution) that are made from the completion of scientific research contracts / services are highlighted distinctly in the accountancy of the University and their total is decided by the University Senate. (2) The internal revenues stipulated at paragraph (1) will be used with the purpose of assuring the necessary conditions for the functioning of research laboratories by paying the utilities (water, heat, electricity) as well as for the salary of the personnel who took part in the administration of the research contracts. (3) From the internal revenues stipulated at paragraph (1) the following spending categories can also be financed: the accreditation of invention patents, awarding the research activity and others. (4) The incomes made and unutilized by the end of the year are forwarded to the same destination the following year. Art. 25. The costs of the research centers acknowledged by BU are fully financed from internal incomes based on research contracts/ services/ consultancy/expertise etc. Art. 26. For each research contract the project director has to make an income and spending budget which is subject to accountable appraisal by the beneficiaries and the DC&TT. Art. 27. The following obligations are assumed by BU through the DC&TT, for the scientific research based on research contracts: a) They offer the environment for research evidence; b) They control the way in which the funds are utilized, according to the legal provisions and assumed obligations. c) They inform, if requested, the beneficiaries on the development of the research contract. d) At the proposal of the Research center, they validate the appointment of a new project director, if the one initially appointed cannot coordinate the project anymore. e) They return to the financer the received sums if a research contract cannot be fulfilled Art. 28. (1) Any research contract is a distinct object in the evidence of the accountancy. 5
6 (2) The incomes and spending of each research contract are registered in separate accounts opened for the evidence of the research activity. These accounts control in what measure the costs are within the made incomes. The level of the spending must be smaller or at least equal with the incomes. If they exceed them, BU can give an advance of maximum 30% from the value of the stage in development, advance which is guaranteed through the value of the contract. (3). The BU will only give the advance following a written request, based on the report of the project director. (4). Handling different sums of spending awarded under the form of an advance is effectuated only on the written request, based on a report of the contract director, having as aims paying the bills of the products suppliers,or paying the salaries for the research activity, or giving sums in advance in the view of attending conferences and symposiums. (5) The materialization of the costs ( acquired by endowment, consumpitble, articles, services, payment of salaries) is executed by the BU specific departments (6) All the funds in money received for the financing of the research contracts are kept in distinct accounts at the bank, utilized in an auto financing regime. (7) In the costs paragraphs of the research projects sums for the management (institution management and section management) are established, in a percentage designated by the BU Senate. Art. 29. The disregard of the legal provisions related to the way of spending the funds destined to the research activity can have as consequences, penal responsibility, civil, material or administrative of the BU as an institution, and/or of the project director. CHAPTER V. FI AL DISPOSITIO S Art. 30. The approval of the present Regulation regarding the organization, development and financing of the research activity has been made in the meeting of the Senate Bureau of the Bucharest University from February 23 rd and will be carried out after 15 days from this date. 6
