8 Integration in Global Treaties 1. UNCLOS Art 237 (2) Specific obligations assumed by States under special conventions, with respect to the protection and preservation of the marine environment, should be carried out in a manner consistent with the general principles and objectives of this Convention. 2. UNCLOS Article 311 Relation to other conventions and international agreements (1) This Convention shall not alter the rights and obligations of States Parties which arise from other agreements compatible with this Convention and which do not affect the enjoyment by other States Parties of their rights or the performance of their obligations under this Convention. 3. CBD Article 22. Relationship with Other International Conventions 1. The provisions of this Convention shall not affect the rights and obligations of any Contracting Party deriving from any existing international agreement, except where the exercise of those rights and obligations would cause a serious damage or threat to biological diversity. 2. Contracting Parties shall implement this Convention with respect to the marine environment consistently with the rights and obligations of States under the law of the sea.

12 Integrated Decision Making in Regional Agreements Convention on the Protection of the Marine Environment of the Baltic Sea, 1992, 2099 U.N.T.S 195, Article 3 (1) The Contracting Parties shall individually or jointly take all appropriate legislative, administrative or other relevant measures to prevent and eliminate pollution in order to promote the ecological restoration of the Baltic Sea Area and the preservation of its ecological balance. Article 15 expressly refers to the adoption of measures to preserve biodiversity and ecological processes.
13 Integrated Approach in Regional Agreements II Adoption of an integrated approach Cooperation between OSPAR and the North-east Atlantic Fisheries Commission and between OSPAR and EU
14 Memorandum of Understanding between the North East Atlantic Fisheries Commission (NEAFC) and the OSPAR Commission Agreement where [OSPAR] considers that action is desirable in relation to a question relating to the management of fisheries, shall draw that question to the attention of the authority or international body competent for that question. Where action within the competence of the OSPAR Commission is desirable to complement or support action by those authorities or bodies, the Commission shall endeavour to cooperate with them;

The transboundary effects of management decisions on neighbouring ecosystems should be considered by those managing the ecosystem The approach must be applied at the appropriate spatial and temporal scales. Ecosystems should be managed in an economic context i.e. taking account of externalities either that impact on the ecosystem or that are created by its management and incentives should be created to promote its conservation An appropriate balance between conservation and use of biodiversity should be struck

Long-term objectives should be set to take account of the variability of ecosystems across time. Management must recognize that change is inevitable.

It is for each society to choose its conservation and management objectives Management of ecosystems should be decentralised and take place at the lowest appropriate level All forms of information and knowledge should be drawn upon in decision making including scientific, indigenous and local knowledge The ecosystem approach should involve all relevant sectors of society and scientific disciplines.
23 Involving Society Global Level Article 23(5) of the Biodiversity Convention any governmental or non-governmental body can apply for observer status provided that they be qualified in fields relating to conservation and sustainable use of biological diversity. Article XI of CITES any governmental or non-governmental body can apply for observer status provided that they be qualified in protection, conservation or management of wild fauna and flora. IWC non-party States and intergovernmental organisations may become observers and that [a]ny non-governmental organisation which expresses an interest in matters covered by the Convention, may be accredited as an observer. IWC Rules of Procedure and Financial Regulations as amended by the Commission at the 64th Annual Meeting, July 2012, Rule C(1)(b).

26 Conclusions There is growing evidence of acceptance of the ecosystem approach In particular there is evidence of a move away from sectoral to integrated approaches There are still some problems: Few regimes apply all elements of the ecosystem approach or any elements (fully) Engagement by and with stakeholders is variable Cooperation across regimes is variable Application takes place within a system still focussed on use rather than conservation and use
27 Key areas for research What is the nature of interaction between these different organisations and legal regimes? Who sets priorities for actions? Or decides on key principles? To what extent have decisions on use changed to take account of the need for conservation? How does/should law take account of the need to preserve ecosystem functions, or of the natural change in ecosystems across time?
