2 The policies contained in this manual apply to all employees, while they are present in any building, facility or grounds owned, occupied or managed by NYFL irrespective of their employment relationship with NYFL, inclusive of employees, contractors, employees of contractors, volunteers, work experience students or other persons. The content of this Policy Manual has been aligned with key elements from: AS/NZS 4801 OHSAS Work Health and Safety Act 2011 Work Health and Safety Regulations 2011 Occupational Health & Safety Act 1984 Occupational Health & Safety Regulations 1996 EPA Victoria ECO footprint Managing Impact on the Environment EPA Victoria Sustainable Business and Industry Work Safe Victoria Sample Environmental Policy References Work Health & Safety Act 2011 Work Health & Safety Regulations 2011 EPA Victoria ECO footprint Managing Impact on the Environment EPA Victoria Sustainable Business and Industry WorkSafe Victoria Sample Environmental Policy Introduction Ngarluma and Yindjibarndi Foundation Limited are committed to conducting its business in an environmentally aware and responsible manner. We seek the co-operation of our staff and business partners in ensuring our organisational practices are conducted with minimal environmental impact. Objective NYFL Management to work with employees, contractors, visitors and business partners to achieve compatibility between economic development and the maintenance of the environment to minimise harm. Policy NYFL shall endeavour to minimise impact on the following: Atmospheric emissions Site contamination and spills Noise and light emissions Damage to flora and fauna Protection of Ngarluma & Yindjibarndi culture and sacred sites Storm water management Unnecessary water and energy consumption To fulfil this commitment, NYFL Management, employees and contractors, will observe all environment laws and promote environmental awareness among all to increase understanding of environmental matters. NYFL will seek to: Assess Eco-footprint to identify environmental impacts and move towards more sustainable practices Identify waste streams and options for effective waste management Improve purchasing (buy recycled materials, reduce waste, use less harmful/volatile chemicals) Improve storage (reduce quantity, waste and spills, reduce odours by keeping containers closed) Conserve energy (eco-friendly lights, turn lights off, emergency efficient equipment, greener fuel sources such as LPG and methane) Conserve water (install water saving accessories, repair leaks)
3 Preserve waterways (clearly mark and protect storm water drains) Emergency planning and spill response Seek appropriate licenses/permits from State Environmental Protection Agencies and other relevant Authorities Improve education/awareness Notify relevant authority in the event of a major environmental impact Promote awareness of the Ngarluma and Yindjibarndi cultures Ngarluma Yindjibarndi Foundation Limited (NYFL) recognises its moral and legal responsibility to provide a safe and healthy work environment for employees, contractors and employees of contractors, clients and visitors. This commitment extends to ensuring that operations do not place the local community at risk of injury, illness or property damage. Policy Statement - Commitment We at NYFL Group commit to managing risks to prevent incidents, we understand our requirements for compliance with relevant legislation and aim to achieve Zero harm Workplaces. Everyone within and associated with the NYFL Group will be provided with transparent, easy to navigate systems. Ensuring that NYFL complies with the sharing of information through our consultation, procedures and policies and having strong communication s with all of NYFLs stakeholders. NYFL commit to providing a safe and healthy workplace for employees, temporary staff, contractors, clients and visitors to NYFLs workplace. NYFLs key performance indicator (KPI) is the uninterrupted health and safety of employees, contractors and employees of contractors, clients and visitors. We at NYFL have committed to this policy and its implementation in ensuring a healthy and safe work environment. Policy Statement - Responsibilities of the NYFL Board Duty of Care to make sure everything reasonably practicable is done to ensure the health, safety and welfare of NYFL in consultation with the NYFL CEO Ensuring compliance with Commonwealth WHS Act and Western Australian Occupational Health & Safety as far as reasonably practicable Reviewing and monitoring Work Health & Safety audit reports, very high risks and major incidents within the NYFL Group Reviewing key strategy business plans, ensuring that health & safety is incorporated in planning consideration Reviewing CEO recommendations and providing direction to implement necessary measures to provide a safer working environment for all Providing sufficient resources for the maintenance of best practices for workplace health & safety within the NYFL Group Responsible for the endorsement of NYFLs health & safety standards, policies, and guidelines Policy Statement - Responsibilities of the NYFL CEO Duty of Care to make sure everything reasonably practicable is done to ensure the health, safety and welfare of NYFL Ensuring compliance with Commonwealth WHS Act and Western Australian Occupational Health & Safety as far as reasonably practicable
4 Commit to health and safety by being a visible leader in the workplace, guiding NFYL Group forward by embodying a strong WHS culture Ensure that health and safety is included in any part of day to day business, business planning and where appropriate board meetings. Responsible for the endorsement of NYFLs safety standards, policies, and guidelines Understanding all facets and operations within the NYFL Group and the hazards and risks involved Overseeing the overall management, investigations and monitoring of any High Risks and Incidents occurring within the NYFL Group Consultation with the WH&S Officer and NYFL workforce to improve decision-making on WHS and environmental matters Consult with and guide the NYFL Board on any Work Health and Safety matters, Major Incidents and Very High Risks Ensuring that information is provided along with training and supervision to staff, contractors, clients and visitors to ensure safety Ensure the appropriate resources and processes are provided to enable best practice WHS with and around the NYFL Group Policy Statement Responsibilities of Senior Management Duty of Care to take measurable step to doing everything reasonably practicable to ensure the health, safety and welfare of its employees while they are at work Ensuring compliance with Commonwealth WHS Act and Western Australian Occupational Health & Safety as far as reasonably practicable Ensuring internal compliance by following NYFLs policies, procedures and guidelines Keeping up-to-date with Work Health & Safety (WHS) matters Understanding the nature of the operations and the hazards and risks involved within the NYFL Group. Identifying any hazards, risks and incidents that occur in the workplace that may be a risk to health and safety and eliminating or controlling those hazards, actioning these appropriately to comply with NYFLs procedures and guidelines Reporting any High Risks and Major Incidents occurring within NYFL Group, then handing over to the WHS Officer to investigate further Consultation with the WH&S Officer and NYFLs workforce to improve decision-making on WHS and environmental matters and setting Measurable targets to ensure continued improvement Provide information, training and supervision to staff, contractors, clients and visitors to ensure safety Policy Statement Responsibilities of Work Health & Safety Officer Duty of Care to take measurable step to doing everything reasonably practicable to ensure the health, safety and welfare of NYFL Group s employees while they are at work
5 Ensuring Compliance with Commonwealth WHS Act and Western Australian Occupational Health & Safety as far as reasonably practicable. Integrating WHS into all aspects of NYFLs operations, creating & embodying a safe work culture To eliminate risks to health and safety and if it is not reasonably practicable to minimise those risks so far as is reasonably practicable Reviewing any risks or incidents within the NYFL Group, Devising an action plan aiming to eliminate the risk so far as reasonably practicable, if required conducting an investigation Identifying any hazards in the workplace that may be a risk to health and safety and eliminating or controlling those hazards Conducting workplace inspections, assessing risks and hazards and taking appropriate measures to control or eliminate Consultation with employees and other parties to improve decision-making on WHS and environmental matters Development, implementation and review of written safe work procedures & policies Distribution and communication of safety information and safe work procedures & policies Provide Information, training and supervision to staff, contractors, clients and visitors to ensure safety Support and assist employees in effective injury management and rehabilitation Review and assessment of WHS policies and procedures Policy Statement Responsibilities of the Employees Duty of care to take reasonable care for the health and safety of themselves and others at work Co-operate with NYFL management to enable compliance with WHS legal obligations Participate in consultative arrangements Assist management to meet WHS targets/key performance indicators Participate in return to work programs Comply with all reasonable instructions from NFYL Management in relation to health and safety issues at work Ensure that the NYFL employee is deemed to be competent to use any of NYFLs equipment safely and that the equipment is used in a correct manner Reporting or rectifying any unsafe conditions, Incidents and near misses that comes to the employee s attention. Policy Statement Responsibilities of the Subcontractors Duty of care to take reasonable care for the health and safety of themselves and others at work Co-operate with NYFL management to enable compliance with WHS legal obligations Participate in consultative arrangements Assist management to meet WHS targets/key performance indicators Comply with all reasonable instructions from NYFL Management in relation to health and safety issues at work
6 Ensure that the NYFL employee is deemed to be competent to use any of NYFLs equipment safely and that the equipment is used in a correct manner Reporting or rectifying any unsafe conditions, Incidents and near misses that comes to the subcontractor s attention. Policy Statement Joint Ventures and Subsidiary Companies Each joint venture and subsidiary company is a commercial entity in its own right, and is required to develop and maintain their own policies and procedures framework that is applicable to its specific circumstances. However, where there is no existing framework; such as on start-up or entity size is too small to support the development and use of their own framework, the relevant entity/ies are to use the NYFL Policies and Procedures Framework. Policy Statement Adherence to WA Legislation and Regulations Requirement s NYFLs policies, procedures, plans, guidelines and templates will be maintained and used in accordance to the Occupational Health & Safety Act 1984, Occupational Health & Safety Regulations 1996 and the WHS Act and Regulations Policy Statement Training At NFYL we commit to train our workers on anything that poses a risk to the health and safety of those engaged with NYFL. We will engage our people at every level, and will encourage a top-down safety culture to demonstrate and reinforce our commitment to the health and safety of our workers. The identification of WHS training courses required will be compiled by the WHS Officer in consultation with HR & the WHS Committee. This will be presented to the board by the CEO to assess the current training courses to be delivered. Training records shall be maintained as evidence of training delivery and assessment of competence. Records for generic and risk-specific WHS training will be maintained electronically and hard copies will be stored in employee s files in the HR Office Policy Statement Consultation At NYFL we consider NFYL s workers before making a decision on any health and safety issues. At NYFL we commit to maintaining a NYFL Group Health and Safety Committee which holds regular meetings with representatives from NYFL and also each of the NYFL Group s Entities. NYFL management shall also undertake formal consultation, cooperation and other coordination methods with employees and other duty holders, such as contractors (and employees of contractors) to ensure that all are aware of health and safety matters relevant to each person and any issues are resolved. NYFL management recognises the benefits that regular and effective communication/consultation can produce and is committed to fulfilling this duty. Policy Statement Co-operation NYFL recognises its moral and legal responsibilities under WHS legislation for NYFL employees to comply with their duty which requires them to co-operate in the interests of safety and health and to follow directions given by the NYFL Group. Just as the employees are required to co-operate, NYFL management are also required to co-operate in the interests of safety and health as far as reasonably practicable. Policy Statement Co-ordination NYFL Management shall undertake the provision to co-ordinate methods to enable NYFLs workforce to work together with NYFL employees and other duty holders, such as contractors (and employees of contractors) effectively by utilising consultation methods.
7 Policy Statement Compliance and evaluation NYFL is committed to the development and implementation of a WHS Management System and understands the importance of evaluating the WHS Management system to ensure it is effective. NYFL shall undertake annual audits to identify any areas for improvement and embrace any legal obligations that may arise from inspections undertaken by Regulatory bodies. NYFL commits to analysing the results of all audits/inspections and taking corrective actions to rectify any issues. These results will also be communicated to NYFLs employees and relevant parties. Policy Statement Contractor, Subcontractor and Visitors Management NYFL is committed to ensuring all contractors, sub-contractors and employees of contractors and visitors, who are engaged to perform work on NYFL premises or other nominated locations, are required to comply with relevant Legislation, Standards, Codes of Practice, NYFLs health and safety policies, procedures and programs. NYFL also require the contractor to maintain current public liability and employee's compensation insurance. It is a requirement for the contractor to co-operate and consult with NYFL management to enable compliance with WHS legal obligations. Evan Maloney Chief Executive Officer Jan 2015
