3 Welcome We are a leading provider of skills training and assessment for the legal profession in England and Wales. Our founders, John Loosemore and Rob Parsons, started out back in 1979 as Lawyers Planning Services. They had identified a gap in the market for management and skills training for lawyers; and this has remained our focus ever since. After changing the name to Altior in 2008 we became part of Kaplan; and together with Kaplan Law School and Kaplan QLTS we make up Kaplan s legal education offering in the UK. Based in Cardiff, we offer our programmes nationally and count over 20 of the Top 100 firms among our valued clients. John and Rob put excellent customer service at the heart of what they did and although the business now looks quite different to the one they set up back in 1979, our personal approach stays the same. 6 Route to Qualification Your Journey Starts Here PSC Professional Skills Course days compulsory training. Must be completed during the 2 years of the training contract. 3 Core Modules: Client Care & Professional Standards, Financial & Business Skills (includes exam) and Advocacy & Communication Skills. Plus 24 hours of Electives, 12 of which need to be face-to-face. With Kaplan Altior, you can choose from a selection of locations and a wide variety of quality and relevant elective courses. Training Contract 2 years with a solicitor or law firm. Or a period of recognised training. TLP Trainee Litigation Programme Our Trainee Litigation Programme is open to all trainees and is designed to expose them to contentious practice skills, ideal for those working in a non-contentious environment. The comprehensive programme builds on the foundation of litigation knowledge gained on the LPC and the Advocacy and Communication skills. Higher Rights of Audience (HRA) This qualification allows you to conduct advocacy in the higher courts. HRA can also be completed as an alternative to electives as part of the PSC. Qualified Solicitor! Management Course Stage 1 & Stage 2 Stage 1 is compulsory in the first 3 full CPD years of being qualified providing insight into management skills. Stage 2 is an optional top-up but compulsory if you eventually want to run your own practice. These courses also count towards CPD hours. Continuing Professional Development (CPD) Although the rules are changing in 2016, qualified solicitors must complete 16 hours of training per year. 7 Professional Skills Course Professional Skills Course We were the first provider to be accredited by the Law Society to provide the Professional Skills Course in Since then, we have helped thousands of trainees to qualify into the profession. Our programme moves away from a traditional lecture-style approach to training and we focus instead on the course being practical, inclusive and relevant to the trainee. I learnt so many valuable lessons from my course, I was positively encouraged and given constant feedback, which made me feel comfortable and eager to improve. 8 The Solicitors Regulation Authority prescribes three core modules for the course: Client Care and Professional Standards (2 days). Advocacy and Communication Skills (3 days). Financial & Business Skills (3 days including examination). You can pick and mix these across dates and venues throughout your training contract, or they can be studied in a block so that they are completed over 8 days. You will also need to complete 24 hours of electives*. 12 hours have to be attended face-to-face, but the rest can be completed as distance learning work before the course. Most of our electives are one day (6 hour) courses, and have corresponding 6 hour distance learning components. This way, 24 hours of electives don t sound so daunting and are much more achievable. 9 Kaplan Altior additional features Professional Skills Course Higher Rights of Audience If when you qualify advocacy or litigation will be central to your role, then completing the Higher Rights of Audience training to fulfil the elective requirement could be an attractive option for you. You can complete the training (and take the assessments if you wish) during your training contract and once you are admitted to the Roll, you may obtain the qualification. City/commercial core modules We recognise the importance of delivering the core modules in the context of a trainee s working environment. So we offer specially designed public City/ commercial core modules. These use case studies which are set in the context of the work and everyday practice of a typical major commercial firm. We also explore the wider client skills expected of practitioners at major firms and cover subjects including business development, knowing your client and commercial awareness, how to generate solutions to client problems and understanding and managing client expectations. FBS online preparation module To help you prepare for the FBS exam, we offer a self-paced online preparation module. The module takes you through multiple choice exercises and case study exam questions, with tips and guidance on exam technique. 13 Electives as part of the SRA Professional Skills Course Electives Most trainees need to complete 24 hours of electives, of which 12 hours have to be face-to-face training. Some of our electives, although designed for trainees, are also suitable for recently qualified solicitors who are looking to develop personal skills in specific areas and carry CPD hours. Continuing Professional Development This section also contains our Continuing Professional Development courses. Although the rules will be changing in 2016, qualified solicitors still require 16 hours of CPD each year. Our CPD courses are designed to enhance already existing skills and introduce new skills that you may not already possess. 17 Trainee Litigation Programme Trainee Litigation Programme Our Trainee Litigation Programme is open to all trainee solicitors and is designed to expose trainees to the contentious practice skills of the training contract. It is also suitable for those seeking litigation experience for in-house legal departments. The comprehensive programme builds on the foundation of litigation knowledge gained on the LPC and the Advocacy and Communication Skills module of the PSC.
18 The Programme The course is designed to replicate the kind of experience which a trainee from a commercial firm will typically face when working on a contentious matter: The tuition element is based around a commercial case study on which you will work throughout the programme. Alongside your tuition you will also run several realistic case studies based on actual cases. You will take instructions from a professional role player as the client and deal with the issues and legal problems that are raised. You will be expected to make decisions and deal with the case as if you were the litigator in the case, receiving expert advice and feedback throughout. There will be an opportunity to undertake court visits to observe experienced practitioners at work. 27 Higher Rights of Audience Kaplan Altior has been granted accreditation by the SRA to deliver assessments under the Higher Rights of Audience Regulations Our assessments and training are delivered by our team of highly experienced trainers who are all practising Higher Court Advocates. 28 What are Higher Rights of Audience? Higher Rights of Audience are extended rights of advocacy for solicitors, enabling them to conduct trials in the higher Criminal and Civil courts, usually the Crown Court and High Court. When you obtain the qualification, you can call yourself a Solicitor- Advocate. To gain Higher Rights, you must pass an SRA-validated assessment in advocacy. Although the scheme is intended for solicitors, trainees can also take the assessment during their training contract (and satisfy the elective requirement of the PSC through the associated training if they wish). They have to wait until they qualify before they can apply to call themselves a Solicitor Advocate. Why do Higher Rights? 29 How is the assessment structured? The single assessment comprises of two elements; a written examination and a practical advocacy assessment. Higher Rights of Audience Written Element This part consists of a 2½ hour examination with an additional 30 minutes of reading time. The paper contains a section of short answer questions based on case studies and a section of multiple choice questions. You are able to take permitted materials into the examination (please see candidates handbook for further details). Practical Element This element is split into two parts and lasts for approximately 50 minutes. The first part requires candidates to submit a skeleton argument and conduct a contested interim hearing. The second part revolves around a mini mock trial and requires candidates to submit a trial plan and be assessed in two or more of the following areas: Opening Speech. Examination in Chief. Cross examination. Re-examination. Closing Speech. Candidates will receive the case papers for the assessment approximately two weeks before the assessment date. This allows you about a fortnight to prepare your skeleton argument (for the interim hearing) and your trial plan (for the mini mock-trial). altior@kaplan.co.uk
30 Pass Marks The written and practical parts of the Assessment each account for 50% of the total available marks. Candidates must achieve a minimum of 60% across both parts (an aggregate mark) to pass the Advocacy Assessment. Candidates will also be required to satisfy the Equality and Diversity and Ethics Standards throughout the assessment. Because the two elements of the assessment comprise one assessment, candidates will only be notified of their final aggregate mark. Why choose Kaplan Altior s Higher Rights programme? 33 CILEx Advocacy Qualification This is the CILEx advocacy skills training course under the CILEx Advocacy Qualification Scheme. Fellows and Members of CILEx must attend and successfully complete the course in the relevant practice area if they wish to obtain extended rights of audience in either family, criminal or civil proceedings. CILEx Advocacy Qualification
34 Who can attend this course? If you are a Member of CILEx, you can attend the course and take the assessments, but you can only be granted an Advocacy Certificate once you have been admitted as a Fellow. Fellows of CILEx. Members of CILEx (i.e. those who have completed the CILEx Professional Qualification). Before you can attend the course, you must first obtain a Certificate of Eligibility from CILEx. What are the benefits? There are many benefits to completing the CILEx Advocacy Programme. Once you have successfully passed, you will receive an Advocacy Certificate and the right to use the title Legal Executive Advocate. You will have extended rights of audience in your chosen practice area, including: Family: to appear in court in all County Court family proceedings. Criminal: to appear in the adult Magistrates Court and the Youth Court. Civil: to appear in the County Court in all actions except family proceedings. The course is led by advocacy experienced trainers, and its intensive and interactive approach means you will improve your advocacy and case preparation skills, giving you greater self-confidence in your own advocacy ability. 35 You will choose to specialise in one of the following: Family Proceedings Criminal Proceedings Civil Proceeding CILEx Advocacy Qualification The family, criminal and civil courses will each include materials and training relevant only to the specialist area of work, but they are all likely to cover some common topics including: Interviewing skills Oral presentations Case analysis Interim applications/ submissions Drafting Trial advocacy Negotiation Evidence and procedure Professional ethics Format The training courses run over six days. There is a short written evidence assessment around half way through the course and on the final day, you will undertake an advocacy assessment based on clear criteria that will be explained to you during the course. Groups are strictly limited in size to ensure the training remains interactive and each delegate receives adequate feedback and assistance from the trainer. You will follow practical case studies, learn in trainer-guided sessions and take part in role-play exercises to ensure you have every chance to develop your advocacy skills and associated knowledge in your chosen subject before the assessments. 40 An exciting new undergraduate level Apprenticeship for people who want to work in law or are already working in a legal environment and want to progress. What are Legal Apprenticeships? Apprenticeships have recently been introduced into the legal sector, both in line with government plans and as a means of keeping up with a very dynamic sector. They currently offer an alternative entry point into the sector and it is intended that they will eventually provide a complete route to qualification as a solicitor. An Apprenticeship is a real job with training so you can earn while you learn and pick up recognised qualifications as you go. 41 The Higher Apprenticeship in Legal Services (HALS) HALS is a Level 4 Qualification, which means it s the equivalent to the first year of a degree. Level 2 Intermediate Apprenticeship in Legal Administration. Employers usually take on school leavers as legal administrators. Equivalent to a GCSE. Level 3 Advanced Apprenticeship in Legal Services. A non- graduate route into a career as a paralegal. Equivalent to an A Level. Level 4 Higher Apprenticeship in Legal Services. For people who already work in the legal environment. Equivalent to a first year of a degree. Higher Apprenticeships in Legal Services The Level 4 scheme provides a structured system of training and a recognised qualification for individuals working in legal departments, usually as case workers, claims handlers or paralegals. It takes around 2 years to complete. This legal apprenticeship is made up of three elements: 1. A knowledge-based technical qualification to teach learners the underpinning legal knowledge required, as well as the expertise required for their area of practice. There is a choice of three specialist pathways: Commercial Litigation This refers to the disputes arising in matters of business such as corporate governance, banking transactions, mergers and acquisitions. The dispute usually involves money or property. Debt Recovery and Insolvency This is about the recovery of monies owed to a particular party. Where individuals or organisations cannot pay for their debts, they are classed as being insolvent. Personal Injury This is a legal term for an injury to the body, mind or emotions. 2. A competence-based qualification to ensure that learners understand their role and can carry out all aspects of their job to at least the level required by the nationally recognised standards of the qualification. 3. Essential Skills Wales Communication, Application of Number and ICT all need to be completed in the workplace through a combination of training and assessment. altior@kaplan.co.uk
42 Who are the HALS suitable for? If you re bright, committed and wish to pursue a career in the legal sector, then an apprenticeship could be for you. The framework is open to: Apprentices who have already completed levels 2 and 3. People currently working in the legal sector who do not already have a law degree or the GDL. A level school leavers or those changing careers who want to work in the sector but do not wish to go to university and complete a postgraduate qualification. 43 The 7 Steps to Achieving your HALS: Step 1. Initial Assessment (IA) Your IA will involve testing in literacy, numeracy, Information Communication Technology (ICT) and learning styles. Some of this testing will be conducted online and some will be conducted offline. Step 2. Induction This will take place in a group with other apprentices or on a one- to- one basis. It will help you to understand what the scheme involves and what is expected of you and your employer. Higher Apprenticeships in Legal Services Step 3. Individual Learning Plan After your induction, you, your training provider and your employer will agree your Individual Learning Plan. Each plan is specific to the learner. Step 4. Vocational and Knowledge Certificates These are completed via a combination of on and off the job training and assessments. The on the job element includes producing work completed on a day- to- day basis and the off the job element involves workshop sessions and home learning as a precursor to formal written assessments. Step 5. Essential Skills Wales (ESW) This is a suite of three different skills qualifications considered essential for all Welsh employees and include: Communication, Application of Number and ICT. They are completed in the workplace through a combination of on and off the job training and assessment. Step 6. Employees Rights and Responsibilities (ERR) This element will help you understand your rights and responsibilities in the areas of Equal Opportunities and Health and Safety. Step 7. Completion Once you have completed all required modules and your evidence has been externally assessed and quality assured, you will be presented with your qualification certificate. How is the training delivered? Assessors agree an individual timetable with each apprentice at the outset, comprising both the knowledge and competence elements, and visit the learner s premises regularly to check on progress against the timetable, and to assess the learner s portfolio of work-related evidence. altior@kaplan.co.uk

A legal apprenticeship could be an opportunity to get ahead of the game and earn a salary whilst you gain the knowledge and skills to build a successful career in law. The key benefits to the Apprentice are: 1. Earn a salary while you learn. 2. Get paid for holidays. 3. Receive training. 4. Enhance your job specific skills. 5. Gain qualifications. 6. You can apply for an Apprenticeship NUS card giving you a range of discounts at online and high street retailers, restaurants and bars while you re learning. 7. Research shows around a third of former apprentices receive a promotion within a year of completing their apprenticeship.* *Evaluation of Apprenticeship for Learners, BIS, May The Benefits for the Employer Apprenticeships are a cost-effective, high quality way to attract and retain talent within your business. The key benefits to the employer are: 1. Cost effective If you recruit an apprentice, you are able to apply for Government funding towards the cost of the training. The amount you will receive is dependent on the age of the apprentice but it could be between %. Support with recruitment is also free and if your firm has not enrolled an apprentice in the last year you may also be eligible for a grant of 1,500. Funding support for training is also available for many existing non law graduate staff, making apprenticeships a very cost-effective part of your staff development strategy. 2. Low risk Apprentices are monitored throughout their training so you can keep track of how they are progressing. In addition, because an apprenticeship is about competence you know that, on completion, your apprentice not only has the requisite knowledge but is also effectively putting it into practice. 3. Once qualified, apprentices give you an additional source of talent as opportunities arise in more senior positions. Research carried out by the National Apprenticeship Service has shown that over 80% of people are more likely to use a business if it offers apprenticeships to young people and modern workforces need to reflect the customers and communities they serve. 5. Offering apprenticeships is a way to build links with local schools and the wider community and demonstrates your firm s corporate and social responsibility. Higher Apprenticeships in Legal Services What happens after the HALS? HALS could be the start of your legal career. Successfully completing the qualification could be an end in itself, allowing you to continue working in the same role with your employer, albeit with an enhanced level of skills and knowledge. For higher apprentices wishing to progress further there are a number of options: a) CILEx professional qualifications (higher apprentices are exempt from some units) to become a Chartered Legal Executive (a period of qualifying employment is also required). b) A qualifying law degree (either part or full-time). c) After (a) or (b), the Legal Practice Course (LPC). d) Chartered Legal Executives who have completed the LPC do not have to complete a training contract in order to become a solicitor. Other LPC graduates normally have to complete a two year training contract. e) Note that Skills for Justice are currently developing Higher levels 6 and 7 of the Apprenticeships scheme which will be the direct equivalents of the Law Degree and the Legal Practice Course. With further training and assessment (currently under development), you could eventually qualify into professional roles including: Licensed conveyancer Notary Chartered legal executive Solicitor Barrister Costs Lawyer Patent attorney Trade mark attorney altior@kaplan.co.uk
