The Win Me 5k Contest ( Promotion ) is sponsored by The Giving Trio, LLC. ( Sponsor ). The Promotion consists of two separate contests, The Giveaway Tour and the, Win Me 5k Color Run ( The 5k Color Run ), (collectively the Contests ). Promotion entrants may enter to win prizes in one or both of the Contests, which are designed to promote the family-oriented Win Me 5k Color Run and to raise money to support charitable organizations. 1. ELIGIBILITY: The Promotion is open to legal residents of Washington State. The Contests are void where prohibited or restricted by laws. Participation in either Contest constitutes entrant s full and unconditional agreement and acceptance of these Official Rules, which shall be final in all respects. Sponsor s affiliates and subsidiaries, and advertising or promotion agencies engaged by Sponsor in connection with the Contests and their immediate family members are not eligible to enter the Contests. 2. PROMOTION PERIODS: The Promotion Periods for the Contests begin August 15, 2014 at 12:00 a.m. PDT and end August 1, 2015 at 6:00 p.m. PDT as further detailed below. a. The Giveaway Tour Promotion Period: The Giveaway Tour Promotion Period begins August 15, 2014 at 12:00 a.m. PDT ( Start Time ) and ends October 4, 2014 at 4:00 p.m. PDT ( End Time ), when all submissions must be received by Sponsor ( The Giveaway Tour Promotion Period ) with the possibility of extension at the sole discretion of the Sponsor. b. The 5k Color Run Promotion Period: The 5k Color Run Promotion Period begins August 15, 2014 at 12:00 a.m. PDT ( Start Time ) and ends the earlier of: when the Sponsor receives 10,000 contest entries, or on August 1, 2015 at 6:00 p.m. PDT ( End Time ) when all submissions must be received by Sponsor. 3. HOW TO ENTER: To participate, go to during the applicable Promotion Period to gain access to the Promotion entry forms. a. NO PURCHASE NECESSARY. No purchase is necessary to enter this FREE drawing. Entrants are not required to pay the registration fee for The 5K Color Run in order to participate in either Contest. Submitting an entry form on the website constitutes entry in this drawing. Entrants must completely and accurately submit all required information in order to enter. Entrants must comply with all submissions requirements as detailed herein. Receipt of entries will not be acknowledged. b. The Giveaway Tour Promotion Period: Entrant submissions are limited to one (1) entry per person during The Giveaway Tour Promotion Period. Winners of The Giveaway Tour prizes will be selected on August 24, 2014, October 4, 2014 and any further promotion date will be submitted here.

2 c. The 5k Color Run Promotion Period: Entrant submissions are limited to one (1) entry per person during The 5k Color Run Promotion Period. Winners of The 5k Color Run prizes will be selected on August 1, 2015 at 4:00 p.m. PDT. d. General Information on Submissions: All entrant information, including addresses, is subject to the Privacy Policy of the Sponsor. Sponsor is not responsible for lost, late, incomplete, delayed, garbled, illegible or misdirected entries, or for any error, human, technical or otherwise, which occurs or may occur in the processing of submissions as fully described herein. Entrants are required to abide by governing Promotion rules and regulations as outlined. 4. PRIZES: [Twenty-two (22) prizes] will be awarded, consisting of [three (4)] prizes for The Giveaway Tour and [fifth-teen (15)] prizes for The 5k Color Run as described herein. The total Approximate Retail Value ( ARV ) for prizes is $23, USD. Entrants must select a prize of interest at the time of entry to the Contests. The prize the entrant selects on the entry form will be the only prize for which the entrant s entry form will be submitted during a randomized drawing. a. The Giveaway Tour Prizes: Five (5) winners for The Giveaway Tour will be selected to win an ipad or a laptop. The winners of an ipad (ARV - $ USD each) and the winner of a laptop (ARV - $1, USD) will be announced on August 24, 2014, October 4, 2014, and TBD, 2015 (outlet collection) at 4:00 p.m. PDT. b. The 5k Color Run Prizes: Sixteen (16) winners for The 5k Color Run Prizes will be announced on August 1, 2015 at 4:00 p.m. PDT at The Win Me 5k Color Run. The drawing winners of The Color Run will be selected to win one of the following prizes: Car (ARV - $12, USD) Apple Mac Book Pros (2 prizes) (ARV - $1, USD each) Apple 27 imac (ARV - $1, USD) Apple ipad Air (2 prizes) (ARV - $ USD) Sponsored Trip Tulalip Casino (ARV - $ USD) Sponsored Trip Salish Lodge (ARV - $ USD) Tablets (5 prizes) (ARV - $ USD each) Apple Watch (ARV - $ USD) 5. GENERAL PRIZE CONDITIONS: Limit one (1) prize per person is allowed. Prizes will be awarded solely to the authorized account holder of the address who submitted the entry. The actual retail value of prizes may vary based on market and price fluctuations. A winner will not receive the difference between the prize s actual and approximate retail value, if any. All Promotion entries become the property of the Sponsor and will not be acknowledged or returned. Prizes will only be awarded by Sponsor upon potential winners verification of eligibility and final approval by Sponsor. Sponsor retains the rights, in its absolute and sole discretion, to make substitutions of equivalent kind or approximate value in the event of the unavailability of any prize or component of a prize for any reason whatsoever. a. Ineligibility: An entrant who is discovered during prize verification to have entered or used multiple accounts to enter the Promotion for more than the stated limit will be disqualified at the discretion of the Sponsor, or will be void.

3 Entrants who submit Promotion entries using script, macro or other automated means, or which subvert the entry process, will be disqualified. b. Minors: If any winner is a minor under the age of 18, or is legally considered a minor, the prize will be awarded in the name of his/her parent or legal guardian, who may waive acceptance of the prize, or if the parent or legal guardian accepts the prize, will be responsible for fulfilling all of the requirements imposed on winners set forth herein. A minor s parent or legal guardian grants the Sponsor the right to use the minor s image or likeness for use to print, publish, broadcast and use worldwide in any media now known or later developed for any purpose, including but not limited to, in advertisements, publicity, and other communications, worldwide, in perpetuity, without additional compensation, notification or permission, except where prohibited by law. c. Taxes: Each winner is responsible for applicable taxes associated with the receipt of their prize. d. Odds of Winning: The odds of winning depend on the number of eligible submissions received. 6. WINNER NOTIFICATION: Winners must be present to win. The winners of The Giveaway Tour Prizes will be selected at random and notified as follows: a. August 24, 2014 at 4:00 p.m. PDT winner will be notified at the Hotshots 3- On-3 Tourney, located at 101 North Fair Avenue, Yakima, Washington, b. TBD, 2015 at 4:00 p.m. PDT winner will be notified at Super Mall, located at 1101 Outlet Collection DR SW, Auburn, WA c. October 4, 2014 at 4:00 p.m. PDT winner will be notified at The Pirate Plunder Adventure Race, located at 10 N 8th St, Yakima, Washington. d. The winners of The 5k Color Run Prizes will be selected at random and notified on August 1, 2015 at 4:00 p.m. PDT at the Enumclaw Expo Center, located at th Ave SE Enumclaw, WA Prize winner notification for The 5k Color Run Prizes will be announced over a public address system for contest entrants located both inside and outside of the race event area onsite at the Enumclaw Expo Center. Due to space limitations, only race participants will be allowed priority inside the race event area. If a winner is not present at the times and places of notification, a new potential winner s name will be selected until a winner is called who is present at the times and places of notification. 7. GENERAL CONDITIONS: Sponsor reserves the right to amend the Official Rules at any time in its sole discretion. Sponsor reserves the right to cancel or modify the Promotion if fraud or any other factor impairs the integrity of the Promotion as determined by the Sponsor, in its sole discretion. If, in the Sponsor s opinion, there is any suspected or actual evidence of tampering with any portion of a Promotion, or if the integrity of a Promotion is otherwise compromised, the Sponsor reserves the right, in its sole discretion, to void any submissions at issue (including disqualifying any individual who tampers with the submission process), and to cancel, terminate, modify or suspend such Promotion, in whole or in part, at any time without notice. Upon entering the Promotion, winners grant Sponsor the right to print, publish, broadcast, and use worldwide in any media now known or later developed, the winner s name, portrait, picture, voice, likeness, city and state of residence, and biographical information for any purpose, including but not limited to, in advertisements, publicity, and other

4 communications, worldwide, in perpetuity, without additional compensation, notification or permission, except where prohibited by law. All entrants agree to comply with these Official Rules and the decisions of the Sponsor shall be binding and final. 8. LIABILITY AND RELEASE: By participating in the Promotion, Entrant accepts all risk and consequences of entry and participation in the Promotion, and agrees to release and hold Sponsor and its companies, affiliates, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to these Promotion, including but not limited to your entry and participation in either Promotion, the acceptance and /or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. Entrant shall indemnify Sponsor Parties from and against all claims or suits and any damages or costs (including reasonable attorneys fees) arising from or relating to entrant s violation or inaccuracy of any warrantees or representations made relating to the Promotion. Sponsor Parties assume no responsibility for errors, which may occur in the transmission of entrant s entry. Sponsor Parties are not responsible for any fraud or misconduct on the part of the Entrants. IN NO EVENT SHALL SPONSOR PARTIES BE LIABLE TO ENTRANT FOR ANY LOST PROFITS, OR FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS PROMOTION. Entrant s sole damages shall be limited to entrant s actual out-of-pocket expenses, excluding attorneys fees. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR PARTIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT. 9. LAW: These terms and conditions shall be governed by, construed and enforced in accordance with the laws of Washington State. Entrant agrees and irrevocably consents to bring any action necessary to enforce the terms and conditions of this Agreement in the courts of King County, State of Washington, and further agrees to submit to the jurisdiction of the same. Entrant agrees that all claims relating to the Promotion shall be resolved individually, without resort to any form of class action. 10. ENTIRE AGREEMENT: These terms set forth the entire agreement between the parties relating to the subject matter hereof, and supersede all prior agreements and understandings relating thereto, whether oral or written. 11. CONTEST ADMINISTRATION: Sponsor is responsible for the collection, submission and processing of submissions and the overall administration and execution of the Promotion. Entrants should contact Sponsor at the info@winme5k.com address with any questions, comments or problems related to the Promotion. 12.
