1 XXXX GOLD - Horse Racing Promotion Terms & Conditions 1. Information on how to enter and details of prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid. 2. Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter, its agencies and venues associated with this promotion are ineligible to enter. This promotion is limited to ten (10) one-day or multi-day events in Australia that have been invited by the Promoter to participate ("Participating Event"). 3. At each Participating Event, the promotion will commence and close at the time and date detailed on the promotional materials displayed at the Participating Event ("Promotional Period"). All promotions will be conducted during the period between EDT on 20/12/2013 and EDT on 31/12/14 or while stocks of prizes last. 4. To enter, during the Promotional Period: A. Purchase a can of XXXX GOLD 375mL can from a licensed bar at the Participating Event during the Promotional Period; B. Present the XXXX GOLD 375mL can to a member of the XXXX GOLD promotional team located at the Shuffle Board within the XXXX GOLD precinct at the Participating Event. A XXXX Gold promotional team member will then provide the entrant with three (3) Shuffle Board Discs ("Disc"); and C. Under the supervision of one or more member(s) of the XXXX GOLD promotional team present at the relevant Participating Event, place each Disc one at a time behind the starting line on the Shuffle Board and release the Disc from your hand allowing it to slide down the Shuffle Board table, aiming for the three clearly marked sections. There are three (3) marked XXXX GOLD sections on the Shuffle Board, namely: i. The 600m Zone (the area in between 600m 300m); ii. The 300m Zone (the area in between 300m Finish); and iii. The Finish Zone (the area in between the end of the 300m zone and the Finish line as marked on the Shuffle Board). D. Entrants who successfully land at least one (1) Disc completely within the 600m zone will receive a Minor Prize, as described in clause 10 below. 5. The first twelve (12) entrants who are successful at landing their first Shuffle Board Disc within the 600m zone, and successful at landing their second Disc within the 300m zone, and then are able to land their third Disc within the Finish zone in sequential order will qualify to compete for a Major Prize in the XXXX Challenge Final. If an entrant's first Disc lands anywhere but within the 600m zone, the entrant is not eligible to qualify to compete for a Major Prize. However, the entrant is still eligible for a Minor Prize as long as the entrant is successful in landing at least one (1) of his/her three (3) Discs within the 600m zone, The entrant's remaining Discs are not forfeited if the entrant fails to land his/her first or second Disc in the 600m zone. 6. 2 7. The Shuffle Board component of this promotion is a game of skill. Chance plays no part in determining the Minor Prize winners. All entries will be judged individually on their merits based on the entrant's ability to successfully land their Disc on part or all of a particular XXXX icon on the Shuffle Board. 8. Judging will take place during the Promotional Period at each Participating Event. Entries will be judged by one or more members of the XXXX Gold promotional team. 9. Minor Prizes will be awarded to entrants who successfully land at least one of their Shuffle Board Discs completely within the 600m zone. Minor Prizes consist of one (1) of the following items of XXXX Gold merchandise, distributed at the Promoter's sole discretion, subject to availability: XXXX GOLD Stubby Cooler (RRP $6.00); XXXX Cufflink (RRP $20.00);XXXX Racing Pin (RRP $15.00); XXXX Sunglasses (RRP $10.00); XXXX Key Ring (RRP $10.00); XXXX Money Clip (RRP $10.00); or XXXX GOLD Trucker Cap (RRP $15.00). All taxes (excluding GST) which may be payable as a consequence of receiving a Minor Prize are the sole responsibility of the Minor Prize winner. 10. Total Minor Prize pool (across all Participating Events) = 1,500 x XXXX GOLD Stubby Coolers; 1,500 x XXXX Cufflinks; 1,500 x XXXX Racing Pins; 1,500 x XXXX Sunglasses; 1,500 x XXXX Key Rings; 1,500 x XXXX Money Clips; and 1,500 x XXXX GOLD Trucker Caps. Total RRP value of Minor Prize pool = RRP $129, Minor Prize winners will be notified in person and presented with their Minor Prize by a XXXX GOLD promotional team member immediately after completing their entry. The Promoter is not responsible for delivering Minor Prizes to winners. 12. Limit applies of one Minor Prize per person. Entrants are not excluded from qualifying for a Major Prize if they have already received a Minor Prize. If an entrant lands more than one Disc completely within the 600m zone, the entrant will only receive one (1) Minor Prize and no additional Minor Prize. The entrant will not receive any additional Minor Prize if they are successful at landing their first Disc completely within the 600m zone, and then successful at landing their second Disc completely within the 300m zone. 13. All valid claims for Minor Prizes will be met notwithstanding that the advertised prize pool has been exceeded. Printing errors or other quality control matters will not be used as the sole basis for refusing to award a Minor Prize. All Minor Prizes must be redeemed during the Promotional Period. XXXX CHALLENGE FINAL: 14. The first twelve (12) entrants at each Participating Event who successfully complete the qualification process outlined in clause 5, will qualify to compete for a Major Prize in the XXXX Challenge Final. 15. To compete in the XXXX Challenge Final, finalists must, under the supervision of the XXXX Gold promotional team, participate in a knockout style Shuffle Board game as follows: (a) (b) Each finalist will be provided with two (2) Pucks which are numbered The numbers from 1-12 correspond to the order in which the finalists qualified for the XXXX Challenge Final, as determined by the XXXX Gold promotional team. Finalists must place their Pucks on the Shuffle Board before the game commences. The position of the Pucks is at each finalist's discretion, except Pucks must not be placed behind the foul line. One at a time, in the order in which they qualified and as per the numbers on their Pucks (as determined by the XXXX Gold promotional team), finalists must release a Shuffle Board Disc from behind the foul line to slide along the Shuffle Board, aiming to knock other finalists' Pucks off the Shuffle Board table. The process will continue until only one Puck remains on the Shuffle Board table. 16. The finalist with whom the remaining Puck is identified, as judged in the sole discretion of the XXXX Gold promotional team, will win a Major Prize. 17. Major Prize winners will be notified in person after completion of the XXXX Challenge Final. Major Prize winners will also be notified via within 48 hours of the applicable XXXX Challenge Final. Major Prize

3 winners must provide certain personal information (including phone number, address and mailing address) to the XXXX Gold promotional team at a Participating Event in order to claim the Major Prize. 18. The XXXX Challenge Final component of this promotion is a game of skill. Chance plays no part in determining the Major Prize winners. All entries will be judged individually on their merits based on the entrant's ability to knock other competitors' Pucks off the Shuffle Board table and ensure that their Puck is the final Puck remaining on the Shuffle Board table. 19. Major Prize consists of a trip for the winner and three (3) guests aged 18 years or over to XXXX Island (located on the Great Barrier Reef, Australia). The trip includes return economy class airfares for four (4) adults from the winner s nearest Australian capital city to Rockhampton Airport, including airline and airport taxes, transfers from Rockhampton Airport to and from XXXX Island and three (3) nights 3 star (or equivalent) accommodation. Winner and guests must travel together. Accommodation may consist of a mix of single, double and/or dormitory-style rooms, with a mix of ensuite and communal bathrooms, and will be allocated at the discretion of management on arrival. Selected food and beverages will be provided at Promoter's discretion, including unlimited water. Activities available on the Island are subject to weather and management discretion, and may include (but are not limited to) snorkelling, rod fishing, kayaking, canoeing and beach games. Participation in any activities will require the completion of an indemnity form and are taken at the risk of the individual. The Promoter may amend or substitute available activities in its absolute discretion. Major Prize value is up to RRP $10,000 (depending on point of departure). All other ancillary costs, including but not limited to taxes (excluding GST), fuel, meals and beverages (unless specified), transfers (unless specified), activities (unless specified), insurance, incidentals and any and all other expenses are the responsibility of the winner. It is a condition of accepting the Major Prize that the winner and his/her guests have valid travel insurance with the highest available coverage for their period of travel. 20. There are ten (10) Major Prizes to be won across all Participating Events. Total RRP value = up to $100, Major Prize winners and their guests must be Australian residents and aged 18 years and over. Major Prize winners will be allocated a two (2) month window within the period 01/01/14 to 31/06/2015. Within 7 days of being notified that they are a winner, Major Prize winners will receive an confirming their two month travel window. Major Prize winners will be required to respond to the to accept their prize. Upon accepting their prize, details of how the Major Prize winner can nominate a weekend within their travel window will be provided by . Weekends will be allocated on a "first come, first serve" basis and are subject to availability, including airline economy class seat availability. Major Prize winners are responsible for nominating a weekend, and providing all documents and information requested by the Promoter to complete the booking (including documents and information in respect of their guests). If a winner's nominated weekend is not available the Promoter will (where possible) consult with the winner to identify an alternative weekend, but the Promoter reserves the right to allocate a weekend in its sole discretion. Major Prize winners must complete their booking at least 60 days prior to departure. If a Major Prize winner is unable to travel on the allocated specific travel dates, between 01/01/14 to 31/06/2015 the Major Prize will be forfeited. 22. Accommodation and flight arrangements, including suppliers, will be determined by the Promoter in its sole discretion. The Promoter may refuse any requested changes, and will not accept any request made within 24 days of departure. If any requested change is accepted by the Promoter, change fees may be applicable. 23. Before any Major Prize is awarded, the Major Prize winner and each of their guests will be required to: a. sign a Participation Agreement and Release in favour of the Promoter and the event organiser; and b. provide evidence of valid travel insurance with the highest available coverage for their period of travel.

Major Prize winners and their guests may also be required to provide a credit card imprint at check-in to the accommodation on XXXX Island that will be used to charge for incidentals (such as optional activities) and/or as a bond in case of damage to the property. 25. If a Major Prize winner does not accept their prize within 14 days of receiving the confirmation or forfeits the Major Prize, the Promoter may in its sole and absolute discretion assign the Major Prize to the entry judged next best finalist in the relevant XXXX Challenge Final, or withdraw the Major Prize unawarded. GENERAL: 26. The total prize pool value, including Minor Prizes and Major Prizes, is up to RRP $229, Prizes (both Minor and Major) are not redeemable for cash. The Promoter s decision is final and binding no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. 28. If any prize or any element of a prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize or element of a prize of equal or greater value at the Promoter s sole discretion, subject to any written directions from the relevant authorities. Winners will not be entitled to any additional compensation in the event that the prize or element of a prize has been substituted at equal or greater value. 29. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this promotion. 30. The prizes are subject to the terms and conditions of the transport, accommodation and other third party suppliers or prize components. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner or their guests as a result of the conduct of any third party prize suppliers, or otherwise as a result of the winner and their guests accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or willful misconduct of the Promoter or which cannot be excluded by law. 31. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol. 32. Entrants consent to the Promoter using their name, entry, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter. 33. Entries remain the property of the Promoter. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
