2 CABRILLO HIGH SCHOOL CONSTITUTION PREAMBLE We, the Associated Student Body of Cabrillo High School, in order to promote an atmosphere of higher learning to create an effective student government, and to encourage school spirit, hereby ordain this constitution. ARTICLE I NAME AND TRADITIONS The name of this school shall be Cabrillo High School. The initials shall be used on emblems, decals, the seal, and the crest. SECTION II The following items concerning traditions of Cabrillo High School are irrevocable: 1. The Mascot (Conquistador) 2. The Colors (gold, black, and white) 3. The Seal and Crest 4. The Flag 5. The Cabrillo C 6. The School Newspaper (The Fore and Aft) 7. The Yearbook (Tierra Royal) 8. The Wilde Trophy for Excellence 9. The School Ring 10. The Alma Mater 11. The Golden Fleece Award SECTION III 1. Any official reproduction of any of the above must be exact. 2. These copies will always be available in the Director of Activities office to authorized personnel. 3. Decals and caricatures must have the approval of the Associated Student Body and the Administration.

3 ARTICLE II MEMBERSHIP 1. All students attending Cabrillo Senior High School are members of the student body. 2. Students purchasing Associated Student Body cards become members of the Associated Student Body, may hold office and will be entitled to certain discounts and privileges as decided by the Associated Student Body. Elected/Appointed officers represent the Associated Student Body, and vote on their behalf. SECTION II 1. Members of the faculty and administration shall be considered honorary members of the Student Body. 2. Foreign exchange students shall be awarded special privileges as designated by the governing body. ARTICLE III LEGISLATIVE 1. All legislative and executive powers hereafter are vested in the Associated Student Body. 2. The Associated Student Body Council will consist of: President; Vice-president; Secretary; Treasurer; the four Class Presidents, Vice Presidents, Secretaries, Treasurers; five to seven appointed representatives from each class; and all the Commissioners. All of the above are voting members of the Associated Student Body Council. A. The Director of Activities or an appointee (ASB advisor) will act as advisor and will have the power to vote in the event of a tie. 3. A quorum shall consist of over one-half of the voting members. 4. The Associated Student Body Council shall elect its own by-laws and conduct meeting under acceptable parliamentary procedures. 5. The Associated Student Body Council shall keep and publish a simple voting record on the Fore and Aft. 6. The Associated Student Body Council shall meet at least once every week during the school year.

4 A. A calendar shall be submitted by the Associated Student Body President in September. B. Meeting dates, times, and places shall be announced. C. Official meeting dates will be adhered to unless extenuating circumstances present themselves. 7. A bill or motion shall be considered passed with a majority of the members present voting in favor. ARTICLE IV DUTIES OF SCHOOL OFFICERS 1. The duties of the Associated Student Body Officers shall be as follows: A. The President of the Associated Student Body shall convene and preside over the Associated Student Body Council of Cabrillo High School. The President will: i. Be responsible for the work, progress, and effectiveness of the Associated Student Body. ii. Appoint, with the approval of the Associated Student Body Council, the Parliamentarian. iii. Appoint, with the approval of the Associated Student Body Council, the School Board Representative. iv. Appoint, with the approval of the Associated Student Body Council, students to represent the Associated Student Body in these areas of school service: a. Commissioner of Communications b. Commissioner of Spirit & Assemblies c. Commissioner of Publicity d. Teacher / Student Relations e. Historian f. Commissioner of the Student Store g. Commissioner of Athletics h. Special Committees which the President feels necessary for the operations of the Associated Student Body. v. Suggest policies and plans for all the Associated Student Body and all committees.

5 vi. Fill all vacancies in the Associated Student Body offices with twothirds vote of the Associated Student Body Council. vii. An agenda shall be prepared and submitted to the Director of Activities and the Associated Student Body Advisor no less then three school days prior to the scheduled meeting. B. The Associated Student Body Vice-President will: i. Take over all duties of the President in case of absence. ii. Chair the Inter-Club Council. iii. Be a member of the Spirit & Assembly Committee. iv. Coordinate the annual election of upcoming ASB members. C. The Secretary of the Associated Student Body will: i. Submit minutes to the Director of Activities, Associated Student Advisor, and Activities Accountant within forty-eight hours of the meeting of approval. ii. Be responsible for duplication of the minutes and read them to all officers. iii. Handle all incoming and outgoing Associated Student Body correspondence. iv. Type and duplicate the agenda for all meetings. v. Prepare daily bulletin notices for all meetings. D. The Treasurer of the Associated Student Body will: i. Be in charge of checking Associated Student Body cards. ii. Review the general fund monies of the Associated Student Body at least every two months with the aid of the ASB Account Clerk. iii. Make financial recommendations to the Associated Student Body Council and review the financial enterprises of the Associated Student Body Council on these matters. iv. Report to the Associated Student Body Council the status of the Lompoc Unified School District audit of the Associated Student Body s books. v. When the profit from the student store has met the Associated Student Body s budget, the money, which is needed, is given to support groups. Needs are met in order of priority.

6 E. The Commissioner of Communications will: i. Be in charge of publicizing, off-campus as well as on-campus, all school and club events during morning announcements. ii. Be responsible for announcements. iii. Program the electronic sign with up-to-date information. F. The Commissioner of Spirit & Assemblies will: i. Arrange and supervise all student initiated assemblies and pep rallies. ii. Chair Rally Committee with the following membership: Band Director, Head Spirit leader, Director of Activities, Spirit leader Advisors, and Vice-presidents of classes. iii. Have an outline of how the pep assembly will be organized. The outline must include the amount of time to be scheduled for each activity. iv. Notify all those who are involved in the assembly and make sure they understand what it is they are to do. v. Have all supplies ready to go before an assembly starts. vi. Work with all Vice-Presidents on Spirit Activities. vii. Oversee and help plan Spirit Days / Weeks. viii. Prepare supply list of Spirit Activities. ix. Inform vice presidents on how many from their class is needed for spirit activities. H. Commissioner of Teacher / Student Relations will: i. Organize student / teacher secret pals. ii. Be the middle-person in exchanging gifts. iii. Recognize teachers on special days. I. Historian will: i. Clip all school related articles from the newspaper and place them in the school s scrapbooks in chronological order. J. Commissioner of the Student Store will: i. Work with the class presidents to create a monthly calendar available for members of the Associated Student Body to reference. ii. Take inventory regularly.

7 K. Commissioner of Athletics will: i. Put up the flag in the morning when a varsity athletic team was victorious on the previous day. ii. Take down the flag before leaving campus on that day. L. School Board Representative will: i. Attend all meetings of the LUSD Board of Trustees. ii. Report all activities of the LUSD Board of Trustees which effect students of the Associated Student Body monthly. iii. Communicate with the Board of Trustees through the Superintendent of Schools all important feelings expressed by the students of Cabrillo. 2. The duties of the Class Officers shall be as follows: A. The Class Presidents shall convene and preside over all class meetings. The President will: i. Be responsible for the work, progress, and effectiveness of their class. ii. Appoint the necessary committees for their respective class, and suggest policies and plans for the class and its committees. B. The Class Vice-Presidents will: i. Assume the duties of the Class President in case of absence. ii. Chair committees as appointed to them by the President. iii. Be a member of the Spirit & Assembly Committee. C. The Class Treasurer will: i. Prepare the class budget. ii. Organize class fundraisers with the help of the President. D. The Class Secretary will: i. Be responsible for any correspondence as directed by the Class President. ii. Take minutes of class meetings. E. The Class Representative will: i. Be responsible for the duties appointed to them by the Class Officers. F. All Class Officers will: i. Be responsible for regular attendance at meetings, e.g., Associated Student Body, class, or committee. ii. Report the progress of all class activities to the Class President.

8 ARTICLE V QUALIFICATIONS 1. Candidates for Associated Student Body offices and class officers must meet the following requirements to run for office: A. Submit a Declaration of Intent to run to the election committee. B. Students can run for and only hold one class or Associated Student Body Office at a time. C. The candidates must be enrolled in Cabrillo High School full time and be an Associated Student Body member in good standing to campaign and hold office. D. Candidates must not drop below 2.5 GPA, determined by the grading period, if elected, or to miss class without causing academic failure. E. Aside from the freshman class, one year s experience is required to hold office. F. Representative s may or may not have previous experience. ARTICLE VI ELECTIONS 1. The Associate Student Body offices to be filled each year are as follows: A. President B. Vice-President C. Secretary D. Treasurer 2. Appointments to be made each year are as follows: A. Commissioner of Communications B. Commissioner of Assemblies C. Commissioner of Publicity D. Commissioner of Teacher / Student Relations E. Historian F. Commissioner of Athletics 3. The new officers and representatives will assume the duties of their office depending on the time of election / appointment. The old officers and representatives will still be responsible for any unfinished business of the current school year.

9 SECTION II 1. The class offices to be filled each year are as follows: A. President B. Vice-president C. Secretary D. Treasurer 2. Qualified Freshmen President, Vice-president and representative candidates will be interviewed in September. 3. Each class will elect five to seven representatives from their members to represent them in the Associated Student Body Council. 4. Representative candidates will be placed on a ballot, where their peers will vote. 5. Qualified Representative candidates will than receive an interview from their class officers. 6. Scores from the ballots, interviews and teacher evaluations will be formulated to determine representatives for each class. SECTION III 1. All of the above mentioned officers will be selected by a formal interview process and scored written prompt. SECTION IV 1. During the Spring semester, the Associated Student Body President shall announce to the Cabrillo Student Body that those interested in becoming a candidate for Associated Student Body office may obtain their Declaration of Intent. 2. The Associated Student Body Vice President will be in charge of the election process, providing the Declaration of Intent forms and assist in recruiting qualified candidates. 3. Three Associated Student Body Officers will discuss with the Director of Activities or Associated Student Body Advisor and interview each candidate one week before the election. SECTION V 1. The line of succession shall be as follows: A. The President of the Associated Student Body B. The Vice-president of the Associated Student Body C. The Senior Class President D. If none of the above are able to fill these offices, an emergency election will be held.

10 2. Vacancies during term of office A. The Associated Student Body President will, with the approval of the Associated Student Body Council, appoint members from the Associated Student Body Council to fill vacancies in the three Associated Student Body offices. B. Class Presidents and the ASB Advisor, with the majority approval of the class representatives and officers, will appoint members from their respective classes to fill vacant offices within their classes. SECTION VI 1. Run-Off Elections: In the event that no officer (ASB or Class) does receive the majority vote, then the top two candidates will be decided within the Associated Student Body within a week of the original election. ARTICLE VII FINANCE 1. The Associated Student Body Treasurer, with the aid of the Director of Activities, will be responsible for school financial matters. A. The Associated Student Body Treasurer, the Finance Committee, and the Director of Activities must submit a tentative budget for the following year. B. This tentative budget must be approved by a two-thirds majority vote of the Associated Student Body Council no later than June 1 st. C. The final budget will be approved within the month of September. D. All money matters not represented must be presented in the form of a bill to the Associated Student Body Council for a majority vote. 2. All checks going out pertaining to school funds must have two of the following signatures: A. Director of Activities B. Associated Student Body Treasurer C. Principal 3. Student Store: A. The student store will be the main fundraiser for the Associated Student Body General Account. After the Budgeted amount for the Associated Student Body General Account and expenses have been met, the profit will be divided among the classes: freshman, sophomore, junior and senior.

11 ARTICLE VIII SOURCE OF POWER The powers of the student government are delegated by the Principal. These powers may be revoked as the Principal sees fit. ARTICLE IX AFFILIATION The Constitution gives the Cabrillo High School Associated Student Body Council the power to join any organization pertaining to school government, such as the Inter-Club Council, CASC, etc. ARTICLE X DISMISSAL OF OFFICERS 1. Causes for dismissal will be: A. Failure to fulfill the duties of office (e.g., frequent violations of any article of the constitution) B. Violation of the school code will be grounds for suspensions from school. C. Four unexcused absences. D. Below a 2.5 grade point average. 2. Procedure for dismissal: A. An elected class officer can be removed in three ways: i. If a majority of class advisors agree he/she should be removed. ii. If five class officers agree. iii. If an advisor and four officers agree. B. If one of these three conditions is met, the issue is brought before the ASB for a general vote. C. Dismissal will be for the complete school year.

12 ARTICLE XI ASSOCIATED STUDENT BODY COUNCIL SUPPORT GROUPS 1. Associated Student Body Council Administrative Groups shall be the Executive Board, and Interclub Council. A. Associated Student Body Council Administrative Groups shall meet as often as needed unless otherwise designated. They may meet separately or with other groups when combined effort is required. 2. Membership: A. The Executive Board Associated Student Body Officers, Class Presidents and commissioners B. Interclub Council Consists of the President of approved student clubs C. Student Exchange Committee Five Associated Student Body members, one of which shall be appointed chairperson 3. Duties: A. The Executive Board meetings shall be presided over by the Associated Student Body President. They will have the responsibility of preparing an agenda for the Associated Student Body Council meetings and doing research where needed to improve the effectiveness of the Associated Student Body Council. Agenda items for Associated Student Body Council meetings cannot, except in emergency, be included without going through the Executive Board. B. The Interclub Council meetings shall be presided over by the Associated Student Body Vice-President. They will involve various events, such as noon time events. C. All student council support groups shall, at the request of the council, report on all activities, progress, or financial matters. ARTICLE XII STUDENT BODY SUPPORT GROUPS 1. The Associated Student Body shall be in charge of promoting school spirit and good sportsmanship in the student body. The following groups shall be in charge of the promotion of school spirit and good sportsmanship: A. Cheerleaders B. Marching Band an its Auxiliaries

13 2. Selections of Cheerleaders shall be as follows: A. Tryouts will be held in the spring of the year under the direction of the Cheerleader Advisor. 3. Cheerleaders shall be responsible for splitting cheering duties between sports during the school year. 4. Cheerleaders shall be expected to have a valid Associated Student Body Card at all times during their year of activity. Failure to have a card will mean exclusion from the team. 5. Cheerleaders shall be under the direction of the Athletic Director. 6. The Marching Band and its auxiliary shall be under the direction of the Band Director. SECTION II 1. No more than nine members will be appointed by the Associated Student Body President with Associated Student Body Council approval, to serve on the election committee. 2. The Election Committee shall, in the following order: A. Provide Declaration of Intent forms and assist in recruiting qualified candidates. B. Develop the structure of the election process and arrange the following details: i. Prepare and update nomination papers ii. Distribute candidate s papers C. Review all declarations to make sure candidates meet Associated Student Body qualifications. D. Handle election procedures under supervision of the Director of Activities or an appointee (Associated Student Body Advisor) E. If only one student qualified as a candidate for an office that student may be elected to office by a majority vote of the Associated Student Body Council. ARTICLE XIII AMENDMENTS All good constitutional amendments shall be presented to the Associated Student Body and can be initiated by any member in good standing of the Associated Student Body. SECTION II Judicial power is that authority to see that the constitution and the by-laws are followed and adhered to.

14 SECTION III The name of the person who makes the motion and the person who seconds the motion will be recorded in the Associated Student Body Council minutes. SECTION IV Unscheduled Associated Student Body Council meetings must be announced two days before the meeting, unless deemed an emergency by the Director of Activities. SECTION V 1. The members of the following organizations must purchase an Associated Student Body card in September or no later than October 5 th of a new school year to be able to participate or receive financial assistance from the Associated Student Body: A. Associated Student Body Officers, Associated Student Body Council Members, and Cheerleaders. B. All individuals who participate in Fall, Winter, or Spring Athletics. C. Marching Band and units D. All club members SECTION VI Cheerleaders will have representatives cheer during the Fall and Winter sports seasons. SECTION VII Annual events include the following: 1. Homecoming in the fall senior class responsibility 2. Sadie Hawkins usually in March freshman/sophomore class responsibility 3. Junior-Senior Prom in the spring junior class responsibility 4. Senior Enrichment Day in the spring - seniors only day senior class responsibility SECTION VIII- Students must be in good standing to purchase tickets and to be a part of the Court for the following events: Homecoming, Prom, or Enrichment Day A. The definition of good standing is- a student who is debt free, attendance is cleared with no more than 15 unexcused tardies (in the 6 week grading period prior to the event), Discipline approval may be required to participate in extra-curricular events.

15 B. Nominees for both Homecoming and Prom court shall not have any disciplinary actions against them that will disqualify them from participating as a representative of Cabrillo High School. C. Nominees must have a 2.0 GPA at grading period. D. No Freshmen will be admitted to prom E. Guest Pass Forms must be filled out and approved for CHS Sophomore students wishing to attend Prom with an upper classman. F. Seniors who are in danger of failing a graduation requirement will not be allowed attend Enrichment Day without proper clearance. SECTION IX Student Organizations are not to sponsor fundraising projects that are related to forms of gambling, such as raffles. SECTION X Athletic Support Groups These groups will be student groups whose sole reason for existence is to support their team with favors not covered under the school district but deemed necessary for the team. Including but not limited to: 1. All listed on the Associated Student Body Finance Sheet SECTION XI Foreign Exchange Students Students from other countries will be recognized at a school assembly, at which they will be presented with a gift from the Associated Student Body. SECTION XII Renaissance This is a recognition and incentive program with an emphasis on academics and academic excellence. With this philosophy in mind, Cabrillo has implemented the Winners Circle and the Academic Letter. To qualify for and Academic Letter one must receive a 4.0 GPA for two semesters or a 3.8 GPA for three semesters.

16 SECTION XIII - Graduation Presenters Graduation presenters will be as follows: A. Welcome Speech: Senior Class President if he/she is unavailable the succession is as follows: Senior Vice President, ASB Executive President, ASB Vice President B. Senior Gift: Senior Class Treasurer if he/she is unavailable the succession is as follows: ASB Executive Treasurer, Senior Class Vice President C. Pledge of Allegiance: ASB President, ASB Vice President ARTICLE XIV RATIFICATION The Constitution of Cabrillo High School must be ratified by a majority of the Associated Student Body Council in order to be effective.
