CASH, CHECKS AND VISA/MASTERCARD ACCEPTED. This is a legally binding contract for videography services to be provided by Nick Andrews and/or individuals subcontracted to do work for Nick Andrews. You agree to the following terms and conditions: PAGE ONE

2 ENTIRE AGREEMENT This agreement contains the entire understanding between Nick Andrews and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing. RETAINER A retainer fee is required to hold the date of your event. No date is reserved until a retainer is received. The balance of the complete package price must be paid at the date specified herein. If final payment is not received as set forth herein, Nick Andrews reserves the right to withhold delivery of the video files and/or not attend the wedding until payment is received. CANCELLATION There shall be NO refund of retainer after 48 hours from the signing of agreement due to the reservation of the videography or photography date. If the event is canceled within three months of the date, the CLIENT shall pay the balance of the contract, due to the high probability that Nick Andrews will not be able to further book that date. Once a balance is paid, it is non-refundable. Any other arrangements shall be discussed between the CLIENT and Nick Andrews. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform Nick Andrews of the cancellation. CHANGE OF OR VENUE Nick Andrews must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of event. Notification of any changes can be made by phone along with written notice sent via for documentation. If an is sent, a confirmation of receipt must be in writing. It is the CLIENT S responsibility to confirm all arrangements at least 7-10 days prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify Nick Andrews. PRE-EVENT CONSULTATION The parties agree to a pre-event consultation four to six weeks before the event date in order to finalize the actual shooting times, locations, and CLIENT S request list (in writing) for specific video files and/or photographs. COOPERATION The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Nick Andrews recommends that CLIENT designate an event guide to point out important individuals for informal or candid photographs to the photographer during the wedding that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. Nick Andrews is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Nick Andrews. WEDDING SITE RULES The photographer is limited by the guidelines of the ceremony official or reception site management. The videographer will not go against site rules. CLIENT agrees to accept the technical results of their imposition on the videographer. Negotiation with the officials for moderation of guidelines is CLIENT S responsibility; Nick Andrews will offer technical recommendations only. EXCLUSIVE VIDEOGRAPHER Nick Andrews shall be the exclusive videographer(s) retained by the CLIENT for the purpose of videoing/filming the wedding. Family and friends of the CLIENTS and other wedding vendors shall not interfere with the videographer/photographer s duties. REPRODUCTION/VIDEO RELEASE CLIENT agrees to purchase media directly from Videographer unless in possession of high resolution digital files. CLIENT agrees not to scan, copy or reproduce images printed by Nick Andrews and/or individuals subcontracted to do work for Nick Andrews, in any manner without written permission. If high resolution digital files are purchased, Nick Andrews grants CLIENT the right to reproduce the images provided for their personal use only and does not allow the videos or photos to be altered, sold or published. CLIENT further agrees not to supply video or images to any third parties (including vendors associated with the wedding or album designers) without written permission from Nick Andrews. Nick Andrews agrees to grant video packages and any reproduction rights only as specified in wedding package to the CLIENT. Initial PAGE TWO

3 DIGITAL FILES Upon receipt of digital files, CLIENT accepts all responsibility for archiving and protecting the photographs. Nick Andrews archives image files for up to a year past the wedding date. Videographer/photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is CLIENT S responsibility to make sure that digital files are copied to new media as required. Initial FAILURE TO PERFORM Due to the limited and subjective nature of the event Nick Andrews cannot be held responsible for requested filmed video or audio not recorded or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the church or location restrictions. The videographer is not responsible for lost filming or photo opportunities due to any kind of equipment malfunction, the lateness of the event couple, or other principles. The Videographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location. It is acknowledged that any lists submitted to Nick Andrews will be used for organizational purposes only and in no way represents videography or photography that will actually be produced. Nick Andrews will do its best to fulfill all requests but can make no guarantees all movies or images will be delivered. CLIENTS are responsible for all location fees and permits. UNFORESEEN CIRCUMSTANCES If Nick Andrews cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, or due to the videographer/photographers illness, then Nick Andrews shall return any moneys paid by the CLIENT, less expenses, but shall have no further liability with respect to the agreement. This limitation of liability shall also apply in the event that video or photographic materials are damaged in processing, lost through camera malfunction, memory card malfunction, lost in the mail, or otherwise lost or damaged without the fault on the part of Nick Andrews. SUBSTITUTION In the event of illness or sudden event out of the control of both parties, Nick Andrews will attempt to substitute a photographer at no cost to CLIENT. This contract will be transferable to said videographer. INCLEMENT WEATHER CHARGE In the event of severe weather, including but not limiting, a hurricane, severe storm or other unforeseeable events Nick Andrews may make the decision that it s unsafe to drive home, and hotel stay will be billed to the CLIENT. RETURNED CHECKS Returned checks are subject to a $50.00 returned check fee. CLIENT assumes responsibility for any and all collection costs and legal fees incurred by Nick Andrews in the event that enforcement of this contract becomes necessary. All legal action shall take place in Pitt County, North Carolina. CREATIVE LICENSE Movies and Images may be edited at the videographer/photographer s discretion, and delivered movies/images will not include all movies/images shot. The videographer/photographer reserves the creative right to edit and release only those deemed professional in quality and within the photographer s artistic standards. GARMENTS Nick Andrews and/or subcontracted individuals that work for Nick Andrews can not be held responsible for damage to Garments during environmental events. CLIENT is responsible to arrange personal assistance for wedding garments. TERMS & CONDITIONS It is the client's responsibility to secure access to areas for videography. Nick Andrews will not be responsible for coverage lost due to access restrictions. Creative aspects such as shooting and editing styles, music, and artwork are at the discretion of Nick Andrews and/or subcontracted individual(s). Nick Andrews will not be held liable for any production problems beyond our control, e.g. bad weather, accidents, poor acoustics/lighting, interference from guests, etc. Any liability on the part of Nick Andrews will be limited to the amount of monies paid. Upon taking possession of the finished product, the client must inform Nick Andrews of any technical or other problems with the video within 3 days. After 3 days, if no notification has been received, the client will be deemed to be satisfied with the product. All or part of this video may be used by Nick Andrews for promotional purposes and uploaded to the web. Copyright will be owned by the client and Nick Andrews. Initial PAGE THREE

4 Your wedding film contract includes set-up time and consultation. We will attend the rehearsal upon request and additional fees will apply. We require that our videographers are provided with a warm meal at the reception so please include us in your final catering numbers. For this purpose, we will inform you as to how many cinematographers and assistants we will be using to film your wedding. PACKAGE DELIVERY Typical package delivery is 4-12 weeks after the completed video package has been delivered online to client and after all monies have been paid. Client will receive a certain amount of beautifully edited wedding DVD's based on your wedding package purchased. Extra copies are $20 each beyond the package amount. You may purchase the full set of raw(unedited, full resolution) footage for $499 on multiple DVDs (enough to fit all footage shot on discs, not duplicates). The final 75% of the balance is due two weeks before the wedding. Client has 10 days from the date approval copy is received to request changes/edits. If changes/edits are requested after the 10 day period is over, due to the size of video files being stored on the computer, extra editing charges will apply. This contract constitutes the entire agreement and no verbal agreements are binding between either party. Any additional agreements must be in writing and be signed by both parties. No CLIENT pictured will be identified by full name or address, with the exception of social media tags. I, (bride) and I, (groom) hereby consent to the use by Nick Andrews for the purpose of advertising, trade, promotion, publication, and exhibition in any manner of all photographs or video taken of me on (wedding date) by Nick Andrews (videographer).
