ALLEGATION(S) Child A(female - 2yrs) got out of the outdoor play area opening by the gate and was found by a parent, who gave Child A to another parent who was going in the building, to return to child care staff. Two caregivers were on duty with five children at the time this occurred. Additional Findings Violation Established? Yes No III. ALLEGATION: Child A (female - 2yrs) got out of the outdoor play area opening by the gate and was found by a parent, who gave Child A to another parent who was going in the building, to return to child care staff. Two caregivers were on duty with five children at the time this occurred. INVESTIGATION: On 05/20/2015, I met with Angie Buda, program director. On Monday, 05/18/2015, the children from the afterschool, preschool and toddler rooms were outside playing towards the end of the day. There were five children in the toddler class with two caregivers, Ms. Gorney and Ms. Ekkens. Child A went under the fence and almost went into the parking lot, while the two caregivers from the toddler class were standing by the slide. A parent saw her and stopped and handed her to another parent who handed her to the staff. The two caregivers didn t notice Child A had slipped under the fence. Ms. Buda stated that she has already contacted the fence company; as well as maintenance. Maintenance came out and placed blocks in all of the areas where there was a gap between the bottom of the fence and the ground. She is currently waiting for the fencing company to come out. She also suspended both caregivers for a week. 2

5 In viewing the outdoor play area, it is enclosed completely by a fence. However, in some areas, the height of the bottom of the fence does not touch the ground. Ms. Buda is aware that there is another area that needs to be fixed by the fencing company as well. On 06/10/2015, I met with Ms. Buda to conduct an exit interview and to complete the corrective action plan. Ms. Buda stated that they already have a plan in motion to make sure this won t happen again. They will be lowering the fence and prior to the fence company coming out, they have placed blocks in the high risk areas, installed cameras, and each caregiver has a specific station that they should monitor while outside. On 06/15/2015, I spoke with Child A s mother. She was pulling into the parking lot at the Y, and saw Child D s (male, 1.5 yrs) mom stop her car. She didn t realize why she stopped. She later told that Child A got underneath the fence and Child D s mother saw her and gave her to another parent, who gave her to the caregivers. She was upset when it happened but knows that the center takes real good care of Child A as she has a lot of health issues. She is happy with the actions that the center has taken so that it won t happen again. On 06/15/2015, I spoke with Child B s (male, 2.5yrs) mother. She is aware that there are some spots in the fencing area that are deeper than others. She likes the security system and has no concerns or problems with the center. On 06/15/2015, I spoke with Child C s (male 1.5 yrs) mother. She does not have a problem or any concerns with the center. On 06/15/2015, I spoke with Child D s mother. She had just picked up Child D and was pulling out of the driveway when she saw Child A just outside of the fence. She looked for Child A s mother, blocked the driveway with her car and grabbed Child A. Another mother saw the incident from a different direction. She hollered over the fence that Child A was out of the fence and the staff came to get Child A. The whole incident happened really quickly. She put her back over the fence. Everything was fine and she is confident with the staff. On 06/15/2015, I spoke with Rebecca Gorney. Shaylynne Ekkens was helping someone on the slide and she was walking around the playground watching the six toddlers on the playground. She didn t see Child A climb underneath the fence. They do watch the children more closely now. She denied that she and Ms. Ekkens were outside talking to one another. On 06/15/2015, I spoke with Shaylynne Ekkens about the incident. There were other children on the playground from other rooms. She and Ms. Gorney had six toddlers on the playground. She was helping someone on the slide while Ms. Gorney was walking around the perimeter. They counted five toddlers and realized Child A was gone. A 3

6 mother had her outside of the fence. Ms. Ekkens denied that she and Ms. Gorney were talking to one another. APPLICABLE RULE R Staff and Volunteers. ANALYSIS: CONCLUSION: (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. The center failed to ensure that all staff provided appropriate care and supervision of children when on 05/18/15, Child A was able to go under the fence in the playground area and almost get to the parking lot of the center.
