2 About this agreement This is an agreement between you and Kingwood. The agreement tells you: what support service you will get when you will get support how much your support service costs your rights and responsibilities Kingwood s rights and responsibilities what we will do if you and Kingwood disagree about something.

5 Information about your service from Kingwood The service is: e.g. *Domiciliary Support provided in the home & community. ** hours funded through an individual budget and invoiced privately. *please refer to your support plan for details of the support provision. Please note Kingwood cannot provide nursing care or undertake duties outside their remit. When the service will be provided: The service will start on: The service will end on: If someone else, like the adult services (the council) pays for part of your service, the start date and end date will have to be the same as in their agreement with Kingwood. The service will carry on until someone wants to end the service. This could be: you the other person who pays towards the service, like adult services Kingwood. We will agree any changes with you before we make any changes to your service. We will also talk to any other people we need to, like the person who is acting for you or people that pay towards your service. If we need to make any changes to your support, Kingwood will also look at how much the service will cost, and whether we can give you the new service.
6 Rights and responsibilities When you get a service from Kingwood, you have some rights and responsibilities. These are like a set of rules. Both you and Kingwood must follow these rules. Your rights say what you can expect Kingwood to do. Your responsibilities say what you must do. Your rights Kingwood will: do its best to do what its says it will do give you the support that is written in your support plan give you a support agreement if you pay for any part of your service make sure you are fully involved in any decisions about your support - where you are able and willing to do so. give you advice about being healthy and safe help you to tell us what you think of the service make sure you can complain if you are not happy make sure your support workers are trained and supervised to do their job make sure your support workers treat you and your home with respect try to make sure the same staff support you each time have the right insurance for the work it does.
7 Your responsibilities You must: try to let us help you to do the things that are written in your support plan, especially important things that will help you to stay safe tell the Kingwood office if you are going away and do not need the service. You must tell the office 24 hours before you go away pay any money you owe to Kingwood on time try as best as you can to make sure that your support worker is safe when they support you tell your support worker or the manager if you are unhappy about your support or the service you get.
8 Paying for your service How much you must pay for your service You must pay Kingwood for your service. The amount you must pay is: Total weekly cost **** This includes; **.** of support at per hour ** sleep ins for a sleep in (11pm 7am) **.** for an hour of wake night support (10pm 8am) If you have support only at weekends, there may be an enhanced rate. **.** for weekend support If your service is on bank holidays there may be higher rates applied. You will be informed of this in advance. When you must pay for your service You must pay this money within 28 days of receiving an invoice. How to pay for your service Kingwood will tell you how to pay us for your service. The cost of your service going up once a year Kingwood will probably put the cost of your service up (so you will have to pay more money for the service) every year. This will happen every April. We will tell you 4 weeks before we put the cost of the service up how much more money you will have to pay. If we cannot agree the new cost with you, we will deal with it as a disagreement (please see the section on Dealing with disagreements ).
9 The cost of your service going up sooner that once a year Kingwood will sometimes put the cost of your service up (ask you to pay more money for the service) at other times in the year. Kingwood may ask you to pay more for your service if: there are changes in your lifestyle there are changes in the level of support you need there is a change in the agreements that we have with other people, like social services. If we think we might need to change your service, we will talk with you before we ask you to pay any extra money. Paying if you do not get a service If you do not let Kingwood give you any part of your service at the times and places you and Kingwood have agreed, you will still have to pay Kingwood for that part of the service. But you will not have to pay Kingwood for that part of the service if: you gave us 24 hours notice you had an emergency like an accident or illness. If Kingwood does not give you the service at the times and places you and Kingwood have agreed, you will not have to pay Kingwood for that part of the service. Shared service costs If you share the service you get with others, you may have to pay some money towards the cost of the services you share. This agreement does not cover these other shared costs. We will talk to you if you have to pay any shared costs. If you do not pay your invoices within 28 days and upon a second reminder Kingwood reserves the right to stop providing support until payment is made. If payment is not received, this might mean Kingwood will need to take further legal action and you will be advised of the details at the time.
10 Checking your service is right for you Kingwood will keep checking that your service is right for you. We will check that your service is right for you on an ongoing basis. If you are not happy with your service we will talk to you about what we can do to make things better for you. We will then talk to you at least once a year to check your service is still right for you. If you need a different type of support, Kingwood will decide if it can give you the different support. If Kingwood can give you the support, we will agree a new support plan with you. We might need to change your support agreement, or we might need to agree a new support agreement with you. If Kingwood has to give you more support (like more hours of support or more staff to support you), we may have to ask you to pay more money for your service. At any time, you or Kingwood may think that your support is not right for you. If you or Kingwood think that your support is not right for you, we will meet with you to talk about your support. You can have a representative (someone who speaks up for you) at these meetings if you wish. Some other people may also need to come to meetings to talk about your support, like someone from social services if they pay for part of your service.
11 Telling us what you think about your service You have the right to tell us what you think about your service. You can tell us if you like your service. You can tell us if you do not like your service and what changes you want. If you are unhappy with your service you can also make a complaint. Making a complaint means speaking up about something you are not happy with or do not like. Complaining can be a good way of making things change for the better. You can complain about your service to Kingwood. You may also be able to complain to other people, like Adult Services or the Care Quality Commission. You can find out how to contact these people by looking in your copy your user guide. Changing or ending your service If you want to change your service, we will discuss this with you and try to make those changes. This may mean you need to sign a new contract. If you want to change the number of hours you receive, you will need to tell us in writing, 1 month before the change will take place. Either you or Kingwood can decide to stop your service. If you want to stop getting your existing service, you must do one of these things: tell us in writing 1 month before you want your service to end if we cannot agree on the findings of a review or agree a new support plan, you need to tell us in writing 1 month before you want your service to end if we cannot agree on the cost of the service, tell us in writing 1 month before you want your service to end. If Kingwood wants to stop giving you a service, we must do one of these things: tell you in writing 1 month before we want your service to end if we cannot agree on the findings of a review or agree a new support plan, we will tell you in writing 1 month before we want your service to end if we cannot agree on the cost of the service, we will tell you in writing 1 month before we want your service to end
12 if you do not do the things you are responsible for despite us talking to you about it, we will tell you in writing 1 month before we want your service to end if any agreements that Kingwood has with other people (like adult services) end and that means we could not carry on giving you your service, we will tell you as soon as possible. If someone else pays for part of your service, Kingwood might have a different agreement with them about ending the service. We will have to do what it says in this agreement as well. Keeping information about you private Kingwood will keep all information about you private and safe. We will only give information about you to other people where the law says we have to, or if you tell us it is okay. Fairness Kingwood will always try to treat you fairly. If you do not think we are treating you fairly, please tell us. We will see what we can do to make things better for you. The Law The law of England and Wales covers this agreement. Dealing with disagreements (called disputes) If you and Kingwood disagree about something, or if one of us does not do what we have said we will do in this agreement, we will have a meeting. If we cannot sort the problem out, we will get help from someone who does not know you or Kingwood. This person will help us to sort the problem out.
