1 May 26, BOROUGH COUNCIL REGULAR MEETING NO. 7 HELD ON MAY 26, 2015 AT THE BOROUGH OF LENNOXVILLE OFFICE LOCATED AT 150 QUEEN STREET, LENNOXVILLE MINUTES PRESENT: Borough President Borough Councillor Borough Councillor David W. 2 May 26, OPENING OF THE MEETING At 5 p.m., the Chair of the meeting, David W. Price, declared the meeting open. 2. ADOPTION OF THE NOTICE OF MEETING AND THE CERTIFICATE OF SERVICE RESOLUTION B.C. LE Adoption of the notice of meeting and the certificate of service THAT the notice of meeting and the certificate of service for the present meeting be adopted. 3. ADOPTION OF THE AGENDA RESOLUTION B.C. LE Adoption of the agenda presented. THAT the agenda of the present meeting be adopted as 4. MINUTES RESOLUTION B.C. LE a) Reading and adoption of the minutes of meeting No. 5 of the Lennoxville Borough Council held on April 28, 2015 THAT the Secretary not be required to read the minutes of meeting No. 5 of the Lennoxville Borough Council held on April 28, THAT the minutes of meeting No. 5 of the Lennoxville Borough Council held on April 28, 2015 be adopted. THAT the minutes of meeting No. 5 of the Lennoxville Borough Council held on April 28, 2015 be filed.
3 May 26, PUBLIC QUESTION PERIOD DOSSIER B.C. LE Karl Hunting 1 st intervention: Mr. Hunting informed Council that there are large potholes on Queen Street in front of the Esso service station, as well as on the Bishop s bridge on College Street, and in front of 1501 Campbell Street, all of which pose a danger to the safety of drivers. Borough President David Price stated that the requests would be followed up. He reminded those present that residents should call the Ville de Sherbrooke s control centre directly ( ) with requests in this regard, among others. 2 nd intervention: Mr. Hunting indicated that all of Winder Street is in a deplorable state. He asked what plans have been made to repair it in its entirety. Mr. Price provided information on the city s local street repair program and on the section in the Borough where repairs are planned for rd intervention: Mr. Hunting asked what has been planned in the short term for repairs to Glenday Road given the medium- and long-term extension of Highway 410. Mr. Price informed him of possibilities in this regard, noting that a meeting will be held with the Urban Infrastructure and Environment Service to discuss potential options for Glenday Road. 4 th intervention: Mr. Hunting described the condition of the curbs on Little Forks Street and asked that the city repair them. Mr. Price responded that this would be followed up with the appropriate department. 5 th intervention: Mr. Hunting noted that the signs along Little Forks Street had been vandalized, and recommended that they be re-installed but in different locations. Mr. Price and the Borough Director stated that this would be followed up with the municipal department concerned, with due consideration given to Mr. Hunting s proposed solutions. May 26, th intervention:
4 Mr. Hunting also drew to the attention of the Borough Council members that the municipal parking area between the Provigo grocery store and Fleuriste Lennoxville is now almost empty as a result of the new signage indicating a three-hour parking limit. Mr. Price qualified this statement and noted certain issues related to the Borough s municipal parking areas. DOSSIER B.C. LE Raynald Chailler Mr. Chailler pointed out that the signs on Church Street limiting parking in front of Saint-Antoine elementary school to a 60-minute maximum were not being respected, and that some drivers seemed to be using the parking spaces on a permanent basis. Mr. Price responded that discussions to rectify this situation had been initiated with the school s administration. DOSSIER B.C. LE Doug Newman Mr. Newman asked if there was a by-law pertaining to residents who play hockey or basketball in the street. Mr. Price stated that this type of activity is tolerated, but if problems arise from such activity, the police may intervene as needed. DOSSIER B.C. LE Robert Salesse Mr. Salesse indicated that when the municipal department involved uses the fire hydrant at the northern end of Conley Street in carrying out certain work, this erodes one of the riverbanks belonging to him along the St. Francis River. Mr. Price assured this resident that the situation would be followed up with the department concerned. 6. CORRESPONDENCE RESOLUTION B.C. LE Tabling of the list of correspondence May 26, THAT the list of correspondence No. 5 dated May 26, 2015 kept in DOSSIER B.C. LE be tabled.
5 7. PLANNING ADVISORY COMMITTEE DOSSIERS RESOLUTION B.C. LE a) Tabling of the minutes of meeting No. 4 of the Borough of Lennoxville s Planning Advisory Committee held on April 28, 2015 THAT the minutes of meeting No. 4 of the Borough of Lennoxville s Planning Advisory Committee held on April 28, 2015, be tabled. RESOLUTION B.C. LE b) Decision Application for a minor exemption to former Town of Lennoxville Zoning By-law No Residential Zone Ra-37 4 Academy Street (Claudette Lamothe and Keith Kobelt) TO ADOPT THE RECOMMENDATION TO LENNOXVILLE BOROUGH COUNCIL: THAT the minor exemption to Zoning By-law No of the former Town of Lennoxville pertaining to lot of the cadastre of Québec located in Residential Zone Ra-37 be accepted, thereby authorizing: An encroachment of 0.17 m from the standard of 2.0 m in effect to therefore allow the minimum lateral setback to the right of the main building to be 1.83 metres subsequent to the extension; An encroachment of 1.77 m from the standard of 6.0 m in effect to therefore allow the main building s total minimum lateral setbacks to be 4.23 metres subsequent to the extension. The exemption is subject to the following conditions: That the mature cedar hedges located on the eastern and western sides of the main building, serving as a buffer between it and the adjacent properties, remain in place; That the detached garage located in the backyard be demolished or moved after the work has been completed. The main building would be located at less than 0.90 m from this garage if it is kept, which is non-compliant with the standard-setting provisions in effect. May 26, RESOLUTION B.C. LE
6 c) Decision - Application for a minor exemption to former Town of Lennoxville Zoning By-law No Residential Zone Ra A Warren Street (Lorna Gordon) TO ADOPT THE RECOMMENDATION TO LENNOXVILLE BOROUGH COUNCIL: THAT the minor exemption to Zoning By-law No of the former Town of Lennoxville pertaining to lot of the cadastre of Québec, located in Residential Zone Ra-29, be accepted, thereby authorizing: 1- An encroachment of 1.13 m from the minimum front setback of 6.0 m in effect, in order to authorize that the main building be located 4.87 m from Deacon Street; 2- An encroachment of 3.17 m from the minimum front setback of 6.0 m in effect, in order to authorize that the two-storey veranda on piles, identified on the location certificate in the file, be located 2.83 m from Deacon St.; THAT the minor exemption to Zoning By-law No of the former Town of Lennoxville pertaining to lot of the cadastre of Québec, located in Residential Zone Ra-29, be accepted on the condition that the exemption apply only to the existing accessory building, providing for an encroachment of 0.14 m from the distance of 0.90 m in effect, in order to legalize the shed measuring 3.74 m by 2.53 m that is located 0.76 m from the neighbouring property. 8. COUNCIL COMMITTEE AND WORK GROUP DOSSIERS 9. CULTURE, RECREATION, AND BOROUGH PARK DOSSIERS RESOLUTION B.C. LE a) 1 st Lennoxville Scouts Funding for the year 2015 THAT the Borough Council grant the 1 st Lennoxville Scouts financial assistance in the amount of $200 for the year 2015, and that the Treasurer be authorized to issue a cheque for the corresponding amount. RESOLUTION B.C. LE b) The Army, Navy & Air Force Veterans in Canada Unit 318 Funding for the year 2015 May 26,
7 THAT the Borough Council grant the Army, Navy & Air Force Veterans in Canada Unit 318, financial assistance in the amount of $2010 for the year 2015, and that the Treasurer be authorized to issue a cheque for the corresponding amount. RESOLUTION B.C. LE c) Signature of performance contracts THAT the President and the Director of the Borough of Lennoxville be authorized to sign the performance contract on park management, as filed in DOSSIER B.C. LE of the municipal archives; THAT the President and the Director of the Borough of Lennoxville be authorized to sign the performance contract on culture, recreation, cultural and recreational facilities and equipment, community life, and neighbourhood services, as filed in DOSSIER B.C. LE of the municipal archives. RESOLUTION B.C. LE d) Community Clean-up Tabling of the 2015 report THAT the Annual Community Clean-up 2015 Report dated May 21, 2015 in DOSSIER B.C. LE be tabled. RESOLUTION B.C. LE e) Volunteer Night Tabling of the 2015 report THAT the Volunteer Night 2015 Report dated May 21, 2015 in DOSSIER B.C. LE be tabled. 10. 8 b) Adoption of by-laws c) Notices of motion d) Other by-law business 12. NEW BUSINESS 13. MESSAGES FROM BOROUGH COUNCIL MEMBERS DOSSIER B.C. LE Linda Boulanger Councillor Boulanger thanked Suzanne Bergeron, urban planner-designer with the Urban Development and Planning Department, for the work that had been done on the Lennoxville gateway structure so that the seven themes that characterize the community are more visible to the public entering the Borough from the southern end of Queen Street. DOSSIER B.C. LE Claude Charron Councillor Charron noted that the postponement of the Borough s Community Clean-up did not hinder residents from participating in this activity in great numbers. He thanked all of the event s partners who contributed to this annual activity s success. Councillor Charron expressed his appreciation to the Water Management Division of the Urban Infrastructure and Environment Service for their professional service when the pipes in the Borough were cleaned this spring. 14.
