TEAM STATEMENT OF OWNERSHIP USA CDL Driving School Corp. is a private corporation operating under the laws of the State of Florida and doing business as USA CDL Driving School Corp. We have assembled an administrative staff and faculty of knowledgeable professionals who are prepared and dedicated to respond to the challenge ahead. It s Owner/President Denis Moredo, Director of Operations/Executive Director/Director of Admissions and placement director, Vivian Menendez, Juan Reyes and Jottyn Santos our third party tester and instructors direct the day to day operations. Their goal is to develop skills and abilities and concurrently reinforce a positive self-image in each student we train. ADMISSION ADMISSION REQUIREMENTS AND PROCEDURES Upon completion of the enrollment procedures, the admissions representative will assist the student in preparing for a successful entry into the scheduled starting class. The admissions representative will finalize all necessary paperwork, Including the appropriate applications and documents. Student will be notified of the scheduled date and time of the session. In order to be considered for enrollment, each candidate must possess the following qualifications: All prospective applicants must complete a Student Application For Admissions Form and be interviewed by admissions representative of the school. Be at least 18 years old. (21 years old for Interstate) Possess a valid driver s license. (NOT SUSPENDED IN ANY OTHER STATE) Be able to obtain a CDL learner s permit, have a CDL learner s permit, or USA CDL Driving School will assist you in obtaining a CDL learner s permit. As per the Federal Motor Carrier Safety Regulations ( ) can read and speak the English language sufficiently to converse with the general public, to understand highway traffic signs and signals in the English language, to respond to official inquiries, and to make entries on reports and records. Must pass a DOT (FMCSA) physical examination. Must pass DOT (FMCSA) (Part 382 CSAUT) drug test before attending school. Must be drug and alcohol free and agree to random drug and alcohol testing as per DOT (FMCSA) (Part 382 CSAUT) requirements while attending in vehicle training. For Free Evaluation Call Page 5

6 Complete an Enrollment Agreement. Submit other information such as past work history, other instruction received, military service, etc., which may be required to determine qualifications. USA CDL Driving School recognized that some applicants may not meet all of the admission requirements listed above. These applicants are encouraged to speak with the School s Director of Admissions for assistance. GENERAL INFORMATION All facilities have a vehicle range for close quarter maneuvering and backing skills training. In addition, USA CDL Driving School Corp. includes various types of late model tractor-trailers for the use of student training. Plus computer based interactive training utilizing extensive use of videos and high quality graphics. All classrooms are equipped for discussions and demonstrations. Audiovisual aides are used as an important part of the regular classroom sessions. CLASS STARTING DATES CDL learners permit preparation (open entry) UC Hour Program day classes start the first Monday of every month. UC Hour Program part time night classes start the first Monday of every other month. 7 STUDENT SERVICES JOB PLACEMENT ASSISTANCE At no cost to the student USA CDL Driving School Corp. maintains an employment assistance service for graduates. Although the school offers no guarantee of employment directly or indirectly implied, considerable effort is put forth to bring together potential employers and graduates who have the skills employers are seeking. The job placement assistance department continually seeks new employment opportunities for students. Job search techniques are taught, and job placement counseling takes place during the student s job procurement class. There is no additional charge for placement assistance. STUDENT RECORDS Student s records are currently maintained electronically by our multi-user database system located at the administration office, and hardcopies are kept in file cabinets in a secure designated storage area. This database system maintains grade point averages, standards of progress status, pertinent individual financial records, and personal data for instantaneous retrieval. All pertinent records are available for individual review upon academic records will be provided to potential employers for employment consideration, or by written request from the student. For those students who are denied entry, dismissed or terminated records will remain on file permanently in a file cabinet. CATALOGS Students may receive a catalog a week prior to enrollment for their review, understanding of the school academics and policies. GENERAL POLICIES NON-DISCRIMINATORY POLICY Students are admitted, trained and referred to employers regardless of race, color, creed, sex, age, religion, marital status, disability or national origin to the extent of the law. USA CDL Driving School Corp. complies with all local, cities, county, municipal, state and federal regulations. USA CDL Driving School Corp. does not discriminate against physically disabled persons in the recruitment and admission of students, the employment of faculty and staff, and in the operation of its programs. FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACTS Parents and students have a right to inspect educational records specifically pertaining to student. However, USA CDL Driving School Corp. reserves the right to refuse disclosure to students the financial records of his or her parents. USA CDL Driving School Corp. has the right to release information without consent in the following circumstance: For Free Evaluation Call Page 7

8 Release to comply with judicial order of subpoena. Students may ask to review their educational records by a written letter addressed to the School Director expressing his/her wishes to do so. A Written replay will be sent to the student within three business days after receiving the request. SUBSTANCE ABUSE POLICY USA CDL Driving School Corp. complies and enforces Federal and State requirements for drug and alcohol, on school property. Any student determined to be in violation of this policy is subject to disciplinary action, which result in expulsion, even for the first offense. It is a standard of conduct for students of USA CDL Driving School Corp. to not use illegal drugs or abuse alcohol. In order to maintain this standard, USA CDL Driving School Corp. complies with the Federal Motor Carrier Safety Administration Part 382 Controlled Drug & Alcohol Use & Testing requirement. The U.S. Department of Transportation (DOT), Federal Motor Carrier Safety Administration (FMCSA), adopted regulations requiring certain commercial motor vehicle operators to be tested for alcohol and drugs in order to reach the goal of an alcohol and drug-free transportation environment. Part 382 of the Federal Motor Carrier Safety Administration s alcohol and drug testing rules apply to every person and to all employers or CDL schools of such persons who operate a commercial motor vehicle in commerce in any state. FMCSA PART 382 TESTS REQUIREMENTS: The following requirements apply to all individuals who are required to have or are obtaining a CDL for the type vehicle they plan to operate: 1. Pre-In-Vehicle Training: This test is required and negative results must be received before an employer or CDL School allows a student/driver to perform a safety sensitive function. The pre- In-Vehicle test is only required for controlled substances (Drug). Alcohol testing is permitted. 2. Reasonable Suspicion: This test is required when a trained instructor/supervisor/employer has reasonable suspicion to believe that the student/driver has used alcohol and or controlled substances. 3. Random: This unannounced testing is based on a random selection of students/drivers. The selection must be made by a scientifically valid method and all students/drivers who are selected for testing must be kept confidential until such time that the employer/school notifies the student/driver to take the test. Once the student/driver is notified, he/she must immediately proceed to the testing facility and undergo testing. Every student s/driver s name that is selected for testing must be returned to the selection pool so that all students/drivers have an equal chance of being selected at any time. 4. Random alcohol: Random alcohol testing is also required by the DOT. However, random alcohol tests can only be administered just prior to a student/driver performing a safety-sensitive function, while performing a safety-sensitive function, or just after performing a safety-sensitive function. Random controlled substances tests can be conducted at any time the student/driver is notified. A student/driver who is selected and refuses to submit to a test must follow the requirements of 49 CFR Part 40, Subpart O. (SAP) 5. Post Accident: This test applies to all students/drivers who are involved in fatal crashes. The test must also be conducted on all students/drivers who are cited for moving violations arising in a crash that requires a vehicle being towed or an injury requiring medical attention away from the For Free Evaluation Call Page 8

9 scene. The alcohol test must be conducted within 8 hours and the controlled substances test must be conducted within 32 hours of the crash. Consequences: A student/driver who has violated the FMCSA part 382 Controlled Drug & Alcohol Use & Testing is prohibited from performing DOT safety-sensitive duties for any employer or CDL Training School until he/she completes the Substance Abuse Professional (SAP) evaluation, referral, and education/treatment program set forth in 49 CFR Part 40 Subpart O, and in applicable FMCSA regulations. Confidential resources for referral will be made available by USA CDL Driving School Corp. to student/driver who will need to participate in a SAP program, where they can address problems associated with the misuse of alcohol and the use of controlled substances, (DRUGS). GENERAL PROCEDURES I acknowledge that if I elect to enroll in any in-vehicle training programs or courses offered by USA CDL Driving School Corp. I must agree to the following: 1. Must pass a DOT (FMCSA) Part 382 Controlled Substances Drug test prior to attending school. Alcohol testing may also be required. 2. Must be drug and alcohol free and agree to random drug and alcohol testing as per FMCSA (DOT) Part 382 Controlled Substances & Alcohol Use Testing requirements while attending in vehicle training at the school. 3. I understand that a refusal to participate in testing when so directed by USA CDL Driving School Corp., as well as a positive test result will result in my expulsion from attending School. 4. A refusal or positive test result will result in a referral by USA CDL Driving School Corp. to a Substance Abuse Professional (SAP) evaluation, referral, and education/treatment program set forth in 49 CFR Part 40 Subpart O, and in applicable FMCSA regulations. 5. I will be prohibited from attending school for CDL training until I complete the Substance Abuse Professional (SAP) evaluation, referral, and education/treatment program set forth in 49 CFR Part 40 Subpart O, and in applicable FMCSA regulations. GROUNDS OF TERMINATION AND DISCIPLINE A student on USA CDL Driving School Corp. s property having possession of, possessing on the student s body, transferring, selling or attempting to sell or transfer any form of illegal drugs during the hours between the beginning and end of the student s classes, is guilty of misconduct and is subject to expulsion, even if this is a first offense. 10 ACADEMIC POLICIES AND REGULATIONS PREVIOUS TRAINING USA CDL Driving School Corp. does not grant credit for academic standing to students that have received training or education from any Institution prior to enrollment. It is the student s responsibility to confirm whether or not credits will be accepted by another institution of the student s choice. ATTENDANCE Regular attendance is essential for academic success. In some cases, regular attendance may offset an otherwise poor academic record. Provisions for reasonable absences due to circumstances beyond the control of the student, such as personal illness, a death in the family, or court appointments are permitted. Beyond these allowances, students can seldom maintain a satisfactory grade level. Students must notify USA CDL Driving School Corp. of all intended absences. All work missed must be completed through arrangements with the School Director and the Director of Training, who will determine the amount of work, the time, and method of completing the work in conjunction with the student. WITHDRAWAL FROM SCHOOL Students terminated will be readmitted only at the discretion of the School Director. Students wishing to withdraw from USA CDL Driving School Corp. must notify the school in writing or in person of their intent. Failure to withdraw properly may result in the assignment of failing grades that become part of the student s permanent record. LEAVE OF ABSENCE A leave of absence may be granted for illness or other legitimate purpose for a maximum period of 60 days in any 12-month period. Students failing to return and re-enroll by the end of the leave of absence will be terminated. Such leaves are not encouraged unless absolutely necessary. TARDINESS Any student not present at the start of his/her class period will be considered late. Tardiness will be recorded by the quarter hour. For example, a student arriving at 8:10 will be marked 15 minute late; a student arriving at 8:23 will be marked 30 minutes late, etc. Quarter hours late will be tallied and will accumulate toward total absences. Accumulative record of tardiness will be maintained. When the hours of tardiness equal the number of hours in a scheduled class, it is considered one day of (8 hours) absent. (Tardiness is defined as 8 minutes or more in a quarter hour) When excessive tardiness equals 5% of the total clock program hours, the student will be warned. The Director of the School and the Director of Training will make an assessment as to the student s ability to continue the program. STANDARD OF PROGRESS FOR STUDENTS 1. In case a student does not complete a subject due to a verifiable illness or other approved circumstances, the student may repeat the calss at no additional cost when it is scheduled next in the curriculum. 11 2. USA CDL Driving School Corp. reserves the right to dismiss the student or withhold the Diploma or CDL Certification Exam for inappropriate behavior, non-attendance, or non-payment of tuition. The student will be liable for all reasonable attorney s fees and all other costs and charges necessary for the collection of any amount not paid when due. MAKE-UP CLASS POLICY If a student misses a class due to illness, personal problems, or any other reason, it is his/her responsibility to make up the material missed. Private tutoring is at the Director of Trainings discretion. GRADUATION REQUIREMENTS Students eligible for graduation must have completed each of their subjects with a passing grade and maintain a minimum overall average of 70% or better. A Diploma is awarded following satisfactory settlement of financial, academic and other school requirements listed below: 1. Achieve an overall grade average of 70% in written examinations. 2. Successfully pass the State of Florida CDL Skills examination. 3. Have a minimum attendance of 90%. 4. Has fulfilled all monetary obligations to the school. TIME-FRAME REQUIREMENTS AND COMPLETION TIME Students training must be completed within one (1) year from the date of enrollment agreement. All students rights are protected for the full period of the one (1) year completion time allowed. Full tuition payments entitle you to attend school in the time allowed, and during any authorized program extension. Other students rights, (including the right to cancel your enrollment), cease upon expiration of the completion time allowed for your program. TO RE-ENTER A student whose training has been interrupted due to unsatisfactory progress, who wishes to re-enter must obtain permission from the School Director. If re-entry is approved, a student must maintain satisfactory progress. GRIEVANCE POLICY AND PROCEDURES Students who wish to appeal the decisions of USA CDL Driving School Corp., relative to academic probation or dismissal, must address a letter to the school within three business days of the probation or dismissal. The letter must state the student s reasons, for appeal as well as any other mitigating circumstances. The School Committee will conduct a hearing with the student within three business days of the receipt of the student s appeal letter. USA CDL Driving School Corp. will render a decision in writing within two business days. The decision by USA CDL Driving School Corp. is final. If the student wins the appeal, he/she will be reinstated, providing the student improves his/her attendance, academic average or both to the designated standard of the satisfactory progress definition. 12 APPEAL PROCEDURES If a student has a complaint regarding his/her training, he/she should initially discuss the matter with his/her instructor. The Director of Training is next. Student complaints can be done either verbally or written if the complaint is not resolved or toll free number It is the goal of USA CDL Driving School Corp. to provide quality educational training programs. When problems arise, students should make every attempt through the formal complaint procedures within USA CDL Driving School Corp. to find a fair and reasonable solution. TO APPEAL A FINDING OF UNSATISFACTORY PROGRESS A student may appeal a determination for unsatisfactory progress by submitting a written appeal to the School Committee. If a student demonstrates mitigating circumstances (that is, death in the immediate family, serious illness, etc.) an exception can be made. The decision of the School Committee is final. (The school s committee consists of: The School Director, Admissions Director, Director of Training, and Director of Operations) GRADES To be making satisfactory progress, a student must achieve an average of 70%. If a student fails to achieve the 70% average, he/she will be placed on probation for one subject matter. If at the end of the probation period, the student has not achieved a 70%, he/she will be terminated at this time. Academic records are permanently maintained and open for inspection and review upon request. Records of academic progress are furnished to students upon graduation. Written exams, tests, and performance exams determine students grades. Emphasis is placed upon the practical phase of each subject. Practical skills are evaluated on a pass or fail basis. GRADING SCALE Students are graded on the basis of behind the wheel of proficiency and written examinations. USA CDL Driving School Corp. uses a numerical scale grading system. The following examples show the comparisons to other types of grading scales. However, all instructors, student services, and administrative staff members are available to assist the student in the successful completion of the program of study. 13 CONDUCT AND DISMISSAL POLICIES When students enroll, they agree to conduct themselves in a manner that enables USA CDL Driving School Corp. to recommend them to prospective employers as courteous, considerate, and well mannered. Therefore, students are expected to conduct themselves, both in and out of class, in a socially acceptable manner. USA CDL Driving School Corp. reserves the right to place students on probation or to exclude them from class or school for any of the following reasons: 1. Failure to maintain an acceptable academic or attendance record. 2. Conduct found by the administration to be detrimental such as damaging school property, drinking alcohol during school hours, coming to school under the influence of drugs or alcohol, fighting with other students, carrying guns or weapons, or any other conduct, which would bring discredit to the individual, other students, the community, or USA CDL Driving School Corp. PROBATION Students may be placed on six-week probationary period or may be dismissed. Students who have been suspended because of attendance may be reinstated at the discretion of the school. In the event that the student s training is suspended twice in a academic year, the student may be re-admitted and placed on probation. If another suspension occurs, the student will be dismissed permanently. For Free Evaluation Call Page 13

14 PROGRAM CDL 160 hour Tractor-Trailer Driver Program Program Objective This program is designed for individuals with no previous tractor-trailer driving experience. The program will prepare each student with the skills and knowledge required for successfully passing all aspects of the CDL Class A exam in both the written and skills portion of the examination and also be employable as an entry-level commercial tractor-trailer driver. The program will furnish students with an understanding of the equipment they will be using in the field, their responsibilities as commercial driver, and the trucking industry as a whole. Federal rules and regulations that govern the industry are major foundations of our program. This program is intended to supply OTR employers with certified drivers to fill the national job market s needs. USA CDL Driving School Corp. has adapted the Thompson Delmar Learning & JJ Keller Tractor-Trailer Handbook/Workbook textbooks for the curriculum outline. Both are designed with the cooperation of the Professional Truck Driver Institute and the Department of Transportation s Federal Highway Administration as described in their Proposed Minimum Standards for Training Tractor-Trailer Drivers. It is our belief that this curriculum offers the most complete and comprehensive material available and will be instrumental in the teaching of this program of study. 16 Course Descriptions UC160A00 CDL WRITTEN KNOWLEDGE (Preparation for CDL learners Permit) (.5 HRS) CDL Knowledge Preparation includes review of General Knowledge, Air Brakes, Combination Vehicle, Tanker, Doubles & Triples endorsements, and Hazardous Materials Certification. UC160A01 ORIENTATION (1 HR) Student will be given a familiarization and overview of training activities as well as introduction to school facilities, rules and regulations and all student documents will be verified. UC160A02 AN INTRODUCTION TO TRUCKING (1 HR) The purpose of this exercise is to introduce the student to the trucking industry as well as State and Federal rules and regulations under which the industry operates. UC160A03 DOT RULES AND REGULATIONS (FMCSR) (2 HRS) The purpose of this exercise is to introduce the student to the Federal Motor Carriers Safety Regulations handbook and how it relates to truck driving. (FMCSR) UC160A04 CONTROL SYSTEMS (2 HRS) The purpose of this exercise is to introduce the student to three basic types of control system used on a tractor-trailer and how they vary from those found on an automobile. UC160A05 HOURS OF SERVICE (LOG BOOKS) AND TRIP PLANNING (4 HRS) This exercise will introduce the student to the concept of documenting each 24-hour period and learn the requirements by FMCSR on how to keep a record of this time in a document called the Driver s Daily Log or Driver s Log Book. The Student will be introduced to the importance of trip planning. They will learn how to use a road map, estimate mileage from point to point, estimate fuel requirements for an identified trip, and personal financial needs for the trip. UC160A06 VEHICLE INSPECTIONS (2 HRS) The purpose of this exercise is to teach the student how to inspect the tractor-trailer correctly. The student will gain an understanding of the federal and state regulations for inspections, and the routine to use when inspecting a rig before, during and after each trip. UC160A07 SHIFTING TECHNIQUES (2 HRS) The purpose of this exercise is to teach the student correct procedures for shifting gears correctly. The students will be introduced to various shift patterns used on major transmissions. UC160A08 BACKING MANUEVERS (2 HRS) The purpose of this exercise is to teach the student correct procedures for backing a tractor-trailer. The student will be introduced to the steering principles that need to be mastered to correctly maneuver the tractor-trailer. For Free Evaluation Call Page 16

17 UC160A09 COUPLING AND UNCOUPLING (2 HRS) This exercise will explain to the student a detailed step-by-step sequence to couple a tractor to a trailer and to uncouple a tractor from a trailer. UC160A10 DEFENSIVE DRIVING (6 HR) The purpose of this exercise is to make the student aware of the necessity of knowing at all times what is going on around his or her vehicle. They will be introduced to skills in visual search, communication, night driving, extreme driving conditions, and procedures to take in case they come upon an accident or have an accident. UC160A11 PREVENTATIVE MAINTENANCE AND SERVICING (2 HR) The purpose of this exercise is to introduce the student to the different types and importance of performing regular preventive maintenance in order to achieve maximum safety while on the road. UC160A12 HANDLING CARGO AND CARGO DOCUMENTATION (4 HR) The purpose of this exercise is to introduce the student to the correct ways of handling cargo, the responsibility of the driver, and the responsibility of the carrier. They will also be introduced to the correct way to maintain proper documentation of the cargo. UC160A13 JOB PROCUREMENT (1.5 HR) The purpose of this exercise is to introduce the student to different sources available to find a job, how to fill out employment applications, and how to present him or herself for a job interview. UC160A20 VEHICLE INSPECTION PROCEDURES (12 HR) The purpose of this exercise is to give the student a demonstration of a vehicle inspection. The student will practice, perform, and demonstrate a vehicle inspection both verbally and hands on. UC160A21 BASIC VEHICLE CONTROL PROCEDURES (8 HR) The purpose of this exercise is to teach the student start up and warm up procedures prior to moving the vehicle. They will also learn to select the proper gear and learn how to release the clutch properly. They will also learn the importance of the engine cool down period prior to turning the vehicle off. UC160A22 COUPLING AND UNCOUPLING PROCEDURES (16 HR) The purpose of this exercise is to demonstrate the steps taken to couple and uncouple tractor-trailers. They will practice, and demonstrate a proper coupling and uncoupling of a tractor-trailer. UC160A23 BACKING MANEUVERS SKILLS (45 HR) The purpose of this exercise is to teach the student the skills necessary to properly setup and back a tractor-trailer. They will practice and demonstrate proper vehicle setup, straight-line backing, stop line, parallel parking, alley parking and measured right turns in a variety of different situations. 18 UC160A24 ROAD DRIVING SKILLS (45 HR) The purpose of this exercise is to teach the student the skills necessary to operate a tractor-trailer safely, clutch operation, up shifting, and down shifting, driving techniques in rural, urban, expressway, and interstate highways, mirror and scanning techniques, right and left turns from single and multiple lane roads, safe passing techniques and lane changing, highway entering techniques, speed and space management, railroad crossings, braking techniques, starting on grades, and driving techniques from different weather conditions. UC160A25 CDL SKILLS & ROAD TEST CERTIFICATION (2 HR) The student will be given a two-hour CDL certification test upon successful completion of the program of study. The school will issue a certificate waiver that must be taken to the Department of Motor Vehicles for processing. *Course number systems are based on the database assignment code number (CU160A) for the Industry Standard Tractor Trailer 160 Hour Certified Program; the last two digits identify the course s subject matter. 19 CANCELLATION AND REFUND POLICY Should a student be terminated or cancelled for any reason, all refunds will be made according to the following refund outline: 1. Cancellation must be made in writing either in person or by certified mail to the attention of Student Services. 2. All monies will be refunded if the school does not accept the applicant or if the student cancels within three (3) business days after signing the Enrollment Agreement and making the initial payment. 3. Cancellation after the third (3 rd ) business day, but before the first day of class will result in a refund of all monies paid with the exception of the $ Registration Fee. 4. Cancellation after attendance has begun, but prior to 50% completion of the program, will result in a pro-rated refund computed on the number of clock hours attended to the total scheduled program clock hours plus the $ Registration Fee. 5. Cancellation after completing 50% of the program clock hours will result in no refund. 6. Termination Date: The termination date for refund computation purposes is the last day of actual attendance by the student unless earlier written notice is received. 7. All refunds will be made within 30 days of termination date or receipt of written cancellation notice. 8. Student training must be completed within one (1) year from the date of the Enrollment Agreement. All students rights are protected for the full period of the one (1) year completion time allowed. Full tuition payment entitles you to attend school in the time allowed and during any authorized program extension. Other student rights, (including the right to cancel your enrollment), cease upon expiration of the completion time allowed for your program. PROCEDURE FOR COLLECTING MONEY OWED AND FOR DELINQUENCY 1. The student will be contacted by the financial aid department and be advised of the money owed or delinquency status. 2. A return receipt requested letter would be sent to the student s mailing address advising the student of his/her status and legal action that may be taken against him/her. 3. If no contact with the student is made or no reply is received within three (3) business days, the student will be referred to a collection agency. INSTITUTION POLICY FOR SCHOOL CLOSURE In the case of closure by USA CDL Driving School Corp., all enrolled students will complete their program of study in a timely manner.
