3 Direct Payments A Direct Payment is an amount of money allocated by a CCG, or other commissioners of NHS services, which is paid directly to individuals (or their representative) to allow them to purchase the health care they need. A Direct Payment can be spent on a broad range of things that will enable the person to meet their health and wellbeing needs. A Direct Payment may only be spent on services agreed in the care plan. A Direct Payment can not be spent on:- Primary medical services provided by GPS Surgical procedures Unplanned emergency treatments NHS prescriptions To purchase alcohol Gambling
4 Receiving a Direct Payment Direct Payments must be paid into a separate bank account used solely for that purpose. It can be paid into the same account as another Personal Budget a person may have, for example their Direct Payment for social care. The Direct Payment can be received and managed by the person who gives their consent, or that person can identify a nominee to receive and manage it for them. Where a person lacks the capacity to consent, DP can be given to their authorised representative, if they consent to receiving the payment on the person s behalf. In the case of children, DP can be received by their parents or those with parental responsibility for that child. The Direct Payment can be paid to an organisation who will hold the funds in a Managed Account. The person still has full control but the organisation can make payments on behalf of the person and keep financial records.
5 Responsibilities To choose support that meets their needs. To meet financial responsibilities to staff, agencies, HMRC etc. To be accountable for use of public money, by keeping appropriate records of the spending. To meet legal and contractual responsibilities as an employer or agency user.
6 ILS Support If the person is receiving a Direct Payment the Independent Living Scheme can support:- By holding the Direct Payment in our Managed Account To recruit and manage Personal Assistants Manage the payment of Personal Assistants To contract with a support / care agency Individuals can pick and mix from the above list of support services.
7 Employer support Our Independent Living Advisers can provide information and support to recruit and manage Personal Assistants. This includes support to: Recruit Personal Assistants (PAs) Contract with staff Manage staff Information on good employment practices The Independent Living Advisers also offer: One-to-one advice on Direct Payments Support to identify and express the persons support needs Support to liaise with their local CCG and other appropriate organisations
8 Payroll Service When people are employing their own Personal Assistant(s) it is their responsibility to ensure that the correct amount of tax and national insurance is deducted from each of their employee's wages and paid over to the HMRC. The ILS payroll service can do this and a whole lot more: Processing of Timesheets and calculation of Wages. Production of Payslips and Statements. Electronic payment of Wages via BACS. Registering the person as an Employer with the HMRC. Quarterly returns of Tax and National Insurance to HMRC. Electronic End of year returns to HMRC (e-filing). Provide ongoing Information and Support.
9 Managed Bank Account The Direct Payment has to be paid into a designated bank account. For people who have difficulty in opening and/or managing a bank account, or just do not want the added responsibility of managing the paperwork directly, the money can be paid to ILS. The person still retains all the control and choice. ILS Managed Account means that we will:- Operate a bank account on the persons behalf. Maintain a record of the bank account for financial audits. Maintain a record of how the money has been spent. Make salary payments to their Personal Assistants or preferred care provider. Maintain a record and make payments to the Inland Revenue on the persons behalf.
10 Contracting with an agency The Independent Living Scheme can provide support when contracting with a support agency by: Supplying information on local agencies Arranging initial meetings with agencies Support with drawing up a contract with the agency Make payments to the agency (if you have an ILS Managed Account)
