1 WROCŁAW WATER PARK RECREATIONAL ZONE RULES AND REGULATIONS THE BATHING COMPLEX IS MANAGED BY WROCŁAWSKI PARK WODNY S.A. WITH ITS REGISTERED OFFICE AT WROCŁAW, UL. BOROWSKA 99 THE FACILITY OPENING HOURS ARE AVAILABLE IN THE CURRENT OFFER 1. GENERAL TERMS AND CONDITIONS 1. The WWP S.A. Facility is defined as the building and adjacent lands managed by Wrocławski Park Wodny S.A. The recreational part of the Facility (hereinafter also referred to as the Bathing complex), comprises the external and internal pool zones, water slides, the wave pool and the swimming pool. 2. The user must have a valid admission ticket purchased on the day of admission or a valid pass. The user receives a transponder activated by the cashier for the amount equivalent to the service sold. It should be attached to the wrist and produced whenever required by WPW S.A. staff or other authorised persons. 3. A single ticket is valid on the day of purchase and entitles the user to a single use of the swimming pool. By purchasing a ticket, a pass or by presenting an entry card accepted by WWP S.A. that entitles the user to use the services of WWP S.A., the user confirms that he/she is familiar with the Terms and Conditions applicable throughout the WWP S.A. Facility. 4. Wrocław Water Park reserves the right to modify prices. Current prices are listed on the price lists located over the cash desks and on the cash desk counters. 5. Each admission ticket has an internal cash limit loaded onto the transponder. This limit enables the purchase of food and drink, as well as paid attractions on the premises of the Wrocław Water Park. Information terminals located throughout the pool areas let the users check the remaining cash limit on their transponders. 6. It is only possible to enter the premises of the Wrocław Water Park upon the presentation of an active transponder issued by the cashier. This does not include the areas before the cash desks and the external food&drink area. This rule does not apply to persons who have special authorisation from WPW S.A. Any person entering the pool area without authorisation or illegally using paid services shall be removed from the Wrocław Water Park premises and shall be held responsible in accordance with applicable law. 7. Admission tickets sold and payments made for used WPW S.A. services are non-refundable. 8. Staying in and around the locker rooms is only allowed for the purpose of changing. 9. The users of the pools and the Saunarium are obligated to wear the transponder on the wrist throughout their stay in these areas and to take good care to appropriately lock the clothes locker and to appropriately store the safe deposit box keys. Money, jewellery and other valuables must be left in safe lockers provided for this purpose. 10. The following sums must be paid by the user if he/she loses a transponder/safe deposit key: 1) regular price transponder 220 PLN, 2) concession price transponder 120 PLN, 3) child price transponder 40 PLN, 4) safe deposit box key 120 PLN.

2 11. The charge for lost towels and dressing gowns belonging to WWP shall be covered by the deposit paid upon their rental. 12. Each user shall take individual care of the transponder received at the entrance. 13. It is forbidden to transfer or lend the transponder to any third person. 14. In the case of questioning the liability to pay the price of goods and services or claiming that such goods and services were not used by the user, appropriate evidence shall be collected. 15. The recreation-entertainment areas, saunas and external grounds should be vacated no later than 20 minutes before the facility closing time, regardless of the time of purchase of the admission ticket. The Wrocław Water Park building should be vacated when the closing time arrives. 2. CIVIL RESPONSIBILITY 1. Wrocławski Park Wodny S.A. bears no responsibility for accidents resulting from circumstances outside its control, random incidents and deficiencies that were not noticed despite appropriate care for the state of the facility. 2. Wrocławski Park Wodny S.A. bears no responsibility for the loss, destruction or damage by any third person of items brought into the facility by the visitors. 3. The user is responsible for any damage resulting from inappropriate use of the facility and the devices on its premises or any damage caused by inappropriate conduct while using the devices in the pool. Parents and legal guardians bear full responsibility for persons under their care and for potential damage caused by their charges. 4. Accidents and damage should immediately be reported to the Wrocławski Park Wodny S.A. staff. Should the user fail to do so, he/she loses the right to claim any relevant compensation. 5. Before using any WPW S.A. services, the users are obligated to place all their belongings in the locker located in the locker room and to close the locker properly using the transponder. 3. GENERAL PROVISIONS CONCERNING BEHAVIOUR AT THE INTERNAL AND EXTERNAL POOLS, WATER SLIDES, THE WAVE POOL AND THE COMPETITION POOL 1. Users of the recreational zone (hereinafter also referred to as the bathing complex), which consists of the external and internal pool zones, water slides, the wave pool and the 25m swimming pool, who violate public order, good manners, pose a threat to the users of the facility, as well as persons who do not keep to the provisions of the Rules and Regulations, instructions, and orders of the WPW S.A. staff may be removed from the facility with no right to admission ticket/pass price refund. Such behaviour might also lead to taking appropriate legal action. 1a. WWP S.A. can temporarily or permanently ban those who repeatedly violate the provisions of the Regulations from entering the premises of the Wrocław Water Park S.A. The introduction of the aforementioned ban will be preceded by a warning given by a WWP S.A. employee or staff member. 2. People under the influence of alcohol, narcotic substances or any other similar substances have no access to the bathing complex. It is strictly forbidden to sell, serve, bring from the outside and use alcoholic beverages, narcotic substances and any similar substances.

3 3. In justified cases, the facility staff shall have the right to perform a sobriety test on the users of the bathing complex or persons willing to use the bathing complex. Refusal to undergo a sobriety test by the user is equivalent to that user being considered under the influence of alcohol. 4. The use of the facility locker rooms and the lockers is obligatory. As the locker rooms are CCTV monitored, users should change in the designated cabins. 5. After leaving the locker room and before entering the pool or the sauna, the user is obligated to take a cleansing bath/shower using appropriate cosmetics or personal cleaning products. Using bathing cosmetics outside the designated shower cabins is forbidden. The user is obligated to use the shower when passing from the green areas to the external pools. 6. Users of the bathing complex are obligated to move around barefoot or wearing appropriate bathing footwear in all areas where this is required, i.e. locker rooms, showers, the Saunarium, Wellness Day Spa and pool zones, as well as the external pool. When using the bathing complex, the user is obligated to wear a bathing suit (except for the Saunarium zone and special rooms). 7. Classes on the premises of the bathing complex can only take place in the presence and under the supervision of swimming instructors (or instructors of other disciplines) employed at or authorized by WPW S.A., as well as lifeguards employed at WPW S.A. A swimming group can include a maximum of 15 members per one instructor. 8. It is forbidden to act in a way that could jeopardize safety or disturb peace and order. This includes, in particular: 1) bringing into the bathing complex any dangerous items, such as, in particular: glass containers, pressure containers (including deodorants, hair lacquers etc.), knives and other sharp items. Such items should be left in the lockers, in the locker room or in the safe deposit box, 2) jumping into the pool, unless doing so in designated areas and having obtained prior consent from the lifeguard, 3) hanging on to/from the ladders, bars, lines, 4) running, 5) swimming under water and diving under water slide exits, 6) pushing and throwing other persons into the pool, 7) using rescue equipment for purposes other than rescue, 8) using easily-breakable glass containers, 9) consuming food and drink brought from the outside of the facility, 10) engaging in ball games and exercises outside areas designated by signs or by WWP staff on duty, 11) bringing musical instruments, music players, TVs, binoculars, 12) throwing anything into the water and polluting the water in any other way. 9. It is forbidden to use clothing and items that are inadequate for use at the bathing complex, clearly soiled or items that could chemically react with water. 10. The bathing complex can be used by anyone, apart from persons suffering from infectious diseases (in accordance with the regulations on preventing and combating human infections and infectious diseases), skin diseases, visible open wounds (excluding minor cuts), as well as persons under the influence of medicine, drugs and narcotic substances. In doubtful cases, the user is required to produce a certificate, based on which the facility manager shall decide whether to allow the user into the facility.

Persons with a tendency to suffer from cramps, faint, undergo epileptic fits and circulatory system disorders may use the bathing complex only when accompanied by a carer, who is obligated to report to the facility staff/management any symptoms of the person they are accompanying. 12. Organized groups consisting of children and youth under 12 years of age must have at least two adult supervisors per each 10 group members and at least one adult supervisor per each additional started group of 10 members. The supervisor is responsible for the members of his/her group throughout their stay at the Wrocław Water Park. 13. After entering the bathing complex, the supervisor and his/her group are obligated to contact the lifeguard shift supervisor in order to agree the rules concerning the use of the bathing complex by the organized group and to undergo a quick training. Organized group supervisors must wear bathing or sport suits. 14. Children under 12 years of age and persons who cannot move, undress and change without the help of another person may use the pool only when accompanied by an adult. When the cashier suspects a child is under 12, he/she is obligated to verify the child's date of birth based on a picture ID. 15. Children under 3 must wear disposable nappies designed for bathing; other persons using nappies are obligated to have disposable nappies designed for bathing. 16. No baby prams are allowed into the bathing complex. 17. WPW S.A. bears no responsibility for potential damage to bathing suits caused when using the attractions, the water slides and the pipes in particular. 18. The lifeguards, taking into consideration the number of users, shall decide about the possibility of using balls, inflatable mattresses, any swimming aids, flippers, snorkels, goggles etc. at all pools. 19. Bringing and using one's own sport and recreational equipment at the facility premises is only allowed following prior consent from WWP staff. 20. Glasses and contact lenses are worn at the users' own risk. Any broken or cracked corrective glasses should be reported to the lifeguard by their user. 21. The 25m long swimming pool is intended for use only by persons who can swim, excluding persons taking part in physical exercise classes conducted under the supervision of the Wrocław Water Park instructors and lifeguards. One exception is the lane with the shallowing platform. 22. Using the pools and other water attractions is equivalent to the user declaring he/she has appropriate swimming skills. 23. The users use the bathing complex together with the attractions, entertainment devices and sport equipment at their own risk. Wrocław Water Park makes all necessary efforts to maintain and guarantee safe use of the facility. When using the aforementioned devices, the users are obligated to follow any clearly displayed instructions. 24. During atmospheric discharges, it is forbidden to stay inside any of the following pool basins: external recreational pool, brine pool, lazy river, wave pool and the water slide complex, including the water slide tower. Permission to enter the aforementioned areas shall be communicated in a separate announcement. WPW S.A. bears no responsibility for any inconvenience caused by the weather, and no admission ticket/pass price refund shall be offered in such cases.

5 4. USING THE WATER SLIDES 1. Users of the water slides use them on their own responsibility and at their own risk (the water slides are areas of elevated accident risk). 2. The Wrocław Water Park bears no responsibility for accidents that happen at the water slides caused by violating the provisions of the Rules and Regulations or instructions. 3. Water slides can only be used by persons who can swim. Two exceptions are the family slide and the children slide, which can also be used by children who can't swim, as long as they are accompanied by an adult. 4. Water slides should not be used by persons with reduced mobility and heart disease. 5. When using the water slides, users should observe the instructions from the lifeguards on duty at all times. 6. There are slides with three difficulty levels at the Wrocław Water Park: easy, medium and difficult. 7. Each water slide is marked with an appropriate colour denoting its difficulty level. 8. Users of the water slides should bear in mind the following limitations concerning age, health, weight and height: - Turbo slide, yellow colour, difficult: min. 12 y/o; min. 150cm tall; - Skocznia (Jump) slide, difficult: min. 12 y/o, max. 120kg; min. 150cm tall; - Black Hole slide, blue colour, medium: min. 8 y/o; min. 130cm tall; - Magic Eye slide, orange colour, medium: min. 8 y/o, only with a dinghy; min. 130cm tall; - Multimedia slide, red colour, difficult, min. 12 y/o, min. 150cm tall, max. 120kg, slide can only be used by persons who can swim; - Rodzinna (Family) slide, blue colour, easy: min. 3 y/o; - Dziecięca (Children) slide, silver colour, easy: max. 8 y/o. 9. Only one person at a time can stand on the starting platform of each water slide. 10. Only one person can slide down at a time, except for the family slide and the shared dinghies on the Magic Eye slide. 11. Before setting off, the user must make sure that there is water in the slide pipe. Sliding down when there is no water is forbidden. - on the Turbo, Skocznia (Jump) Multimedia and Black Hole slides, users can only set off when the green light goes on; red light means sliding down is strictly forbidden; - on the Magic Eye slide, users can only set off when the previous user disappears from the sight of the following user an interval of at least 30 seconds is obligatory (the principle of maintaining safe distance between the slide users); - on the Rodzinna (Family) and Dziecięca (Children) slides, users can only set off when the previous user leaves the landing zone visible from the top of the slide. 12. Before setting off, users should calmly climb the starting platform. 13. The use of the multimedia slide is paid additionally, according to the current WWP S.A. price list. The charge is registered upon turning the turnstile unlocked with the transponder. 14. After climbing the starting platform, users should assume the correct starting position (sit with their legs directed forward or lie on their back in the slide, with legs directed forward). Users should slide down in a lying or semi-sitting position.

6 15. In order to begin the slide, the user should push off from the side walls of the water slide or from the starting bar. Users should slide down freely, not stopping inside the water slide pipe. 16. While sliding in the Magic Eye and Black Hole slides, the user should constantly be watching the part of the pipe in front of his/her legs, in order to be able to slow down and avoid crashing into the previous user. 17. Users must leave the landing zone immediately after reaching it. 18. Users of the multimedia slide must leave the landing zone and move to the lazy river immediately after finishing the slide. 19. Any slide defects noticed during the ride should immediately be reported to the WWP lifeguard on duty. 20. Stopping during the ride is strictly forbidden. 21. Corrective glasses, swimming goggles, diving masks, watches, chains, earrings and other similar items must be removed prior to using the slide. 22. Slide users should not behave in a way that could pose a threat to themselves or any other slide users. This includes, in particular: - running on the stairs of the water slide tower, pushing other users on the starting platform and forcing other users to begin the slide, - using the water slides in case of a defect of the light signals, the water slide pipe or other technical defects, lack of water in the slide; - sliding in groups, - sliding in a position other than sitting or lying on the back with the legs directed forward, - running into the water slide in order to increase slide speed, - using the water slides by users who consumed alcohol, drugs or psychoactive medicine. - using swimming boards, rings or any other items (except for the dinghies) on the Magic Eye slide; 5. USING THE WAVE POOL 1. Users of the wave pool use it on their own responsibility and at their own risk (the wave pool is an area of elevated accident risk). 2. The initiation of artificial waves is signalled by the lifeguard on duty one minute prior to the beginning. 3. The maximum wave height is 0.7m 4. Access and use of the wave pool is only available from the beach side. 5. The wave pool consists of a zone for users who cannot swim, as well as a zone for users who can swim. The border between these zones is marked with a line with yellow buoys. 6. Children under 12 cannot use the wave pool if not accompanied by an adult. 7. Users should not be anywhere near the walls of the pool during the initiation of the waves. 8. Users of the wave pool are obligated to observe the instructions from the lifeguards.

7 6. SEPARATE PROVISIONS ON THE USE OF THE COMPETITION POOL 1. Information on swimming lane reservation is available at the cash desk or over the phone. 2. Using the competition pool is only allowed to users who can swim (at least one length of the pool with no assistance or supporting devices) or persons taking part in physical exercise classes conducted under the supervision of the Wrocław Water Park instructors and lifeguards. 3. Access to the pool is only allowed to persons over 5 years old, while children between 5 and 12 y/o can only use the pool when accompanied by an adult or a swimming class instructor. 4. Classes at the competition pool are organized in groups in accordance with the set timetable. 5. A fully reserved swimming lane cannot be used by individual users. 6. Swimming lane reservation is available upon signing an appropriate agreement with The Wrocław Water Park. 7. A maximum number of swimmers in a single lane is 8. Purchasing 8 individual tickets is not equivalent to the reservation of an entire lane. The regulation above does not apply to organized classes conducted by The Wrocław Water Park employees. 8. Users of the competition pool should follow the right-hand traffic principle. Side lanes are for slow swimmers, while inner lanes are for fast swimmers. 9. Admission to the competition pool every hour on the hour. 7. All matters not regulated by the present Rules and Regulations shall be regulated by the provisions of the Wrocław Water Park Rules and Regulations.
