3 Ministerial Decree No. (820)of 2014 on Registration Terms for Student Minister of Education After perusal of: Federal Law No. (1) of the year 1972 regarding the competence of Ministries, powers of Ministers and its amendments. Federal Law No.(29) of the year 2006 on therightsof thedisabledas amended by Law No. (14) oftheyear2009. Federal Law by DecreeNo. (3) of the year 2007 on private education. Council of Ministers Resolution No. (24) of the year 2001 regarding regulations for the enrollment of children of expatriates in the levels of education and its amendments. Council of Ministers Resolution No. (185 /1) of the year 2001 on the approval of the reorganization of primary and lower secondary education and extension of compulsory years of education. Council of Ministers Resolution No. (29)of the year 2008 on the regulations of private education. Council of Ministers Resolution No. (22)of the year 2010 on the organizational structure of the Ministry of Education. Ministerial Decree No. (20 / 2) of the year 1996 on the terms and conditions of enrollment and acceptance of students in the government education schools and its amendments. Ministerial Decree No. (3481) of the year 2005 on the terms and conditions of admission to the model government schools. And in consideration of public interest, the following has been decided: 3

4 ARTICLE (1) DEFINITIONS In applying the provisions of the regulations below, the following terms and expressions have the meanings assigned to them unless the context requires otherwise: Country: United Arab Emirates Ministry: Ministry of Education Minister: Minister of Education Zone: The Educational Zone responsible for the management and supervision of the educational process in the Emirate. Educational Authorities: educational councils and committees, each within theirauthority School: Every government or private educational institution across the country from kindergarten to secondary education under the supervision of the Ministry or educational authorities. General Education Schools: Public schools governed by the Ministry and operates under its supervision and management. Local citizens: Holders of the UAE passports Children of Emirati mothers Whoever has a decree issued by His Highness the President of the UAE and his deputy to obtain the nationality of the State with a valid passport issued by their home country. Citizens of the Gulf Cooperation Council (GCC). Admission: Meeting student registration requirements needed for the target grade. Enrollment: A student entering one of the UAE s schools for the first time. Student Dismissal: Termination of student s registration in school. Delisting student s name: Termination of student s registration in school. Re-enrollment: Student re-enrolls into school. 4

5 Transfer: Student transfers from one school to another. Academic Year: The determined periodof time to start and end a school year according to a decree issued in this regard. Class density: Number of students in the classroom. Kindergarten: First stage in education, which consists of two years prior to basic education. Basic Education: Includes grades one through nine, and comprised of Cycles 1 & 2. Secondary Education: Includes grades ten through twelve. Adult Education Center: An educational institution that provides education for a specific group of students under the management and supervision of the Ministry of Education. Home Schooling: a system that allows a registered student in any public educational institution which adopts this system to sit for examinations as per the policy of the Ministry regardless of regular attendance. Compulsory education: the levels of education through which a child s guardian is bound to enroll the child in school. Compulsory Education Age: the age determined by law and resolutions issued thereunder. Absence: student s not attending school for one school day or one period or more. Educational Committee: a committee of the school board entrusted with the discussion of students educational and behavioral problems. Commissioned Medical Authorities: includes Ministry of Health- Public Medical Authorities in the UAE. 5

6 Article (2) Scope of Implementation of Terms and Conditions Provisions of these terms and conditions apply topublic and private schools, taking into account any rules or regulations or special conditions issued by the Ministry of Education within the limits stipulated in this document. Article (3) Compulsory Education Education is compulsory for both males and females in accordance with the provisions of the applicable law in this regard and resolutions issued thereunder. Article (4) Age of Student Acceptance 1. A student is accepted in the first year of kindergarten if he/she completes four years of age before the 31st of December of the year in which they have been accepted. 2. A student is accepted in grade one of basic education if he/she has completed six years of age and doesnot exceed the age of eight by the 31st of December of the year in which they have been accepted. 3. In private schools whose academic year starts in the month of April, 31st of July is the date considered to calculate the completion of student age for the target grade. 4. The Ministry of Education in accordance with the regulations in place to this regard, will determine the grade level for registration of those students who did not obtain school certificates, or were not enrolled in the grades they were supposed to have completed prior to registration. 5. Assessment terms and conditions outlines matters related to student failure, promotion and maximum age of each grade level and circumstances in which similar exceptions might be made. 6

7 Article (5) Registration Dates School registration for newly attending students extends from the period of March 1st to the end of April of the academic year the student is due to attend. Education Zone Director/Education Authoritiesare commissioned to exempt students from the mentioned dates until the beginning of the academic year for the benefit of students. Article (6) Registration of the Disabled Registration of the disabled is in accordance with the procedures, conditions and dates mentioned in the inclusion programs issued by the Ministry. Article (7) General Rules for Registration 1. Reside in the country with a valid residence visa for expatriates. 2. Meet age requirement for grade registration. 3. Register as per the set dates. 4. Meet any other required conditions by the Ministry. 5. Submit registration documents. 7

8 Article (8) Registration Categories in Public Schools 1. Registration in public schools is open for the following categories: a. Emiratis and children of Emirati mothers and those of a similar status. b. Children of workers in the diplomatic career and Arab Organisations holding diplomat cards issued by the Ministry of Foreign Affairs in the UAE. c. Children of expatriates provided their registration in public schools is subject to the resolutions and policies issued by the UAE. 2. Registration in public Kindergartens is for Emiratis and children of Emirati mothers only. Article (9) Registration of Learners in Adult Centres and Home Studies Learners in Adult Centres and Home Studies shall be registered in any of the public education institutions as per the standards and regulations issued by the Ministry of Education in this regard. Article (10) Registration Documents First: Study Certificates With the exception of registration in kindergarten and grade one in Cycle 1, it is mandatory to submit the following study certificates: 1. Pass certificate of the last grade level in any of the following grades (Grade 2 to Grade 12). 2. Pass certificate for the last two grades for registration in Grade 11 and Grade Transfer document for students applying for registration during the academic year. 8

9 Second: Evidence and Required Documents For student registration, it is mandatory to submit the original copies of the following documents: 1. Student identity card. 2. Diplomat ID (for children of diplomats). 3. Applicant s birth certificate. 4. Immunization certificate. 5. Applicant s valid passport. 6. Family book (for Emiratis). 7. Mother s family book Log (children of Emirati mothers). 8. Father s valid passport. 9. Documents and evidence should the guardian be other than the father. 10. Valid residence visa (expat students). 11. Recent student photo (4 cm x 6 cm). 12. A copy of the decree issued in the name of His Highness the President or his Deputy for decree holders. Third: Conditions of Registration Documents 1. All certificates and documents must be formally attested. 2. Study certificates and documents issued abroad must be attested by the Ministry of Education, or relevant authority; the Ministry of Foreign Affairs; the UAE embassy in the issuing country. 3. Certificate and documents of the GCC citizens issued by these countries need to be attested by issuing Ministry/Authority in the GCC countries. Article (11) Registration Procedures 1. The parent requests registration for student, and completes the necessary school registration forms. 2. The parent will receive the submission receipt and the required attachments. 3. The submission of application and its attachments will not be considered as a final registration until it is approved by the concerned zone or educational authority. 4. The school is obligated to respond within a week of submission of registration forms if the application has been accepted or rejected. 5. The school is obligated to determine whether the application of registration should be accepted or rejected within a week at the latest from the date of receiving it. The school should providejustifiable reasons for any rejection. 9

10 Article (12) Registration Log 1. Every school should register all accepted students in their registration log as per the system approved by the Ministry/Education Authority. 2. Every school is obliged to provide the Education Zone/authority with the registration log for revision and approvaltwo weeks prior to the beginning of the academic year. 3. Every school is obliged to advise the Education Zone/authority of any changes in the registration log throughout the academic year. 4. The Education Zone /authority will follow up on the implementation of procedures with regard to student registration in the schools under their administration. Article (13) Rules to Enrol Emirati Students in Public Education Schools 1. Emirati students and those who are considered so can enroll in the nearest kindergarten or school as per the geographical distribution of residential areas as approved by the concerned education zone or authority. 2. Should the parent desire to enroll his child in a school located outsideof the geographical distribution area of their residence, the class density in this particular school mustaccommodatethe student and the students living close to the school are given first priority. This exception should be accompanied with a written approval on behalf of the parent stating that he will provide private transportation for his child. Article (14) Continuation of the Obligatory Education Stage The student s parent must write a personal commitment to the school on the provided form stating that he is aware of the rules of the Obligatory Education Law and any other resolutions issued in this regard and will undertake sending his child to school during this Obligatory Education Stage. Should he decide otherwise, he will be liable for all consequences and penalties as stated in the relevant rules and regulations. 10

11 Article (15) Behavioral Discipline Every school is required to inform the student and his parentsof the rules and code of conduct issued by the Ministry/Education Authority and will update them with any alterations in this regard. Article (16) Transfer 1. Student transfer from one school to another within the country or abroad is subject to the parent s desire and as per the following conditions: a) The school that the students are being transferred to must be able to accommodate transferees within the country. b) Transfer should take place in the first month of the academic year if the school transferred to adopt the same curriculum. c) Transfer should take place within two weeks from the beginning of the academic year in case the school implements another curriculum. The student should be registered in a grade level that permits him to transfer to another curriculum within the framework of the rules and regulations of certification equivalencies. d) Students transferring from outside of the country must be enrolled in his/her current school and cannot have been absent more than a month. e) Student who gets married shall be transferred to an adult education center. 2. The zone director/education authority is commissioned to exempt certain cases from the set dates for transfer throughout the academic year for the benefit of the student. 11

12 Article 17 Attendance and Absence The school administration assumes the responsibility of recording daily attendance of registered students for each session. A student is considered absent in the case that (s)he is absent from one or more sessions in a period of one day. Article 18 Excused Absence Absence is considered excused in the following cases: 1. Illness that is documented by a doctor s report certified by official medical authorities. 2. Travel outside the UAE for the purpose of accompanying a relative of first degree relation during medical treatment under condition of proof (via an official accredited certificate) for a period not exceeding one month during the academic year, extendable through permission of the director of the educational zone or authorized educational authority. Evidence of being outside the country must be testified by the UAE s embassy in that country. 3. Official and patriotic duties assigned to the student. 4. Appearance before official organizations or associations under condition of proof via official documentation. 5. Death of a relative (of first and second degree relation) for a maximum period of three days. 6. Absence for a period of a day or two consecutive days up to a maximum of five days during an academic year for reasons accepted by the school administration. 12

13 Article 19 Student Suspension/Expulsion Students can be expelled from school in the following cases: 1. Unexcused absence exceeding ten consecutive days or fifteen inconsecutive days during the academic year. Prior to expulsion the student must receive three official warnings at a rate of one warning for each three days of absence. 2. Based on recommendation of a school based educational committee with the approval of the Education Zone or other Educational Authority. 3. Final conviction against the student for a felony or misdemeanor concerning honor or honesty. In any of the circumstances, the school principal recommends expulsion, the Educational Zone Administration / Educational Authority endorses it,and the parents/guradians are notified. Article 20 Deactivation of Student Records The official record of a student shall be removed from school lists in the following cases: 1. The student is expelled from the school as per article Death of the student. 3. The school receives an official transfer certificate to another country. 13

14 Article 21 Reinstatement of Student Records 1. The Educational Zone or any other official educational authority is authorized to reinstate a student s records under the following circumstances: 2. The student was notterminated for disciplinary reasons according to behavior policy issued by the Ministry. 3. The student was not terminated for any reason involving conviction of felony or misdemeanor of honor or honesty. 4. The student was not reinstated in the same academic year. 5. A discontinuance of the student s studies has not exceeded two consecutive academic years. 6. Student age does not exceed maximum age restrictions per grade at time of reinstatement. 7. Any student not meeting the above criteria for reinstatement is referred for home schooling or adult education centers according to rules and regulations issued by the Ministry and concerning such issues. Article 22 All schools, Educational Zones/Educational Authorities must abide by the use of forms, records and regulations regarding student registration issued by the Ministry. Article 23 Ministry Decree and adjustments of decree (20/2) for year 1996 are annulled. All decrees and decisions opposing or conflicting subject matter of this document are deemed redundant.
