4 legal trends Seattle law 2013 From mandating new employee health benefits to pioneering recreational marijuana laws, the Evergreen State continues to set a precedent for progressive social policy. RULES PROPOSED FOR BUDDING RECREATIONAL POT INDUSTRY In November 2012, Washington voters passed Initiative 502 allowing adults over 21 to possess up to one ounce of marijuana for recreational use. U.S. Attorney General Eric Holder announced in August that the Department of Justice would not interfere with voter-approved legislation. As supervisors in individual cities and counties scramble to figure out their authority to regulate marijuana use, one state agency has leapt into the fray: the State Liquor Control Board proposed rules in September for producing, processing and retailing recreational marijuana. Chief among the Board s recommendations is the number of licensed dispensaries or retail locations allocated to each county and city. A total of 334 licenses will be issued, apportioned on anticipated demand, geography, and population density. King County will be allotted 61 stores, a third of which will be located in Seattle. The proposed regulations would also restrict the size of growing facilities and place caps on total state production at 40 metric tons. These directives, along with restrictions on the number of production and retail licenses a single business entity can hold, aim to prevent a few large groups from monopolizing the industry. In establishing a new system, lawmakers are faced with the challenge of striking a delicate balance: The supply of marijuana must meet customer demand without producing a surplus that could result in state-sanctioned growers looking for customers in bordering states. This is a shot in the dark, Liquor Control Board s deputy director Randy Simmons told The Los Angeles Times. Trying to exactly determine market forces in a market that doesn t exist is not easy. As for safety and preventative measures, the rulebook includes mandates for child-resistant packaging and the establishment of serving sizes. It also includes and a 1,000-foot buffer zone between public locations, such as schools and parks, and marijuana production facilities or retail stores. 4 Seattle s top rated lawyers \ An Annual Check-Up on Seattle s Paid Sick-Leave Thanks to a year-old law mandating paid sick-leave, Seattle workers are enjoying expanded health benefits without, studies suggest, a negative impact on the local economy. Under the law passed last September, workers at Seattle-based companies with four or more employees are entitled to paid time off to use for the healthcare needs of themselves or members of their families. Both San Francisco and Washington, D.C., have had similar ordinances in place since Paid sick leave laws in New York City and Portland, Ore., take effect after in Critics feared that the benefits would strain business owners, compelling them to reduce employee hours, decrease hiring, or move operations outside of the city. But the non-profit Economic Opportunity Institute s initial data from King County showed no adverse effect on sales or job growth. In fact, job growth in the county was even stronger after the ordinance was passed. The addition of more than 10,000 new jobs in retail and food service during the first seven months of 2013 outpaced numbers from that same time period in The report does not include data this is city-specific, but it notes that more than 40% of the jobs in King County are based in Seattle. Two more studies revealed a somewhat mixed reception from employers. A preliminary report by the Employment Policies Institute found that employers were still concerned about the future costs of the mandate. Another survey by the University of Washington showed that a majority of employers understood how to comply with the law and were adjusting their current policies to accommodate the new provisions. NEW DUI BILL INTRODUCED Washington has a drinking-and-driving problem and the statistics are sobering. In 2011 alone, 34% of total driving fatalities there involved alcohol-impaired drivers. makers are hoping that a more aggressive crackdown on repeat offenders will help change that. This spring saw a pair of particularly gruesome, highly-publicized crashes including one that involved a drunk driver hitting a Seattle family in a crosswalk. In response, legislators passed Senate Bill 5912, which takes aim keeping impaired drivers off the road. Provisions of the bill, signed into law in July, include mandatory jail time for second-time offenders and the installation of an ignition interlock device in the cars of repeat offenders. The devices can gauge the blood-alcohol content of the driver and effectively disable the vehicle. Another measure helps city officials enforce terms of probation. In August, members of the family injured in the crosswalk accident filed a $45 million suit against the city of Seattle for failing to properly monitor the five-time DUI offender who hit them. The new bill introduces a pilot program that uses technology to electronically monitor the sobriety of repeat offenders. Violators of the program would serve six months in jail. Still, a number of legislators say the provisions of what was purported to be an extremely aggressive and comprehensive reform don t go far enough. It s a huge disappointment, State Rep. Brad Klippert told The Seattle Times. It s obviously very different than what we have been talking about. Absent from the law is one of its original centerpieces: A condition would have charged offenders with a felony after their third DUI in ten years, rather than after their fifth offense. According to lawmakers, the provision would cost up to $300 million over the next three years, proof - for approval only michael r. Jay Inslee told The Times. It s going to cut down on impaired driving in this state, and you can t walk away from something like that just because it s not everything. It s too important an issue to do that. SOCIAL MEDIA PRIVACY LAW Issues still loom over Facebook s privacy policy, but the social networking profiles of employees in Washington are now safe from at least one set of prying eyes: their bosses. A new social media privacy law that went into effect this July bars employers from requesting login information for current or prospective employees social networking websites, accounts, or profiles. Under the new statute, employers may not compel any employee to add a contact (including themselves) via a social network, or adjust their personal settings in a way that gives third parties more access to the content of their account. It also prohibits the practice know as shoulder-surfing, the practice of asking an employee to access their social media account in the presence of an employer. There are some limited exceptions. Employers may request access to employees social content in order to investigate allegations of misconduct or the leaking of company information. Yet, even in these cases, they cannot demand that an employee turn over their login information. We don t have to sacrifice our privacy for advances in technology, Democratic Sen.
