1 161 GOVERNMENT REGULATION of 28 April 2008 on the technical plan for the transition from terrestrial analogue television broadcasting to terrestrial digital television broadcasting (Government Regulation on the Technical Transition Plan) The Government orders the following, pursuant to Article II(1) of Act No 304/2007 amending certain laws in connection with the completion of the transition from terrestrial analogue television broadcasting to terrestrial digital television broadcasting, in order to implement Article II(1) of that Act: Section 1 Scope This Regulation shall apply to terrestrial analogue television broadcasting 1) and terrestrial digital television broadcasting at the standard. 2) For the purposes of this Regulation a ) b ) c ) d ) e ) Section 2 Definitions high-power transmitter shall mean a transmitter 3) providing terrestrial analogue television broadcasting 1) in the Czech Republic with a maximum effective radiated power (ERP max) equal to or greater than 30 dbw, low-power transmitter shall mean a transmitter 3) or television converter providing terrestrial analogue television broadcasting 1) in the Czech Republic with a maximum effective radiated power (ERP max) of less than 30 dbw, broadcasting network shall mean a public communications network consisting of digital transmitters, 3) digital multiplex shall mean the aggregate data flow containing partial data flows belonging to individual television or radio channels, services directly related to channels or additional services that are tailored to common transmission and subsequent distribution through the broadcasting network, simultaneous broadcasting shall mean the simultaneous distribution of terrestrial analogue television broadcasting and terrestrial digital television broadcasting of the same television channel in one geographical area, f) basic simultaneous broadcasting shall mean simultaneous broadcasting covering at least the territorial scope of broadcasting from an analogue high-power transmitter. Section 3 Definition of geographical areas The process of transition from terrestrial analogue television broadcasting to terrestrial digital television broadcasting (hereinafter referred to as transition process ) shall proceed in geographical areas that are defined by joining the vertex points of the respective polygon, or by the State borders of the Czech Republic. The breakdown of the Czech Republic into geographical areas, a specification of vertex points, and a graphic representation of geographical areas is set out in Annex 1 to this Regulation. Section 4 Basic conditions of transition (1) The scope of the geographical area covered by terrestrial digital television broadcasting shall be assessed according to the following planning parameters: a ) a modulation scheme comprising sixty-four quadrature amplitude modulation (64- QAM),

2 b ) c ) d ) an operating system with 6,817 carrier frequencies (8K) a convolution code indicating a 2/3 rate of transmission system security against error, a 1/4 guarding interval to ensure reception unimpeded by undesirable reflections. (2) Basic simultaneous broadcasting shall be ensured for the period specified in Annex 2 to this Regulation over the territorial scope of broadcasting covered by the high-power transmitters listed in Annex 3 to this Regulation. (3) A high-power transmitter referred to in Annex 3 to this Regulation may be switched off only if basic simultaneous broadcasting is safeguarded for at least six months, unless otherwise provided in this Regulation, and the information campaign lasts for at least three months prior to the time the transmitter is switched off. (4) Terrestrial analogue television broadcasting may be discontinued only if coverage of the relevant geographical area with terrestrial digital television broadcasting broadcast is ensured at least to the extent covered by the existing analogue terrestrial television broadcasting, and the information campaign lasts for at least three months prior to the date on which terrestrial analogue television broadcasting is to be discontinued as indicated in Annexes 3 to 5 to this Regulation. (5) The scope of coverage with terrestrial digital television broadcasting shall be ascertained by the operator 4) of the broadcasting network by means of a calculation or shall be verified by measurements in accordance with other legislation laying down the method for determining television broadcasting coverage. 5) (6) Where this Regulation specifies periods over which basic simultaneous broadcasting is to be provided before a high-power transmitter is switched off, or over which simultaneous broadcasting is to be provided before terrestrial analogue television broadcasting is discontinued, which are longer than the periods referred to in paragraphs (3) and (4), the transmitter may be switched off or the terrestrial analogue television broadcasting discontinued before the end of the periods listed in Annexes 2 to 5 to this Regulation. In this case, the operator of terrestrial analogue television broadcasting in the area which is covered by such broadcasting shall arrange an information campaign at its own expense. This provision shall not prejudice the conditions and periods set out in paragraphs (3) and (4). (7) Where Annex 2 to this Regulation does not specify a period of basic simultaneous broadcasting, the statutory television broadcaster or licensed television broadcaster may switch off a high-power transmitter if the radio channel thus vacated is immediately used for terrestrial digital television broadcasting after the transmitter is switched off. This shall not prejudice the duration of the information campaign referred to in paragraph (3). (8) The maximum usable values of the technical parameters of radio channels for the launch of terrestrial digital television broadcasting in the broadcasting network for the distribution of the public service multiplex (hereinafter referred to as broadcasting ) and in broadcasting networks 2 and 3 in the geographical areas are listed in Annex No 3 to this Regulation. Section 5 Broadcasting (1) Broadcasting Network 1 6) shall consist of the following radio channels: 29, 32, 33, 34, 36, 40, 43, 49, 53 and 54. (2) The radio channels, the launch dates of terrestrial digital television broadcasting, the period of basic simultaneous broadcasting, the dates for switching off the high-power transmitter and the dates for discontinuing terrestrial analogue television broadcasting in geographical areas for broadcasting are listed in Annex 2 to this Regulation. (3) A statutory broadcaster shall terminate terrestrial digital broadcasting which is not distributed in broadcasting, in the geographical areas of Prague, Ústí nad Labem, Plzeň or, in the Brno město part of the Brno geographical area no later than 30 September 2008, and in the Ostrava geographical area no later than 30 April.

3 Section 6 Other broadcasting networks for nationwide terrestrial digital television broadcasting The radio channels of broadcasting networks 2, 3 and 4, the dates for switching off high-power transmitters and the dates for discontinuing terrestrial analogue television broadcasting in geographical areas for broadcasting networks 2 and 3, and the launch dates of terrestrial digital television broadcasting for broadcasting networks 2, 3 and 4 are listed in Annex No 2 to this Regulation. Section 7 Provision of regional terrestrial digital television broadcasting (1) Broadcasting networks 2, 3 and 4 may be used also to distribute regional terrestrial digital television broadcasting. 7) Where broadcasting networks 2, 3 or 4 are used for the distribution of the channel of a broadcaster holding a licence granted under other legislation, 8) the broadcasting network shall be regarded as a broadcasting network facilitating regional terrestrial digital television broadcasting. (2) Regional terrestrial analogue television broadcasters holding a licence extended under other legislation, 9) whose regional terrestrial analogue television broadcasting is distributed on shared radio channels with a licensed nationwide terrestrial analogue television broadcaster, shall convert their regional terrestrial analogue television broadcasting to regional terrestrial digital television broadcasting in accordance with the procedure followed by the licensed nationwide terrestrial analogue television broadcaster no later than the date on which the terrestrial analogue television broadcasting is discontinued in the geographical area concerned. Section 8 Discontinuance of terrestrial analogue television broadcasting (1) Terrestrial analogue television broadcasting shall be discontinued in a geographical area in which terrestrial digital television broadcasting has been commenced in accordance with Annex 2 to this Regulation as follows: a ) b ) high-power transmitters shall be switched off or converted to terrestrial digital television broadcasting in accordance with paragraph (3) within the time limits and under the conditions set out in Annexes 3 and 4 to this Regulation, low-power transmitters shall be switched off or converted to terrestrial digital television broadcasting in accordance with paragraph (3) within the time limit under Section 9 and under the conditions set out in Annex 5 to this Regulation, This shall not prejudice the provisions of Section 4(4). (2) Where harmful interference 10) is caused to an allocated radio channel for terrestrial analogue television broadcasting by terrestrial digital broadcasting, the necessary technical measures shall be taken to eliminate or reduce such interference, including, without limitation, switching it off, changing the technical parameters or changing the radio channel of the low- or high-power transmitter, or reducing the power of the digital broadcasting transmitter. The transmitters in this case may be switched off earlier than the time laid down in Annexes 3 to 5 to this Regulation. (3) If, in the period of basic simultaneous broadcasting, the coverage of the geographical area with digital terrestrial television broadcasting distributed via a broadcasting network incorporating the channels a) of licensed broadcasters fails to reach at least the same value of territorial coverage recorded by terrestrial analogue television broadcasting, or b) of a statutory broadcaster fails to reach coverage of at least 95% of the population in the geographical area, the operator of the relevant broadcasting network shall use the radio channel assigned to the geographical area for transmitters at the sites in this area other than those listed in Annex 2 to this Regulation. Where an assigned radio channel cannot be used for such a solution, the broadcasting network operator shall proceed in accordance with paragraph (5). (4) In order to use a radio channel at sites other than those listed in Annex 3 to this Regulation, the broadcasting network operator shall apply to the Czech Telecommunications Office (hereinafter referred to as the Office ) to grant an individual authorization for the use of radio

4 frequencies so that the times of commencement and termination of basic simultaneous broadcasting and the discontinuance of terrestrial analogue television broadcasting may be met, but at least a 6 months for high-power transmitters, ) b 2 months for low-power transmitters, ) prior to the planned putting into service of such a transmitter. (5) Where the broadcasting network operator in the geographical area cannot, for technical reasons, to ensure terrestrial digital television broadcasting coverage to the extent provided for in this Regulation, it shall immediately inform the relevant broadcasters and submit a proposed method of solution to the Office. Section 9 Completion of the transition process The date for discontinuing terrestrial analogue television broadcasting shall be set as 11, with the exception of the geographical areas of Jeseník and Zlín. In these areas, terrestrial analogue television broadcasting shall be discontinued on 30 June As at 11, broadcasting shall provide terrestrial digital television broadcasting coverage in the area that encompasses at least 95% of the population; broadcasting networks 2 and 3 shall provide coverage corresponding to that available with terrestrial analogue television broadcasting, and broadcasting network 4 shall provide coverage encompassing of at least 70% of the population. Common and final provisions Section 10 (1) The broadcasting network operator shall submit to the Office, at its request pursuant to Section 115 of the Electronic Communications Act, a specific timetable for the development of its broadcasting network provided under this Regulation. (2) The Office shall collect information on the transition process in different geographical areas, the implementation of the timetable for the development of the broadcasting networks and other conditions laid down in this Regulation, and shall evaluate the progress in the transition process. (3) The Office, on the basis of the data and information under paragraphs (1) and (2) and the results of an evaluation of the coverage of the relevant geographical area by terrestrial television broadcasting in accordance with Section 4(5), shall assess, as at 15 March and 15 September of the calendar year, the progress in the transition process for each geographical area. The first evaluation shall be carried out by the Office as at 15 September The Office shall publish the results of the evaluation within 14 days from the date of the evaluation in a manner facilitating remote access. Section 11 If a licensed broadcaster fails to provide radio channels which are part of the set of technical parameters, 11) as set out in its licence, for the development of broadcasting networks, the Office, where natural or technical conditions so permit, shall arrange for the geographical areas and provinces where these radio channels cannot be used to used alternative radio channels in order to use the broadcasting networks referred to in Section 6 within the time limit laid down in Section 9. Section 12 Effect This Regulation shall enter into effect on 15 May 2008.
