THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY (EXCLUDING RESIDENTS OF QUEBEC) AND IS GOVERNED BY CANADIAN LAW 1. CONTEST May 12 th June 2 nd, 2014: The Florida Georgia Line Contest (the Contest ) begins on May 12, 2014 at 12:00:00 a.m. Eastern Time ( ET ) and is scheduled to end on June 2, 2014 at 11:59:59 p.m. ET, or whenever Scratch Card (defined below) supplies are officially exhausted, whichever occurs first (the Contest Period ). 2. ELIGIBILITY: Contest is open to residents of Canada (excluding residents of Quebec) who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Montana s, a division of Cara Operations Limited and Universal Music Canada Inc. (collectively, the Sponsor ), their respective parent companies, subsidiaries, affiliates, prize suppliers, franchisees, advertising/promotion agencies and any other individual or entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the Contest Parties ). By participating in this Contest, you are signifying that you agree to be legally bound by these Official Rules and Regulations (the Rules ). 3. HOW TO OBTAIN A SCRATCH CARD: NO PURCHASE NECESSARY. At the start of the Contest, there will be three hundred thousand (300,000) Cookhouse & Bar Scratch and Win Cards (each, a Scratch Card and collectively, the Scratch Cards ) available for distribution at Montana s Cookhouse & Bar locations in Canada (excluding Quebec). There are two (2) ways to obtain a Scratch Card, while supplies last, as follows: 1. During the Contest Period, you will receive one (1) Scratch Card, while supplies last, with any purchase made during regular operating hours at a Montana s Cookhouse & Bar location in Canada (excluding Quebec) (each, an Eligible Purchase ); 2. To obtain one (1) Scratch Card, while supplies last, without making an Eligible Purchase, print your first name, last name, telephone number and complete mailing address (including postal code) on a plain white piece of paper with the title FLORIDA GEORGIA LINE CONTEST and mail it (in an envelope with sufficient postage) along with: (i) a handwritten sentence explaining why you want to see Florida Georgia Line in Concert; and (ii) a self-addressed pre-paid stamped envelope with sufficient return postage, to the following address: 2450 Victoria Park Avenue, Suite 1, Toronto, Ontario, M2J 5H3 to the attention of Kori Skeffington (collectively, the Request ). Upon receipt of a Request in accordance with these Rules, you will receive one (1) randomly selected Scratch Card, while supplies last, per unique and original Request per envelope with sufficient postage. To be eligible, each Request must: (i) be received separately in a single envelope bearing sufficient postage (i.e. multiple Requests in the same envelope will be void); and (ii) be post-marked during the Contest Period and received by no later than May 23, 2014 to allow Sponsor time to mail back the Scratch Card via regular mail. The Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the Released Parties ) take no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed Requests (all of which are void). No mechanically reproduced or computer-generated Requests allowed. 4. ELIGIBLE WINNER SELECTION: Once you have obtained a Scratch Card in accordance with Rule 3, you must scratch where indicated on the Scratch Card (the Scratch Area ). Do not scratch outside the Scratch Area. Each Scratch Card will contain one (1) of the
following Prize Notifications (each a Prize Notification ): (i) Congratulations! You ve Won the Grand Prize ; (ii) 10% Off Next Entrée ; (iii) Free Deep Fried Pickles ; or (iv) Free Mini Donuts. IMPORTANT NOTE: Each Scratch Card can only be used one (1) time in this Contest. Each Scratch Card will automatically become void after its first redemption. Please retain the original Scratch Card for your records. To be eligible to redeem the applicable Secondary Prize or the Grand Prize, you must have correctly answered the skilltesting question identified on the Scratch Card. Any Scratch Card that cannot be verified to the complete satisfaction of the Sponsor, in its sole and absolute discretion, is subject to immediate disqualification. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) falsely obtain or redeem a Scratch Card without obtaining a valid Scratch Card in accordance with these Rules; (ii) re-use a Scratch Card a subsequent time after its first use; and/or (iii) use or redeem a Scratch Card that has been falsified, manipulated or otherwise altered in any way (all as determined by Sponsor in its sole and absolute discretion); then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. 5. VERIFICATION: All Scratch Cards are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Scratch Card; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Further, the Sponsor reserves the right to request the original Scratch Card for the purposes of verification. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner (including, if required, providing the original Scratch Card) may result in disqualification in the sole and absolute discretion of the Sponsor. 6. PRIZES AND ODDS OF WINNING: The following Prizes (each, a Prize and collectively, the Prizes ) are available to be won in this Contest: Grand Prize: There will be one (1) Grand Prize (the Grand Prize ) available to be won consisting of: Round trip economy airfare for the confirmed Grand Prize winner (the Winner ) and one (1) guest (the Guest ) to Jacksonville, Florida (the Destination ) from and returning to a Canadian airport near the Winner s place of residence (as determined by the Sponsor in its sole discretion) scheduled to depart on or about June 14, 2014 (exact date to be determined by the Sponsor in its sole discretion); Two (2) nights standard accommodations for two (2) persons, based on double occupancy, at a hotel in the Destination to be selected by the Sponsor in its sole discretion; Two (2) tickets to see Florida Georgia Line in Jacksonville, Florida (the Event ); and The opportunity for the Winner and his/her Guest to attend a meet and greet with Florida Georgia Line (subject to artist availability). The approximate retail value of the Grand Prize is $3000 CAD based on a Toronto departure example, although the actual retail value may vary depending on the point of departure. No difference between the actual and approximate retail values will be awarded. Choice of travel dates, flights, airline(s), hotel accommodations (including, without limitation, room size and occupancy) and ticket levels are at the sole and absolute discretion of the Sponsor. Without limiting the generality of the foregoing, the following general conditions apply to the Grand Prize: (i) Grand Prize must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be
specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions except at Sponsor s option; (iii) all travel related to the Grand Prize must occur within the dates specified by the Sponsor (otherwise the Grand Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the Winner and his/her Guest must: (a) travel on same itinerary; (b) have all necessary documentation to permit international travel to the United States of America; and (c) not have any barrier to entry into the United States of America and/or re-entry in Canada; (v) the costs of everything not specifically stated above as included in the Grand Prize are the sole and absolute responsibility of the Winner and his/her and Guest, including, without limitation: meals and drinks; gratuities; entertainment; health and travel insurance; transportation for Winner and his/her Guest to and from the applicable Canadian airport; transportation while in the Destination; excess baggage fees; and items of a personal nature (NOTE: Winner and/or his/her Guest may be required to present a valid major credit card in Winner s/guest s name at the time of hotel check-in to cover any incidental expenses); (vi) if the Winner and/or his/her Guest do not utilize any part(s) of the Grand Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor s sole discretion, a cash award; (viii) all travel arrangements relating to the Grand Prize must be made through the Sponsor or its designated agents; (ix) by accepting the Grand Prize, the Winner agrees to waive all recourse against the Released Parties if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part; and (x) the Winner s Guest must: (a) either be of the age of majority in his/her province/territory of residence or have the express written consent (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed Winner on the Grand Prize trip; and (b) sign (and have his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence) and return the Sponsor s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Released Parties relating to his/her participation in the Grand Prize (including, without limitation, any travel related thereto). The Released Parties accept no liability or responsibility whatsoever: (i) if the Event is cancelled, rescheduled, delayed, postponed or otherwise affected in any what whatsoever; and/or (ii) the Winner and/or his/her Guest is denied entry to the airline, venue, hotel or the United States for any reason whatsoever. In any such circumstance, the Grand Prize shall be deemed to be fulfilled. The odds of winning the Grand Prize at the start of the Contest Period are 1 in 300,000. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Secondary Prize or a component thereof with a prize or prizes of equal or greater retail value, including, without limitation, but at Sponsor s sole and absolute discretion, a cash award. Must present original Scratch Card before ordering. Limit of one Scratch Card redemption per table. Dine in only. No cash value. Applicable taxes extra. May not be combined with any other offer. Valid at participating locations only.
The odds of obtaining a particular Scratch Card will vary based on distribution of Scratch Cards by Sponsor and will change throughout the Contest Period as Scratch Cards are distributed and redeemed. The total number and particular quantities of Prizes available to be won will decrease as Scratch Cards are distributed and Prizes are claimed. If due to printing, production, online, internet, computer or other error of any kind whatsoever, more Prizes are claimed than intended to be distributed or awarded according to these Rules, then, in addition to having the right to terminate the Contest immediately, the Sponsor reserves the right to rescind invalid Prize claims. In no event will the Sponsor be liable for more than the stated number of Prizes in these Rules or the number of Prizes appropriate to the actual distribution of Scratch Cards to the time of termination of the Contest, as the case may be. 7. REDEMPTION PROCESS: Grand Prize: If your Scratch Card indicates that you are eligible to win the Grand Prize, the winning Grand Prize Scratch Card may be redeemed at a participating Montana s Cookhouse location in Canada (excluding Quebec) by no later than June 6, 2014 (the Grand Prize Redemption Deadline ). To be eligible to redeem the Grand Prize, you must have correctly answered the skill-testing question identified on the Scratch Card. BEFORE BEING DECLARED THE CONFIRMED GRAND PRIZE WINNER, you will be required to sign and return within the time frame specified by the Sponsor the Sponsor s declaration and release form, which (among other things): (i) confirms your compliance with these Rules; (ii) acknowledges your acceptance of the Grand Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, your participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof (including, without limitation, any travel related thereto); and (iv) agrees to the publication, reproduction and/or other use of your name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet. If you: (a) fail to correctly answer the skill-testing question on the Scratch Card; (b) cannot accept (or are unwilling to accept) the Grand Prize (as awarded) for any reason; (c) do not redeem the Grand Prize in accordance with these Rules by the Grand Prize Redemption Deadline; and/or (d) are determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then you will be disqualified (and will forfeit all rights to the Grand Prize). If the Grand Prize is forfeited or unclaimed, then it will not be awarded. Secondary Prizes: If your Scratch Card indicates that you are eligible to win a Secondary Prize, you must bring the original Scratch Card to a Montana s Cookhouse & Bar locations in Canada (excluding Quebec) during regular operating hours between June 15, 2014 and July 7, 2014 (the Secondary Prize Redemption Period ). To be eligible to redeem the applicable Secondary Prize, you must have correctly answered the skill-testing question identified on the Scratch Card. By participating in this Contest and redeeming a Secondary Prize, you hereby: (i) confirm your compliance with these Rules; (ii) acknowledge your acceptance of the Secondary Prize (as awarded); and (iii) agree to release the Released Parties from any and all liability in connection with this Contest, your participation therein and/or the awarding and use/misuse of the applicable Secondary Prize or any portion thereof. If you: (a) fail to correctly answer the skill-testing question on the Scratch Card; (b) cannot accept (or are unwilling to accept) the applicable Secondary Prize (as awarded) for any reason; and/or (c) do not redeem the applicable Secondary Prize in accordance with these Rules during the Secondary Prize Redemption Period; and/or (d) are determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then you will be disqualified (and will forfeit all rights to the applicable Secondary Prize). Any forfeited or unclaimed Secondary Prize(s) in this Contest will not be awarded. 8. GENERAL CONDITIONS: All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries, Scratch Cards and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the
terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. The Released Parties will not be liable for the failure of any Scratch Card or other information to be received, captured or recorded for any reason whatsoever. The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, problem, tampering, unauthorized intervention, fraud or failure. Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information only for the purpose of administering the Contest and in accordance with each Sponsor s privacy policy. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information. The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant, Scratch Card or other information with these Rules, or as a result of any problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
