DRUG TREATMENT COURT Rules and Expectations The Linn County Drug Treatment Court has been created to give persons accused of certain crimes, probation violations, or conditional discharge violations an opportunity to address their substance abuse problem. Persons entering the program will be given an opportunity to have their probation terminated early, avoid jail sentences, or have their drug possession charge dismissed by successfully completing this program. Participating in Drug Court is a privilege and should be seen as an opportunity to develop positive lifestyle changes. The Linn County Drug Treatment Court is committed to assisting with the early intervention, treatment, and rehabilitation of non-violent offenders who desire to change the circumstances in their lives and break the cycle of drug addiction. The following expectations include general guidelines for participation in the program as well as requirements for each phase of the program. DRUG TREATMENT COURT EXPECTATIONS ATTENDANCE DTC Schedule: 8:30 A.M. to 2:45 PM Monday, Tuesday, Thursday, and Friday except holidays. Check in for groups at 8:30 a.m. Attend all scheduled DTC activities. Punctuality: Be on time to all activities. Clients are expected to check-in by 8:30 and be in group at 9:00am according to the clock on the group room wall. If you are more than 10 minutes, you will not be allowed admission into group. Clients are expected to arrive in Drug Court on Mondays by 4:00pm. If you are denied group admission due to being more than 10 minutes late, you will receive a sanction for an unexcused absence. Lateness to group or Drug Court will result in a Phase 1 level continuance or two-week extension if in Phases 2-4. Exceptions To Attendance Requirements: Approved Absences: All absences from the DTC must be pre-authorized by DTC staff. More than one excused absence in a level will result in a level continuance. Clients are required to phone the front desk and leave DTC staff a message prior to 9:00am if canceling group. Make sure to include information as to whether you are canceling the morning or afternoon group, or both. Failure to notify the front desk and leave a message for DTC staff before 9:00am will result in a warrant being issued. Clients may not attend treatment activities until they have turned themselves in on the outstanding warrant. 1. Illness: Call the office at 967-3819 before 9:00 am to report directly to the DTC counselor that you will not be attending. You must also be seen by a doctor and bring a copy of the completed Drug Court medical excuse form to the next treatment day. 2. Court Appearance: Verification of a court appearance must be submitted the following treatment day. 3. Incarceration: Staff will verify periods of incarceration to confirm an excused absence. 4. Death in the family: Verification includes newspaper announcement or funeral home schedule. TRANSPORTATION Pick-up Time: If you are signed up to ride the van, you must be ready when the van arrives. It is recommended you arrive at your pick-up location ten minutes early since the van will not wait. Compliance With Van Rules: Each person must wear a seat belt at all times while riding on the van and follow all other van rules. Canceling Rides: If you do not need a ride to treatment, you must call the van cell phone 541/979-3463 and leave a message. Failure to be picked up at your designated pick-up location will result in termination from transportation services. To resume being picked up by the van, you will need to receive approval from DTC staff and sign a Transportation Probation Contract. Having another infraction while on probation will result in a loss of van privileges. 3
COMMUNITY SUPPORT GROUPS Minimum Requirement: Three community support groups such as AA/NA, ACTS, Smart Recovery, and the DTC Healthy Baby Group, are required each week. There is a list of approved community support activities in the treatment folder. Meeting Logs: Logs must be completed and submitted during DTC Accountability Group by 9:00am every Friday. DTC Healthy Baby Group DTC participants that are pregnant or have children up to four to six months old are required to attend the DTC Healthy Baby Group on Tuesdays 3:00-4:00pm. Clients with children are required to attend for a minimum of 12 weeks. Pregnant women are required to attend throughout the duration of their pregnancy, followed by a minimum four months following the birth of their baby. The focus of the group is learning ways to have a healthy baby and a healthy recovery. PARENTING CLASS If recommended by staff, you will need to complete a parenting class in order to graduate Drug Treatment Court. Resources to cover the cost of the class are available if eligible for the Byrne grant (see DTC counselor for more information.) Documentation of completion of a parenting class must be provided to DTC staff. DHS-SSP/CWP INVOLVEMENT Participants with active enrollment at Department of Human Services-Self-Sufficiency Program (SSP) regarding welfare grants, or Child Welfare Program (CWP) must demonstrate compliance with their requirements in order to maintain compliance in Drug Treatment Court. URINALYSIS AND BREATHALYZER TESTS: Breathalyzers: A breathalyzer is required prior to each morning group. Urinalysis Tests (UAs): Only monitored UAs will be accepted. Check in prior to each morning group to determine if a UA has been scheduled. Failure to provide a UA prior to 9:00am will result in a level continuance. If you checked-in on time at 8:30am but due to long lines or staff unavailability, a UA was not given by 9:00am, the UA must be given before you leave by 11:30am. If a UA is scheduled on a day you call in sick, you must provide a UA the following day by 5:00 p.m. Skipping a scheduled UA will result in a warrant issued for arrest. Dilute UAs: Dilute UAs are considered a failed UA test since drug detection is not possible. A dilute UA may be the result of health problems. If you believe you have health issues contributing to dilute UA samples, a letter from your physician must be provided. Dilute UAs may be treated similar to a positive UA, and may result in a sanction to include a level continuance and evaluation for return to Level I. 4
Positive Test Results: All positive UA tests will result in a sanction as determined by the Court. Over-the-Counter Medication Use: Use alcohol-free over-the-counter medications only. Avoid over-the-counter medication such as Nyquil cough syrup, as well as food products such as vanilla and other cooking extracts that contain alcohol. Using alcohol-free mouthwash is preferred. Since poppy seeds can show up in a UA as an opiate, refrain from all foods such as breads and muffins that contain poppy seeds. Prescription Medication Use: Abstinence from the use of addictive substances as required with exceptions for needed prescribed medication as approved by staff and in coordination with your physician. It is not permissable to obtain over-the-counter medication from someone else. You need to be responsible for of all medications you take. It is illegal to obtain prescription medication from someone else. In the case of a doctor's prescription, compliance with the following expectations is required: 1. Inform your doctor of your history of substance abuse and current treatment involvement. It is recommended to request non-narcotic pain medication or alternative forms of medical treatment. 2. Inform DTC staff when prescribed any medication. In the case of addictive medication, notify DTC staff before hand. 3. If you are given a prescription for narcotic medication and decide against taking it, bring in your prescription so it can be destroyed under the supervision of DTC staff. 4. When taking any medication, complete a medication form given at the front desk. This information includes name of medication, reason for prescription, number of pills prescribed, prescribing doctor. 5. Discuss use of prescription medication during the next group you attend. 6. Complete homework assignment regarding use of prescription medication during treatment which addresses risk issues, safety plan, and relapse prevention plan. Avoid taking narcotic pain medication the morning before group in order to avoid being in group under the influence. 7. If you will be taking a medication throughout treatment on an as-needed basis, you must report every group when you have had a recent medication use. Abstinence Requirement: Each participant must have 8 weeks clean and sober to graduate from Phase 1 of DTC. If a relapse occurs in Phases 2, 3, or 4, depending upon how you address the relapse determines if a return to an earlier phase is recommended. For example, honest reporting to DTC staff as soon as possible following the relapse, increasing community support group attendance, talking to your sponsor, and reviewing the relapse in the first treatment group you attend, are some initial positive steps you can take toward addressing a relapse in a constructive manner. Clients in Phases 2-4 that provide a +UA but do not report a use, automatically return to Phase1 and face an additional 8 months in treatment due to needing to complete Phases 1-4 with a minimum two months in each phase. Clients in Phases 2-4 that provide a +UA need to attend the following Drug Court at 4:00 for a sanction and review of treatment plan changes. 5
SMOKING Smoking indoors is prohibited. Smoking is permitted in the alley on the south side of the Old Armory building. Loitering outside the Fourth Street entrance is not allowed. Breaking this rule will result in loss of the following break. Repeated offenses will result in a level continuance. HOMEWORK Homework booklets are due to a Phase 2-3 client for a peer review on the first Friday of every level by 9:00 a.m. during group. Revisions must be submitted by 9:00 a.m. to the same peer reviewer on the following Friday. Complete homework assignments for the required level only without working ahead. Tuesday and Thursday group homework assignments are due the following Tuesday or Thursday group, and are turned in during group. Failure to bring completed homework assignments will result in a level continuance. RELATIONSHIPS No inappropriate relationships with other clients in treatment will be tolerated. Inappropriate relationships include any romantic or sexual relations other clients enrolled in Linn County Alcohol and Drug Treatment Program. Inappropriate relationships also include forming cliques that exclude other clients or detract from the group process, "secret keeping" and "colluding". PARTICIPATION Respect Treat treatment staff, fellow clients, police officers, fellow citizens and yourself with dignity, courtesy and respect at all times. There are no exceptions to this rule. Clients whose cell phone rings during group will receive a level continuance in Phase 1, or a two-week extension in Phases 2-4. Prosocial Standard No profanity is allowed in the DTC. Prosocial language and behavior are required. Communication Crosstalk is defined as talking at the same time as another person, carrying on side conversations, interrupting, and whispering. Crosstalk is not allowed in the DTC. War Stories and Glorifying Criminal Behavior Avoid telling stories about past alcohol/other drug use and criminal activity that sounds like bragging. The use of "jail-house" terms are not allowed. Active Participation Each person in the DTC Program will be expected to participate actively in all treatment groups. This includes sharing and asking questions when appropriate, completing homework assignments, presenting homework assignments in groups, discussing problems and issues in group, and demonstrating active listening. 6
CONFIDENTIALITY Do not discuss who is attending treatment or what they said with anyone else outside of the group. "Who you see here, what you hear here, let it stay here". Everything you say or do in treatment is confidential. DTC staff may not report any of this information to any other agency or persons without a signed release of information form. However, there is a need to communicate information between Linn County Alcohol and Drug Treatment Program, Linn County Probation and Parole, Linn County Community Services, Linn County Sheriff's Office and Linn County Courts in order to provide coordinated and productive treatment. As a result, each person who enters the DTC will be required to sign a release of information that allows each of the agencies to communicate necessary information with each other. Also, be mindful of protecting another s confidentiality by protecting their written assignments. For peers reviewing homework booklets, they should make sure that the client s first name and last initial appear on the front cover without reference to full last names. Booklets should be kept in a secure place at your residence such as in an envelope or folder, and be kept in your personal living area (versus the kitchen or living room). Booklets should only be out in the open when you are in the process of reviewing them. BOOKS Each person in DTC will have the Alcoholics Anonymous and Narcotics Anonymous books issued to them which are needed to complete reading and writing assignments. These books are allowed to be taken home in order to complete homework assignments. Books are required to be returned to the DTC room the following day. Books are required to be kept in good condition and return them to staff at the end of their treatment in order to graduate. If the books are damaged or lost, the person to whom the books were checked out to will be responsible to pay the cost. APPROPRIATE CLOTHING Socially appropriate clothing will be worn at all times. Shoes and shirts will be worn at all times. Revealing tank tops are not appropriate. Clothing with logos concerning alcohol/other drugs or other offensive material as determined by treatment staff is not appropriate. No hats or headbands are allowed in the group room. WEAPONS No weapons are allowed in treatment. Definition of a weapon is at the discretion of treatment staff. DISCIPLINARY ACTION Breaking any of the rules mentioned in the preceding pages will result in some sort of disciplinary action. Disciplinary action is designed to teach and instruct DTC participants. The DTC and other treatment staff will decide disciplinary action. Examples of disciplinary actions are additional assignments, dropping one or more levels, a level continuance, work crew, compensatory service, repeating Phase 1, electronic home detention, jail sanction, curfew, and expulsion from treatment. 7
DTC ACCOUNTABILITY GROUP The DTC Accountability Group provides a time to review accountability for their past week s performance in meeting level expectations. Group consists of each group member briefly rating their progress in treatment and receiving feedback from group members. Group also provides the opportunity to present weekly homeworks and level assignments. COGNITIVE SKILLS GROUP This afternoon group 12:30-2:45pm addresses thinking errors and how to better address problemsolving and healthy decision-making in recovery. Attendance is required in Phase 1. Failure to comply with group expectations results in receiving one check on the white erase board. A second check received in the same week results in a homework assignment focusing on the problem behavior. A third check received in the same week results in a level continuance. Phase 2 clients are required to attend gender group on Monday, Recovery Skills Group on Thursday, and DTC Accountability Group on Friday. After a minimum of four months in Recovery Skills Group, Phase 2 clients may elect to attend Cog Skills instead of Recovery Skills Group. A Phase 2 client may choose a Cog Skills class on Thursday or Friday only. This spacing of treatment groups allows for more continuous support throughout the week. Phase 3 clients are required to attend gender group on Monday and may choose between DTC Accountability Group on Friday or a Cog Skills Group on Thursday or Friday. Phases 2-4 clients may elect at any time to attend additional Cog Skills Groups and must inform the group leader, Dave Amity, ahead of time. Treatment graduates are not permitted to drop in Cog Skills Group due to confidentiality issues. DRUG COURT APPEARANCE DTC clients are expected to appear in Drug Court on Mondays at 4:00 on their scheduled weeks. Clients are expected to present in appropriate dress suitable for court. Inappropriate clothing includes such things as tank tops, shorts, shirts exposing midriffs, low-cut shirts, and flip-flops. Dress code for court appearance is more formal than treatment expectations. Behavior in Drug Court should include respectful listening to proceedings, avoiding leaving the courtroom, and avoiding crosstalk. Inappropriate dress or behavior during Monday Drug Court may result in a level continuance or phase extension. GRADUATION When you complete treatment groups at the conclusion of Phase 4, there will be a graduation ceremony in your final gender group. Following treatment completion, you will remain on probation while awaiting the next quarterly Drug Court graduation. Some clients may be approved to complete treatment even though they are still working on their GED and employment requirements and paying on their restitution. In this case, participants would continue on probation until all requirements are met, and then await the next scheduled Drug Court graduation. Graduates are encouraged to invite family members, friends, and community partners such as probation officers and CSC staff to both ceremonies. 8
PHASE SYSTEM A four-phase, multi-level system will be in place for all DTC participants. Phase 1 includes levels one through four. Each level is a minimum two weeks in length. Phases 2 through 4 are a minimum eight weeks in length. Each DTC participant must complete all four phases in order to successfully graduate treatment. Treatment may be completed in a minimum of 32 weeks. If treatment is completed in less than one year, clients will remain on probation until they have successfully met all Drug Court requirements for graduation. All levels in Phase One include: Court Appearance: once weekly P.O. Contact: once weekly Individual appointment: once monthly Home visit (random) If applicable, comply with DHS/Self-Sufficiency Program or Child Welfare. Attitude Expectations Positive attitude towards treatment. Treat other group members with respect. Treat staff with respect. Willingly comply with all treatment requests by staff. Abstinence Requirements Abide by all UA and breathalyzer rules. Stay clean and sober from alcohol/other drugs. 9

A level continuance will be given each subsequent week that the DSA is not turned in. DSA revisions are due the following Friday by 9:00am in group. Revisions need to be added within the story, not listed on a separate page. Obtain sponsor within the first 3 weeks of treatment. Maintain weekly contact and monitor on Recovery Inventory. Demonstrate recovery oriented attitude, no war stories, talk favorably about recovery, encourage recovery in others, significantly decreased amount of criminal thinking. Abstinence Requirements Abide by all UA and breathalyzer rules. Stay clean and sober from alcohol/other drugs. Payment Requirements Made $10 weekly treatment payment by 9:00 Friday, or show OHP card monthly as required. 11

Demonstrate appropriate dress and behavior in Drug Court. Attitude Requirements Treat group members and staff with respect and courtesy. Demonstrate recovery oriented attitude, no war stories, talk favorably about recovery, encourage recovery in others, no use of criminal behaviors and consistently intervene on criminal thinking. Abstinence Requirements Abide by all UA and breathalyzer rules. Stay clean and sober from alcohol/other drugs. A minimum two-page book report on each of the first five chapters of the AA Big Book and NA text is required (total of four pages minimum). Reports should include summary information about those chapters as well as how the information might apply to you personally. A final draft of the DSA must be approved before advancing to Level 4. Revisions need to be added within the story, not listed on a separate page. Maintain weekly contact with sponsor and monitor on Recovery Inventory. All Cognitive Skills assignments given must be completed and approved by the DTC counselor. Maintain daily inventories of minimum 10 each relapse and recovery signs and SPTs (total of three inventories). Daily inventories including 1) recovery, 2) relapse, and 3) SPTs, are expected throughout the duration of treatment. Complete all chores in group accurately and in timely manner without being reminded. 14

Contact: once weekly Individual appointment: once monthly Home visit (random) If applicable, comply with DHS/Self-Sufficiency Program or Child Welfare. Begin working on educational/work plan. Attendance Requirements Abide by all attendance rules. Punctual to all groups including Drug Court and returned on time from all group breaks. Any absences were pre-approved or a doctor s slip was turned in. A missed individual appointment, psychiatrist appointment, or P.O. visit will result in a sanction. Participation Requirements Be consistently active in groups. Avoid crosstalk Consistently model pro-social behavior. Consistently assist DTC members currently in Levels 1, 2, and 3 in understanding expectations and assignments. Demonstrate appropriate dress and behavior in Drug Court. Attitude Requirements Treat group members and staff with respect and courtesy. Demonstrate recovery oriented attitude including no war stories, talk favorably about recovery, encourage recovery in others, no criminal behaviors and consistently intervene on criminal thinking. Abstinence Requirements Abide by all UA and breathalyzer rules. Stay clean and sober from alcohol/other drugs. Must have minimum 60 days abstinence in order to advance to Phase 2. Payment Requirements Made $10 weekly treatment payment by 9:00 Friday, or show OHP card monthly as required. Change Fee Agreement with front desk the week prior to advancing to Phase 2 in order to change payment to $20 weekly. 15

Failure to bring completed homework assignments will result in a level continuance. Maintain weekly contact with sponsor and monitor on Recovery Inventory. All Cognitive Skills assignments given must be completed and approved by the DTC counselor. Maintain daily inventories of minimum 10 each relapse and recovery signs and SPTs Complete all chores in group accurately and in timely manner without being reminded. If applicable, notify van driver and Rachel regarding changes in transportation schedule. 16
PHASE TWO Attendance Requirements Abide by all attendance rules. Missed individual and psychiatrist appointments result in a twoweek extension. A missed P.O. appointment results in a warrant being issued. Be punctual to all groups and returned on time from all group breaks. Any absences were pre-approved or a doctor s slip was turned in. Unexcused absences result in a sanction. More than two group absences in a four-week period results in a four-week phase extension. Attend Drug Court weekly. To graduate Drug Court: Complete four phases of treatment. Turn in copy of GED certificate or High School diploma to DTC staff. Complete a parenting class and turn in copy of completion certificate to DTC staff. Be employed full-time or enrolled in school full-time. Exceptions made on an individual basis. Pay treatment fees in full. Pay restitution in full. Have recommendation from Drug Court team. During probation following completion of treatment groups: Attend Drug Court on the 4 th week of the month. Keep all scheduled P.O. appointments. Turn in community support meeting logs to P.O. weekly. Call 971-0243 daily for random UAs. All scheduled UAs are given at the P.O. s office. 20
