2 Program Overview The Sixth Judicial DUI Court Program is a court-supervised treatment program which accepts participants who have received a third Driving Under the Influence conviction with two or more prior convictions, a felony offense. All participants have been determined to have a Substance Use Disorder. The DUI Court program is a voluntary program. Participation includes: regular court appearances, treatment, and alcohol testing. Each participant will also be expected to obtain and maintain employment and/or involvement in a vocational or educational program. The length of the DUI Court program is determined by each participant s progress and will be a minimum of three years. Program Eligibility To be eligible to participate in the DUI Court Program, you must: Have received a third Driving Under the Influence conviction and have two or more prior convictions Have a Substance Use Disorder Have the capacity to manage the structure of DUI Court Be ordered to the program through the court system Pay for all services ordered by the Court 2
3 Expectations All DUI Court participants must comply with the following expectations: Attend Court as Ordered Court is held Thursday at 9:30am. Turn your cell phone off, and dress appropriately. The following is not allowed: hats, sunglasses, shorts, t-shirts, baggy pants, showing midriffs, gum. Residential Confinement/Electronic Monitoring You will be placed on a house arrest and electronic monitoring program for the first six months of the program. Driving Interlock Device All DUI Court participants that drive must install an interlock device on any vehicles they drive. The device must remain installed for the first year of the program. Abstain from using Alcohol and Drugs Alcohol and/or drug use is not permitted. We understand relapse is a part of the recovery process; however, unauthorized substance use will be sanctioned. Payment The cost of the three-year DUI Program is $5500. This program cost will cover all treatment services and testing fees. Stay away from Alcohol, Drug, and Gambling Establishments Casinos, bars, liquor stores, huka bars, and smoke shops are off limits. You may not purchase alcohol, drugs, or paraphernalia. You may not gamble. Be Honest Honesty is an important part of recovery and building strong relationships. Participants who choose not to be truthful may have additional sanctions. Payment All DUI Court participants are responsible for payment of all services. This includes, but is not limited to: electronic monitoring, counseling services, group treatment, and drug testing. Travel Travel out of town must be approved by the Court. Requests to travel must be made in writing and should explain WHO you are going with, WHERE you are going, WHAT you are traveling for, WHEN you expect to leave and return, and HOW you will get there. Keep the Court Informed Notify the DUI Court any changes in your employment, address, or phone number. Failure to Comply A DUI Court participant can be sanctioned or terminated from the program for failing to meet DUI Court expectations. 3
4 Treatment You will be required to seek treatment through a certified treatment provider. The treatment team will assess the level and intensity of treatment that will best meet a participant s needs. An outpatient service plan will be developed, which will include: Counseling An important aspect of DUI Court is counseling. This may include mental health and substance use counseling. It may also include both individual and group counseling. Participation in one or both of these will be at the recommendation of the treatment team. Attendance at counseling sessions will be reported to the Judge as a part of a participant s progress report. Prior permission from the treatment counselor must be obtained in order to be excused from a counseling session. Self-help Meetings Attendance may be required at self-help meetings such as SMART Recovery, Narcotics Anonymous, or Alcoholics Anonymous. Attendance is an important part of the recovery process to develop levels of trust and to learn and create social bonds with other people in recovery. The participant must provide proof of attendance to the Court. Provide Urine Samples Drug testing may be conducted using urine analysis, Breathalyzer, hair testing, sweat patches, and swab tests. Missed tests, failure to provide a sample, leaving the testing facility after signing in, and dilute tests will be considered positive samples. You may be sanctioned for positive samples. Medication Many over the counter medications can interfere with drug testing. Please refer to your testing packet for a list of restricted over-the-counter drugs. All prescriptions must be approved by the DUI Court team before they can be taken. Medical marijuana will not be approved. 4
5 Treatment Phases Phase I- Assessment and Primary Treatment Phase Length- 6 months During Phase I, a treatment plan will be developed and participants will work with their counselor to create goals and objectives to establish recovery. Phase I Requirements Attend court every Thursday at 9:30am. Comply with Residential House arrest. Comply with electronic monitoring requirements Obtain an interlock driving device (if applicable). Attend 3 AA meetings each week. Attend 2 group treatment sessions each week, or as directed by your treatment provider. Attend 1 individual treatment session each week, or as directed by your treatment provider. Meet with probation officer as directed. Curfew 9:00pm. Phase II- Treatment Phase Length- 9 months In Phase II, the treatment plan will be updated to identify treatment goals and objectives. Counseling and meetings will focus on areas that are challenging for the participant and identify ways of coping with stressful situations. Phase II Requirements Attend court every Thursday at 9:30am. Test at least 3 times each week. Testing color: RED (first six months of phase). Maintain an interlock driving device on any vehicles you drive (if applicable). Attend 2 AA meetings each week. Attend 2 group treatment sessions every week, or as directed by your treatment provider. Attend 1 individual treatment every other week, or as directed by your treatment provider. Meet with probation officer as directed. Curfew 10:00pm. 5
6 Phase III- Action Phase Length- 9 months Phase III focuses on creating an action plan to maintain long-term recovery. The phase is designed to support the participant in his/her return to the community as a productive and responsible community member. Phase III Requirements Attend court two times each month, Thursdays at 9:30am. Test at least 2 times each week. Testing color: YELLOW. Attend a minimum of 1 AA meetings each week. Attend 1 group treatment session every other week, or as directed by your treatment provider. Attend 1 individual session every other week, or as directed by your treatment provider. Meet with probation officer as directed. Curfew 11:00pm. Phase IV- Aftercare Phase Length- 12 months Phase IV focuses on maintaining long-term recovery outside of the court setting. The phase is designed to provide you limited support while you establish your new life within the community. Phase IV Requirements Attend court one time each month, Thursdays at 9:30am. Test at least 2 times each week. Testing color: PURPLE. Attend a minimum of 1 AA meeting each week. Attend 2 group treatment sessions every month, or as directed by your treatment provider. Meet with probation officer as directed. Curfew 11:00pm. 6
7 Graduation Requirements 1. Satisfactory attendance at all treatment services. 2. Six months of continuously clean alcohol tests. 3. Balance paid in full. 4. Participant has obtained his/her GED or Adult Diploma. 5. Participant has completed a relapse prevention plan. 6. Participant has completed a minimum of three years in the DUI Court Program.
