Message from the Director This past year has been another year of growth and accompishment for the Heath Law Institute; for our students, our facuty and our aumni. As you read in the foowing pages, we have much to ceebrate, but et me start with just a few highights: End-of-ife care experts gathered at our November Symposium: Lega, Medica, and Ethica Issues in Minnesota End-of-Life Care. Over 200 regiona and nationa experts expored issues and topics such as: the use of POLST orders; Minnesota guardianship procedure; institutiona and community responses to medica futiity disputes; and decision making for unbefriended patients without surrogates. The first onine cohort of Heath Care Compiance Certificate students graduated. Ten working professionas from across the country competed their Heath Care Compiance Certificate in May 2013 and are now eigibe to sit for the Certified in Heathcare Compiance exam. This program, under the eadership of Director Barbara Coombo, aso received a $10,000 grant from the Compiance Certification Board. This certificate can aso be competed as part of Hamine s new Master in the Study of Law program. We continue to ceebrate our position as a recognized eader in the heath aw community. Since 2009, Hamine s heath aw program has been recognized among the top twenty nationwide in the U.S. News and Word Report rankings. In the 2014 rankings, the Heath Law Institute moved up one position to the 16th best program in the country. Our aumni found meaningfu careers. Hamine graduates have secured competitive positions across a areas of the heath care industry in a difficut economy, incuding: aw firms, state and federa government, manufacturers, hospitas and cinics, insurers, trade associations, and consuting. student experiences. More than 94% of students woud woud recommend that a new student earn an HLI certificate. HLI facuty continue to ead schoasticay. Once again, our facuty produced outstanding schoarship over the past year. Most notaby, Professor Jonathan Kahn pubished his book Race in a Botte: The Story of Bidi and Raciaized Medicine in a Post-Genomic Age (Coumbia University Press 2012). A compete isting of our accompishments can be found in the fina pages of this report. Heath aw revoves around an industry, not a casebook. It impacts every American every day. The heath care chaenges for academics, industry eaders, and students confront us in the headines each morning. And, because it is so dynamic, we need to make sure that our students experience the most advanced heath aw curricuum in the most compeing way from expert instructors. In the coming year, we wi again strive to insti reaife heath aw experience in our students. Through the Institute s nationa speaker series and advanced expertise courses for working professionas, we wi take education beyond aw students to the Upper Midwest s stear heath care community of awyers, managers, compiance officers, cinicians, and poicy makers. It is a benefit to earn, teach, and practice heath aw in the heart of a premier heath care market. We hope this report provides you with a better understanding of our work to date, as we as the Institute s pans for a significant future. We hosted a number of meaningfu events. Heath Law Institute highights Compeing events, new programs, awards, and student success EVENTS Symposium: Lega, Medica, and Ethica Issues in Minnesota End-of-Life Care. The Heath Law Institute and the Hamine Law Review were peased to present, Lega, Medica, and Ethica Issues in Minnesota End-of-Life Care on Friday, November 9, 2012. Federa and Minnesota aws recognize that individuas generay have the right to choose the time and manner of their death. However, these rights are not uniformy recognized in practice and there are many ega and practica imits on when and how they are honored. Regiona and nationa experts, both schoars and practitioners, expored a broad range of ega, medica, and ethica issues in Minnesota end-of-ife care. We wecomed more than 200 participants to Hamine University s Saint Pau campus. These participants incuded: attorneys, physicians, nurses, socia workers, ethicists, patient advocates, ega aids, government reguators, professors, students, chapains, and other aied heath professionas. To enhance its vaue and interest to these diverse professionas, we quaified the Symposium: for CLE credits by the Minnesota Board of Continuing Lega Education, for CE credits by the Minnesota Board of Nursing, and for CE credits by the Minnesota Board of Socia Work. Voume 36, number 2 of the Hamine Law Review serves as a compement to the Symposium. Our guests came from a diverse range of professiona settings, incuding: hospitas, government agencies, universities, non-profit organizations, aw firms, and heath insurance companies. They represented a virtua who s who of Minnesota heathcare and pubic poicy organizations, incuding: Chidren s Hospitas and Cinics of Minnesota, Mercy Hospita, the Minneapois Veterans Affairs Heath Care System, the University of Minnesota, Wiiam Mitche Coege of Law, Aina Heath, Heath Partners, Hamine Law Review students gather on Thursday evening, before the Symposium, at the reception and specia performance of Expiration Date which brought to ight the reaities of a termina diagnosis. Evauations show attendees over 94% satisfied with the conference content and speakers. Nationa Speaker Series features Professor Maxwe Mehman. The Arthur E. Petersige Professor of Law and Director of the Law-Medicine Center, Case Western Reserve Schoo of Law, and Professor of Biomedica Ethics, Case Western Reserve Schoo of Medicine presented Medica Practice Guideines and the Lega Standard of Care. Professor Mehman s March presentation caimed that organized medicine is seeking to gain unprecedented contro over the standard of care to which mapractice aw hods physicians. He argued that this woud be bad poicy not ony from the standpoint of patients but for the profession itsef. According to Professor Mehman, American medicine has ong fought to contro the standard of care that physicians are expected to provide to their patients. It has waged battes on two fronts: against interna disagreements within the profession over what constitutes proper care, and against attempts to deineate the standard of care by forces outside the profession, such as private heath insurers, the government, and the judicia system. 4
Professor Jonathan Kahn Pubishes Book: Race in a Botte: The Story of Bidi and Raciaized Medicine in a Post-Genomic Age, Coumbia University Press (2012). In February 2012 the Heath Law Institute hosted a presentation, reception, and book signing recognizing Dr. Kahn and his new book. The book is the product of a three-year research project. The Nationa Library of Medicine awarded Kahn a $124,000 grant to research and write the book. Professor Kahn with his new book and Professor Pope. The aim of the project was to provide a book-ength treatment of the emergence of race as a centra organizing concept in the deveopment of pharmaceuticas and reated biotechnoogica innovations in a post-genomic age. This book examines how aw, science, and commerce converge in the fied of biomedicine to produce distinctive understandings and uses of race as a centra organizing concept in the deveopment of pharmaceuticas, biotechnoogy patents and reated medica practice in a post-genomic age. This book directy addresses concerns about justice and equity in heath care reguation and drug deveopment. It buids from a case study of BiDi, the first drug ever approved by the FDA with a race-specific abe for the treatment of heart faiure in a back patient. CCB s schoarship program wi assist universities that partner with CCB, the Heath Care Compiance Association (HCCA), and the Society of Corporate Compiance and Ethics (SCCE) to provide earning opportunities and resources to students who are interested in pursuing compiance careers, said Debbie Trokus, CCB president and managing partner at Aegis Compiance & Ethics Center. In September 2012, Hamine Law facuty members Laura Hermer, Morgan Hocomb, and Jonathan Kahn presented The Affordabe Care Act Decision: Impications for Heath Law & Beyond. Professor I. Genn Cohen of Harvard Law Schoo traveed to Hamine in October 2012 to present Medica Tourism for Experimenta Therapies: An In Depth Exporation of Stem Ce Therapy Tourism. Hamine aumna, Cathy Caitin, Executive Director of the Austraian Counci on Smoking & Heath, and Doug Banke, Executive Director of the Pubic Heath Law Center, presented Tobacco Contro: Comparing U.S. & Austraian Labeing Reguations in January 2013. AWARDS Minnesota Business Magazine Leaders in Heath Care Awards Finaist: The Hamine Heath Law Institute has been named a finaist in the 2013 Leaders in Heath Care Awards by Minnesota Business Magazine. This notabe honor ceebrates individuas and organizations eading the charge in Minnesota s word-cass heath care industry. These coveted awards honor exceent patient care, outstanding eadership, and thoughtfu innovation. HLI was nominated for the category of Education and Workforce Deveopment. A gaa wi be hed October 29, 2013 to announce the award winners. Heath Care Compiance Program Receives Grant. Hamine Law s Heath Care Compiance program is one of ony six programs accredited by the CCB. It is one more indication that the great work of our students, facuty, and industry partners is being recognized and endorsed. Hamine Law s Heath Care Compiance program is offered in two formats, a cassroom option for JD students and an onine option for working professionas. The program prepares students to make an immediate contribution in their chosen heath care setting by arming them with a sophisticated understanding of governing aws and reguations, introducing them to industry eaders, and providing hands-on earning and interactive simuations through its in-depth curricuum. continued 5
Onine Compiance Certificate students began their program with a four-day residentia component on Hamine s Saint Pau campus, and it cuminated with students reuniting for a two-day capstone experience that incuded a comprehensive, mutifaceted simuation exercise to test operationa and substantive concepts earned throughout the program. 6 NEW PROGRAMS First onine cohort competes Heath Care Compiance Certificate program: Hamine Law s highy regarded Heath Care Compiance Certificate program is now onine and avaiabe nationwide to a broad range of professionas. Unti now, the program has ony been avaiabe in the cassroom, but the new onine version of the program heps professionas across the country increase their vaue to empoyers by teaching them how to effectivey navigate the compex maze of government aws and reguations. Heath Care Compiance is one of the fastest growing career fieds, requiring a sophisticated understanding of a compex reguatory environment, said Barbara Coombo, a Senior Feow in Hamine s Heath Law Institute, and director of the program. Our program is one of ony six accredited by the Compiance Certification Board. The onine version, which aunched in June 2012, is buit on cutting-edge technoogy that aows students to both earn directy from word-cass professors and engage with coeagues anywhere they have an internet connection. Ten Onine Heath Care Compiance students competed the 12-credit Certificate ast year, and nineteen are currenty enroed. Once students compete the certificate program they are eigibe to sit for the nationay recognized Certified in Heathcare Compiance exam. New Master s in the Study of Law features Heath Care Compiance track: Hamine University s Master in the Study of Law program is designed for working professionas who recognize that a sophisticated understanding of aw and confict resoution makes them more vauabe in their current job or the next one. The Hamine MSL is for anyone whose work invoves aw or who routiney receives the advice and counse of awyers, incuding a wide range of non-awyer professionas. The Hamine MSL is offered in two concentrations, Confict Resoution and Heath Care Compiance, powered by two of Hamine Law s nationay renowned centers of exceence the Dispute Resoution Institute and the Heath Law Institute. STUDENT ACCOMPLISHMENTS Heath Law Institute students continue to exce: Hamine Law students competed and exceed in three heath aw moot court competitions this year. The Heath Law Institute was proud to award American Bar Association Boomberg BNA Awards for Exceence in Heath Law to weekday students Joseph Cooch, Eizabeth Winche, Lukas Anton and weekend students Morgan Vanderburg and Gregory Hanson. The award entites the recipients each to an award certificate and $500 in heath aw reference materias. Dustin Bethke served as the student representative on the Governing Counci of the Minnesota State Bar Association Eder Law Section.

Peer-support activities incude faciitating heath aw student discussion groups and creating a network that acts as a springboard for academic and empoyment success. During the 2013-2014 academic year, the SHLA wi be ed by Leah Fitzgerad, Beth Deines, Shamia Merchan, Brice Dzubinski, and Marissa Newton. Rob and Tescia wi be featured as the cover story of the November 2013 issue of Compiance Today, a pubication distributed every month to more than 9,000 compiance professionas across the United States. Student Heath Law Association: At Hamine, we take pride in the invovement of our students. The Student Heath Law Association (SHLA) provides opportunities for students to get invoved in the community, expore the fied of heath aw, and earn about the diverse opportunities in this evoving fied. Edward Bryant, Jr. Nationa Heath Law Transactiona Competition: The Hamine Law team made up of Hoy Danieson, Kassandra Heinrich, and Matthew Wasik competed in March 2013 at Loyoa University of Chicago, Schoo of Law, Beazey Institute for Heath Law & Poicy. Nationa Heath Law Moot Court Competition: Heath aw students Joseph Cooch and Eizabeth Winche, competed at the Nationa Heath Law Moot Court Competition at Southern Iinois University Schoo of Law in November 2012. HLI Director Thaddeus Pope accompanied the pair to the competition, where they finished among the top four of thirty-two teams. Cooch and Winche aso won the Runner-Up Best Brief award. The 2013 team is made up of Kristin Kunz and Michae Manning. 7
Experientia Learning HLI students receive hands-on, skis-based training through a variety of experientia earning opportunities in the heath care industry. Experientia earning is the current that runs through the entire Hamine Law curricuum. We decidedy integrate skis training, work experience and career services throughout every facet of the aw schoo. HLI strongy embraces this uniquey Hamine Law approach to ega education. HLI students are kept apprised of the wide range of experientia earning opportunities through a weeky e-newsetter, the HLI Brief. Through this reguar communication, students are better informed of ways in which they can engage with the oca bar and community heath aw events. The HLI Brief aso aerts students to position openings, writing competitions, CLE presentations, and other opportunities. Over the past year, HLI students served cients, worked cosey with attorney mentors and aumni, and participated in the rich Minnesota heath aw community. We prepare our students to make an immediate, meaningfu contribution upon graduation. HEALTH LAW CLINIC Combining course work and case work, the Heath Law Cinic aows students to represent cients in heath-reated administrative hearings or written appeas, perform egisative research, and provide case anayses and cient advice. Through the cinic, students have the opportunity to participate in a variety meaningfu experiences. 8
Administrative Hearings and Reated Work During the Fa 2012 semester, two students successfuy represented a cient in an unempoyment benefits hearing. The cient was a food service worker who had been terminated from her empoyment due to aeged misconduct. The students researched the issue and interviewed the cient after the cient had initiay been denied benefits. The students prepared the cient for the hearing and represented the cient in the teephone hearing, which invoved examination of the cient and cross examination of the empoyer s witness. The cient won the hearing and began receiving unempoyment benefits. Two students represented a cient in a Minnesota Department of Heath (MDH) matreatment and disquaification proceeding. The cient worked as a home heath aide in an assisted iving faciity. A MDH investigation determined that she was responsibe for negect/matreatment reated to a patient s fa and aeged that she shoud be disquaified from empoyment in the faciity. The students did extensive research, interviewed the cient and a cinica nurse expert, and prepared a settement anaysis for MDH that was rejected before hearing. At the hearing, one of the students conducted direct examination of his cient and the cinica expert. The Department of Human Services Judge issued a recommended decision in favor of MDH on the matreatment determination and in favor of the cient on the disquaification set-aside determination. Since the decision was issued after the semester ended, facuty prepared exceptions contesting the matreatment decision and are awaiting the Commissioner of Heath s decision in the matter. A Spring 2013 student wrote and fied a request for a setaside with the Minnesota Department of Human Services for a cient who had been permanenty disquaified from direct care empoyment due to a very od arrest record. The Department denied the written request, and the student advised the cient about a further appea. Judicia Hearings In Spring 2013, two students prepared expungement petitions for individuas who had been disquaified from heath-reated empoyment based on crimina background studies. To prepare the petitions, they conducted interviews of their cients and witnesses; and, they researched the appicabe aw and Court fie systems. Hearings for the two petitions were schedued after graduation, so another Cinic student was abe to present and argue the petitions before the oca district courts in June. The expungement requests were granted to the extent permitted by recent Minnesota Supreme Court decisions imiting a judge s expungement authority to judicia records. Case Anaysis and Cient Advice Both during Fa 2012 and Spring 2013, students worked with cients to discuss disquaification and expungementreated issues. Students interviewed the cients to evauate their cases, conducted research on the cient s specific situation, and wrote advice etters to the cients regarding their individua cases. 9
Experientia Learning continued EXTERNSHIPS, INTERNSHIPS, AND OTHER OPPORTUNITIES Heath Law Externships: Through the Heath Law Externship, students appy cassroom earning to reaword experiences under the direction of an attorney mentor. These externships require a cassroom component and 114 hours of fied work. Hamine students have recenty worked with attorney mentors at, among other paces: Chidren s Hospitas and Cinics of Minnesota; Compassion & Choices; DuVa & Associates, P.A.; Ecoab; HeathPartners; Jardine, Logan and O Brien; Leonard Street & Deinard Medica Lega Partnership; the Mayo Cinic; Medica; Medtronic; MN Department of Heath; MN Department of Human Services; Minnesota Hospita Association; Office of Institutiona Compiance, University of Minnesota; Panned Parenthood of MN, ND, and SD; Scheer Lega Soutions LLC; UCare Minnesota; U.S. Attorney s Office; and the VA Hospita. Judicia Externships: In addition to the Heath Law Externship, students can aso engage in experientia earning by working for academic credit in a courthouse setting under the direction of a judge. Recent heath aw students have cerked for menta heath courts and probate courts. Internships: Many Hamine students convert their externships into internships, part-time jobs, and even futime post-graduate empoyment. Hamine students have recenty interned at, among other paces: the Food and Drug Administration; the Minnesota House of Representatives; Prime Therapeutics; Panned Parenthood; Aina; HeathPartners; Avera Heath; the Emiy Program; UCare; the Minnesota AIDS Project; Midwest Disabiity; Giette Chidrens Speciaity Heathcare; St. Catherine University Office of Research; and the Pubic Heath Law Center. Part-time Jobs: Many part-time students in the Hamine Law weekend program work fu-time. Even fu-time Hamine Law students often work not just in the summer, but aso during the academic year. This gives them vauabe experience and credentias. Students have recenty worked at: the Pubic Heath Law Center; Nian Johnson Lewis; 10 Haeand Habicht; Haberg & McCain, P.A.; and Moore, Costeo & Hart. HUSLink Mentorship Program: The HUSLink Mentorship Program was designed to make networking and mentoring avaiabe in a fexibe, timey, and customized manner. Mentors and protégés can designate that they woud ike to work with someone focused on heath aw, which creates a unique opportunity for our students to interact with eaders in the heath aw community. This program is managed by the Hamine Law Career Services Office. Pro Bono Heath Law Experiences: Hamine has a strong tradition of serving underserved communities. With the honor of a aw icense comes the responsibiity to give back, in the form of ega services without compensation, to those who cannot afford to pay. Many Hamine Law students choose to vounteer at heath aw reated sites, such as: the Cancer Lega Line, Chidren s Denta Services, the Pathways Counseing Center, and the Minnesota Disabiity Law Center. These pacements are often faciitated by the Minnesota Justice Foundation. Career Panes: Introducing Hamine Law students to aumni and community professionas who have successfuy navigated the various paths to meaningfu heath aw careers is an important part of the Heath Law Institute s mission. HLI hosted four career panes during the 2012-2013 academic year. These panes highighted careers in medica mapractice, compiance, transactiona aw, and reguatory affairs. Students attend Upper Midwest HCCA Conference. On September 14, 2012 over 15 Hamine Law students and aumni attended the Heath Care Compiance Association s Upper Midwest Regiona Annua Conference in Minneapois, MN. The HCCA Conference provided great insight into the variety of roes that compiance officers pay in the function of companies. It was great to see the speakers who hod J.D. s as we as their CHC paying vita roes in companies from UnitedHeath to Target. This opportunity gave me more insight and hope that the word of compiance is ever expanding, prevaent, changing, and chaenging. Amanda Pittman, JD 13 As my first year of aw schoo comes to a cose, I am excited to announce I have accepted a summer aw cerk position with Haberg & McCain, P.A. The firm speciaizes in paintiff s medica mapractice with more than 25 years of experience. Haberg & McCain, P.A. strives to te the cient s story with compassion and integrity. Being a nurse for the ast 11 years has provided me with the opportunity to advocate for patients. I beieve my ega education wi aow me to promote patient safety through the representation of aw and further advocate for patients. The prospect of using my nursing background to further assist cients in a compassionate manner is motivating. Heath Law Institute Curricuum In May 2013, the Heath Law Institute awarded twenty-two Genera Heath Law Certificates and twenty-three Heath Care Compiance Certificates. Every heath aw student is paired with a Heath Law Institute facuty advisor to guide them through course and career panning. Since 2008, the Heath Law Institute has awarded 84 Genera Heath Law Certificates and 76 Heath Care Compiance Certificates. Heath Law Institute courses serve not ony our certificate students, but aso the broader aw schoo community. During the 2012-2013 academic year, 400 students enroed in over twenty different heath aw courses. These courses covered a broad range of topics, incuding: heath care organization and finance, quaity of care and iabiity, eder aw, HIPAA privacy, and medica mapractice. ESTABLISHED PROGRAMS Genera Heath Law Certificate The Genera Heath Law Certificate shows future empoyers that students have concentrated their studies in heath aw. Earning the Certificate both requires and demonstrates a significant understanding and practica appication of key heath aw concepts. Twenty-one JD students are currenty registered to compete the 14-credit program that requires cassroom courses, experientia earning, and extracurricuar engagement. Heath Care Compiance Certificate Heath Care Compiance Certification enabes students to be uniquey positioned to make a positive impact as prepared and effective eaders in their chosen heath care settings. The program provides a thorough examination of governing aws and reguations, introduces students to industry eaders, and offers hands-on earning and interactive simuations through its in-depth and in-person curricuum. With Hamine s Compiance Certificate, students are eigibe to take the the nationay recognized Certified in Heathcare Compiance Exam without satisfying the otherwise-required work experience and continuing education requirements. Hamine was the 2009 recipient of the Society of Corporate Compiance and Ethics 5th Annua Internationa Compiance and Ethics Award. Fourteen JD students are currenty registered to compete this 14-credit program and nineteen students are currenty enroed in the 12-credit onine program. Master s in the Study of Law The Hamine MSL is for anyone whose work invoves aw or who routiney receives the advice and counse of awyers. This degree is offered in two concentrations, Confict Resoution and Heath Care Compiance, powered by two of Hamine Law s nationay renowned centers of exceence the Dispute Resoution Institute and the Heath Law Institute. Each MSL student wi focus their studies in a 17-credit subject area concentration each incudes a set of required courses but aso the opportunity to expore eective subjects from the rich array of course offerings in the JD curricuum. Students take aw schoo courses aongside fu-time aw students. And they can compete the degree in 12 months. Joint JD and Masters of Arts in Organizationa Leadership Program Students interested in obtaining a Masters of Arts in Organizationa Leadership (MAOL) with an emphasis in heath care compiance can do so through our coaborative program with St. Catherine University. The MAOL is designed to enhance an individua s abiity to ead and infuence in an ethica, effective, and enduring manner within and among organizations. The joint degree program permits students to compete both degrees with just 109, instead of 127, credits. SUMMER AND JANUARY TERMS The Heath Law Institute attracts many non-traditiona aw students and heath aw professionas who are ooking to advance in their current positions, earn CLE credits, or to change careers. The compact courses offered over summer and January terms, increasingy in an onine asynchronous format, offer an aternative to the reguar academic caendar and accommodate busy work and famiy schedues. They aso provide many non-hamine aw students with the opportunity to take heath aw courses that are not avaiabe at their home campuses. WEEKEND JD The part-time weekend JD program offers an aternative scheduing option for students. The weekend program is perfect for professionas who want to continue working whie advancing or changing careers. Hamine s weekend courses incude a number of heath aw professionas such as physicians, nurses, compiance officers, and reguators. Heath aw courses are schedued so that weekend students can earn the Genera Heath Law Certificate and/or the Heath Care Compiance Certificate. 14
