The Well-Rounded Investigator Defense Investigators Association - Fall 2013 Seminar Biographies of Presenters Honorable Judge Rogelio R. Flores, Santa Barbara County Superior Court, Santa Maria Division Testifying: The Defense Investigator on the Stand Judge Flores has been a judicial officer in the North Santa Barbara County Courts since 1987, having served as a court commissioner Prior to taking the bench, he worked as a lawyer for the Legal Aid Foundation of Los Angeles, private practice and the s Office in Santa Maria, CA. Judge Flores has previously been assigned to the various collaborative courts in Santa Maria including the Substance Abuse Treatment Court-SATC, (Drug Court), and drug treatment mandated by passage of Proposition 36, the High Risk DUI calendar, and the Veterans Treatment Court. He also presided over the Mental Health Court and calendars specializing in co-occurring disorders. Currently, Judge Flores is assigned to a felony trial calendar and continues to preside over the Veterans Treatment Court. Jim Voysey, Assistant Public Defender, Santa Barbara County Sexually Violent Predator (SVP) cases Jim Voysey has handled sexually violent predator cases since 1996, and has done extensive research on the methodology of psychologists who predict future behavior. Jim is familiar with Static-99, Static-2002, MnSOST-R, and Hanson's Meta-Analysis of risk factors. Jim has also attended all CPDA seminars on SVP defense representation. Jim Voysey was sworn in to the State and Federal Bar in 1977 and began his legal career working in private practice in San Diego. He was hired as a Deputy Public Defender in 1985, and handled all assignments over the years including misdemeanor trials, juvenile petitions, felony trials and death penalty cases. Jim was part of the first drug court team in Santa Barbara in 1995, and has been involved in therapeutic court policy since the beginning. Jim became an administrator in 2003, supervising the Public Defender Offices in northern Santa Barbara County, including the Santa Maria, Lompoc and Juvenile Divisions. Jim currently handles probate conservatorships, Mentally Disordered Offenders, NGI extension commitment petitions and sexually violent predator petitions. Robert Aguero, Private Investigator, Aguero Investigations Cell Phone Forensics Cell Tower Forensics GPS Forensics Robert Aguero is the owner of Aguero Investigations/CTF DataPro, Inc., a Bakersfield-based team of licensed Private Investigators. Aguero Investigations was founded in 1994 and has over 30 years of experience in investigations. Robert has completed more than 200 forensic cell phone examinations and cell tower data analysis investigations. Robert has provided expert witness testimony in the area of cell phone forensics and cell tower data analysis in Kern County Superior Court, Los Angeles County Superior Court, San Francisco County Superior Court, San Diego County Superior Court and Butte County Superior Court. Robert has been licensed as a private investigator in the State of California for 17 years. The Aguero Investigation team can provide an unbiased, independent analysis of the data on cell phones and GPS units. They have multiple certifications and utilize multiple programs and systems to retrieve data, including the Cellebrite UFED (Universal Forensic Extraction Device) Logical Unit, the Cellebrite Physical Pro and Susteen SecureView. These systems allow them to access thousands of the cell phones on the market today, as well as many GPS units. Robert also worked for 15 years as a police officer and detective. He wrote and executed over 200 search warrants and has been the lead investigator in over 30 homicides. 1

Rick Wall, Rick Wall and Associates, Somis, CA; Los Angeles Police Captain (Retired) Defending Subjects With Mental Illness Rick Wall is a police tactics consultant, lecturer and expert witness on the subject of law enforcement encounters involving the mentally ill, and a consultant on cases of stalking, workplace violence, and mass shootings. Rick retired from the LAPD as a Captain after more than 32 years with that agency. While with the LAPD he developed the department s best practices for interactions with persons with possible mental illnesses. He was awarded numerous commendations including a Certificate of Commendation from the Office of the Attorney General, State of California in recognition of his outstanding contribution to community, state, and nation in developing programs to assist law enforcement in addressing calls involving the mentally ill; and the Los Angeles Police Meritorious Service Medal for developing the department s Mental Illness Program (2007). Rick has testified before the United States Congress, Committee on the Judiciary on the Impact of the Mentally Ill on the Criminal Justice System and has made presentations at the Americans for Excellence in Law Enforcement Conference (AELE) on Mental Health, Legal Issues, and Suicide by Cop in Custodial Settings and for the Institute for the Prevention of In Custody Deaths (IPICD) on Dealing With Mentally Ill Prisoners: The Impact on Correctional Facilities. Rick has served on the advisory boards for the International Association of Chiefs of Police (IACP), Police Executive Research Forum (PERF), the Bureau of Justice Administration (BJA), and the Council of State Governments on issues related to law enforcement responses to the mentally ill. Rick is a certified instructor in Crisis Intervention Team (CIT) Techniques, Suicide and Suicide by Cop, Ethics in Law Enforcement, and POST Certificates (Basic, Intermediate, Advanced, Supervisory and Management). He is also a Licensed Private Investigator and Licensed Private Patrol Operator in the State of California Rick has a both a Bachelor of Arts Degree and Master of Arts Degree in History from California State University Long Beach, and was a Fulbright Scholar in the United Kingdom in 2002 where he attended the National Police Staff College at Bramshill. Steven D. Rice, Deputy Public Defender, Santa Barbara County Interviewing Informants Steve Rice currently handles serious felonies, including gang related crimes such as murder, attempt murder, robbery, burglary, rape and other serious and violent crimes. Steve has been practicing law since 2003, and has handled several hearings and trials involving confidential informants and witness-defendants turned informant. Steve has been an instructor in the Criminal Justice and Law Department at Santa Barbara Business College and is currently a member of California Attorneys for Criminal Justice (CACJ) and California Public Defenders Association (CPDA). Steve is a graduate of University of California, Santa Barbara and Golden Gate University School of Law. Ramon Gomez, Public Defender Investigator, Santa Barbara County; Instructor, Santa Barbara Business College Interviewing Informants Ramon Gomez is currently an Investigator for the as well as a Lead Instructor in the Criminal Justice Department at Santa Barbara Business College. Ramon Gomez is currently pursuing a PhD in Forensic Psychology, and has already earned Associate and Bachelor of Science degrees in Criminal Justice, as well as a Master of Science (MSLM) in Leadership and Management. Before working for the, Ramon worked as a Private Investigator and as a Juvenile Institutions Officer for the Santa Barbara County Probation Department. 2

Patricia Ashbaugh, Maguire and Ashbaugh, Primary Public Defender, San Luis Obispo County The law firm of Maguire and Ashbaugh, Attorneys at Law, serves as the Primary Public Defender for the County of San Luis Obispo. The firm has provided public defender services since 1980. Currently there are 21 attorneys, 4 investigators, 3 paralegals and one social worker. Patricia Nemec Ashbaugh is a principal in the law firm. Ms. Ashbaugh is a graduate of the University of California School of Law and has devoted her career to the representation of indigents accused of crimes. She has represented clients charged with both misdemeanor and felony crimes and has conducted trials in serious felony cases including homicides, three strike cases and death penalty litigation. Currently, Ms. Ashbaugh serves on the AB109 Executive Committee for San Luis Obispo County. Ms. Ashbaugh has been practicing in San Luis Obispo County since 1977. She was one of the founders of The San Luis Obispo Women Lawyers Association and the Women's Network. She has also volunteered with Mock Trial, serving as a committee member, team coach and scoring attorney. Bob Mulvaney, Chief Investigator, Maguire and Ashbaugh, Primary Public Defender, San Luis Obispo County Bob Mulvaney has been a criminal defense professional for 38 years, having worked both as an attorney and as an investigator. Bob is currently the Chief Investigator for the contract Public Defender in San Luis Obispo County, supervising a staff of four investigators. Bob is a graduate of Santa Clara University and the University of San Diego School of Law. Alan Costa, Social Worker, Maguire and Ashbaugh, Primary Public Defender, San Luis Obispo County Alan Costa earned a Master s Degree in Social Work from California State University, Fresno, and is currently the Social Worker for Maguire and Ashbaugh, the contract Public Defender for San Luis Obispo County. Prior to his employment with the San Luis Obispo County Public Defender, Alan was a career Probation Officer. He worked eight years as a Juvenile Probation Officer for Tulare County in an intensive "treatment" supervision unit before becoming a United States Probation Officer in Fresno, California in 1978. Alan performed various duties, including presentence and bail investigations and reports and field supervision. In 1984, Alan became a Mental Health Specialist, supervising a caseload of offenders with mental health and dual-diagnosis disorders. Alan also became a national trainer for the United States District Courts, providing training in "Working With and Supervising Mentally Ill Offenders to U.S. Probation Officers in various Court Districts in the United States. In 1995, Alan transferred to the Central District of California in Santa Barbara where he worked as a Field Supervision Officer and a District Mental Health Specialist. After retiring from his probation career in 2000, Alan began working for the San Luis Obispo County Public Defender, initially as an Investigator, and for the last four years as a Social Worker. Jim Allen, Arson-Bomb Investigator (Retired), Fire Technology Instructor, Allan Hancock College. Arson Investigation Jim Allen has investigated approximately 800 fires of all types, and is a member of the training committee for the State Board of Fire Services that developed the Certification Training Standards for the State of California certified fire investigators. Jim assisted in rewrite of Certification Training Standards in 1996, 2005 and 2010. Jim is a member of the California Department of Justice, Peace Officers Standards and Training Committee, which developed safety procedures for arson and explosives training for peace officers throughout the state. Jim has trained approximately 5000 fire service and law enforcement officers in California State Board of Fire Service, and California Peace Officers Standards and Training Certified Fire/Explosives Investigation Courses.
