3 What is the Victim Compensation Program? The California Victim Compensation Program (CalVCP) can help pay bills and expenses that result from certain violent crimes. Victims of crime who have been injured or have been threatened with injury may be eligible for help from CalVCP. Who Qualifies for Victim Compensation? CalVCP can help victims of crimes such as: Domestic Violence Homicide Child Abuse Robbery Assault Drunk Driving Sexual Assault Vehicular Manslaughter Elder Abuse Hate Crimes Minors who suffer emotional injuries as a result of witnessing a violent crime may be eligible for up to $5,000 for mental health counseling through CalVCP. CalVCP can help victims of crimes that occur in California as well as California residents who become victims while visiting other states or outside the country. Additionally, people who suffer a monetary loss because of death or injury to a crime victim may also be eligible for compensation. These victims can include: Spouses or Domestic Partners Brothers Children Sisters Parents Grandparents Legal Guardians Grandchildren California Victim Compensation Program 3
4 What Expenses Can CalVCP Help Pay? CalVCP may help pay for expenses related to a crime such as: Medical and dental treatment Mental health services Income loss Funeral and burial expenses Loss of support for dependents when a victim is killed or disabled because of a crime Home or vehicle modifications Home security Relocation Crime scene clean-up What Expenses Cannot Be Paid By CalVCP? Any expense not related to the crime Any expenses paid by insurance or another source of reimbursement or coverage Expenses for lost, stolen or damaged property Damages for pain and suffering There are limits on how much can be paid for each loss. The program cannot pay any expense for a person who is on felony probation, on parole, in county jail or prison. 4 California Victim Compensation Program
5 How Do I Apply for Compensation? There are four ways to apply: Contact the local Victim Witness Assistance Center in your county (see page 11). A victim advocate at the Center can help victims complete and submit the application. The victim advocate can also help victims learn more about the criminal justice system. Call CalVCP at Download an application at CalVCP at info@vcgcb.ca.gov When Submitting an Application Remember: Include copies of crime reports, bills and receipts with the application. Send bills to the insurance company, workers compensation carrier, or Medi- Cal right away. CalVCP will correspond with such providers as needed to verify benefits and coordinate payment of bills. How Do I Qualify for CalVCP Assistance? In addition to being affected by a qualifying violent crime: Report the crime to the police, sheriff, child protective services, or other law enforcement agencies. Apply to CalVCP within one year of the date of the crime. If the victim was under 18 and the crime was a sexual offense, the application must be filed by the victim s 28th birthday. Applicants/victims must cooperate with law enforcement during the investigation and prosecution of the crime. A victim cannot have participated in or been involved in committing the crime. Applicants/victims must cooperate with CalVCP by providing the information needed to review the application. California Victim Compensation Program 5
6 How Does CalVCP Pay My Bills? CalVCP verifies that all the bills are related to the crime, applies payment rates, and in most cases, pays the provider directly. If the applicant/victim already paid the bill, they should document it with CalVCP and the program will reimburse them directly. If the applicant/victim missed work because they were injured and are applying for wage loss, CalVCP will ask for information from their employer. The program will also ask for a disability statement from their healthcare provider. If the applicant/victim is self-employed, CalVCP will ask for two years of tax returns. If CalVCP paid the provider and the provider cashed the check, the provider cannot ask the applicant/victim to pay more money toward that bill. If the applicant/victim is asked to pay any money for a bill that the program already paid, they should let their victim advocate know or call CalVCP at What if Property is Lost or Stolen? CalVCP cannot pay for lost or stolen property. CalVCP can pay for medically necessary items such as wheelchairs, walkers, eyeglasses and dentures that are lost, stolen or broken during the crime, or that become necessary due to the crime. What if I Need Financial Help Immediately? CalVCP can provide the applicant with emergency financial assistance within 30 days, in certain situations. For example, if your personal or emotional well-being is at risk, you may qualify. Verification from law enforcement or a licensed mental health professional may be required. Child Witnesses to Violent Crime According to California Law, a child who witnesses a violent crime may be eligible for CalVCP assistance. Children under the age of 18 who witness a crime may qualify for mental health counseling benefits, even if they are unrelated to the crime victim. The minor witness must have been in close proximity to the crime. 6 California Victim Compensation Program
7 Will CalVCP Pay for My Relocation Expenses? CalVCP can help pay moving expenses such as first and last month s rent, deposits and temporary lodging if a victim needs to relocate for their own safety or emotional well-being. Relocation forms are available at Local victim advocates can assist with this process. What if an Insurance Company or Other Source Pays for Crime-Related Expenses? CalVCP works with the insurance company to determine how much of the bill qualifies for payment by CalVCP. By law, only bills that the insurance company or other sources do not pay can be paid by CalVCP. According to California law, CalVCP can only reimburse victims of crime-related expenses if there are no other sources of reimbursement. If CalVCP reimburses a victim for losses, but another source of funds becomes available to the victim because of the same criminal incident, CalVCP is entitled to be reimbursed. 8 Can I Receive Court-Ordered Restitution and CalVCP Assistance? Yes. Judges should order restitution from offenders on behalf of all victims who suffer a financial loss as a result of crime. There are two types of Restitution: Orders and Fines. A Fine is an amount determined by the type of crime committed, that the offender has to pay as his or her debt to society. Crimes including homicide, drug charges, sexual assault, and kidnapping are subject to felony restitution fines from $200 to $10,000. Fines go directly to the State s Restitution Fund to provide for victim compensation. An Order is the amount determined by the judge, with help of the victim and prosecutor, which is to be paid directly to the victim or family for the actual costs of the crime. If the offender is convicted, the court must issue a restitution order requiring them to pay the victim for actual financial losses resulting from the crime. Often, victims have expenses from the crime that require payment prior to the availability of restitution from offenders. CalVCP can provide financial assistance for qualified expenses until restitution becomes available, at which point CalVCP should be reimbursed. 8 California Victim Compensation Program
9 Victim s Right to Appeal Claimants have the right to appeal within 45 days of the decision if they are denied compensation. Except as required by law, CalVCP only discloses victim or applicant information with written permission. If the applicant or victim is a child or incapacitated adult, the written permission must be provided by a parent, guardian or other person legally authorized to represent the applicant or victim.
