President s Corner The Boca West Homeowners Association extends a hardy welcome home to all our residents. Summer time when the living is easy has drawn to a close and we are gearing up for a full season of activity. This season we delayed the first issue our publication, The Voice Of Boca West. This issue, October/November has more pertinent and timely information. It was planned to coincide with the arrival of the majority of our homeowners. For many years BWHA has been proactive with the voter registration program. This year we again made absentee ballots available. The cutoff date to request an absentee / vote by mail ballot is Oct. 26, 2012. We have stepped up our voter registration program. Rose Lee Wander, a Boca West resident who is certified to re-register voters has been busy re-registering our residents at The Boca West Homeowners office. Incidentally the cutoff date to re-register is October 9, 2012. Re-registration is required if you have changed your name and/or address since the last election. You must appear in person for Rose Lee to register you. Interested?? We have partnered with the Police and Fire Departments under the auspices of the West Boca Community Council to bring you a valuable safety and health opportunity. In the event you are in an automobile accident in your car, or you were to take sick while driving and have to pull to the side of the road, the police or fire department upon arrival will see a yellow dot decal placed in the lower left corner of the rear window on the driver`s side to alert first responders. This will alert them to the fact that there is a folder in your glove compartment which will contain a picture I.D. as well as a record of all your medical information. This information could be life saving as it would contain a list of your medicines and any medical conditions you have. It will be immediately available even if you are not conscious or lucid. In order for you to receive this packet, your village MUST be a member of BWHA. Packets will be distributed to your board president and/or management company representative for distribution. Voters are asked to provide valid picture identification with signature The following photo ID will be accepted.: Florida driver`s license, Florida Identification Card issued by the Dept. of Highway Safety and Motor Vehicles, United States Passport, Debit or Credit Card, Military Identification, Student Identification, Retirement center ID, Neighborhood Association ID and Public Assistance ID. If your photo ID does not include your signature you will be asked to provide additional identification. If you do not have the proper identification, you will be provided a provisional ballot. Your provisional ballot will count if the signature on the provisional ballot envelope matches the signature on your voter registration application. You can apply for an absentee ballot, vote at home and avoid any problems at the polling place. As a citizen you have the right to vote but also the responsibility to know what is required. 11 Proposed Constitutional Amendments The Republican dominated Legislature put a total of 11 constitutional amendments on the Nov. 8 ballot. If approved by 6o% of those voting, they would scale back abortions; allow state aid to religious and parochial schools; and attempt to ban implementation of the health care law in Florida. Five- Amendments 2,4,9, 10 and 11 would give bigger tax breaks to first time homebuyers, seniors living in a home for 25 years or more, surviving spouses of military veterans or first responders, and companies in purchasing equipment. PROPOSED AMENDMENTS Amendment 1: It prohibits laws from compelling any person or employer to purchase, obtain or otherwise for health care coverage Amendment 2: expands homestead exemption for combat disabled veterans to those who were not Florida residents when they entered the military Amendment 3: Replaces the existing state revenue limitation based on personal income growth with a new one based on inflation and population changes. Amendment 4: Multiple property tax changes include a temporary 50% homestead exemption for new homeowners and a 5% cap on annual assessment increases of no homestead property. Amendment 5: Allows the Legislature to repeal court rules by a majority vote rather than the two-thirds vote now required. Amendment 6: Prohibits public funds from paying for any abortion or for health benefits coverage that includes abortion coverage. Provides that the state constitution may not be interpreted to create broader rights to an abortion than those contained in the U. S. Constitution. Amendment 8: Provides that no individual or entity may be denied government funding or other support on the basis of religious identity or belief, except as required by the First Amendment of the U.S. Constitution, and deletes the prohibition against using public funds to aid any church, sect or religious denomination or sectarian institution. Amendment 9: Provides homestead property relief to the surviving spouses of military veterans and first responders who died in the line of duty. Amendment 10: Provides an exemption fro ad-valorem taxes leveled by counties, municipalities, school districts and other governments on tangible property worth more than $25,000 but less than $50,000. Amendment 11: Allows counties and cities to grant a homestead exemption equal to the assessed value of a home if that property ia valued at less than $250,000 and theowner has lived there for at least 25 years, is at least 665 and has a low income as defined by general law. Amendment 12: Replaces the president of the Florida Student Association with the chair of the council of state-university student-body presidents as the student member of the State University System`s Board of Governors. The League of Women Voters and the Sun Sentinel are recommending we vote NO! on all the above listed amendments. We are merely passing this information on to you --- but the League and Sun Sentinel are reputable sources. The choice of how to vote remains with you!

Citizens OK s 10% Rate Hike On July 26,2012 Citizens Property Insurance board voted to increase premiums by more than $ 250 million with a statewide average rate hike of 10 percent. Board member killed two controversial proposals to charge new policyholders much higher rates and to reduce coverage for certain water damage to $15,000. Florida`s largest property insurer, with 1.4 million policies are capped at 10% a year by state law, but some premiums may be higher, because the cap does not cover fees for certain backup coverage costs. Personal residential policies would receive a 10.2% statewide average increase, including 10.5% for homeowners and 9.7% for renters. Premiums for most of Citizens` 583,526 homeowners insurance customers in South Florida would increase by about 11% because of surcharges that are not subject to the rate cap. For many, the rate hike will come on top of premium increases in recent years after inspections and revoking discounts for hurricane resistant features. Citizens estimated premiums have increased by $137 million based on inspections done in the past few years. The board voted to provide options for higher non hurricane deductibles of 1,2,and 5% of the coverage value; change sinkhole coverage and increase minimum deductibles for condominium building and businesses from $1000 to $2,500 and offer 5% deductibles for hurricane and other wind or hail coverage. STEP UP AGAINST UNWARRANTED SOLICITATIONS Boca West is a wonderful community and as residents we are very fortunate in many ways. A big advantage is living within a gated complex. There are however some vendors who take advantage of their gate access to distribute advertisements. We`ve found them tucked into our car windows and the doors of our homes. This is a violation of our rules and there is no reason for us to be subjected to these solicitations. If you receive an ad, flyer, business card etc., in this manner please call the security office and file a complaint against the vendor involved. They will contact the vendor and if there are any further violations that company or individual will lose entrance privileges to Boca West. Lets all do everything we can to keep Boca West beautiful. A Big Step To End Drug Pay-For-Delay Deals A long running battle over whether manufactures of brand-name drugs should be able to pay their rivals to keep lower cost generics off the market may be headed to the U.S. Supreme Court. In July, a federal appeals court found pay for delay agreements to be anti-competitive, as drug wholesalers and retailers claimed in a lawsuit. But because three other appeals courts have upheld the deals, the issue is likely to be settled by the nations highest court. The FTC estimates that the deals cost consumers at least $3.5 billion a year.

UNSUNG HEROINE S GROUP HELPS FUND U.M. CANCER CENTER JoAnne Goldberg, along with her husband Gerry, are long term residents of Boca West. Twelve years ago, she attended a breakfast where a doctor from the Sylvester Center spoke. He was so passionate about his work and the break tthroughs he felt were at hand. But its research needed funding. That was when she knew that the Pap Corps, where 90 % of the money raised goes to research, was where she wanted to volunteer. In May, 2012, she became president of the Pap Corps. She heads the executive board, which oversees and coordinates 55 chapters and 20,000 volunteers in the tri-county area. The board creates joint fundraising events, provides support to the chapters, builds relationships within the communities and allocates funding. Her goal is to exceed in fundraising the $3.4 million, a record, achieved last year. She stated that the Pap Corps is celebrating it s 60th year with a variety of fundraisers. For Your Information Can a board inspect your home, inside or outside, to make sure your property is up to snuff according to the association? Outside Yes, inside No. During the sales process title companies prepare an estoppel letter, which ensures that the unit is current with its maintenance obligations and advises if any special assessments are imminent. Also many estoppel letters also ask if the property is in violation of association rules so that new owners are not wrongly held responsible for actions of prior owners. Can a condo or HOA board require a down payment from a potential owner or renter? Yes. As long as the requirement is officially included within the community`s declarations, an association is allowed to demand down payment in excess of those required by mortgage lenders. This makes sense because associations are more cognizant that their interest in the property is subordinate to first mortgages, and the smaller the owners equity in the property the greater the likelihood that they may walk away from the property. Being on a Board brings legal risk: Serving on your condominium or HOA board is almost akin to a civic duty, but it comes with a legal risk. Anyone who considers joining a board should understand the heavy burden Florida places on volunteer directors.. Financial stakes are high, which causes more friction between board members and owners, Also there is also the possibility of being sued while on the board. That is why it is important to make sure that your board is covered by adequate liability insurance. Florida law does not require boards to purchase liability insurance, but it holds board directors liable for failure to meet fiduciary duties. Second Turnpike Interchange not planned for Boca: Turnpike officials in 2010 shelved plans for a second Boca Raton interchange because traffic volume has declined at the Glades Road exit. Officials preferred Palmetto Park over Yamato for a second interchange because Palmetto Park is south of Glades and most turnpike traffic in Palm Beach County is headed to and from the south. Also in a few years the Glades Road interchange should see more relief as the toll booths are demolished in a move to collect all tolls electronically. Expect Higher Premiums: A new analysis shows Sociual Security benefits probably won`t keep up with Medicare premiums in the next few years. The Congressional Budget Office forecast Social Security increases of no more tha 1.3% in 2013 and 1.4% for the two years after that, while Medicare Part B premiums are expected to rise next year almost 11% or about $10.60 a month to $110.50. The rising Part B premium would trigger a special hold harmless provision that would adjust premiums so that the increase is no more than the monthly Social Security benefit increase. However there is no such protection against rising Part D drug plans premiums, or those for Medicare Advantage plans.

No Disabled Permit? Don`t Park Illegally! There are a multiple of reasons why you should not park in a handicapped spot without a permit in your name. First and foremost it is illegal. Florida statute makes it unlawful for any person to stop, stand or park a vehicle within any such specially designated and marked parking space unless that vehicle displays a handicapped parking permit or license plate. Too many people believe it is permissible to use someone else`s parking permit, while borrowing that person`s car oe even when driving their own vehicle. That to is illegal unless the handicapped person is with you as a passenger. When a permitted driver parks in a designated spot but forgets his placard, the fine is $250. But id you illegally borrow his placard, not only will you be charged with a second degree misdemeanor, and a $1,000 fine or up to six months in jail, the permit holder could very well lose his parking privileges. This hopefully will deter deter individuals from loaning their permit to family members.. Even if you are running an errand for the disabled person, if he is not present the fine is $1,000. If the law does not inspire you to observe those signs, how about a little compassion. Some people have difficulty getting around so if you can walk the extra distance from a regular parking spot be thankful for the exercise and the ability to do it. CHANGES TO PERSONAL INJURY PROTECTION (PIP) INSURANCE On July 1, 2012 changes to personal injury protection insurance, the no fault coverage that pays up to $10,000 for injuries suffered in an accident regardless of fault. The system which regulators say is riddled with fraud, will see major reforms that lawmakers, Gov. Scott and CFO Jeff Atwater hope will curb fake accidents and control over-billing health care providers. Many of the changes became law on July 1, 2012 other don`t go into effect until Jan. 1, 2013. Under the immediate changes, a crash report must include information about all drivers and passengers. License requirements for clinics are tightened and a new organization, run by Atwater`s office will be formed to combat PIP fraud. The component of the bill that limits payments to $2500 for non emergency treatment does not take effect until Jan.1, 2013, as does a ban on payments for acupuncture and massage therapy. At this point no one, including CFO Atwater know how the group being formed will work. Aside from the fact that the CFO, attorney general and other state officials will make appointments to it from the insurance and medical industries, details still are nit clear. Insurers are required to reduce rates by 10% by Oct. 1, 2012 or explain to the state why that is not feasible. A second deadline of Jan. 2014 requires a reduction of rates of 25% or an explanation of why that reduction cannot be achieved. One reason insurers are still skeptical about the laws effect on rates is that several unanswered questions remain- one of them being what effect if any Atwater`s fraud fighting group will have. Another is how emergency medicval conditions will be defined. Under the new law, accident victims must see a physician, which could include a chiropractor within 14 days. If they require emergency treatment. A doctor cann bill up to $10,000. If not, doctors can only bill up to $2,500.
