Published for more than a quarter of a century, Best Lawyers lists attorneys in 79 specialties, representing all 50 states and the District of Columbia, who have been chosen through an exhaustive survey in which thousands of the nation s top lawyers confidentially evaluate their professional peers. The 2012 edition of Best Lawyers, which was published in November 2011, is based on more than 2.8 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 26 years ago. Lawyers are chosen for inclusion based solely on a vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2012 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Voting lawyers were provided this general guideline for determining if a nominee should be listed: If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them? All votes and comments were solicited with a guarantee of confidentiality a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. A Special Advertising Supplement Changing Lives Medical Malpractice Titan Jack H. Olender Fights Hard and Gives Generously COVER Spotlight When defense experts testified that an injured girl would not live long enough to justify a significant amount of money to pay for her care, her attorney, Jack H. Olender, was furious. Due to errors made by two obstetricians, the little girl was rendered with cerebral palsy at birth. Olender fought hard, and it worked. The injured girl, in fact, did not die very young, but graduated college and went on to counsel children with disabilities. Without the lawsuit, the outcome would have been very different, Olender says. Thanks to the money obtained from the jury verdict, the child was able to get excellent care and good schooling, Olender recalls. The administrator at the hospital where the girl was delivered later stated the jury verdict was the best thing that ever happened to the hospital, because it helped improve practices within the obstetric department. Dubbed the King of Medical Malpractice, Olender achieved the country s first multimillion dollar obstetric malpractice verdict in 1976. Since then, his work has resulted in more than 200 verdicts and settlements of $1 million or more. The verdicts and settlement awards Olender wins on behalf of his clients mean these children can receive the best in treatment, therapy, and training. These results mean that these children have the financial means to live as nice a life as possible, he says Without these verdicts and settlements, most families would not have the means to obtain adequate full care, training, rehabilitation, and education for their children who suffered from birth injuries. Olender s dedication to helping children who suffer brain damage or cerebral palsy as the result of birth injuries and improper prenatal care has also resulted in improved policies and procedures in hospitals, as well as impacted legislation. He wishes more attorneys would avoid agreeing to complete secrecy of cases in settlement agreements, since this limits the potential positive changes that can result from education relating to a case. A desire for secrecy means that doctors and medical personnel aren t always informed about mistakes, and therefore are limited from preventing recurrences. In many jurisdictions, including the District of Columbia, a lawyer can ethically agree not to disclose the amount of the settlement, but cannot be required to agree to keep the case secret, Olender explains. This is something that many lawyers know about, but some do not and will sign a total secrecy agreement. In another case in which a CT scan was misread, a neurosurgeon performed brain surgery on the wrong side of a teenage girl s brain. Instead of removing the cancerous area from her brain, the surgeon mistakenly removed a portion of the healthy side of her brain. As a result, the girl lost her short-term memory and had to undergo a subsequent surgery to have her tumor removed. That mistake occurred with a particular brand of CT scan equipment, and I attempted to place advertisements in six of the top medical journals in the country to warn doctors of the tendency of this particular CT scan machine to improperly designate right and left, Olender recalls. All six journals rejected the ad. Finally, American Medical News found out about the danger and published an investigative report. The radiologist in Olender s case devised a simple method to correct the equipment s mistake. He placed a chip on the right side of the patient s head, so that when he read the scan, he could always be sure which side was which. Yet, he never told anybody about that, Olender says. Throughout his expansive career, Olender has observed changes that have made malpractice cases increasingly more challenging to prosecute. The courts have changed the law to require very high standards for expert testimony and have stiffened the rules relating to those who can testify in court, Olender says. In addition, the expense of undertaking medical malpractice cases makes them harder to get to trial. It is not rare for an attorney to shell out $100,000 and more to advance the costs of a medical malpractice case. My firm s experience in handling these types of cases, our ability to access the right experts, and our financial capability to front the costs mean that we can tackle medical malpractice cases when some other firms cannot, Olender says. Olender s commitment to making a difference is not limited to his legal work. He and his wife, Lovell, created the Olender Foundation to counter poverty and violence and to promote opportunity and equal justice. We use the foundation to aid in medical, civil rights, and community projects that benefit both our local community and the nation, Olender says. In addition, the foundation honors leaders at an annual event that draws crowds upward of 500 at the Ronald Reagan Building and International Trade Center in Washington, D.C. Previous honorees include Muhammad Ali, Jerry Lewis, Buzz Aldrin, and more. A Special Advertising Supplement Barry J. Nace Reflects Upon 40-Year Career of Helping Victims of Medical Malpractice COVER Spotlight Exceptional Case If you want to make Barry J. Nace angry, talk to him about so-called frivolous medical malpractice cases. When I hear someone say something about a frivolous medical malpractice suit, I want to tell them to come and work with me for a day to find out what s really happening, Nace says. Medical malpractice cases are expensive to take on; an attorney doesn t invest that kind of money in a case unless he or she believes that it is a strong case. For almost four decades Nace has been a go-to attorney for injured people and victims of medical malpractice. As someone who always wanted to be a trial lawyer, Nace has handled historic cases that have resulted in multimillion-dollar verdicts and settlements, along with new legislation. Three of his cases resulted in awards in excess of $30 million. As a result of his work on the landmark case of Daubert v. Merrell Dow Pharmaceuticals, Inc., the Supreme Court lessened the standard for the admissibility of expert testimony. The case continues to be widely cited in commentary related to the subject. During his lengthy career, Nace has observed definite changes in medical malpractice law. It has become more difficult to take medical malpractice cases to trial because the requirements have become so onerous, requiring more time and money, he says. As a result, many cases never make it to trial, leaving victims with few options. Most people never hear about the clients Nace represents. They come to him often at their most critical hour, desperately needing help. Everyone likes to criticize trial lawyers until they need a trial lawyer, but people forget that we help people who are hurting, Nace says. To this day, he has never forgotten the expression of one of his clients who ran up to him during a trial break in the courtroom. A defining moment in the trial had just taken place, and Nace s client literally had him against the wall in excitement. He told me, Now I know what happened, Nace recalls. It was very important to him to finally know and understand what occurred in his medical malpractice case. Another memorable moment came when Nace watched one of his three sons win his first case on his own. Today his sons, Christopher T. Nace, Jonathan B. Nace, and Matthew A. Nace, all work with him at the firm, along with Caitlin Palacios, who began her legal career with Nace in the 1990s. As children, Nace s sons would accompany him when he attended legal conventions. He was pleasantly surprised when they all decided to go to law school and, ultimately, practice medical malpractice law. Anyone who works with their children will tell you that it is a unique experience. I have three of them working with me, so I have triple the unique experience, Nace says with a chuckle. Nace earned a BS degree in chemistry from Dickinson College in 1965 and earned his JD from Dickinson School of Law four years later. The law school also awarded him an honorary doctor of laws degree in 1994. A founding member of the board of the Public Justice Foundation, Nace was elevated to the highest rank of advocate with the American Board of Trial Advocates. He served as president of the Association of Trial Lawyers of America and as chairman of the ATLA PAC, which lobbies to promote justice and fairness for injured persons. In addition, Nace served two terms as president of the Trial Lawyers Association of Metropolitan Washington, D.C. Fellow attorneys elected Nace to join the International Academy of Trial Lawyers and the American Law Institute, and he is Board Certified in both civil litigation and medical malpractice. He also served as President of the National Board of Legal Specialty Certification. He has been selected for inclusion in The Best Lawyers in America for nearly 20 years. Nace is also a repeat honoree of both Who s Who in American Law and is among the Top 100 Washington, D.C. Area Super Lawyers. He attributes his success to hard work and ripping his cases apart to study every single detail. Bekman Achieves $1.25m Jury Verdict for Victim of Knife Attack Case Settled for a Confidential Amount Following Appeal by Nordstrom Spotlight Malls are supposed to be safe places where customers should only have to worry about overspending, and maybe missing out on a great sale. They aren t supposed to be places where people get hurt. But that s exactly what happened at a Maryland shopping mall in 2005, when a woman attacked employees and shoppers in a department store with knives. Recently released from prison, the woman carried a plastic bag with knives inside. She had taped two together, so there were blades on each side. It was around 5:30 p.m. on a weekday evening when the woman went to the third floor of a department store and walked to the customer service area. Two store employees were behind the counter assisting customers. The woman removed the knives from her bag, climbed over the customer service desk, and attempted to stab the two employees. They fled to an office and locked themselves inside. The woman stomped around the customer service area before attempting to stab another employee, who ran away. The attacker moved to another department, where she knocked down a young woman and stabbed her several times. Another customer was in the dressing room and heard the commotion. She investigated, but didn t see anything and returned to the dressing room to change into her clothes. After leaving the dressing room a second time, the customer took the escalator to the third floor. The attacker pushed her down from behind and stabbed her multiple times. The injured woman staggered to the bottom of the escalator. An off-duty FBI agent happened to be at the bottom of the escalator. He pulled out his gun and arrested the attacker. Following the horrific incident, the victim in the dressing room hired respected trial attorney, Paul D. Bekman. Second, they failed to train their employees about this manual, which had existed for some time. Bekman tried the case for two weeks along with associate, Ryan Perlin. It took the jury about an hour and 45 minutes to award Bekman s client $1.25 million. When the store appealed the case to the Maryland Court of Special Appeals, mediation was held, and the case was settled for a confidential amount. Today Bekman s client suffers atrophy and limited motion due to her injury, in addition to post-traumatic stress disorder. She was unable to work following the attack, but is now able to work part time. Bekman attributes the outcome of the case to intense preparation. We out-prepared the other side and were ready for everything, he says. We spoke to several employees who were on duty that evening, and they didn t know about the store manual and were not trained on its contents. Following the incident, the store amended its manual to include a specific code for emergency situations like the attack. I think my client felt redeemed in the sense that she went through this terrible tragedy, and she always held the belief that this could have been prevented. The jury agreed, says Bekman, who has been recognized by his peers for achieving a significant amount of multimillion-dollar awards. Bekman has been selected for inclusion in The Best Lawyers in America since 1989 for the practice areas of personal injury, medical malpractice, product liability, maritime law and alternative dispute resolution. He was named Lawyer of the Year for the personal injury category in 2009, for medical practice law in 2010, for products liability litigation in 2011, and alternative dispute resolution in 2012.
