Working Condition Certification for Maritime Labour Convention (MLC, 2006) Maritime Labour Management Systems MLC, 2006 The date of enforcement: 20 Aug. 2013 This Convention has been adopted to establish a forth pillar in the maritime field to support high quality shipping, namely SOLAS, MARPOL, STCW, MLC, 2006. The MLC updates and consolidates existing ILO requirements concerning the working and living conditions of seafarers onboard ships. Inspection and certification under the Convention are applicable to ships of 500 GT or more engaged in international voyages. The requirements of the Convention apply to all seafarers who are employed or engaged or who work in any capacity onboard the above ships. The requirements of the Convention for working and living conditions of seafarers on board ship contain minimum requirements for seafarers, conditions of employment, accommodation and recreational facilities, food and catering, helth protection, medical care, welfare and social security. The shipowner (Company under the ISM Code) must establish and implement a Maritime Labour Management System incorporated with measures for ongoing compliance with the requirements of Convention and national provisions of the flag state, namely Declaration of Maritime Labour Compliance Part II (DMLC Part II). The shipowner and master of the ship are to properly implement the MLC according to DMLC Part II and shipboard inspection and certification are required similar to SMC/ISSC certifications. Working Condition Seafarer Recruitment and Placement Services Certification in accordance with Maritime Labour Convention (MLC, 2006) This certification is provided to seafarer recruitment and placement service providers to certify compliance with Maritime Labour Convention 2006 (hereinafter referred to as MLC2006 ). ClassNK will certify that the seafarer recruitment and placement service providers conform to the standards set out in the Regulation 1.4 and the applicable code of MLC 2006. What are the benefits? Under MLC2006, seafarer recruitment and placement service providers are required to establish, implement and maintain a quality system complying with the requirements regarding; no fees or other charges for seafarer recruitment and placement or for providing employment to seafarers, prohibition of using means intended to prevent or deter seafarers from gaining employment, establishment of appropriate procedures for complaints concerning providers activities, maintaining of an up-to-date register of all seafarers, etc., which are stipulated in Regulation 1.4 and the applicable code of the MLC 2006. Safety & Environment Certification for ISM Code & ISPS Code Safety Management System & Ship Security Management System ISM Code: Safety Management System Safety management objectives of the Company should provide for safe practices in ship operation and a safe working environment, assess all identified risks to its ships, personnel and the environment, establish appropriate safeguards, and continuously improve safety management skills of personnel onshore and onboard ships, including preparing for emergencies related both to safety and environmental protection. Verification (audit) and certification under the ISM Code applies to Companies and ships of 500 GT or more which engaged in international voyages under their management. ISPS Code: Ship Security Management System Security management objectives are to establish an international framework to detect security threats and take preventive measures against security incidents affecting ships or port facilities, to ensure the early and efficient collection and exchange of security-related information, to provide a methodology for security assessments so as to have in place ship security plans and procedures to react to changing security levels, and to ensure confidence that adequate and proportionate maritime security measures are in place. Verification (audit) and certification under the ISPS Code is applied to ships of 500 GT or more which are managed by the company and engaged in international voyages. What are the requirements? ISM Code Certification The company shall establish a Safety Management System containing the company s policy, Manual and procedures which ensure compliance with mandatory rules and regulations; and that applicable codes, guidelines and standards recommended by the IMO, Flag States, Classification Societies and maritime industries are taken into account and implemented onboard and ashore. ISPS Code Certification The company shall establish a Ship Security Management System containing a Ship Security Assessment and Ship Security Plan to identify and take preventive measures against security incidents and implement them onboard and ashore.
