III. REQUIRED DOCUMENTS FOR CUSTOMS CLEARANCE Exhibits for temporary use: * ATA CARNET: For merchandise which is being imported only for the exhibition purposes and for which sale during the exhibition is not expected and we strongly recommend to use ATA Carnet (issued by Chamber of Commerce and Industry in the country of origin). Additional a Power of Attorney on behalf of Schenker is required. * PROFORMA-INVOICE: If you are not sure, what will happen with your goods after the show, we recommend sending the shipment under Proforma Invoice (3 Originals) clear description of items and nature (= HSCode), gross/net weight, no. of pieces, price & Incoterms (= delivery terms). Permanent Entry & Advertising, consumer materials/catalogues for consumption: For these goods please provide separate PROFORMA-INVOICE as this merchandise follows valid customs regulations after arrival identified for release into free circulation, or for consumption during the exhibition and customs fees (customs duty, VAT, Consumer tax) are applicable to this merchandise. Please also note that they are strict restrictions for consumable items such as foodstuff and beverages, to be imported to the European Union. Please indicate full details 2 weeks before dispatch of cargo. IV. INSURANCE We would like to advise that it is the responsibility of each exhibitor to arrange a transport insurance covering transport to the exhibition, time during the exhibition and the return transport. Please ask our branch office in your country or our Berlin office for assistance. SCHENKER is not responsible for any material left unattended at the stand or in empty crates (labelled as empty), unless the exhibitor has stipulated the contrary. V. TERMS AND CONDITIONS OF TRADING All our business is transacted exclusively on the basis of the German Freight Forwarders' Standard Terms and Conditions (ADSp) and, to the extent these do not apply to logistics services, in accordance with the General Terms and Conditions for Logistics (Logistik-AGB) most recent edition. - Under Clause 23 ADSp, liability for damage/loss to goods according to 431 HGB (German Commercial Code) is limited - to 5 EUR/kg whilst in the custody of the freight forwarder - to 2 SDR/kg (Special Drawing Rights) for multimodal carriage incl. sea transport - to 1 million EUR or 2 SDR/kg per claim or to 2 million EUR or 2 SDR/kg per event, irrespective of the number of claims per event, in each case whichever is higher If we are liable according to the provisions of the Montreal Convention, clause 27 ADSp shall not apply. Clause 27 ADSp shall also not be considered as an extension of our liability through imputation of default by agents, representatives, employees,
