SECTION 1 GENERAL INFORMATION AND GUIDELINE TO THE TARIFF & RATES 1. WORKING HOURS ADMINISTRATIVE 0830-1700 : Monday to Friday 0830-1230 : Saturday Closed : Sunday and Public Holidays OPERATIONS The port operates 24 hours per day whole year thorough Per Shift means one of the following periods:- 0800 to 1600 hours 2 nd Shift 1600 to 2400 hours 3 rd Shift 2400 to 0800 hours 1 st Shift Per Day means from the following days. G.R.T means the gross registered tonnage of the vessel. L.O.A means length overall of the vessel. Port Operator means Lumut Maritime terminal Sdn Bhd (LMTSB). 2. NOTICE TO DISCHARGE OR LOAD CARGO The owner, master or agent of every vessel shall give written notice to the Operation Manager of his intention to discharge or load before such work is commenced. Cargo discharged without permission of the Operations Manager being first obtained, shall not be deemed to be in the custody of Lumut maritime Terminal Sdn Page 5 of 33

Bhd. (LMTSB) nor shall LMTSB be held responsible for any loss or damage that may result to such cargo from any cause whatsoever. 3. DEPOSITING CARGO FOR SHIPMENT Goods shall not be deposited anywhere within the premises of port proper without the written permission of the Operations Manager. 4. CONDITION OF HIRE EQUIPMENT OF GEAR Lumut Maritime Terminal Sdn Bhd while taking all reasonable precautions that the gears are in sound and useable condition, will accept no responsibility for any consequences which may arise owing to breakage or other unforeseen circumstances during the period of hire. The articles are hire on condition that the entire liability rests with the hirer who will be required to indemnity Lumut Maritime Terminal Sdn Bhd accordingly. 5. FIRE Lumut Maritime Terminal Sdn Bhd shall not be responsible for losses or damage by fire nor any loss or damage resulting from a necessary and bona fide effort to put out a fire. 6. RESPONSIBILITY OF CHARGES Unless otherwise specifically provided or previously agreed, responsibility for all charges will be as stated in the General Tariff & Rates. 7. UNDERCHARGES Lumut Maritime Terminal Sdn Bhd shall be entitled to collect any amount which may be ascertained to have been undercharged or that which may otherwise have been found to be due. 8. SPECIAL RATES FOR SERVICES Lumut Maritime Terminal Sdn Bhd can enter into special agreements for the provision of any services and application for special rates particularly where large consignment and/or guaranteed volume are involved should be made to the General Manager. 9. HEAVY PACKAGE OR HEAVYLIFT Heavy packages means any package of cargo exceeding 2,500 kilograms per unit. 10. VALUABLE CARGO Valuable cargo means:- a. Any package containing bullion, precious stones and jewellery or b. Any package of goods exceeding RM2,000 in value and less than 1 cubic metre in measurement per package. 11. CHARGEABLE TONNAGE Chargeable are based on metric units of 1000 kilograms or one cubic metre, whichever is the greater. Lumut Maritime Terminal Sdn Bhd may elect to calculate all tonnages of cargo according to the cubic measurement or gross weight whichever is the greater whether or not a ship s manifest or shipping note is lodge with Lumut Maritime Terminal Sdn Bhd. DEFINITION Per tonne means one metric tonne of 1,000 kilograms or one cubic metre or part thereof. Per metre means per metre or part thereof. Per day means per day or part thereof. Page 7 of 33

Per week means per week or part thereof. Per month means per month or part thereof. 12. DELIVERY AND SHIPMENT When application is made for delivery or shipment of cargo, Delivery or Shipping Order must be produced showing the contents and the measurements and gross weight of packages described in Bahasa Malaysia or English. The date of ship s arrival in or departure from Lumut Port must be stated in these documents. 13. BERTH OCCUPANCY Berth Occupancy charges are payable by vessels alongside LMTSB wharves (including barge berth). These charges are based on the tonnage of cargo discharged and/or loaded. 14. PILOTAGE FEE Pilotage service to enter or leave the harbour is compulsory for vessels of above 25 metres length overall (LOA). Pilotage fee is payable on length of vessels per operation. 15. STORAGE CHARGES (a) In including the free storage allowed, Sundays and all gazette public holidays will be included. (b) The storage period for import cargo will be counted from the time of completion of discharge of vessel/barge or completion of each consignment of cargo from the lighter. (c) For export cargo, the storage period will be counted from the time of receipt of the cargo until the time the vessel/barge is berthed or in the case of lighters, from the commencement of loading into a lighter for shipment. (d) Long storage may be granted at the discretion of the Operations Manager and maybe done on acceptance of an application for long storage rate. Rates shall be quoted on a case to case basis by the General Manager. (e) When tarpaulins are used to protect cargo stored in the open storage, the rental will be charged at covered shed rates. (f) Arms, ammunition and explosives will not be received into storage by LMTSB. (g) Store-rent on heavy-lifts will be based on weight or measurement whichever is the greater. 16. PASSENGER VESSELS Passenger vessel means a vessel which fulfils the following:- i) The vessel must have definite and fixed estimated time of arrival, estimated time Departure and sailing which shall be published at least six months in advance and. ii) The number of passengers carried during a voyage when the vessels calls at Port shall not be less than one hundred and these passengers may or may not embark or disembark. 17. LIEN ON CARGO i) All goods shall remain subject to lien for any port charges or other charges due in respect of such goods and may be wholly or partly detained until all such charges have been paid. ii) All goods coming into the custody of the port operator shall also be subject to lien from either the owner or consignee of such goods. iii) The goods detained under paragraphs (i) and (ii) may be sold by auction and in the case of perishable goods, such goods shall not be sold earlier than twenty four hours after the landing and the proceed shall be applied in satisfaction or reduction of the amount due and expenses. 18. GENERAL CONDITION (a) LMTBS shall not provide any service or accommodation to any person unless such person make a request in writing for the same, where such request is made, LMTSB may where it deem fit to do so in the interest of LMTSB refuse the request without assigning any reason therefor. (b) A Delivery Order for delivery of imported goods shall not to be acted upon until such order in writing has been received from the ship owners or agents. (c) A Shipment Order for the shipment of goods shall not be acted upon unless it is endorsed by the ship owners or agents. (d) In all cases Customs Requirements shall be complied with before delivery or shipment is carried out. (e) LMTSB may removed goods at any time it considers necessary and the appropriate removal charges shall apply. 19. VESSEL Vessel include barges, lighters and any ship or boat or any sea going or inland water craft including any floating objects used in the navigation for carriage of goods and passengers. 20. CARGO (GOODS) Cargo includes livestock, minerals, wares, vehicles and merchandise of every description whether containerized or otherwise and include any passenger luggage and effects. Permission to an owner of goods to open packages within the port premises may be granted by the Operations Manager upon an application being made, subject to Customs regulation and subject to the Lumut Maritime Terminal Sdn Bhd and no subsequence claims for damage or shortage of contents shall be entertained. Packages which have been opened for Customs Examination, appraisement, survey Page 10 of 33

or for any other purpose by the owner of goods shall lie in the port premises at he risk and expense of the owner of the goods. 21. CHARGES FOR OTHER SERVICES Charges for any services not provided for in the General Tariff & Rates will be quoted on application to the General Manager. 23. DANGEROUS CARGO Dangerous Goods includes ammunition, explosive, petroleum or other inflammable, noxious or dangerous substance or article and any goods defined as dangerous or hazardous by Statute, Statutory Instrument or Order, and Regulation or Recommendation made by Government or by the Local Bye-Law relating to the handling, storage or carriage of goods; likewise all goods which although not so defined are known to have properties likely to endanger life or property. 24. TOXIC WASTE No vessel or individual will be allowed to bring in toxic waste through Lumut Maritime Terminal Sdn. Bhd. facilities. 25. CONDITION OF OFFER Upon the User doing or transacting business with Lumut Maritime Terminal Sdn Bhd. whether by agreement or otherwise The Terms And Condition Of Business shall constitute a standing offer as to the condition upon which Lumut maritime Terminal Sdn. Bhd make its port services and facilities at Lumut Port available to the User. Lumut maritime Terminal Sdn. Bhd reserves the right to vary the charges in the general tariff and rates. Page 11 of 33

SECTION II CHARGES FOR ACCOUNT OF VESSEL 1. PILOTAGE SERVICES Pilotage is compulsory for all vessels, barges or crafts above 25 meters Length Overall (LOA) entering or leaving the Port. 1.1 PILOTAGE FEE The pilotage fees are based on Length Overall (LOA) of each vessel, barge or craft entering or leaving the Port, or shifting from a berth to another berth, or quay or dock or anchorage within the Port and excludes sending and bringing back the pilot. 1.2 NIGHT FEES A 50% surcharge will be levied on the respective pilotage fees for services rendered between 1930 hours of one day to 0730 hours of the following day. 1.3 DETENTION FEE For detention of pilot, a detention fee shall be imposed at the rate of RM100.00 per hour or part thereof for each detention. 1.4 CANCELLATION FEE Where a pilot is ordered and subsequently for any reason whatsoever his services is not used there shall be in addition to all applicable charges a cancellation fee of RM100.00 1.5 The pilotage fee is for the professional services of pilot and does not include the use of pilot boats to ferry the pilots to and fro. 1.6 For table of charges, please refer Section IV. 2. TUG SERVICES 2.1 The use of tugs for berthing/unberthing operations of vessels will depend upon tidal condition and shall be determined by the pilot and/or master of the vessel. 2.2 This charge is based on per operation per hour per tug. 2.3 A 50% surcharge shall be levied for use of tugs between 1930 hours of one day to 0730 hours of the following day. 2.4 For Tug Charges please refer Section IV. 3. MOORING 3.1 Mooring & unmooring boats will be required in assisting the berthing of vessels alongside wharf. 3.2 This charge shall be based on per vessel per operation per boat. 3.3 For Mooring & Unmooring Charges please refer to Section IV. 4. BERTHING & UNBERTHING 4.1 Berthing & Unberthing labour will be required for securing/releasing of berthing ropes from bollards. 4.2 This charge shall be based on per vessel per operation. 4.3 A surcharge of 50% shall be levied for berthing and unberthing services between 1930 hours of one day to 0730 hours of the following day. 4.4 For Berthing & Unberthing Charges please refer Section IV. 5. BERTH OCCUPANCY 5.1 Berth occupancy charges are raised against vessels for occupying the main berth of barge berth or wharf and anchorage. 5.2 This charge is based on the total tonnage of cargo loaded and/or discharged and is calculated on per tonne or part thereof basis, deadweight or measurement weight whichever greater. 5.3 For Berth Occupancy Charge please refer to Section IV. 5.4 Berth Occupancy for passenger vessels shall be based on length overall of vessel (LOA) at RM 15.00 per metre per day of 24 hours or any part thereof. In the event the passenger vessel occupies the berth for less than 8 hours a rebate shall be considered. 6. STEVEDORAGE 6.1 Stevedorage is the supply of manpower and labour for the loading and/or discharging of cargo on board vessels and includes the supply of winchman, deckman and cargo handling labour. 6.2 STEVEDORAGE CHARGE This charge is calculated on the tonnage of cargo loaded or discharged and is based on deadweight or measurement weight whichever is the greater. For Stevedorage Charges please refer Section IV. 7. HIRE OF GEARS AND EQUIPMENTS 7.1 Stevedoring gears and equipments are required for cargo handling onboard vessels for discharging and/or loading operations. Page 15 of 33

7.2 RATE OF HIRE The gears and equipments are hired out on per shift basis and is subject to the terms on Condition of Hire of Equipment or Gears as provided for in Section I and The Terms and Conditions of Business of LMTSB. CALCULATION OF MEASUREMENT AND WEIGHTS For the purpose of calculating charges, fractions of a tonne shall be charged as follow:- a) In calculating the measurement, fraction of a cubic metre shall be taken to the next higher 0.5 cubic metre subject to a minimum charge per consignment of 1 cubic metre. b) In calculating the weight, fraction of a tonne shall be taken to the next higher 0.5 tonne subject to a minimum charge per consignment of 1 tonne. 2. LEVY ON CHARGES (TONNE BASIS) Except where otherwise provided, charges will be based on weight or measurement tonnage, whichever is greater. Conversation from cubic measurement will be 1 cubic metre per tonne and from weight at 1000 kilograms per tonne. Not with standing the foregoing:- a) LMTSB may levy charges on measurement tonnage if the weight cannot be ascertained or vice versa. b) Bulk cargo shall be charged on manifested tonnage or draft survey whichever greater. c) Heavy packages or heavylifts the charges to be raised will be determined by the weight of the cargo. However the chargeable weight will be based on dead weight or measurement weight whichever greater. Page 18 of 33

3. THE WHARF HANDLING CHARGES COVERS (a) INWARD CARGO ( OTHER THAN LIQUID CARGO) This charge covers the handling of the goods from the vessel/barge ex-hook at the wharf (main and barge berth) including wharf labour, equipment and supervisory staffs. (b) OUTWARD CARGO (OTHER THAN LIQUID CARGO) This charge covers the handling of the goods at the wharf (main berth or barge berth) on to the vessel s/barge s hook, including wharf labour, equipment and supervisory staffs. 4. TRANSIT CHARGE (a) INWARD CARGO ( OTHER THAN LIQUID CARGO) This charge covers the handling of the handling of the goods at the wharf (main berth and barge berth) horizontal transfer to the transit shed / open storage area, receival, offloading and stacking and subsequent delivery to road vehicle and includes labour, equipment, supervisory staffs and free storage period. (b) OUTWARD CARGO (OTHER THAN LIQUID CARGO) This charge cover the receival of the goods from the road vehicle, offloading and stacking in the transit shed / open storage area, handling and subsequent horizontal transfer to the wharf (main berth and barge berth) for shipment and includes labour, equipment, supervisory staffs and free storage period. 5. Cargo not transshipped or reshipped within 28 days will be treated as import cargo and shall lose the right of concessionary rates. Store rent shall be charged retrospective from the date of completion of discharge from the first vessel or commencement of loading into a lighter. The cargo must be manifested or declared in writing to be for transhipment or reshipment at least 24 hours prior to the arrival of the first vessel. Page 28 of 33

3.1.5 DANGEROUS CARGO (a) Group I and Group II Dangerous cargo in Group I and II shall not be received for storage but instead shall be removed immediately they are brought alongside the vessel failing which the Operations Manager may remove, guard or destroy the cargo at the expense of the owner, agent, consignee or consignor who shall be held liable for any accident arising therefrom. (b) Group III Dangerous cargo in Group III may be received and stored in the port unless the Operations manager notifies the agent or owner to the contrary, in which event the cargo shall be removed from the port premises immediately. 3.2 STORAGE CHARGES 3.2.1 COVERED STORAGE RATES (a) Breakbulk Cargo (b) Dry Bulk Cargo First 7 days at RM0.50 per tonne per day and thereafter at RM1.00 per tonne per day.
