Upon submittal of final plans and prior to the issuance of any development permits, the Owner shall pay the fees for design of the undergrounding of all utilities along Indiantown Road and secure submit for all the necessary permits for undergrounding from FPL, Palm Beach County, The Town and other applicable agencies and provide documentation to the Town verifying the above. Condition #7 Add the following language to the condition: #7 Prior to the issuance of a..fiber Optic Network. Notwithstanding the foregoing, if the identified work is not complete at such time as the Owner seeks its Certificate of Occupancy, the Owner may post a surety equal to 120% of the amount required to complete any remaining such work. The Owner with approval from the Town s Natural Resource Coordinator may remove existing plant material in order to accommodate required undergrounding, lighting, and site improvements along Indiantown Road as well as the new landscaping being installed as part of this approval. The Owner and the Town s Natural Resource Coordinator shall work cooperatively in addressing the proposed improvements and plantings to work to preserve and install landscaping to meet code requirements and that provides screening of the existing FPL substation in a manner that shall not comprise the electrical services at the substation. Upon completion and approval of the final landscape inspection, the applicant shall submit an as-built landscape plan for the buffer along Indiantown Road and Delaware Avenue. Condition #17 Change 30 to 45 days. 38

The Owner shall demolish the existing building within 30 45 days after the issuance of a Certificate of Occupancy for the proposed office building. However, if the bus shelter is not complete at such time as the Owner seeks a Certificate of Occupancy, the Owner may post surety equal to the amount required to complete any remaining work on the bus shelter. Prior to the issuance of a Certificate of Occupancy, the Owner shall paint all accessory structures on site that immediately abut a public right of way to match the colors of the proposed office building.
