TIBCO s Trademark Guidelines TIBCO s trademarks are used to distinguish the company and its products and services from those of others. The public and TIBCO s customers have come to rely on the TIBCO name as being synonymous with high-quality computer software, hardware, and services. This document contains a non-exhaustive list of TIBCO s trademarks and/or registered trademarks and guidelines for their proper use. The trademarks may be cited only as outlined in this document. For a list of TIBCO product names and their applicable trademark attributions please click here. All other uses of TIBCO trademarks, including use of any TIBCO logo or design trademarks (as opposed to trademarks that consist solely of words) require TIBCO s express prior written consent. 1. Trademark Notice Trademark symbols (,, or SM ) are used to indicate the status of a trademark. The letters TM, R and SM enclosed in brackets in each instance (e.g., (TM), (R), (SM)) are appropriate as well, if the symbols cannot be displayed. The symbol indicates that a trademark has been registered with the U.S. Trademark Office and may be used in communications in the United States; the symbol indicates a trademark that is not registered in the U.S.; and the symbol SM indicates a service mark that is not registered in the U.S. Please check TIBCO s Trademark Guidelines and the List of TIBCO Product Names to ensure that the appropriate symbol is correctly applied in the appropriate location. When using TIBCO s trademarks or referencing TIBCO product names in publications that will be distributed outside the U.S. or on websites that are based outside the U.S., use only the symbol. Do not use the symbol for a trademark that is not registered in the particular country in which you are distributing the mark. Falsely indicating (whether intentionally or by mistake) that a trademark is registered outside the U.S. can result in civil and criminal penalties in some foreign countries. 2. Proper Use Trademarks are adjectives (product names), which modify nouns (the product type). A TIBCO trademark should be used as an adjective describing a product or service of TIBCO. TIBCO trademarks should not be used as a noun or verb or as a short hand way of identifying a product. Do not use TIBCO trademarks in a possessive or plural form. Do not abbreviate, alter, edit, modify, or hyphenate TIBCO trademarks. Make sure that use of a TIBCO trademark is distinct from other text, logos or images. Do not use a TIBCO trademark: In combination with any third party trademark or product name; To identify a product or service that is not provided by TIBCO; In any manner that expresses or implies TIBCO s endorsement, sponsorship, affiliation or certification of another company or its products and services; or In a manner that is likely to cause confusion as to the origin of a product or service. Without express permission or license from TIBCO, third parties may only reference TIBCO products or services in text format. Any such references must be truthful, not disparage TIBCO, and not mislead the public. Third parties that wish to indicate the relationship of their products or services to TIBCO s products or services may use TIBCO s trademarks in referential, accurate, and descriptive phrases only as shown in the following examples: Wrong: TIBCO ActiveMatrix BusinessWorks is compatible with XYZ. Correct: XYZ is compatible with TIBCO ActiveMatrix BusinessWorks. Wrong: TIBCO ActiveMatrix BusinessWorks for XYZ Correct: XYZ for TIBCO ActiveMatrix BusinessWorks When using a TIBCO trademark in this context, it should not be used in a more prominent format than your own trademark and should not imply that your product or service is provided or endorsed by TIBCO. 3. Open Source Licenses Open source licenses made available by TIBCO do not grant a license or permission to use TIBCO trademarks or logos. Absent a separate license or express permission, TIBCO does not permit third parties to use its trademarks other than as provided in these Trademark Guidelines. 4. Referring to TIBCO Software Inc. The "TIBCO" name is not only a trademark used to identify TIBCO products and services, it also serves as the company name. When using the "TIBCO" name as a reference to the company, "TIBCO" may be used as a noun or in the possessive form and no trademark symbol is needed. In addition: TIBCO is always written in capital letters. 4

On all first references, the company generally should be identified as TIBCO Software Inc. On subsequent references within a document, the company may be referred to as either TIBCO Software or TIBCO. 5. Use of Trademark Symbols A trademark symbol must be used to indicate TIBCO s claimed trademarks and logos. The symbol must be used to indicate TIBCO's registered trademarks and the symbol must be used to indicate TIBCO's claimed trademarks. Please make the trademark symbol a superscript ( or ) and position it immediately after the trademark to which it applies (e.g., TIBCO Hawk ). The or symbol is needed only the first time a trademark is referenced in a publication (e.g., newsletters, manuals, license agreements, press releases, etc.). 6. Trademark Legend The trademark legend is the legal text that identifies TIBCO's trademarks. The following legend should be included whenever a TIBCO trademark is used and should be in a location typically used for copyright and other legal notices (e.g., the end of a document, on the front cover of documentation or on the bottom of a web page): "< LIST TIBCO TRADEMARKS MENTIONED IN THIS DOC SET> are either registered trademarks or trademarks of TIBCO Software Inc. and/or its subsidiaries in the United States and/or other countries. 7. Domain Names and Social Media Do not use or register a TIBCO trademark or potentially confusing variations thereof as a domain name as this may violate TIBCO s trademark rights and lead to confusion as to the source of the website and its content. Likewise, you may not use or register a TIBCO trademark or potentially confusing variation thereof as a social media account name or handle. A violation of this policy may result in legal action by TIBCO.
