Definition of Contractor/Subcontractor A person, an organization, their employees or a nominated representative engaged to carry out work for the Developer
Definition of an Entity Every Client / developer, Consultant, contractor, and Supplier for the B&C Sector Regulatory Authority Projects is considered as an entity Definition of a Nominated Entity An entity that has been selected by a relevant SRA that is required to develop and implement an EHSMS in compliance to the AD EHSMS RF, based on EHS hazards and risks
Management of contractor process Nominated Entities shall implement the following contractor management process: Establishment of Project EHS requirements Evaluation/Selection Contractual Agreement Co-ordination and Communication Mobilization/Work in progress Monitor Performance Commissioning Demobilization/Decommissioning Contract Close-out
Appointment of Principal contractor process Definition of Construction Work Definition of Developer/Client for Construction Work Definition of Project Manager/Client Representative/Supervising Consultant/Resident Engineer for Construction Work Definition of Principal Contractor for Construction Work Requirement for the Appointment of a principal Contractor
Definition of construction work Construction work includes: Work to erect, construct, extend, alter, convert, fit-out, commission, renovate, repair, refurbish, disassemble, demolish and/or decommission a structure/building/services infrastructure Work connected with site preparation, earthworks, land reclamation, excavation, piling, provision of services infrastructure, or part of a structure/building /services infrastructure or landscaping for work mentioned above Assembly or installation of prefabricated components to form a structure/building/services infrastructure for work mentioned above Disassembly of prefabricated components for work mentioned above
Definition of Developer/Client for Construction Work Developer/Client is the person/entity who finances and/or commissions the construction work and: May engage a Project Manager/Client Representative/Supervising Consultant/Resident Engineer to plan, manage and monitor the project on their behalf May appoint a Principal Contractor to manage, supervise and perform the construction work
Definition of Project Manager/Client Representative/Supervising Consultant/Resident Engineer Entity appointed by the Developer/Client to carry out the management, planning and monitoring of the construction work on their behalf If the Developer/Client fails to appoint a Project Manager/Client Representative/Supervising Consultant/Resident Engineer to the workplace the Developer /Client is taken to be the Project Manager/Client Representative /Supervising Consultant/Resident Engineer
Definition of Principal Contractor Entity appointed by the Developer/Client to manage, supervise and perform the work, including overall control of the site and subcontractors If the Developer/Client fails to appoint a Principal Contractor the Developer/Client is taken to be the Principal Contractor
Requirement for the Appointment of a principal Contractor Developer/Client shall obtain the relevant approval/permit/license/no objection from the relevant authorities Developer/Client shall appoint a Principal Contractor if: Construction work will take 30 days or longer Construction work will take less than 30 days but SRA understand the project involve sufficient hazards and risks for the appointment of a Principal Contractor

Obligation of the Competent Authority Monitoring the implementation of the principal contractor process and mechanism by the Building and Construction Sector Regulatory Authority
Obligations of the Building and Construction Sector Regulatory Authority The B & C SRA shall ensure implementation, monitoring and enforcement of the principal contractor process and mechanism by: ensuring all relevant requirements of the AD EHSMS are met as part of the approval process, reviewing the submissions by clients / developers to ensure appropriate entities have been selected as principal contractor maintaining a register of project / developer appointed principal contractors monitoring compliance to this code of practice; and enforcement including penalties for non-compliance If the developer / client is an individual (e.g. Building a personal villa), the B & C SRA shall provide appropriate mechanisms to ensure the appointment of principal contractor process is implemented
Obligations of the Developer / Client Responsible for ensuring compliance to all EHS legislative requirements. Appoint a principal contractor Ensure that the PM and PC are competent and have adequate EHS resources Obtain all relevant licenses, permits, non-objection certificates from all relevant government agencies Ensure prior to any work commencing, PC has developed a CEHSP which has been approved by B&C SRA Consult with Designer, PM and PC so as to minimize EHS risks Conduct EHS inspection and audits
Obligations of the Project Manager / Client Representative / Supervising Consultant / Resident Engineer Ensure work is planned and managed in a way that prevents or minimizes EHS risk Participate in all EHS activities Notify principal contractor of all hazards and non-compliances Monitor and coordinate all EHS aspects during the design process ensuring that risks and hazards are reduced to as low as reasonably practicable Monitoring & auditing the principal contractor and sub-contractor to ensure compliance to all regulatory and EHS requirements Report non-conformance by the principal contractor and/or sub-contractor to the developer / client
Obligations of the Principal Contractors Plan, coordinate, supervise and oversee construction and demolition work to prevent or minimize EHS risks Develop and implement project specific construction/demolition EHS plan Consult and communicate with stakeholders on EHS risks Monitor and enforce the compliance to all EHS obligations Investigate all incidents and non-compliances Ensure all appropriate incidents are reported to relevant authorities Protect members of the public from injury or illness caused by work activities at or near the workplace
Obligations of Construction Subcontractors Comply with all provisions of this code of practice and to recognize the important supervisory and coordination role that the appointed principal contractor has been granted on a site where Construction Work is conducted under this code of practice
EHS Performance and Incident Reporting Process Principal contractors to report EHS performance and incident data to SRA for their operations and all construction subcontractors that are not nominated entities All EHS incidents at the workplace shall be reported to the principal contractor If a sub-contractor or project manager is involved in an EHS incident and they are nominated, they are also responsible for reporting the incident to the SRA in their monthly report If a sub-contractor or project manager is involved in an EHS incident and they are not nominated the principal contractor is responsible for reporting the incident to the SRA
