Prices Unless otherwise stated prices are quoted in EUR (euro) for delivery EXW, Odense, Denmark (Incoterms 2000). Payment Payments are due at Odense, Denmark. Returns Returns are subject to written authorisation in each individual case and will only be considered if they are in original, unopened packages. Force Majeure Instance of force majeure which release L. Dæhnfeldt A/S from delivery shall include crop failure and failure by LD s growers and other suppliers to deliver. In the event of crop shortage, deliveries will be made on a pro rata basis, and contract orders will be given preference over spot orders. Warranty disclaimer Limitation of Liability Disputes LD warrants that seeds sold are as described on the package, within recognised tolerances. LD gives no other warranty, express or implied, as to the quality of the seeds sold. LD makes no guarantee as to marketability, fitness for a particular purpose or crop performance. Any recommendation for use of the seeds does not constitute a warranty. LD s liability to compensate loss or damage arising from defective quality (including defects as to trueness to variety or varietal purity) or in any way from the purchase or use of the seeds is limited to the purchase price of the seeds or to seed replacement. LD shall in no circumstances be liable for indirect or consequential losses of any kind. Disputes shall be decided in accordance with Danish law and, at the option of LD, be settled either by I.S.F.
