TSC The Service Company Sealift Services Booking HOW TO ARRANGE A SEALIFT WITH TSC 1. COMPLETE AND SUBMIT A BOOKING FORM Please complete a booking form and e mail it to bookings@tsctransport.com or fax it to 877 872 1126 or they can be completed at TSC when you are delivering your order. Even if you have hired TSC in the past we require this information every season as a control for your order. Please complete all sections of your booking form prior to submission. Insurance values may be estimated and corrected upon completion. Preferred sailing dates need to be indicated in order for TSC to make the proper arrangements and provide quality service. If you are unsure please indicate TBA and update it when the information becomes available. Upon submission of your booking form you will be assigned a unique order number that is exclusive to your order, please use this number on all labeling. If you need to make changes to your booking info please submit them in writing by e mail to bookings@tsctransport.com or fax to 877 872 1126 2. SAILING SCHEDULE Please indicate the sailing date that best suits your needs on your booking form. There are generally 3 shipping cycles per season. June / July the first sailing arrives shortly after the sea ice disappears and it is safe for ships to sail. August, the same ships are used for the second sailing so they must make all their stops and return to port in Montreal. The second sailing is used to deliver to the destinations further north because of issues with weather early in the season and late in the season, these destinations will take priority on the second sailing. September / October, the same ships are used for the 3rd sailing so they must make all their deliveries and return to port. The schedule will change throughout the season. The ETA s quoted at the beginning of the season will be different by the end of the season, delays are inevitable. 3. DELIVERING YOUR ORDER TO TSC All items delivered should have a label on them, please notify anyone delivering on your behalf of your customer number, this will be required for TSC to accept your delivery Labels should include at minimum; your name, order number and city of destination. If you require labels, TSC staff would be happy to provide you with some. 1

TSC The Service Company Sealift Services Booking Orders can be delivered without prior notice Mon Fri, 8am to 4pm. We are not open on weekends or holidays but arrangements can be made for deliveries. If you need to make a delivery outside this time schedule please call 24hrs in advance to schedule an appointment. Deliveries can be made on multiple dates, however due to space limitations we ask you make special arrangements if they will span more than 1 week. Please ensure you notify a member of TSC s staff of your delivery. Your sealift order should be packed sufficiently to be loaded into crates. Case orders from Over the years we have learned that some food products will absorb the smell of scented, powdered detergents and dryer sheets. We suggest packing your detergents in Ziploc bags, plastic totes or garbage bags sealed with tape. We received a large number of calls in 2011 claiming that the plastic bottles containing liquid laundry detergent had broken. We suggest packing your liquid detergents in totes to contain any breakage or spills that may happen. 4. SCHEDULING A PICK UP TSC will pick up at most stores in the Ottawa area. A standard pick up costs $58.00 this would include up to 4 skids of groceries at 1 location. Furniture pick ups are generally more depending on the size of the order. Please put your pick up details on your booking form. Or submit in writing by e mail to bookings@tsctransport.com or fax to 877 872 1126. TSC will not pick up at Ikea (no exceptions). TSC will also not receive from Ikea unless the shipper is present to count and sign. Lumber and building supply orders should be delivered by the store they are purchased from. They have the specialized equipment required to properly handle these orders. Please have them delivered to TSC at 6431 Bank St. Metcalfe, ON K0A 2P0 5. SHIPPING A VEHICLE TSC recommends that vehicles are shipped empty and will assume no responsibility for items left inside the vehicle. The ocean carrier will not tolerate a vehicle with more than 150kg of belongings stowed inside. They will refuse delivery and the vehicle will need to be returned and emptied. No parcels are allowed on the front seats, no cargo is to exceed the lower level of the cabin windows and all cargo in the trunk must respect the maximum 150kg limit and the trunk should be locked. The fuel tank should contain no more than ¼ of its capacity and have enough to be moved during loading and unloading operations. 2

TSC The Service Company Sealift Services Booking Vehicles that are not in working condition may be subject to additional charges based on handling requirements. 6. SHIPPING BEER WINE & SPIRITS When delivering beer, wine & spirits for shipping to Nunavut please respect Nunavut s Liquor Act. Please refer to http://www.orientation.hr.gov.nu.ca/i18n/english/pdf/buying%20alcohol_eng.pdf if you are unsure of the regulations. TSC will require an inventory of your beer, wine and spirits and will count and verify your liquor order with your permit. Orders without a valid permit will not be shipped. 7. SHIPPING DANGEROUS GOODS Shipping dangerous goods by sea is regulated. There are specific guidelines that must be followed. Failure to do so may result in fines and demurrage of sea shipments. TSC is certified to package and ship dangerous goods according to the regulations. Please declare all dangerous goods to the person receiving your order. Proper packaging, labeling and documentation is required. 8. RECEIVING YOUR ORDER IN NUNAVUT You must be available to receive your order when it arrives, if you can not be available please ask someone to receive your order for you. The Ocean Carrier will contact you prior to your delivery to make sure you know when it is coming and that someone is available to receive it. Please inspect your crate thoroughly for damage when it arrives and make note of any damage to the crate immediately with the person delivering the crate no matter how insignificant it may seem. If there is damage to the crate please take photographs. 9. PAYMENT FOR YOUR SEALIFT ORDER TSC will require a credit card number upon submission of your Sealift Services Booking Form, no payment will be submitted before your total charges are calculated and you have been notified. Payment in full is required prior to delivery of your crate to the Ocean Carrier. Credit is available, payment arrangements must be made prior to your sealift order being shipped. If you have any comments or suggestions regarding this information please do not hesitate to contact us. GENERAL TERMS AND CONDITIONS I APPLICATION The following provisions shall apply to a transportation of goods by for hire highway carriers licensed under the Motor Vehicle Transport Act (Canada R.S.O. 1970 M 14) or under provincial statutes with the exception of the transportation of: such other specific commodities as may be specified by provincial law II BILL OF LADING 1. A Bill of Lading shall be completed as provided herein for each shipment. 2. On each article covered by the Bill of Lading there shall be plainly marked thereon by the consignor the name of the consignee and the destination thereof. This requirement does not apply in cases where the shipment is from one consignor to one consignee and constitutes a truckload shipment. 3. The Bill of Lading shall be signed in full (not initialed) by the consignor and by the carrier as an acceptance of all terms and conditions contained therein. 4. At the option of the carrier a waybill may be prepared by the carrier and the waybill shall bear the same number of other positive means of identification as the original Bill of Lading. Under no circumstances shall the waybill replace the original Bill of Lading. III CONDITIONS OF CARRIAGE 1. LIABILITY OF CARRIER 2. The carrier of the goods herein described is liable for any loss or damage to goods accepted by him or his agents except as hereinafter provided. 3. LIABILITY OF ORIGINATING AND DELIVERING CARRIERS 4. Where a shipment is accepted for carriage by more than one carrier the carrier issuing the Bill of Lading (hereinafter called the originating carrier) and the carrier who assumes responsibility for delivery to the consignee (hereinafter called the delivering carrier) in addition to any other liability hereunder are liable for any loss of or damage to the goods while they are in the custody of any other carrier. 5. RECOVERY FROM CONNECTING CARRIER 6. The originating carrier or the delivering carrier as the case may be is entitled to recover from any other carrier to whom the goods are or have been delivered in the amount of the loss or damage that

the originating carrier or delivering carrier as the case may be required to pay hereunder resulting from loss of or damage to the goods while they were in the custody of such other carrier. When shipments are interlined between carriers, settlement of concealed damage claims shall be prorated on the basis of revenues received. 7. REMEDY BY CONSIGNOR OR CONSIGNEE 8. Nothing in articles 2 or 3 deprives a consignor or consignee of any rights he may have against any carrier. 9. EXCEPTIONS FROM LIABILITY 10. The carrier shall not be liable for loss, damage or delay to any of the goods described in the Bill of Lading caused by an Act of God, the Queen s or public enemies, riots, strikes, a defect or inherent vice in the goods, the act of default of the consignor, owner or consignee authority of law guarantee or differences in weights of grain, seed or other commodities caused by natural shrinkage. 11. DELAY 12. No carrier is bound to transport the goods by any particular vehicle or in time for any particular market or otherwise than with due dispatch, unless by agreement specifically endorsed on the Bill of Lading and signed by the parties thereto. 13. ROUTING BY CARRIER 14. In case of physical necessity where the carrier forwards the goods by a conveyance that is not a licenced for hire vehicle the liability of the carrier is the same as though the entire carriage were by licenced for hire vehicle. 15. STOPPAGE IN TRANSIT 16. Where goods are stopped and held in transit at the request of the party entitled to so request the goods are held at the risk of that party. 17. VALUATION 18. Subject to article 10 the amount of any loss or damage for which the carrier is liable whether or not the loss or damage results from negligence shall be computed on the cases of: 19. a) the value of the goods at the place and time of shipment including the freight and other charges if paid, or 20. b) where a value lower than that referred to in paragraph (9) has been represented in writing by the consignor or has been agreed upon such lower value shall be the maximum liability. 21. MAXIMUM LIABILITY 22. The amount of any loss or damage computed under paragraph (a) or (b) of article 9 shall not exceed $2.00 per pound unless a higher value is declared on the face of the Bill of Lading by the consignor.

23. CONSIGNOR S RISK 24. Where it is agreed that the goods are carried at the risk of the consignor of the goods such agreement covers only such risks as are necessarily incidental to transportation and the agreement shall not relieve the carrier from liability for any loss or damage or delay which may result from any negligent act or omission of the carrier his agents or employees and the burden of proving absence from negligence shall be on the carrier. 25. NOTICE OF CLAIM 26. a) No carrier s liability for loss, damage or delay to any goods carried under the Bill of Lading unless notice thereof setting out particulars of the origin, destination and date of shipment of the goods and the estimated amount claimed in respect of such loss, damage or delay is given in writing to the originating carrier or the delivering carrier within sixty (15) days after the delivery of the goods or in the case of failure to make delivery within nine (9) months from the date of shipment. 27. (b) The final statement of the claim must be filed within nine (9) months from the date of shipment together with a copy of the paid freight bill. 28. ARTICLES OF EXTRAORDINARY VALUE 29. No carrier is bound to carry any documents, specie or any articles of extraordinary value unless by a special arrangement to do so. If such goods are carried without a special agreement and the nature of the goods is not disclosed hereon, the carrier shall not be liable for any loss or damage in excess of the maximum liability stipulated in article 10 above. 30. FREIGHT CHARGES 31. a) If required by the carrier the freight and all other lawful charges accruing on the goods shall be paid before delivery and if upon inspection it is ascertained that the goods shipped are not those described in the Bill of Lading the freight charges must be paid upon the goods actually shipped with any additional charges lawfully payable thereon. 32. b) Should consignor fail to indicate that a shipment is to move prepaid or fail to indicate how the shipment is to move it will automatically move on a collect basis. 33. DANGEROUS GOODS 34. Every person, whether as principal or agent, shipping explosives or dangerous goods without previous full disclosure to the carrier as required by law, shall indemnify the carrier against a loss, damage or delay caused thereby and such goods may be warehoused at the consignor s risk and expense. 35. UNDELIVERABLE GOODS

36. a) Where, through no fault of the carrier, the goods cannot be delivered, the carrier shall immediately give notice to the consignor and consignee that delivery has not been made and shall request disposal instructions. 37. b) Pending receipt of such disposal instructions: 38. I) The goods may be stored in the warehouse of the carrier, subject to a reasonable charge for storage, or 39. II) Provided that the carrier has notified the consignor of his intention the goods may be removed to and stored in a public or licensed warehouse at the expense of the consignor, without liability on the part of the carrier, and subject to a lien for all freight and other lawful charges including a reasonable charge for storage. 40. RETURN OF GOODS 41. Where notice has been given by the carrier pursuant to article 16a, and no disposal instructions have been received within 10 days from the date of such notice the carrier may return to the consignor at the consignor expense all undelivered shipments for which such notice has been given. 42. ALTERATIONS 43. Subject to article 19, any limitation on the carrier s liability on the Bill of Lading and any alteration, or addition or erasure in the Bill of Lading shall be signed or initialed by the consignor or his agent and the originating carrier or his agent and unless so acknowledge shall be without effect. 44. WEIGHTS 45. It shall be the responsibility of the consignor to show correct shipping weights on the Bill of Lading. Where the actual weight of the shipment does not agree with the weight shown on the Bill of Lading the weight shown thereon is subject to correction by the carrier. 46. C.O.D. SHIPMENTS 47. a) A carrier shall not deliver a C.O.D. shipment unless payment is received in full. 48. b) The charge for collecting and remitting the amount of C.O.D. dues for C.O.D. shipments must be collected from the consignee unless the consignor has otherwise so indicated and instructed on the Bill of Lading. 49. c) A carrier shall remit all C.O.D. monies to the consignor or person designated by him, within 15 days after collection. 50. d) A carrier shall keep all C.O.D. monies separate from the other revenues and funds of his business in a separate trust fund or account. 51. e) A carrier shall include as a separate item in this schedule of rates the charges for collecting and remitting money paid by consignees.

IV OTHER SPECIFICATIONS Received at the point of origin on the date specified from the consignor mentioned herein, the property herein described in apparent good order except as noted (contents and conditions of contents of package unknown ) marked, consigned and destined as indicated below which the carrier agrees to carry and to deliver to the consignee at the said destination if on its own authorized route or otherwise to cause to be carried by another carrier on the route to said destination subject to the rates and classification in effect on the date of shipment. It is mutually agreed as to each carrier of all or any of the goods over all or any portion of the route to destination and as to each party of any time interested in all or any of the goods that every service to be performed hereunder shall be subject to all the conditions not prohibited by law, whether printed or written, including conditions on back hereof, which are hereby agreed by the consignor and accepted by himself and his assigns.
