5. Life Saving Rules From July 1, 2009 Shell's Life-Saving Rules have been fully enforced. Shell s Life-Saving Rules set out clear and simple do s and don ts covering activities with the highest potential safety risk. They are not new. Most people comply with them every day but there are still breaches taking place. The Life-Saving Rules help to make sure that rules are followed and people are protected. Compliance with the Life Saving Rules is mandatory, and the Life Saving Rules are applicable to all operations under Shell s operational and / or governance control. Each reported non-compliance will be investigated. And failure to comply will result in disciplinary action, up to and including termination of employment for Shell employees, or for employees of contractors or sub-contractors, removal from the site and disqualification from future Shell work. Supervisors are held accountable to communicate and ensure compliance. If you choose to break the rules, You choose not to work for Shell. The 12 Life-Saving Rules are: Work with a valid work permit when required Conduct gas tests when required Verify isolation before work begins and use the specified life protecting equipment Obtain authorisation before entering a confined space Obtain authorisation before overriding or disabling safety critical equipment Protect yourself against a fall when working at height Do not walk under a suspended load Do not smoke outside designated smoking areas No alcohol or drugs while working or driving While driving, do not use your phone and do not exceed speed limits Wear your seat belt Follow prescribed Journey Management Plan Werk Schkopau Site Requirements, Version 2. 6. Special requirements of this location w.r.t. Customer Pick Up (CPU / FCA). The haulier must meet the following requirements: 1.To have a satisfactory and recent SQAS assessment. 2.Comply with ADR 1.10. 3.Comply with all other applicable legal requirements. 4.When reporting for loading: present the equipment fit for loading( dry, clean, free of odour) and suitable for the product to be loaded. 5.Present the Uniform European Cleaning Document as proof of equipment being cleaned at a SQAS assessed cleaning station. 6.The haulier, customer and end-user must have an Emergency Response system in place. 7.Only trucks with a single (1) compartment tank will be loaded. No containers. 8.Customer must mention the name of the haulier and charterer at the time of placing an order. 9.Certificate s of Analysis (CoA) will not be given to the driver, for this purpose the Buyer will ensure, at any time during the period of the Contract, that the Seller (Commercial/Logistic Department) is aware of the valid contact information, at time of delivery of the product, to receive a CoA. The CoA will be sent via e-mail or fax. 10. Additional notes: - The delivery note will carry a customer reference, if known to DOW. - The CoA does not include: Volumes or names of the DOW staff who checked the CoA. 7. Personal protection equipment: The driver must be in possession of: - Safety glasses with side protection or chemical goggles. - Safety helmet. - Safety compact footgear. - Closed clothing. (no shorts, no synthetic clothing) - Safety gloves. 8. Codes for Safe and responsible behaviour. - Dow has the right to refuse the haulier if legal requirements or DOW specific requirements, as mentioned in this document, are not met. - Like most other companies, Dow has its house rules that are designed to ensure the safety of its employees as well as visitors on the sites. These rules must be observed. - The driver must be able to communicate with site personnel, whether at DOW loading locations or 3 rd party loading locations and understand basic instructions. Especially in the case of loading ADR products this requirement is mandatory for the safety of the site personnel and the driver. Equipment - Only trucks with a single compartment tank will be loaded, tank containers will not be loaded. - When reporting for loading: present the equipment fit for loading( dry, clean, free of odour) and suitable for the product to be loaded. Connections: - Product connection: VK 80 G 3 - Vapour connection: VK 50 G 2 Both connections have to be on the bottom of the truck. Werk Schkopau Site Requirements, Version 2. Page 5 of 6

Cleaning Certificate/Vacuum Test At reporting for loading the driver has to present the Uniform European Cleaning Document as proof of the equipment being cleaned at a SQAS assessed cleaning station. 9. Other. DOW & non DOW contracted hauliers. Dow prefers DOW contracted hauliers to collect product at a DOW site However, DOW realises that this is not always possible. Therefore DOW allows non-dow contracted hauliers to load product at a DOW location as long as they adhere to the guidelines laid out in this document. It may be also necessary to check their SQAS assessment. DOW and non DOW contracted hauliers have to comply with the same requirements. The name of the haulier is captured at the time the slot booking is made so that the DOW logistics contact can verify upfront the SQAS status of a particular haulier. www.shell.com/chemicals/transport Version 2: August 2009 Werk Schkopau.
